Law and Order: Batavia resident accused of stealing $371 in merchandise from Tops

Joshua G. Bachorski, 34, of South Spruce Street, Batavia, is charged with petit larceny. Bachorski allegedly stole $370.82 in merchandise from Tops Market in Batavia.

Ricky A. Marceill, 53, of South Main Street, Batavia, was arrested on two warrants out of City Court for alleged failure to appear. He was held on bail.

James E. Porter, 66, of Clinton Street Road, Batavia, is charged with unlawful possession of marijuana. Porter was allegedly found in possession of marijuana at 11:22 p.m. Nov. 22 at a location on Clinton Street, Batavia.

Cody J. Dioguardi, 18, of Shepard Road, Batavia, is charged with unlawful possession of marijuana. Dioguardi was allegedly found in possession of marijuana at 11:07 p.m. Nov. 22 at a location on Clinton Street, Batavia.

Nancy E. Chatt, 72, of Prestige Crossing, Batavia, is charged with DWI and driving with a BAC of .08 or greater. Chatt was charged following an investigation into a complaint of erratic driving at 7:24 p.m. Nov. 26 on West Main Street, Batavia. Chatt was stopped by Officer Stephen Cronmiller.

Sath Paul Dhanda, 37, of Clapsaddle Road, Bethany, is charged with criminal mischief and criminal contempt, 2nd. Dhanda was charged following an investigation into an alleged domestic incident reported at 7:52 p.m. at a location on Ellicott Street, Batavia. He was held on $2,000 bail.

Trisha M. Craig, 24, of Bergen, is charged with offering a false written statement and falsely reporting an incident. Craig was arrested by State Police related to an incident reported at 3:54 p.m. Nov. 27 in Bergen. No further information released.

Accident reported, car into a tree, on Creamery Road, Bergen

A car has reportedly hit a tree, and injuries are reported, on Creamery Road at North Lake Road, Bergen.

Bergen fire and ambulance dispatched.

UPDATE 6:58 a.m.: One occupant with a complaint of chest pain.

UPDATE 7:25 a.m.: One person transported to Strong.

Driver arrested after pickup struck by train in Bergen

A 46-year-old Bergen man has been charged with driving while ability impaired by drugs after the truck he was driving yesterday was struck by a train near Buffalo Street Road.

Donald R. Read reportedly fell asleep while behind the wheel of his 2000 Ford F250.

The truck traveled off the north shoulder of the road, down an embankment, and across the south side and north side tracks of the CSX line.

It came to rest near the north-side tracks.

An eastbound train on the north side tracks struck the rear of the pickup truck. The accident was reported at 6:50 p.m.

Both Read and his passenger, Frank L. Morrison, had gotten out of the truck before it was struck.

Even so, Morrison suffered minor injuries and was transported by the Bergen Volunteer Ambulance to Unity Hospital in Rochester.

Read was also charged with moving from lane unsafely, unlawful possession of marijuana, and trespassing. Other charges are pending.

The accident was investigated by Sgt. Jason Saile, Deputy Rachel Diehl, Deputy James Stack, and Deputy Eric Meyer. Assisting at the scene were members of the Bergen Volunteer Fire Department and personnel from CSX.

Man claims rib pain after 'train vs. pickup' accident in Bergen

A man inside a feed store in Bergen is complaining of rib pain after what he says was a train vs. pickup truck accident. It occurred on Buffalo Street near Route 19. Bergen fire and medics are responding.

UPDATE 7 p.m.: "I have located the vehicle; checking on it now," says a first responder.

UPDATE 7:03 p.m.: "The truck is not on the railroad track; it's just east," says a first repsonder.

Law and Order: Employee accused of stealing drugs from UMMC

Janet L. Gatley, 48, of Niagara Falls Boulevard, North Tonawanda, is charged with falsifying business records, 1st, criminal possession of a controlled substance, 7th, petit larceny, and violation of public health. Gatley is accused of stealing numerous controlled substances from UMMC, where she was employed. The alleged thefts were investigated by Batavia PD and the State Attorney General's Office.

Jordan J. Schunk, 18, of Alexander Road, of Alexander, is charged with unlawful possession of marijuana. Schunk was allegedly found in possession of marijuana while in DeWitt Recreation Area after hours, at 8:58 p.m. Monday.

Jammie Lee Brown, 26, of Gates-Greece Townline Road, Rochester, is charged with harassment, 2nd. Brown is accused of grabbing and pushing another person while at a gas station on Route 19, Town of Le Roy, at 4:31 p.m. Thursday. Brown was jailed on $250 bail.

Kenneth Carl Niles, 26, of Route 88 North, Newark, is charged with petit larceny. Niles is accused of shoplifting from Walmart. Also charged, Scott James Gunkel, 38, of North Main Street, Newark.

Collin Wickings, 24, of Bergen, is charged with first-degree sex abuse. Wickings is accused of sexual contact with a child less than 11 years old. Wickings was arrested as a result of an investigation by State Police. No further information released. The investigation is pending.

Law and Order: Medina man accused of sex act with disabled person in Batavia and Perry

Arsenio Youngs, 27, of Medina, is charged with criminal sex act, 2nd. Youngs is accused of a sex act with a disabled person in the City of Batavia. The complaint was made to State Police at 4:31 p.m., Nov. 1. Youngs was also charged with the same crime in the Town of Perry based on a complaint to State Police at 10:01 a.m., Nov. 1. Youngs was released on his own recognizance. No further details released.

Erika L. Gilson, 37, of West Main Street, Le Roy, is charged with felony DWI, three counts of felony aggravated DWI, and felony driving with a BAC of .18 or greater. Gilson was stopped at 3:05 p.m. Wednesday on West Main Street, Village of Le Roy, by Le Roy PD. Gilson was accused of driving while intoxicated with three children in the car under age 16. She was jailed on $2,500 bail.

Shane M. Nugent, 32, of West Middlebury Road, Wyoming, is charged with DWI, driving with a BAC of .18 or greater, and failure to keep right. Nugent was stopped at 2:19 a.m. Saturday on Warsaw Road, by Le Roy PD.

Daun Elizabeth Monachino, 58, Bank Street, Batavia, is charged with DWI, driving with a BAC of .18 or greater, improper left turn, improper right turn, and no left side mirror. Manachino was stopped at 4:34 p.m. Sunday on Richmond Avenue, Batavia, by Deputy Richard Schildwaster, following a citizen traffic offense complaint.

Tyler Lee Walls, 21, of Viking Way, Brockport, is charged with menacing. Walls allegedly threatened another motorist during a road rage incident reported at 1:36 p.m. Sunday on Warboys Road, Bergen.

Anson Torpe Arenas, 43, of Lexington Parkway, Rochester, is charged with driving while ability impaired by drugs, driving left of pavement, driving a vehicle without a valid inspection, insufficient tail lamps, and driving with alcohol in a motor vehicle. Arenas was stopped at 6:16 p.m. Saturday on Townline Road, Bergen, by Deputy Ryan DeLong.

Shawn William Cross, 46, of Craigie Street, Le Roy, is charged with DWI, driving with a BAC of .08 or greater. Cross was arrested following a report of a car vs. deer accident at 9:18 p.m. Friday on Perry Road, Pavilion, by Deputy Travis DeMuth.

Jenna Leann Hernandez, 21, of Hutchins Street, Batavia, is charged with DWI, driving with a BAC of .08 or greater, speeding, driving left of pavement marking, and driver's view obstructed. Hernandez was stopped at 2:16 a.m. Saturday on Wortendyke Road, by Deputy Howard Wilson.

Jeremy Sheehan, 35, of West Bergen Road, Le Roy, is charged with menacing, 2nd. Sheehan allegedly displayed a handgun to a resident in a nearby apartment at 1:18 a.m. Thursday at a location on West Bergen Road, Le Roy. He was jailed on $1,000 bail or $3,000 bond. 

David Michael Bratt, 38, of Carolina Avenue, Lockport, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, moving from lane unsafely, and driving left of pavement markings. Bratt was stopped at 12:54 a.m. Wednesday on Lewiston Road, Alabama, by Deputy Ryan Young. 

Kari Ann Marble, 26, of Pratt Road, Batavia, is charged with petit larceny. Marble is accused of shoplifting from Kohl's Department Store on Veterans Memorial Drive in Batavia at 11:58 a.m. on Nov. 9.

Sarah A. Cheek, 33, of Rochester, is charged with unlawful possession of marijuana. Arrested as part of the same incident was a 16-year-old on an execution of a bench warrant. The incident was reported at 10:48 a.m. Sunday on Route 237, Byron, by State Police. No other details released.

Christina M. Sarratori, of North Chili, is charged with criminal trespass, 3rd. Sarratori is accused of entering an enclosed area at 8315 Park Road, Batavia. The incident was reported to State Police at 12:52 a.m. Saturday.

Amanda M. Volkman, 32, of Byron, is charged with assault, 3rd, obstructing governmental administration and resisting arrest. Volkman is accused of attacking a person with intent to cause serious physical injury. The complaint was reported to State Police at 11:45 p.m. Thursday at a location on Caswell Road, Byron. Volkman was held in jail. No further details released.

Mary B. Thompson, 34, of Batavia, is charged with unlawful possession of marijuana. Thompson was charged by State Police based on an incident reported at 4:31 p.m. Nov. 15 on Pearl Street Road, Batavia.

Grand Jury: Former Walmart employee indicted for allegedly entering bogus returns into computer system

Carlene V. Santiago is indicted for the crime of first-degree falsifying a business record, a Class E felony. It is alleged that on April 30, in the Town of Batavia, that Santiago acted with intent to defraud by making a false entry in the business records of an enterprise. She is accused of entering fraudulent merchandise return information into the Walmart computer system; it is alleged that her intent to defraud included the commission of another crime or to aid or conceal its commission. In counts two through five, Santiago is accused of the same felony on May 13, 27, 31 and June 4, respectively. In count six, the defendant is accused of the crime of petit larceny, a Class A misdemeanor, for allegedly stealing cash or property worth $622.67 between April 30 and June 4.

Marquis R. Brown is indicted for the crime of third-degree burglary, a Class D felony. It is alleged that on Aug. 3, Brown knowingly entered or remained unlawfully inside a building on South Lake Road in the Town of Bergen with intent to commit a crime. In count two, he is accused of the unauthorized use of a vehicle in the third degree, a Class A misdemeanor. It is alleged in count two, that the defendant, knowing he did not have the owner's consent, took a 2006 BMW motor vehicle. In count three, Brown is accused of the crime of fourth-degree criminal mischief. It is alleged in count three, that without having the right to do so, he intentionally damaged property belonging to another person.

Stephen J. Turkasz is indicted for the crime of aggravated unlicensed operation in the first degree, a Class C felony. It is alleged that on Aug. 30 in the Village of Corfu, that Turkasz drove a 2010 Chevrolet on Route 33 while holding a conditional license and while under the influence of alcohol or a drug. In count two, he is accused of driving while intoxicated as a misdemeanor. In count three, the defendant is accused of failure to keep right, a violation of vehicle and traffic law. In count four, Turkasz is accused of consuming or possessing an alcoholic beverage in a motor vehicle on a public highway. In count five, he is accused of the offense of refusal to submit to a breath test, another vehicle and traffic law violation.

Chris K. Mukendi and Darazian W.P. Williams are indicted for the crime of criminal possession of a controlled substance in the fourth degree, a Class C felony. It is alleged on on May 25, the defendants knowingly and unlawfully possessed a stimulant which weighed one gram or more -- about 1.8 grams of amphetamine/dextroamphetamine capsules.

Fatal accident on Bovee Road, Riga, under investigation

Bergen volunteer firefighters and Mercy EMS medics responded to an accident on Bovee Road, Riga, at 5:45 p.m. where a young male driver was pronounced dead as a result of a single-car accident.

The driver's car reportedly struck a tree.

The name of the driver has not yet been released.

The location of the accident is in Bergen's fire district, though in Monroe County.

Monroe County Sheriff's Office is investigating the accident.

The stretch of road is near another fatal accident in August where a woman's car struck a tree.

Law and Order: Oakfield man accused of strangulation, assault

Michael Alan Shetler, 27, of Judge Road, Oakfield, is charged with two counts of second-degree strangulation, five counts of criminal obstruction of breathing, two counts of third-degree assault, unlawful imprisonment, 2nd, and two counts of criminal mischief, 4th. Shetler was arrested following an investigation by Deputy Kevin Forsyth and Deputy Richard Schildwaster into several complaints of domestic violence at a location on Main Street, Oakfield. Shetler was also charged with endangering the welfare of a child. He was jailed on $5,000 bail.

Nicole Leanne Williams, 25, of Kings Street, Albion, is charged with DWI, driving with a BAC of .08 or greater, and driving left of pavement markings. Williams was stopped at 2:45 a.m. Sunday on Quaker Hill Road, Elba, by Deputy Howard Wilson.

Amy R. Sellhorst, 31, of Beaufort Street, Rochester, is charged with harassment, 2nd. Sellhorst is accused of hitting another person at a location on York Road, Le Roy, at 10:37 p.m. on Saturday.

Jason William Wolf, 41, of West Main Street Road, Batavia, is charged with felony DWI, felony driving with a BAC of .08 or greater, aggravated unlicensed operation, 1st, driving a vehicle without an interlock device, and improper left turn. Wolf was stopped at 8:23 p.m. Thursday on West Main Street Road, Batavia, by Deputy Richard Schildwaster.

Jaclyn Kathryn Blackmer, 32, of Cabot Road, Rochester, is charged with DWI, driving with a BAC of .08 or greater, open container, driving left of pavement markings, and moved from lane unsafely. Blackmer was stopped at 2:33 a.m. Saturday on Main Road, Pembroke by Deputy Mathew Clor.

Joseph M. Smith, 41, of State Street, Batavia, was arrested on a warrant. Smith posted bail and was released.

Alaysia L. Henderson, 18, of Gardiner Avenue, Rochester, was arrested on a warrant for alleged failure to appear. Henderson was released on $500 bail.

Christina R. Aaron, 21, of Rochester, is charged with unlawful possession of marijuana and speeding. Aaron was stopped by State Police at 11:51 p.m. Friday on Route 33, Bergen.

Heather M. Captain, 31, of Basom, is charged with harassment, 2nd. Captain was arrested by State Police in relation to an incident reported at 8:35 p.m. Aug. 27 in the Town of Alabama. No further details released.

Crystal D. Cardona, 27, of Bergen, is charged with unlawful possession of marijuana. Cardona was stopped by State Police at 1:55 p.m. Nov. 7 on Route 33, Bergen.

Smoke in the residence on Emily Court, Bergen

Bergen fire along with Le Roy's ladder truck have been dispatched to a residence on Emily Court, Bergen, where smoke is reported in the residence; unknown cause.

There is reportedly a male in the house behaving strangely and refusing to leave. He is now reported outside the residence.

Law enforcement and Mercy EMS also dispatched.

A chief on scene reports there is no fire.

Bergen man accused of sexually abusing a child

Collin Ronald Wickings, 24, of Clinton Street Road, Bergen, is charged with sexual abuse in the first degree. Wickings is accused of sexual contact with a 6-year-old child. The alleged contact was reported Sept. 18 in Stafford.

Wickings was arraigned in Stafford Town Court and released under the supervision of Genesee Justice. Wickings was ordered to stay away from the alleged victim.

Further court proceedings are pending.

The case was investigated by Youth Officer Tim Westcott, assisted by Deputy Richard Schildwaster.

The Rochester Philharmonic Orchestra’s Festival High School Chorale, a group of nearly 200 of the finest vocal talents from more than 30 high schools in our seven-county area, has been part of the popular Gala Holiday Pops concerts every year since 1994.

This year, Byron-Bergen Jr./Sr. High School will be represented in the Chorale by eight young vocalists: Hannah Van Skiver, soprano; Esther Wilkins, soprano; Sydney Brown, alto; Stephanie Buell, alto; Joshua Phelps, tenor; Jerome Spinks, tenor; Mason Fuller, bass; and Brian Ireland, bass.

“This is a great group,” said Byron-Bergen’s Vocal Music Director Laurence Tallman. “They have strong, expressive voices, wonderful musical skills, and unusual depth and maturity. Each one is positive, enthusiastic, and committed to being the best they can be.”

The Festival High School Chorale gives young singers an opportunity to take on a program of challenging winter and holiday-themed music, under conductor Jeff Tyzik with co-directors Amy Story and Harold McAulliffe, and accompanied by the full Rochester Philharmonic Orchestra. Performances will feature guest Denzal Sinclaire, one of Canada's most popular jazz vocalists who is ranked among the finest jazz singers of his generation.

The performances will be held in Kodak Hall at the Eastman Theatre at: 7:30 p.m. on Thursday, Dec. 21; 8 p.m. on Friday, Dec. 22; and 2 p.m. and also 8 p.m. on Saturday, Dec. 23.

Bus involved in accident at routes 33 and 19, Bergen

A car and RTS bus collided at Route 33 and Route 19.

The bus apparently had no passengers.

The drivers of both vehicles are said to be sign-offs (no injuries).

The car is blocking traffic.

Quick response knocks down structure fire on Peachy Road, Bergen

A structure fire was reported at 8524 Peachy Road, Bergen, but a chief on scene reports the fire has been knocked down.

Overhaul and ventilation starting.

The initial fire call was for a dryer with smoke coming from it.

Law and Order: Three traffic stops, three arrests

Timothy John Beaudoin, 29, of Maltby Road, Oakfield, is charged with DWI, driving with a BAC of .08 or greater, aggravated unlicensed operation, speeding, and driving left of pavement markings. Beaudoin was stopped at 1:30 a.m. Sunday on Lewiston Road, Batavia, by Sgt. Thomas Sanfratello. 

Randy J. Heslor, 24, of Cherry Street, Batavia, is charged with second-degree aggravated unlicensed operation and no seatbelt. Heslor was stopped at 3:30 p.m. Saturday on Jackson Street, Batavia, by Officer Christopher Lindsay.

Frank Mastrodonato, 33, of Rochester, is charged with unlawful possession of marijuana and speeding. Mastrodonato was stopped at 12:02 p.m. Monday on Route 33, Bergen, by State Police.
