Person brandishes pistol after dispute over parking space at Tully's

A caller reports that a person got into an argument over a parking space at Tully's restaurant on Main Street in the city and brandished a black 22-caliber semi-automatic pistol. Batavia police are responding to the complaint.

An Erie County man was charged with second-degree menacing after he allegedly displayed a handgun during an argument with another motorist over a traffic incident in the parking lot of an East Main Street restaurant Thursday night, city police said.

Steven M. Mogle, 56, of 28 Greenbriar Drive, Lancaster was charged about 8:10 p.m. Mogle did possess a New York State pistol permit for the weapon.

This is the problem with such vague articles. What was stated in the arguement? Did he brandished the gun after a threat or did he try to show unlawful force? Once again people, before you get your feathers in a ruffle you might want to find out full facts. Remember there is three sides to every arguement! There could of been a veral threat against Mogle. In this case we do not know if a witness(es) were close enough to hear or if they had just walked out as Mogle brandished a handgun. Important issue is that he did not use it and no one was injured! Could of been worst, there could of been a shoot out. Mark, do you know the facts of the arguement? If not, maybe before you judge you get facts from all sides.
