This cigarette story has me baffled. I see numbers but I can't figure out how they relate.
10,000 cigarettes worth (I think the blurb meant dollars) 27,000. Is each fag worth two dollars and seventy cents? Does a pack of fags really cost $54 in New York? Smoke marijuana medicine, it is cheaper if the porcine have a stuffy nose.

The law is possession of more than 10K. Got more than 10K, whether 10,001, or 10,100 or 20,000, you violate the wording of that section of penal code.

The accused allegedly had 27K, which is a sum greater than 10K.

No dollar amounts discussed.

27k cigarettes is 135 cartons @ 200 cigarettes per carton.

FYI George, cartons are $17.50-$20 each at the Rez.

Cigarettes are $90 carton with tax off the Rez.

You're allowed to possess 2 cartons per person, or 400 untaxed cigarettes, if purchased on the Rez.

Yes, I know they are a "Sovereign Nation". But suppose they sold Alcohol to a minor, are they not criminally responsible?? Why not the same with Cigarettes?? Someone sold her all those Cigarettes, and they knew it was illegal. Good job by the sheriff's dept. They should camp out there, and have road check points like they do for booze.

The law is about possession not selling, and that law only applies in NYS. Hence not illegal to drive around the Res with 10,001 smokes, but soon as you cross that border is when it becomes a crime.

Every store on the Res would be in violation otherwise.

" But suppose they sold Alcohol to a minor, are they not criminally responsible??"

Nope.

They don't have alcohol for sale on the Rez. So your suppose is moot.

As far as the store selling 135 cartons to anyone, how would the store know if that person is taking all those smokes OFF the Rez? For all the clerk knew, the person could have been making deliveries on the Rez to home bound smokers, who can't get to the smoke shop.

The stores on the Tonawanda Reservation sell a variety of products. Their 'mainstay', if you wish, are tobacco-related.
I know of none there that advertise, or claim to sell, morality.
That is left up to the individual customers.
