Bruce J. Brade, 33, of Galloway Road, Batavia, is charged with identify theft, 2nd, and grand larceny, 4th. Brade is accused of fraudulent use of a debit card. Brade allegedly used the card to purchase items over the Internet. Following arraignment in Batavia City Court, Brade was released under supervision of Genesee Justice.

Douglas Robert Brown, 45, of South Main Street, Elba, is charged with criminal possession of a weapon, 4th. Brown was arrested following an investigation into a complaint of an irate truck driver who made a delivery to Automotive Corp., Inc. Brown was allegedly found in possession of a billy club.

Thomas James Rose, 18, of Ford Road, Elba, is charged with criminal possession of a controlled substance, 7th, criminal possession of a hypodermic instrument, criminal use of drug paraphernalia and unlawful possession of marijuana. Rose was found to allegedly possess drugs and paraphernalia during an investigation by Deputy Joseph Corona and Deputy Howard Carlson of an incident at a residence in Byron at 2:30 a.m., Saturday.

Arthur Mack Osborne, 47, of West Main Street Road, Batavia, is charged with criminal contempt, 2nd. Osborne is accused of violating a complete stay away order by going to the residence of the protected person and being in contact with that person.

Paul Joseph Kirch, 27, of Angling Road, Corfu, was arrested on a warrant out of the Town of Amherst related to a disorderly conduct charge. Kirch was located when a deputy checked on a vehicle parked on the shoulder of a roadway. Upon investigation, Kirch was identified as a suspect with an active arrest warrant.

Cynthia Louise Reschke, 50, of Transit Road, Stafford, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right, moving from lane unsafely. Reschke was stopped at 1:36 a.m. Sunday on Morganville Road, Stafford, by Deputy Joseph Corona.

Stephen A. Getty, 43, of Gilbert Street, Le Roy, is charged with DWI, driving with a BAC of .08 or greater, moving from lane unsafely and drinking alcohol in a motor vehicle on a highway. Getty was stopped at 5:11 p.m. Friday on Main Road, Pembroke, by Deputy Kevin McCarthy.

Louis Levon Wooden, 28, of Salina Street, Rochester, is charged with petit larceny. Wooden is accused of shoplifting at Walmart. Also charged with petit larceny is Tymekia T. Gaskin, 39, of Champlain Street, Rochester.

Ann Lee Cox, 42, of Main Street, Attica, is charged with criminal possession of a controlled substance, driving while ability impaired by drugs, driving while ability impaired by combined drugs and moving from lane unsafely. Cox was arrested following an investigation by Deputy Kevin McCarthy into a single-car accident on Route 98, Alexander, at 4:22 a.m. on Oct. 20.

Emily Grace Lemen, 19, of Lake Street, Le Roy, is charged with DWI, driving with a BAC of .18 or greater and moving from lane unsafely. Lemen was allegedly driving a vehicle at 4 p.m. on Jan. 6 that went down an embankment at the 490 off-ramp at Route 19. The accident was investigated by Deputy Matthew Butler.

A 71-year-old woman in Byron died overnight after she she wandered outside and was later found in a field near her home.

The body of Carol Magoffin, of Byron-Elba Road, was found about 9:30 p.m. by her husband Robert about 100 yards from their house.

Carol and Robert had been napping together and when he awoke, she was missing. He searched the home and found a rear door unlatched and followed footprints in the snow, which led him to his wife's body.

He called emergency dispatch and the Byron Volunteer Fire Department and Sheriff's deputies responded.

Coroner Karen Lang also responded.

The Sheriff's office reports that Mrs. Magoffin had been ill for some time and foul play is not suspected.

Amy Lynn Showler, 38, of South Manhattan Avenue, Batavia, is charged with petit larceny and trespass. Showler is accused of stealing $7.76 in merchandise from Walmart.

A 17-year-old resident of Main Street, Corfu, is charged with trespass. The youth allegedly entered a residence on Lovers Lane Road without the owner's permission.

Dimetrious Trudell Williams, 24, of Pearl Street, Batavia, is charged with unlawfully dealing with a child. Williams allegedly supplied alcohol to a person under age 21.

Molly Ann Kirsch, 24, of Bonnie Brea Drive, Darien, is charged with DWI, driving with a BAC of .08 or greater, driving left of pavement markings in a no passing zone and failure to keep right. Kirsh was stopped at 12:08 a.m. Saturday on Sumner Road, Darien, by Deputy Jason Saile.

Aaron Matthew Zastrocky, 29, of Mill Street, Le Roy, is charged with felony DWI, moving from lane unsafely, speed unreasonable for conditions and no seat belt. Zastrocky was allegedly the driver involved in a motor-vehicle accident reported at 11:18 p.m. Dec. 20 on Lake Road, Le Roy. The accident was investigated by Deputy Joseph Corona.

Joshua David Quaintance, 25, of Byron Road, Bryon, is charged with criminal mischief, 4th. Quaintance is accused of punching the window out of a vehicle on Townline Road, Byron.

Andrei Karpovich, 42, of Ibis Club Drive, Naples, Fla., is charged with harassment, 2nd. Karpovich allegedly slamming the hand of another person in a truck door during an argument at the Flying J at 5:54 p.m. Dec. 18.

Wendy J. Nelson, 44, of Le Roy, is charged with petit larceny. Nelson is accused of stealing from Walmart.

Scott F. McColl, 42, of Pavilion, is charged with DWI, driving with a BAC of .08 or greater and unlawful possession of marijuana. McColl was stopped at 10:05 p.m. Thursday by State Police on Black Road, Pavilion.

A possible chimney fire has been reported at 6632 E. Bird Road in Byron.

Byron, South Byron and Elba fire departments have been dispatched to the scene.

These are the latest indictments issued by the Genesee County Grand Jury.

Patrick E. Sewar is indicted for first-degree sexual abuse, a Class D felony, for allegedly subjecting another person under the age of 11 to sexual contact on June 24 in the Town of Darien.

Saul D. Standsblack is indicted for second-degree burglary, a Class C violent felony, for allegedly knowingly entering or remaining unlawfully in a dwelling on Bloomingdale Road in the Town of Alabama on Oct. 13 with the intent to commit a crime.

Michael B. Kropp is indicted for driving while intoxicated, a Class D felony, for allegedly operating a 1995 Ford on June 17 on Freeman Road and Ivison Road, Town of Byron, while intoxicated. In count two, he is further accused of aggravated driving while intoxicated, also a Class D felony, for allegedly having a BAC of .18 or more at the time. In count three, he is indicted for aggravated unlicensed operation in the first degree, a Class E felony, for operating a motor vehicle at the time of the incident while knowing or having reason to know that his driving license was suspended, revoked or otherwise withdrawn, and the defendant was driving while allegedly under the influence of drugs or alcohol.

A motor-vehicle accident with minor injuries is reported at 5948 Cochram Road, at the corner of Byron Road, in Byron.

UPDATE 1:39 p.m.: A female complains of hip pain. Two vehicles are involved.

UPDATE 1:41 p.m.: A Mercy ambulance is called in. Byron and South Byron fire department are also responding. Law enforcement is on scene.

UPDATE 2:12 p.m.: The patient is being taken to UMMC. The assignment is back in service.

Sean A. Kota, 20, of 7118 Byron Holley Road, Byron, is charged with DWI, refusal to take breath test, and criminal possession of marijuana, 5th. Kota was arrested following a police response to a report at McDonald's of two males in a vehicle in the drive-thru causing a disturbance at 2:30 a.m., Wednesday. Kota was allegedly found in possession of more than 25 grams of marijuana. Kota was jailed on $2,500 bail.

Michael Vincent Pontillo, 20, of 37 Bogue Ave., Batavia, is charged with assault, 2nd, with intent to cause physical injury to a police officer, obstructing governmental administration, 2nd, and resisting arrest. Pontillo was arrested as part of the same alleged incident involving Kota above.

Lance David Compton, 21, of East Main Street, Attica, is charged with unlawful dealing with a child, 1st. Compton is accused of providing alcohol to two people under age 21. Compton was arrested following a traffic stop at 9:09 p.m. Thursday on Lake Road, Bergen, by Deputy Joseph Corona. Cited for alleged possession/consumption of alcohol under age 21 were Christopher Stuart Nevinger, 20, of Eaton Road, Perry, and Cody Kleitz, 18, Espial Drive, Binghamtom.

Reinaldo Roman, 41, of 140 Jackson St., Batavia, is charged with criminal contempt, 1st. Roman is accused of violating a stay away order of protection by being at the residence of the protected party. Roman reportedly has a prior conviction on the same order for criminal contempt, 2nd.

Kasean L. Shannon, 21, of 115 State St., Batavia, is charged with unlawful possession of marijuana and criminal contempt, 1st. Shannon is accused of violating a stay away order of protection and possessing marijuana at the time of his arrest by Batavia PD.

Banjamin G. Evans IV, 25, no current address, Rochester, was arrested on a bench warrant out of City Court. Evans is accused of failure to appear on a criminal possession of a controlled substance charge. Evans was located by Rochester PD and taken into custody. He was jailed on $2,500 bail.

A two-car accident is reported at Byron and Cockram roads, Byron, with minor injuries.

I've driven past this pond on Transit Road, a bit south of Chapel Road, and never noticed this pond on the Byron side ... until today, with the smooth, still water reflecting the golden trees all around.

The pond had several geese decoys floating about.

Sheriff's deputies are responding to a report of a disturbance on North Byron Road. A man is sitting in his vehicle in his driveway and complains that his neighbor, with whom he has had numerous confrontations, is "basically, staring at him." The complainant also says he "believes the neighbor possibly has a knife and he stuck it in the barn wall."

Daniel C. Dilaura, 39, of Brooklyn Avenue, Batavia, is charged with felony criminal contempt, unlawful imprisonment, 2nd, criminal mischief, 4th, felony DWI, consumption of alcohol in a motor vehicle, refusal to submit to breath test, obstructing government administration, 2nd, and resisting arrest. Dilaura was reportedly in a vehicle on State Route 39 at Chapman Avenue, Town of Castile, when he was observed in an alleged domestic dispute. Dilaura allegedly held a female in his car against her will. Once Dilaura pulled the vehicle to the side of the roadway, she reportedly attempted to call for help, at which time Dilaura allegedly took her phone away. She was able to get the phone back a short time later and phone 9-1-1. The first officer on scene was Aaron Chase, Perry PD. He reported observing Dilaura exit the driver's seat of his car and begin running away on foot. Chase pursued Dilaura into a nearby field and was able to apprehend Dilaura after an alleged brief struggle. Dilaura was turned over to the Wyoming County Sheriff's Office when deputies arrived. Dilaura allegedly violated an order of protection barring offensive conduct toward the female. He was allegedly found to be driving drunk and has a prior DWI conviction from 2007. Dilaura's vehicle was towed from the scene. He was jailed without bail.

Jerald E. Bliemeister, 43, of Gibson Street, Oakfield, is charged with driving while ability impaired by alcohol and failure to keep right. Bliemeister was stopped at 3:37 a.m. Sunday on Route 354 at Schad Road, Town of Bennington, by Deputy Colin Reagan, Wyoming County Sheriff's Office, for an alleged traffic violation.

Three 17-year-old Batavia residents are charged with unlawful possession of marijuana. The youths were allegedly found in possession of marijuana by Batavia PD at 2:15 a.m. Saturday on Walker Place, Batavia (behind Batavia Middle School).

Richard A. Brink, 32, of 1625 Culver Road, Rochester, is charged with disobeying mandate. Brink allegedly violated a court order by contacting a protected person.

Anthony Daniel Micucci, 19, of Bonnie Brea Drive, Darien, is charged with petit larceny. Micucci allegedly entered the vehicle of another person without permission and stole personal property. Micucci was jailed on $2,500 bail. Micucci was also charged with criminal trespass, 2nd, and possession or consumption of alcohol in a motor vehicle.

Amara Michele Dahn, 23, of Royce Road, Varysburg, is charged with petit larceny. Dahn is accused of stealing merchandise from Kmart.

Jorden Mackenzie Charcholla, 23, of Fairgrounds Road, Byron, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right, speeding and drinking alcohol in a motor vehicle on a public highway. Charcholla was stopped at 11:12 p.m. Friday on Townline Road, Byron, by Deputy Joseph Corona.

Amy S. Hofert, 40, of 67 Mechanic St., Elba, is charged with harassment, 2nd. Hofert allegedly punched another person in the nose.

Mark Anthony Antinore, 35, of Clinton Street Road, Batavia, is charged with harassment, 2nd. Antinore allegedly threatened another person with physical injury during an argument.

Shadow S. Jonathan, 18, of Basom, is charged with assault, 2nd, and criminal possession of a weapon, 4th. Jonathan was arrested by State Police for an alleged incident Sept. 13. No further details released.

Kyle A. Arne, 19, of North Tonawanda, is charged with petit larceny. Arne is accused of stealing from a location on Veterans Memorial Drive.

Michael Joseph Dorigo, 56, of Buxton Avenue, Batavia, is charged with DWI, driving with a BAC of .18 or higher and moving from lane unsafely. Dorigo was reportedly involved in a motor-vehicle accident at 10:10 p.m., Sunday, on Fotch Road, Stafford. Dorigo's 2009 GMC was reportedly traveling north on Fotch Road and Dorigo failed to negotiate a curve in the road and drove off the road into a ditch where the vehicle hit an old utility pole base and a large rock. Dorigo's passenger was transported to UMMC with minor injuries. The accident was investigated by Deputy Joseph Graff.

Nina M.E. Kelso, 29, of 142 Hutchins St., Batavia, is charged with unlawful possesion of marijuana. During a check on the welfare of a child at Kelso's residence, Officer James DeFreze allegedly observed marijuana in plain view.

Zackary H. Kelly, 19, of 8 Dartwood Ave., Cheektowaga, is charged with petit larceny. Kelly is accused of shoplifting Amp Engery Drink from Southside Deli.

David Bernard Marsceil, 36, of Arnold Road, Elba, is charged with attempted criminal contempt, 1st. Marsceil, an inmate in the Genesee County Jail, allegedly attempted to send a letter to a person protected from contact by court order.

Colton Andrew Cole, 22, of Warner Road, South Byron, is charged with DWI, driving with a BAC of .18 or higher and no seat belt. Cole was stopped at 4:41 p.m., Sunday, in Byron, by Sgt. Ron Meides after Cole allegedly accelerated quickly and squealed his tires.

Robert Daniel Nowakowski, 38, of Bonnie Brae Drive, Darien, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Nowakowski was arrested following an investigation into a traffic accident on Route 20, Darien, at 6:39 p.m., Thursday. Nowakowski stated he swerved to avoid a deer and reportedly overcompensated. His car struck a National Grid utility pole, shearing the pole near ground level. The accident was investigated by Deputy Patrick Reeves. (Initial Report)

Richard Matthew Godlove, 35, of Main Street, Oakfield, is charged with DWI, driving with a BAC of .08 or higher, failure to obey traffic control device, moving from lane unsafely and failure to notify DMV of address change. Godlove was involved in a motor vehicle accident at 7:03 a.m., Sept. 14 on Route 237, Byron. Godlove reportedly drove his vehicle on a closed portion of Route 237 and struck a concrete barrier. Godlove was arrested following completion of a toxicology test.

Ellen Marie Martinez, 26, of Main Street, Batavia, is charged with falsifying business records, 1st, and grand larceny, 3rd. Martinez is accused of falsifying Section 8 records while receiving benefits through Pathstone, resulting in $10,054 in wrongfuly obtained benefits.

A two-car accident is reported at Walkers Corners Road and Byron Road. A 62-year-old subject complains of chest pain. The vehicles are leaking fluid. Byron medics, Byron and South Byron fire personnel are responding.

UPDATE 6:03 p.m.: One of the vehicles is blocking the intersection.

UPDATE 6:42 p.m.: One person was transported to UMMC. Responders are back in service.

Thomas Richard Ellis, 46, of Kings Lane, Rochester, is charged with DWI, failure to keep right, speed not reasonable and prudent, unapproved/no face shield on motorcycle and driving without corrective lenses. Ellis was charged following a motorcycle accident at 8:06 p.m., Friday, in the area of 4491 Old Ford Road, Elba. (initial report)

Ronald Jason Scroger, 33, of Swan Street, Batavia, is charged with two counts petit larceny and criminal mischief, 4th. On Friday, Scroger allegedly went to Walmart and removed merchandise from its packaging, damaging the item's package. He then allegedly left the store with $170.82 in stolen merchandise. He then allegedly returned with a stolen item and exchanged it for a gift card with a value of $34.97.

Kelly James Rhim, 35, of Eller Street, Batavia, is charged with unlawful possession of marijuana, driving with a BAC of .08 or greater and DWI. Rhim was stopped at 2:15 a.m., Saturday, on West Main Street Road, Batavia, by Deputy Joseph Corona.

Jeffrey Scott Vandusen, 24, of Chapel Avenue, Cheektowaga, is charged with resisting arrest. Vandusen is accused of fleeing from law enforcement during an attempted traffic stop at 8:05 p.m., Sept. 18, on Phelps Road, Pembroke, for alleged traffic violations.

Kory James Towne, 23, of Phelps Road, Corfu, is charged with resisting arrest, speeding and failure to yield. Towne is accused of fleeing from law enforcement during an attempted traffic stop at 8:05 p.m., Sept. 18, on Phelps Road, Pembroke, for alleged traffic violations.

Samuel J. Singletary, 50, of Alphonse Street, Rochester, was arrested on warrants for alleged aggravated unlicensed operation and speeding. Singletary was arrested upon his arrest from the Monroe County Jail on unrelated matters and arraigned in Town of Elba Court. Bail was set at $500.

Kevin Albert Roberts, 22, of Perry Road, North Java, is charged with petit larceny and conspiracy, 6th. Roberts is accused of conspiring with another person to shoplift at Walmart.

Mathew Lee Klein, 19, of Dodgeson Road, Alexander, is charged with trespass. Klein was allegedly seen atop the roof of the bus garage at Alexander Central School at 1:48 a.m., Sept. 21.

Jerell J.T. Jones, 25, and Nathaniel R. Davis, 18, both of 20 N. Spruce St., Batavia, are each charged with two counts of petit larceny. Jones and Davis are accused of shoplifting from YNGodess on two separate occasions. Jones and Davis were jailed on $1,000 bail each.

Dennis A. Edson, 49, of 17 Porter Ave., Batavia, is charged with trespass. Edson is accused of entering a neighbor's property without permission.

Dajuandrick C. Gardner, 36, of 22 East Ave., Batavia, is charged with criminal possession of a controlled substance, 7th. Gardner was allegedly found in possession of a crack pipe.

Andrew DeMara Hewitt, 29, of North Street, Churchville, was arrested on a warrant related to a petit larceny charge. Hewitt allegedly did not appear on a petit larceny charged in Town of Byron Court. He was jailed on $150 bail.

Jeremy L. Jones, 20, of Hammonsport, is charged with unlawful possession of marijuana. Jones was arrested by State Police in the Town of Pavilion. No further details released.

A man on Mill Pond Road in Bryon was reportedly shooting from the window of his red pickup truck into a pond. He's now headed eastbound on Route 262 and allegedly continuing shoot from the window of his truck. A Sheriff's deputy is in route to try and intercept him.

UPDATE 10:19: Deputies located the truck and its driver and will be speaking with him.

UPDATE 10:25 a.m.: A deputy says "It's a blank gun."

After covering Batavia High School girls swimming at Genesee Community College (post on that tomorrow), I decided to go for a drive through our beautiful county and make a few pictures.  Here are three shots from the drive.

The smell of natural gas at Byron-Bergen Central School prompted the principal to pull the fire alarm in order to evacuate students. The natural gas alert came to dispatch through RG&E. Bergen Fire Department is on scene. Mutual aid from Le Roy fire is also requested. The school is located at 6917 W. Bergen Road.

UPDATE 9:29 a.m.: "We do have an odor at the high school in the kitchen area and they are checking out the elementary school as well," says Bergen Command's firefighter Michael Crosier.

RG&E workers just arrived. The superintendent had the elementary school evacuated as a precaution but no odor is of natural gas is reported and the odor of natural gas was found in the mechanical room.

UPDATE 9:33 a.m.: One engine from Churchville is requested to stand by in its hall to provide coverage for Le Roy. Bergen. Bergen command says the smell of natural gas at the high school is coming from a couple of different areas.

UPDATE 9:49 a.m.: Responders are doing a second walk-thru of the high school. There was the odor of natural gas coming from the pool area. When the walk-thru is completed, Le Roy can go back in service.

UPDATE 10:14 a.m.: Stafford also was put on standby for Le Roy and is back in service, along with Le Roy and Churchville.

UPDATE 10:39 a.m.: Bergen command says RG&E has identified a few leaks and crews are working to repair them. The school will be closed for rest of the day and the children are being dismissed.

UPDATE 10:45 a.m.: Bergen command asks dispatch to have a deputy respond to the Byron-Bergen Central School because there are a lot of parents showing up to get their children and "some aren't too happy about things." A deputy is responding.

UPDATE 10:57 a.m.: A Le Roy fire official sent us the following corrections to this post (which have also been noted above):

1) Churchville was put on standby for Bergen, not Le Roy;

2) Stafford was on standby for Le Roy;

3) No odor of natural gas was reported at the pool;

4) In addition to leaks at the high school, the odor of natural gas was found in the mechanical room of the Elementary School.

Dear Byron-Bergen Parents and Guardians,

This is Byron-Bergen Superintendent, Casey Kosiorek. I want to inform that students of the district will not be returning to school today as a result of a gas leak in both buildings. Elementary students may be signed out at the Bergen Fire Hall.  Jr./Sr. High School students may be signed out at the track. Students that can't be picked up will remain at these locations until they can be bussed at their regular time. Lunch will be provided. This evening's Elementary Open House has been cancelled. We will keep you updated as we continue to work through the situation.

UPDATE 11:36 a.m.: The students are evacuated and the schools are closed, according to the superintendent.

UPDATE 11:56 a.m.: The Bergen assignment is back in service. RG&E remains on scene.

An inmate at the Buffalo Federal Detention Center has not eaten for 55 days, according to a caller to dispatch, and an ambulance is called to the facility at 4250 Federal Drive in the Town of Batavia.

The man is said to have "a severe sickness" due to "an apparent hunger strike." Because a Mercy rig is not available, an ambulance from Byron is responding.

UPDATE 11:51 a.m.: Byron is standing down and Mercy is now responding.

UPDATE 12:28 p.m.: The 28-year-old is being taken to UMMC.

UPDATE 3:50 p.m. (by Howard): We're trying to get more information on this situation and have been in touch with a spokesman for ICE. We can say at this point, it's 55 (or 50) meals, NOT days. More information to come, assuming it becomes available.
