Former Oakfield Fire Department treasurer Samantha Hilchey was ordered to pay $16,281 in restitution at her sentencing Monday in Oakfield Town Court. Hilchey created direct withdrawals from the department's account to pay her National Grid, Verizon Wireless and other personal bills before her thefts were revealed by an audit and investigation by the office of New York State Comptroller Thomas P. DiNapoli.

"Ms. Hilchey decided the public should subsidize not only her utility bills but also her K-Mart shopping," DiNapoli said. "Also disturbing is the unknown whereabouts of $4,340 in cash from a Mother's Day raffle. I thank Genesee County District Attorney Lawrence Friedman and the New York State Police for partnering with us to hold this individual accountable. I urge other fire departments to double check their books and increase their oversight to prevent similar abuses."

Hilchey, 31, of Batavia, was also sentenced to three years probation pursuant to her larceny conviction.

"The Genesee County District Attorney's Office thanks the Office of the Comptroller for its assistance and accounting expertise in the investigation and prosecution of this matter," Asst. District Attorney William Zickl said. "Investigations Director Stephanie Kelly and State Police Investigator Ron Wilson were instrumental in uncovering Ms. Hilchey's crime and making her accountable to the Oakfield Fire Department and the community."

The Comptroller's audit and investigation found that Hilchey stole $16,281 for personal use through a variety of bank or cash transactions in 2012 and 2013. The probe also found that $4,340 in cash from a Mother's Day raffle was unaccounted for.

The audit concluded that Hilchey was able to carry out the scheme because the Fire Department Board failed to establish proper internal controls such as requiring that transactions be properly recorded and that an annual audit of the treasurer's books be completed.

The Comptroller recommended that the Oakfield Fire Department:

* Audit and approve claims prior to payment and ensure that all disbursements are supported by vouchers;

* Review bank statements and cancelled checks monthly;

* Ensure that officials keep records of ticket sales and use of raffle funds; and

* Have the treasurer maintain accurate, complete and up-to-date accounting records that document all cash receipt and disbursement transactions.

In response to the audit, the Oakfield Fire Department Board of Directors thanked the Comptroller's Office, agreed with the findings, and promised to take corrective action along with additional safeguards. The Fire Department's response is included in the audit.

This morning, the new Oakfield water tower stood out against the gray, winter sky.

The snowstorm has passed, but a couple of flurries this evening are possible.

It's cold, though, and only going to get colder.

There is a wind chill advisory in effect from 7 p.m. through 10 a.m.

Winds will average 10 mph, creating wind-chill values of 15 to 20 degrees below zero.

There is a greater risk of frostbite and hypothermia, so appropriate dress and caution is advised.

Smoke is reported in the basement of a structure at 2719 Lockport Road. Oakfield fire is responding, along with mutual aid from Alabama. Town is Batavia fire is asked to fill in at the Oakfield Fire Hall. The location is Allied Electric Co., located between Bliss and Lewiston roads.

UPDATE 8 p.m.: Command says responders can proceed non-emergency.

Julian Munoz, 63, of Transit Road, Elba, and Carmelina Chavez, 47, of Drake Street, Oakfield, are charged with criminal obstruction of breathing or blood circulation and harassment, 2nd. Munoz and Chavez, brother and sister, allegedly choked and pushed a victim down a flight of stairs. 

Heather Jaye Interlicchia, 55, of Ramona Street, Rochester, is charged with possession of more than 400 untaxed cigarettes. Interlicchia was stopped for an alleged traffic violation at 12:08 p.m. Sunday on Route 77, Pembroke, by Deputy Patrick Reeves.

Windfield L. Marshall, 44, of Lake Street, Le Roy, was arrested on a warrant for alleged failure to pay fine on a parking violation. Marshall turned himself in and posted $25 bail.

Khadijah Azizza Davis, 23, of Arnett Boulevard, Rochester, is charged with criminal possession of a controlled substance, 7th, aggravated unlicensed operation, 2nd, unlicensed driver and speeding in zone. Davis was stopped at 11:49 p.m. Wednesday on Clinton Street, Batavia, by Officer Jason Davis, for allegedly driving 47 in a 30 mph zone. Davis was jailed on $1,000 bail.

Kasean L. Shannon, 22, of Hutchins Street, Batavia, is charged with unlawful possession of marijuana. Shannon was allegedly found in possession of marijuana during police contact with Officer Marc Lawrence while on Washington Avenue at 1:37 p.m. Wednesday.

Chana J. Mitchell, 22, of Prospect Avenue, Batavia, was arrested on a warrant for alleged failure to appear on a aggravated unlicensed operation, 3rd, charge. Mitchell turned himself in and jailed on $200 bail.

Joseph Michael Marceill, 47, of Pringle Avenue, Batavia, was arrested on a warrant for alleged failure to appear on a driving while registration suspended or revoked charge. Marceill turned himself in, was arraigned and released on his own recognizance. 

Cynthia C. Richardson, 35, of Maple Street, Batavia, is charged with a curfew violation. Richardson was arrested after police responded to a report of a fight at 1:29 a.m. Saturday on Court Street. Richardson's 14-year-old son was allegedly located on Evans Street near Ellicott Street at 1:34 a.m.

Donna A. Cocoran, 41, of St. Mary's Street, Pavilion, is charged with DWI, aggravated DWI, aggravated unlicensed operation, 3rd, and suspended registration. Cocoran was stopped at 12:49 p.m. on Elm Street, Batavia, by Officer Eric Foels.

Samuel J. Barber, 20, of Bank Street, Batavia, is charged with unlawful possession of alcohol under age 21. Barber was arrested following a complaint of a party at 12:32 a.m. Sunday on Bank Street, Batavia. Barber was allegedly hosting the party along with two other individuals. Also charged were Abdullah B. Diallo, 19, of Bank Street, Batavia, and Seanmichael G. Kidder, 19, of Bank Street, Batavia.

Robert Jean Jackson, 38, of Albert Street, Oakfield, is charged with DWI, driving with a BAC of .08 or greater, speeding in zone and failure to change address on license. Jackson was stopped at 1:17 a.m., Saturday, on Main Street, Oakfield, by Deputy Joseph Corona.

Justin L. Sanders, 23, of Byron, is charged with grand larceny, 3rd. Sanders was arrested by State Police and jailed on an unspecified bail. No further information released.

Allison A. Sobczak, 23, of Batavia, is charged with DWI and aggravated DWI. Sobczak was stopped at 11:02 a.m. Friday in the Town of Batavia by State Police.

UPDATE: Later today, State Police put out a press release on Sobczak's arrest.  Here's a portion of it:

Sobczak arrived to the Batavia barracks to file a complaint when Troopers smelled an odor of alcoholic beverage coming from her. After her verbal admission that she drove to the barracks, she was detained for a DWI investigation. After Sobczak failed the Standardized Field Sobriety Tests, she was placed under arrest for DWI. 

Sobczak was arrested and escorted back to the patrol room where she registered a BAC of .24%. She was issued citations returnable to the Town of Batavia Court on January 29, 2015.

Katrina M. Jones, 46, of Buffalo, is charged with conspiracy, 5th, and grand larceny, 4th. Jones was arrested by State Police and held on an unspecified bail. No further information released.

Christopher F. Bragg, 29, of Corfu, is charged with grand larceny, 3rd, and scheme to defraud, 2nd. Bragg was arrested by State Police. No further information released.

Joel David Prouty, 28, of Fisher Road, Oakfield, is charged with grand larceny, 4th, and criminal possession of a weapon, 4th. Prouty was arrested following an investigation by Deputy Chad Minuto into a report of a stolen rifle from a residence in Oakfield sometime between July and August. Prouty is accused of stealing a rifle and selling it to another person. Prouty has a prior felony conviction, leading the weapons charge. The rifle was recovered. Prouty is currently confined in the Genesee County Jail on unrelated charges.

Lauren E. Charache, 35, Myrtle Street, Le Roy, is charged with aggravated unlicensed operation, 2nd, and criminal possession of stolen property, 3rd. Charache was allegedly caught operating a vehicle that had been stolen from a person in Le Roy. Charache was held on $15,000 bail or $30,000 bond.

Steven Anthony Caldarelli, 52, of Portland Avenue, Rochester, was arrested on a warrant for criminal possession of stolen property. Caldarelli is accused of selling stolen property to a business in the Town of Batavia. He was jailed on $2,000 bail. He is also charged with petit larceny. He is accused of stealing power equipment from a vehicle that was parked in a parking lot in the Town of Batavia.

Michael Paul Dickens, 33, of Underwood Avenue, Hilton, is charged with harassment, 2nd. Dickens allegedly struck another person in the head while riding in the vehicle with that person on Route 19, Le Roy.

Jennifer Lynn Stack, 28, of South Main, Batavia, is charged with aggravated unlicensed operation, 3rd, and plate display violation (no front plate). She was also arrested on a warrant out of the Town of Gates. Stack was turned over to Gates PD following her arrest.

Chercal A. Smith, 19, of Bank Street, Batavia, is charged with assault, 3rd. Smith is accused of punching another person in the face with intent to cause injury.

Kristine S. Baker, 27, of Clinton Street, Batavia, is charged with dog running at large. Baker turned herself in on a warrant.

Jerry Tyrone Saddler Jr., 28, of Steel Street, Auburn, is charged with harassment, 2nd, and two counts of criminal contempt, 1st. Saddler was allegedly involved in a fight at 8:13 p.m., Tuesday, at a location on West Main Street in alleged violation of a court order barring offensive conduct around the other person. He reportedly has a prior criminal contempt conviction within the past five years.

An unidentified 18-year-old was arrested on a warrant for criminal obstruction of breathing, endangering the welfare of a child and criminal mischief, 4th. The suspect was located by Niagara Falls PD. The person allegedly did not abide by terms of a release under supervision order. The suspect was jailed on $1,000 bail or bond.

Eileen M. Wilcox, 46, of Brooklyn Avenue, Batavia, was arrested on a warrant for alleged failure to appear on a driving while impaired by alcohol charge. Wilcox turned herself in to BPD and is ordered to court at a later date to pay off her fines.

Grand Jury Report:

Jared E. Fleming is indicted on counts of felony DWI and felony driving with a BAC of .08 or greater. Fleming is accused of driving drunk July 31 on Transit Road, Stafford. He allegedly has a prior DWI conviction from January 2011.

A working structure fire is reported at 102 S. Main St. in the Village of Oakfield. Oakfield fire is responding along with Town of Batavia and the city's Fast Team. East Pembroke is asked to fill in at Oakfield's hall.

UPDATE 9:51 p.m.: Fire police are requested to shut down traffic at Route 63 and Fisher Road, and in the Village at Route 63 and South Pearl Street.

UPDATE 9:59 p.m.: Elba's firefighting "Cascade" is called in.

UPDATE 10:25 p.m.: National Grid has been notified. Command reports the blaze is under control.

UPDATE 10:34 p.m.: One code enforcement officer is on scene and a second one is contacted to respond.

A motor-vehicle accident is reported near Judge Road and Macomber Road, Oakfield.

A medic on scene reports two minor injuries and one person trapped. A second ambulance is requested to the scene.

Payton Malloy, a 13 year old from Oakfield who is an animal loving class clown, is entering this new year with increasingly difficult obstacles.

Payton has very complex medical problems which originated at birth and involve both physical and mental disabilities. These problems have been getting worse over the past year and have been affecting the family greatly. As the problems grow, Payton is losing the skills she has worked hard to learn and the skills many take for granted.

At times, she has trouble climbing stairs, walking and sleeping due to chronic pain. She will be undergoing two surgeries in the next few months on her knee and will be needing specific equipment including a wheelchair/adult stroller, stair lift and other necessary components.

“The hardest thing is what we are going through right now-- the possibility of her losing all of her skills, not being able to walk -- something that she worked so hard for,” said Amanda Malloy, Payton’s mother. “She is going to be 14 soon and there is all of the teenage stuff that I feel like we are going to miss out on like prom and driving and all that kind of stuff, and that is kind of hard for us and it is an everyday struggle. But, we are so fortunate for the things that she can do that I try not to let the negative overcome the positive. We are just fortunate for what she is able to do.”  

Although Payton is struggling, this does not alter her bubbly presence nor her ability to stay strong in hard times.

”The best part [about being Payton’s mother], I would say is just watching her learn and grow and enjoy life so much. Even though she has so many obstacles in her way, she doesn’t let anything bring her down. I mean, she inspires me every day,” Amanda said.

To help out, Payton’s best friend of six years, Emily Edgerton, created and planned “Wheels for Payton.”

“I just want to be able to help the family because they are going through so much and I want to help Payton,” says Emily.

Payton’s family is increasingly thankful for Emily’s support and presence in Payton’s life.

“There are no words to express my gratitude for Emily. This was all her idea. She is a really important part of Payton’s life. Payton looks forward to seeing her every day and if she doesn’t get to see her, she gets very emotional and upset and it kind of interferes with her day,” Amanda said. “She opens her heart to Payton and to us. She is always offering her help in doing things, watching Payton, etc.. We just really want Emily to be recognized for the good person that she is. She did not have to do this.”

“Wheels for Payton” will be held from 4 to 7 p.m. this Saturday, Jan.10, at Oakfield-Alabama High School. It will include a spaghetti dinner and basket raffle. Pre-sale tickets are $6 and the tickets bought at the door will be $8. The food can been eaten there or taken home. All proceeds will benefit Payton. “This [fundraiser] would mean that we could provide things that Payton has to have," Amanda said. "These are not luxury items and these are not things that we want to spend our money on. We would love to go on vacations and buy whatever we wanted but that is just not the case and these items that Payton needs are thousands of dollars. Fortunately, we have people like Emily and Teri, who are willing to volunteer their time and help us. These things will help us improve the quality of life for Payton and make it easier for us to take care of her.”

The family is overjoyed by the amount of support they get from the community.

“This is one of the benefits of having a small community because everyone is willing to help. I mean people who don’t even know Payton ask what they can do. It is just really nice to just see that because there is so much bad in the world. It is just nice to see that people are still willing to be helpful,” Amanda said.

Public support has already touched the lives of the Malloy family and they are very thankful. They hope many people can come out this Saturday to eat spaghetti and raise money for the fun-loving and inspiring Payton Malloy.

Brandon P. Matteson, 18, of Dutton Road, Silver Springs, is charged with burglary, 3rd. Matteson is accused of stealing from a locked concessions stand in an Oakfield Park.

Gary D. Piazza, 59, of Jackson Street, Batavia, is charged with petit larceny. Piazza is accused of shoplifting from the gas station at 99 Jackson St., Batavia.

Michael B. Neth, 37, of Summit Street, Batavia, is charged with harassment, 2nd. Neth allegedly pushed another person to the ground. The alleged incident was reported at 11:15 p.m., Saturday. 

Steven R. Columbo, 28, of East Main Street, Batavia, is charged with assault, 3rd. Columbo allegedly grabbed the arm of another person hard enough to cause dark bruising and substantial pain. The alleged incident was reported at 9:51 p.m., Wednesday.

A 16-year-old resident of Dellinger Avenue was charged with trespass. The youth was allegedly on property on Liberty Street without permission. Also charged with trespass at the same location was Destiny N. Green, 18, of Walnut Street, Batavia.

David Mobley Schmieder, 20, of Silver Road, Bethany, is charged with DWI, driving with a BAC of .08 or greater and moving from the lane unsafely. Schmieder was stopped at 2:37 a.m. Thursday on Erie Street, Darien, by Deputy Andrew Hale.

A person has minor injuries after being hit by a car on Sunset Parkway, Oakfield.

A female appeared to be walking behind him, and then ducked behind a residence.

David R. Cook, 20, of Lindsey Road, Attica, is charged with forgery, 2nd. Cook allegedly altered a prescription in an attempt to deceive a pharmacy into giving him more medication than original prescribed. Cook was jailed on $10,000 cash bail or $20,000 bond.

Daniel W. Hennebohl, 59, of Bethany Center Road, East Bethany, is charged with criminal mischief, 4th. Hennebohl is accused of scratching a car with a key while in the Walmart parking lot at 11:48 a.m., Sunday.

Nancy Ann Bennet, 44, of Center Street, Medina, is charged with petit larceny. Bennet is accused of shoplifting at Kmart.

Christina M. Sanchez-Anderson, 26, of Bank Street, Batavia, was arrested on a warrant for alleged failure to appear. Sanchez-Anderson is accused of failing to appear in court on a grand larceny charge in October.

Daniel J. Saeva, 35, of Central Avenue, Batavia, is charged with strangulation, 2nd, criminal mischief, 3rd, endangering the welfare of a child, harassment, 2nd and assault, 3rd. Saeva is accused of putting his hands around the next of another person and shoving another while in the presence of three children during an alleged incident reported at 9:01 p.m., Friday.

Donya M. Vaughn, 48, of Richley Road, Corfu, is charged with issuing a bad check. Vaughn was arrested on a warrant issued by City Court.

Carter L. Hall, 37, of Oakfield, is charged with DWI and driving with a BAC of .08 or greater. Hall was stopped at 9:10 p.m. Friday at Route 63 and Veterans Memorial Drive by State Police.

Santa and Mrs. Claus paid a visit Friday night to Genesee Sno-Packers Snowmobile Club at its Oakfield Club House, giving children who stopped by a chance to visit with Santa.

Zoey Church with a giant stuff moose that actually belongs to a snowmobile club in Colorado. It's made the rounds at several snowmobile clubs in New York, awaiting a ransom payment from the Colorado club.

Preston S. Daigler, 16, of Batavia-Oakfield Townline Road, Oakfield, is charged with resisting arrest. Daigler was wanted on a warrant out of City Court on an endangering the welfare of a child charge. He was also a reported missing person out of Orleans County. Daigler was located at his residence when the Sheriff's Office attempted to place him under arrest. Daigler jumped from a second-story window and fled into a wooded area behind his residence. Daigler was located about two hours later hiding in a dumpster at a nearby local business. He was treated at UMMC for exposure and then arraigned in Oakfield Town Court. He was jailed on $5,000 bail.

Kevin Michael Lampman, 41, of West Main Street, Batavia, is charged with criminal contempt, 1st, harassment, 2nd, and aggravated family offense. Lampman is accused of trying to bite a woman in the face during an argument. There was allegedly an order of protection in place at the time of the incident. Lampman was jailed on $10,000 cash bail.

Christina AnnMarie Deluna, 34, of Liberty Street, Batavia, is charged with petit larceny. Deluna is accused of stealing $576.72 in merchandise from Walmart. She was located five days later at her residence and issued an appearance ticket.

John Frederick Lightfoot II, 21, of Roslyn Street, Batavia, was arrested on a warrant out of Lancaster for an unlawful possession of marijuana charge.

Anthony Michael Vanille, 55, of Broadway Road, Attica, is charged with driving while ability impaired by alcohol and speed in excess of 55 mph. Vanille was stopped at 8:14 p.m., Saturday.

Michael John Valentino, 48, of Hilltop Court, West Seneca, is charged with DWAI (combined influence of drugs), criminal possession of a stimulant, 4th, criminal possession of a controlled substance, 7th, criminal use of drug paraphernalia, 2nd, criminal possession of a weapon, 4th. Valentino was stopped at 2:37 a.m. Sunday on Oak Orchard Road, Batavia, by Deputy Joseph Corona. He was allegedly found in possession of methamphetamine, hydrocodone and marijuana and related paraphernalia. He also allegedly possessed a weapon at the time of his arrest.

A 17-year-old resident of Spring Road, Alexander, is charged with harassment, 2nd. The youth is accused of striking another person at Alexander High School.

Raymond Lundy Kelley, 24, of Ellsworth Avenue, Batavia, is charged with petit larceny. Kelley is accused of shoplifting at Walmart.

Grayson Carl Stock, 22, of Sunset Parkway, Oakfield, is charged with possession of a hypodermic instrument. Stock was allegedly found in possession of a hypodermic instrument while at a location on West Main Street, Batavia.

Jamie Lee Steinhardt, 22, of Sumner Road, Darien, is charged with petit larceny. Steinhardt is accused of shoplifting at Walmart.

Brandon Aaron Barclay, 27, of Big Tree Road, Pavilion, is charged with criminal contempt, 2nd. Barclay allegedly violated an order of protection by having contact with a protected party.

Cassandra Ann Jimenez, 26, of Oliver Street, North Tonawanda, is charged with petit larceny. Jimenez is accused of going through the self-checkout line at Walmart, scanning several but not all of the items in her cart. She then allegedly passed the checkout area with $128.63 in unpaid items in her cart.

Morgan L. Cox Jr., 22, of State Street, Batavia, is charged with criminal contempt, 2nd, and harassment, 2nd. Cox was allegedly involved in a domestic incident in violation of an order of protection.

A 16-year-old resident of West Main Street, Batavia, is charged with criminal diversion of prescription medication, 4th.The youth was allegedly involved in a trade of prescription medication for cigarettes at Batavia High School. Batavia PD withheld the name of the suspect. An unnamed 17-year-old resident of Highland Park, Batavia, was also arrested.

A 17-year-old resident of Williams Street, Batavia, is charged with disorderly conduct. The youth was allegedly involved in a fight at Batavia High School. Batavia PD withheld the name of the suspect.

Amber L. Ostrander, 24, of Morrow Road, Pavilion, was arrested on warrant for alleged failure to appear. Ostrander allegedly failed to appear on a charge stemming from her arrest in August for driving on a suspended license.

Danielle M. Cravatta, 30, of Walden Creek Drive, Batavia, was arrested on a warrant for allegedly issuing a bad check in November, 2013. 

Gregory A. Emerson, 32, of Park Road, Batavia, is charged with DWI and driving with a BAC of .08 or greater. Emerson was stopped at 1:04 a.m. Friday on Richmond Avenue, Batavia, by Officer Peter Flanagan.

A combine fire is reported at 3238 Maltby Road. Oakfield Fire Department is on scene.

Uriel Ramirez-Perez, 26, of Oak Orchard Road, Elba, is charged with first-degree rape, a Class B felony. The defendant was arrested after allegedly raping a female victim at an Elba residence. The charge is related to the previously reported charges of rape against three other Elba men. This defendant was allegedly present during the Nov. 16 incident. He is in county jail on $25,000 cash bail or $50,000 property bond. The incident was investigated by investigator Kristopher A. Kautz, deputy Dana Richardson and Angel Santos, investigator with the State Police.

Shannon Ann Caton, 39, of Fisher Road, Oakfield, is charged with: driving while intoxicated with a previous conviction within the last 10 years; resisting arrest; attempted escape, 3rd; speed not reasonable and prudent; and following too close. She was arrested Nov. 19 on the charges after she allegedly rear-ended another vehcile twice on East Main Street near Harvester Avenue in the City of Batavia. While at police headquarters, she slipped out of handcuffs and attempted to escape. She allegedly physically resisted her re-apprehension and was then jailed without bail. She is also charged with refusing to take a breath test. The incident was investigated by police officers Jason Ivison and James DeFreze.

Thomas K. Lee, 51, of West Main Street, Batavia, is charged with resisting arrest and obstruction of governmental administration. He was arrested Nov. 18 after allegedly interfering with a Batavia police officer's investigation into a domestic incident involving Lee. He allegedly resisted arrest and "attempted to kick patrols." He is in jail in lieu of $2,500 bail. The incident was investigated by police officers Jason Ivison and Chad Richards.

Shane Zimblis, 43, of Hutchins Street, Batavia, is charged with: operating a snowmobile with a BAC of .08 or higher, first offense; operating a snowmobile without liability insurance; no/inadequate headlight; operating an unregistered snowmobile; and following too close. The charges stem from an accident Nov. 18 on Pearl Street in the city wherein Zimblis was allegedly operating his snowmobile and struck an SUV. He is to appear in city court on Dec. 3. The incident was investigated by police officers Chad Richards and James DeFreze.

April L. Walradt, 37, of Bank Street, Batavia, was arrested Nov. 11 and charged with second-degree harassment. She allegedly made comments to another person and a youth that caused them alarm. She was issued an appearance ticket for city court. The incident was investigated by police offier Matthew Wojtaszczyk.

Matthew Michael Biggins, 25, of Rail Road Avenue, Alexander, is charged with third-degree forgery and petit larceny. He was arrested Nov. 14 after allegedly stealing three checks, making the checks out in his own name and then cashing them. He was issued an appearance ticket and is to appear in Alexander Town Court on Dec. 2. The incident was investigated by Sheriff's deputy Cory Mower.

Terrance Trae Allen Harley, 18, of Frandee Lane, Rochester, was arrested Nov. 22 on Clinton Street Road in Stafford and charged with unlawful possession of marijuana, speed violation (67 in a 55 mph zone), and having no or inadequate taillights. The charges were issued following a traffic stop for alleged vehicle and traffic law violations. Harley is to appear in Stafford Town Court on Dec. 11. The incident was investigated by sheriff's deputy Joseph Corona, assisted by deputy Andrew Hale.

Jennifer Lynn Stack, 28, of South Main Street, Batavia, is charged with criminal contempt, 2nd. She was arrested Nov. 23 after she entered the Batavia Walmart and remained in the store. These alleged actions violated an active order of protection issued by Batavia Town Court, prohibiting her from being on the premises. She was issued an appearance ticket and is to appear in court on Dec. 18. The incident was investigated by Sheriff's deputy Chad Minuto.

Adam Paul Hoopengardner, 34, of Bank Street Road, Elba, is charged with DWI, driving with a BAC of .08 or more and speeding (52 in a 40 mph zone). He was stopped on Lewiston Road Nov. 23 for allegedly speeding and an investigation revealed he was allegedly intoxicated while driving the vehicle. The incident was investigated by Sheriff's deputy Thomas Sanfratello.

James Russell Kosiorek, 22, of East Main Street, Batavia, was arrested Nov. 20 on a state parole warrant. He responded to the Sheriff's Office to turn himself in and was placed in county jail.

Gloria Susan Moretti, 37, of Main Road, Corfu, was arrested Nov. 7 and charged with unauthorized use of a vehicle. She was a co-renter of a vehicle from Sikes Enterprises, which allegedly has not been returned and has not been paid for. She was issued a computer-generated appearance ticket and is due in city court Dec. 2. The incident was investigated by Batavia police officer James DeFreze.

Six special rescue trucks from the New York City Fire Department, part of a special task force, were at the Home Depot in Batavia today on their way to Buffalo. The trucks were specifically designed and built for high-water rescues following Hurricane Sandy. The trucks were sent to WNY in anticipation of flooding Monday with warmer weather, rain and snow melt. The vehicles can carry up to 16 people each through high water. The Thruway Authority announced the I-90 has reopened.

Motorists should be aware of the following restrictions:

• Thruway (I-90) between Exit 50A (Cleveland Drive) and Exit 61 (Ripley – Pennsylvania state line) will be limited to essential travel only, including travel needed to exit the region, deliver necessary supplies, and remove snow. In this section, all exits are open wherever localities have lifted travel bans.

The following exits remain closed to traffic exiting from the Thruway, although traffic is permitted to enter at these locations:

• Exit 56 (Blasdell -- Orchard Park -- Mile Strip Road -- NY Route 179)
• Exit 57 (Hamburg -- East Aurora -- NY Route 75)
• Exit 57A (Eden --  Angola)
• Exit 58 (Silver Creek -- Irving -- NY Routes 5, 20 & 438)
• I-190 (Niagara Thruway) is open, but there is no access to Exit 1 (South Ogden) through Exit 5 (Hamburg – Louisiana).

The Town of Darien office is closed until 9 a.m., Monday.

John Brown's car in Alexander this morning:

A 24-year-old Oakfield woman is being held on $25,000 bail after being accused of robbing a pharmacy this afternoon.

Elizabeth Marie Hamby, 24, of Forest Avenue, is charged with first-degree robbery as well as second-degree robbery.

Hamby is the person initially taken into custody this afternoon after local law enforcement was notified of the robbery.

She reportedly fled from the pharmacy on Main Street in Oakfield to a house less than a block away on Forest Avenue.

A witness saw her leave and go to that location.

A clerk at the pharmacy reportedly suffered minor fingernail cuts in a scuffle with the suspect.

Hamby allegedly made off with $400.

Investigators say Hamby entered the pharmacy and appeared to be shopping for a while and then approached the clerk, displaying what appeared to be a pistol and a knife. She allegedly demanded money.

Deputies and troopers quickly responded to the scene and surrounded the house where the suspect was believed to be hiding.

She's scheduled to appear in Town of Oakfield Court again at 2 p.m., Nov. 26.
