News roundup: City school board cuts a half million from budget

After slimming the budget by a half million dollars last night, the Batavia City School Board has already cut the proposed property tax increase from 23 to 16 percent, according to WBTA's Dan Fischer. City Schools Superintendent Margaret Puzio told Fischer that she hopes an offer of early retirement option to three labor unions could help stave off any outright layoffs of teachers or staff. Puzio also hopes and expects to further reduce the tax increase. Visit the WBTA Web site to hear her comments on that.

Batavia city schools are closed today for Superintendent's Conference Day. Also, LeRoy BOCES school is closed today due to a water main break.

News roundup: City school board will release budget numbers tonight

Batavia's City School Board will meet tonight at 7 o'clock to discuss the proposed budget for next year, WBTA's Dan Fischer reports. In its current version, the budget calls for a 23 percent property tax increase.

Students will not have classes at Notre Dame High School today. A funeral mass will be held this morning at 10 o'clock at St. Anthony's Church for Nadine Netter, the school's cook who died unexpectedly last week.

City department heads slated for raises tied to scheduled union raises

Batavians can take some comfort in the fact that the City Council recently whittled down the proposed tax increase of 3.6 percent down to 2.17 percent, without really sacrificing any city services—the jury is still out on whether the ambulance flap will help or hinder us in the long run.

Nevertheless, some rumors are going around that the Council has instituted raises for all of the city department heads. We put the question to Council President Charlie Mallow this morning in an e-mail. He told us that "all city employees have mandated cost of living increases based on union contracts except seven administrative people." Mallow feels that it's unfair for those seven people not to receive the same sort of "increases"—he never used the word "raise"—as the rest of the union-backed employees.

His words:

There is a sense of right and wrong here. I do not believe non-union employees should be punished for not being part of a collective barging unit. Keep in mind that our administrative people have worked hand in hand with council to eliminate close to a $3 million dollar spending deficit in the last two years. The hard work of these administrative people reduced the size of city government. Some people out of sheer ignorance would like to single these people out; I think the rest of the community understands how far we have come and who helped us along the way.

Here are some of the budgeted figures listed under "personnel services"—does not include overtime, social security, supplies, etc.—for a few of the city's top offices (2008 and 2009):

• City Manager's Office: $103,629 (2008), $106,140 (2009)
• Bureau of Finance: $35,639 (2008), $39,040 (2009)
• Bureau of City Assessment: $33,624 (2008), $34,590 (2009)
• Bureau of Inspection: $138,246 (2008); $195,860 (2009)

Strangely, the "Bureau of the Clerk-Treasure" is scheduled for a reduction in its budget for personnel services in 2009. That office was listed at $64,212 in 2008; $60,790 has been listed for 2009.

Since the budget does not break down each city employee's salary into a tidy, comprehensible format, we asked Mallow if the Council had a document illustrating all of the changes that were effected. He replied: "A list of budget changes does not exist; it was a very fluid process." We then asked if the city could provide a list of every employee's salary for 2008 and the proposed salary for 2009. We're waiting on that.

The single most important thing behind this budget was planning for the future with a series of contingency funds. These funds will allow the city to save for future equipment purchases. Doing this will allow us to have a stable tax rate in the future and be less prone to large swings like we have seen in the past. People should understand that we have taken on the practices that businesses use every day. We plan, we have goals and we live within our budget.

Conversation on the stimulus bill: Where does it go from here?

We were glad to see so many folks getting into the discussion yesterday about the national stimulus package that was passed by the U.S. House of Representatives earlier this week. That bill, already proving quite controversial, will go to the Senate next week for round two.

There were some clear divisions among opinion, yet both sides made strong cases. Some of you expressed a general yet cautious support for the stimulus bill on the grounds that it would "right the ship of state," as Russ Stresing put it so eloquently. Others among you decried the attempt to try to "buy our way out of debt," and called for a reining in of spending.

What is the next step in the conversation when both sides of the argument—because, for now at least, this argument is restricted to only two sides (the classic: for and against)—make valid claims? Neither is wrong. Surely, the nation will have to make "strategic investments" at some point to dress our wounds. It's not unlike a fellow who finds himself unemployed and unable to secure a new job. Perhaps an investment in a new suit, a new haircut or even a credited business course at a local community college could give him that edge. On the other hand, any such investments are based on hypothetical situations: 'If I make this happen, then this could happen...' And funds that could have went toward the perennial costs of food and shelter will have been wasted on a hoped for conclusion that may never come to pass.

Furthermore, accusations that this or that side is playing politics are also all true. One of our readers yesterday commented that the president sought the votes of the House Republicans on the stimulus bill so that said Republicans—none of whom voted in favor of the bill—could not use their unified dissent as a political weapon in the future. Well, doesn't that indict both sides? Democrats are threatening to push through the bill to flex their majority muscle. While Republicans are all too content in playing the foil.

President Barack Obama spoke a lot about "change" during the campaign, but if you ask me, this seems to be a whole lot of politics as usual. In the meantime, while we're trying to figure all that out, Howard passed along this article from a site called Good, that pieces together some of the arguments against a stimulus. Very informative. The author sums up his stance, in this way:

And there you have it. In my mind, economics seems to be a mostly made-up “science,” and I am pretty sure nothing the government does will have as much effect as other events (see: Great Depression and World War II, for instance). That said, doing nothing (or just lowering taxes) does not really seem like a viable move for a government, politically if not also economically. So, if we can get another round of the equivalent of WPA posters and CCC National Park trails out of this, maybe that’s all we need until whatever is really going to cure the recession comes along. But, in the meantime, it’s important to look at all sides.

Poll: Downtown Batavia celebrations: Fund 'em or scrap 'em

Yesterday, we ran a post about the push by some members of Batavia's City Council to cut down on the funding for downtown celebrations, such as Summer in the City and Christmas in the City. Councilman Bob Bialkowski explained that they only wanted to limit the amount of funding available to cut down on overtime costs, but that they would not eliminate the celebrations altogether. Bialkowski justifies the push for cuts as a measure to minimize the city's property tax rate. Opponents of the cuts, however, argue that any cut in funding would shift too much of a cost burden onto the Batavia Business Improvement District, sponsors of the events.

By the Numbers: School aid cuts as suggested in proposed state budget

If Gov. David Paterson's proposed state budget were to be passed as is tomorrow, Genesee County school aid would be looking at a loss of about $3.3 million compared with this past year's aid.

As for specific school districts within the county, here's the breakdown (based on proposed aid levels for the 2009-10 school year as compared with the current 2008-09 year):

• Alexander: A loss of $541,112, or 5.78 percent.

• Batavia: A loss of $637,011, or 3.14 percent.

• Byron-Bergen: A loss of $338,474, or 3.37 percent.

• Elba: A loss of $160,084, or 3.06 percent.

• Le Roy: A loss of $586,993, or 5.64 percent.

• Oakfield-Alabama: A loss of $372,623, or 3.57 percent.

• Pavilion: A loss of $163,353, or 1.88 percent.

• Pembroke: A loss of $537,260, or 5.01 percent.

Meanwhile, Sen. Chuck Schumer has teamed up with Paterson to seek federal block grants to help offset the cuts to school aid. Nothing specific is yet worked out on that. From Schumer's Web site:

There are various approaches that Congress can use to deliver these critical funds to students and schools. U.S. Senate and House Leadership are consulting with the President's team to determine the best, most effective way to provide schools with the targeted resources necessary to maintain jobs and academic programs. Congress is considering using existing federal education funding formulas, such as the one used for Title I, No Child Left Behind funding, to determine the amount each state will receive in block grants. Schumer said it is essential that the block grants are distributed in a way that gives states and districts the flexibility and tools they need to keep serving our children.

What do you think? Is shifting the burden from the state to the Fed to cover these deficits the best move? No matter where the "billions" Schumer quotes so frequently with such bravado come from, don't they, in the end, come from our pockets. But what other choice do we have? Should the schools suck it up and try to face the cuts? How can they?

Downtown events could land on the budget chopping block—or not...

Earlier this morning, one of our readers, John Roach, left the following comment:

It’s a shame that after all the hard work by BID, the 5 Republicans on City Council have submitted a budget proposal that will take enough money away from city celebrations and events that it might kill the Summer/Christmas in the City.

That caught our attention, and we set out to find exactly what the City Council had planned for budget cuts that might affect future events downtown. We asked for comment from Council President Charlie Mallow and Don Burkel, director of the downtown Business Improvement District. Burkel has not yet commented. Burkel responded via e-mail at noon today:

"There should be no budget cuts for Christmas in the City, Summer in the City or any other BID activities, as this would definitely have a negative impact on the downtown businesses.  In this time of economic hardship the merchants need these events to generate activity to attract shoppers and visitors to the Batavia Business Improvement District."

Mallow responded in an e-mail:

"I was sent a proposed amendment to lower the city's contribution from a few of the council members. Council will be talking about this proposed amendment as well as the rest that were submitted on Saturday.

"From my point of view a consensus was come to on the amount of this line item in the last budget. I do not support the cut, I think its unfair and hurts the businesses downtown and I think doing anything to jeopardize either event would lower our quality of life in the city.

"The members that proposed the amendment alluded to the idea that they had a majority in favor of the cut. I find that hard to believe."

While we were waiting to hear back from Mallow and Burkel, we also spoke with a few other members of Council: Rose Mary Christian, Kathy Briggs and Bob Bialkowski.

Bialkowski, who expressed an overall optimism about the budget process this year, said: "We're not eliminating any downtown events." Instead, he said, several members of Council were looking at ways to reduce overtime costs—especially those related to the management of downtown events—to help reduce the property tax burden. While this would not "eliminate" downtown events, it would reduce the funding available for them.

According to the budget proposal prepared by the office of the city manager, actual overtime costs so far paid out in the current budget season total more than $530,000, as listed in the budget's general fund. That total does not include such special funds as water and sewer, ambulance—in which overtime costs exceed $300,000—and the mall, which for some reason is maintained as a separate fund.

Nevertheless, most of those overtime expenses fall within the budgeted amounts. In fact, both fire and police overtime costs were under. For some reason, the communications department totaled more than four times what was budgeted. To date, that department has accrued $28,612 in overtime costs, while a mere $7,000 was budgeted.

What's most apt here, however, is the overtime cost for "community celebrations," which has totaled $4,997 so far. Those are the costs that Bialkowski has called into question. He says that if the city could get more use out of volunteers for the downtown celebrations and shift the schedule for assistance from public works employees from the weekend to Friday and Monday, the cost would drop from, say, $1,000 to $500, since overtime costs would be avoided.

"I'm a big believer for volunteering for events," he said. "We're just trying to keep any property tax minimal. We're looking at all costs, trying to keep it down as low as possible."

Cutting back on overtime costs are just one way he would hope to get expenses down for the next budget season. He has proposed a list of amendments, he says, that would reduce about $70,000 in "miscellaneous items" and by sharing services and getting more time out of certain city vehicles.

Christian and Briggs said that the cuts proposed by Bialkowski and others would, in fact, cut the funding for downtown events and shift the cost burden onto the BID, which would not be able to manage, and so be forced to eliminate the events.

"Some council members have recommended cuts in this area," said Briggs in an e-mail. "One suggestion was cutting it from $3,000 to $2,000. Nothing is definite yet. In my opinion the events shouldn't be scrapped. I'm not going to support this cut. We can't expect the Business Improvement District to pick up all of the cost, and we have to have some celebrations, right!"

Christian is of the same mind. She says that she is "not one of them," referring to some other members on Council who are trying to cut the funding for downtown events. Instead of those cuts, she said that she asked for City Manager Jason Molino to see if he can cut 1 to 1 1/2 percent from elsewhere in the budget. She hopes to get an answer on where and how that might be pulled off at the session Saturday.

"We'll see if Jason can find cuts in certain areas," she said. "The budget is astronomical. It's $24 million. We have to be realistic. The economy is a disaster. The stock market is a disaster. Even the president has said, it's not up to government, it's up to us. It's up to the people to make a change."

As we should expect, there's plenty of next day reaction to Gov. David Paterson's budget proposal in the news this morning. We've included here a roundup of some local reaction, as well as a few choice cuts from around the state.

My personal favorite among our local representatives—other than WXXI's capital correspondent Karen DeWitt who is simply fantastic: literate, articulate and trenchant—has to be Buffalo News reporter Tom Precious, who works out of the paper's Albany bureau. Precious put together another great piece today, now that the smoke screen has dissipated somewhat... well, not really dissipated at all.

“We’re going to have to take some extreme measures,” Paterson told lawmakers of the challenge of closing the state’s largest deficit ever.

The reaction was swift — and negative.

Hospitals and nursing homes would close, health care officials say, and those that don’t would cut back on patient care. As a result of Albany’s decreasing school aid, schools would reduce classroom and after-school programs, and property taxes would rise, education officials warned.

Middle-class taxpayers would be hit hard, critics said, not just from the cuts, but from the stunning array of increases in taxes and fees.

New Yorkers would pay more for registering a car, catching a salmon or trout, going to the movies, getting a haircut, buying gasoline, drinking beer and buying nondiet soft drinks.

Republicans say the Democratic governor’s tax and fee plan is actually $2 billion higher than being revealed. In all, there are 151 proposals that would create or increase taxes.

Rochester's Democrat & Chronicle reinforces the theme of atoning for the sins of our ancestors. Under the subheading: Paying for the Past, Joseph Spector writes: "Paterson warns that the state's fiscal problems are the result of years of overspending." Guilt is implied as a fact of life, it seems, and we're living out the unfortunate tragedy of an Ibsen character, collectively.

The Albany Times Union put together a great piece breaking down the "major elements" of the proposed budget. In an easy-to-navigate bullet-point format, this article is a must read for folks who want to know what's really at stake in the budget. For example, this is the only place we've read about the proposed $7 million reduction in arts grants.

Governor releases budget proposal: Plans to eliminate deficit in two years

A law that would enforce the collection of taxes on the sale of cigarettes by Indian-owned retailers was merely the beginning. Gov. David Paterson today unveiled a $121 billion budget proposal that plans to eliminate the state's $15 billion deficit over the course of the next two years through a hefty dose of cuts and creative taxation.

From the Democrat & Chronicle:

Paterson is calling for massive cuts to state education and health-care aid, an elimination of a property-tax rebate program for homeowners and 88 new taxes and fees.

Put a little more bluntly, with a bit of spleen, by the Buffalo News:

Aid to public schools will be cut by $700 million, state university tuition will rise, the STAR property tax rebates will be scrubbed, prison facilities will close and state workers who aren't laid off will get no pay raises under a budget plan Gov. David Paterson proposed this morning.

Cuts in school aid would total about $700 million, which has some education officials already worried that the loss will need to be offset by increases in local property taxes. Although their worry sounds more like a threat that we're sure to soon see manifested in television advertisements. You know the kind. We've seen them before. For example: Imagine something along the lines of a school playground at recess: the children, the glee, the games. Then, cut to a close-up of Paterson, overlaid with a sombre voice detailing some aspect or other of the budget proposal, followed by the post-apocalyptic image of an empty swing, rocking back and forth in the middle of the now empty playground. Or something like that.

Although, at least Paterson delivered his posion pill with an olive branch. Or so the Buffalo News would have it (note the language: make up for):

To make up for the cuts, Paterson proposes exempting schools from the state's expensive, union-backed Wicks Law … which drives up public facility construction costs … and new pension reforms to reduce local costs.

Wicks Law, a requirement for local governments to hire separate contractors for different aspects (plumbing, heating, electric) of the same public construction project, has been a frequent point of contention among municipalities across the state. The law was restructured some earlier this year.

What else should we expect? From the Buffalo News:

The Paterson budget raids an assortment of accounts that are not part of the state operating budget, increases taxes and fees by $4.1 billion, eliminates sales tax exemption on clothing and footwear purchases under $110, and places new sales taxes on everything from cable TV and satellite radio services to haircuts and massages.

A so-called obesity tax that would increase the levy on sugary, non-diet sodas to 18 percent per bottle is one of many "creative" taxes set up in the budget proposal. From the New York Times:

A tax on car rentals would rise to 6 percent from 5 percent. Taxes on beer and wine would more than double. Licensing fees would increase for private investigators, barbers, bail enforcement agents, home inspectors, notary publics and cosmetologists.

Taxes on gasoline, cable TV, satellite television and radio service, cigars, flavored malt beverages would also increase. And the cost of owning and operating a car would also increase significantly, with 16 fee increases for the Division of Motor Vehicles.

Mainstream media reports mostly give the impression of bracing for a blow from dad's leather belt. In the New York Times, we can read of the "austerity budget" that lays out a "painful plan"—you almost expect to hear the phrase: 'This is going to hurt me more than it's going to hurt you,' as the blows rain down upon us. Paterson, we're told, better get ready for a "reckoning" with the state's workforce. The Democrat & Chronicle's much more inspid coverage shies away from such colorful language, opting for the "trim" this and "limit" that style of budget speak.

Tom Precious, with the Buffalo News, siphons a bit more powder into the gun barrel in his coverage, coloring Paterson something of a pirate who is "raiding" state accounts. Precious talks of Paterson "slapping" this group with cuts and "scrubbing" rebates for that one. Sure, there's no doubt that the governor is scrambling to squeeze revenue from any source possible. But a $15 billion deficit is no chink the armor. We're hammered and dented and our shin buckles have long since rusted away. Isn't it time to strip down and revisit the forge? Or do we keep clambering on, stabbing at the windmills?

Paterson speaks of "sacrifice," mostly on the part of "working New Yorkers." No surprise, then, that we read in the Times: "Unions were bracing for a battle."

In a joint statement, George Gresham, the president of 1199 S.E.I.U. United Healthcare Workers East, and Ken Raske, president of the Greater New York Hospital Association, said “these are staggering cuts that would shatter New York’s health care infrastructure, severely threaten the ability of patients to get access to care, and cause serious harm to communities across the entire state.”

That doesn't sound good. Shattering the health care infrastructure! That's intense. That's colossal. Is it true? What about "education advocates" who are telling us that the $700 million in cuts to school aid "really" amounts to $2.5 billion. Aid was going to increase next year. So that increase should be figured into the loss... so goes the argument. Billy Easton, executive director of the Alliance for Quality Education, told Tom Precious that this is "the most dramatic cut in education in the history of New York." Is that true? I fear we will be hearing a lot more of this most and worst ever talk.

Of course, it's not all bad news.

The Paterson budget would raise $105 million by permitting the sale of wine in grocery stores. And he wants New Yorkers to gamble more: the state's Quick Draw lottery game, derided as Crack Draw by gambling opponents, would see restrictions relaxed for the kinds of places the games could be offered as well as the number of hours a day the machines could be run. And racetrack casinos could keep their doors open longer each day.

So, when you can no longer afford to buy a Coke and listen to your satellite radio while you're trout fishing—license fees are listed to go up—you can buy a box of wine or go gamble away your last few bucks at the local watering hole... you know, engage in some real civic activity... that is, If you can afford the booze.

Seriously though, this budget proposal is big news. One has to wonder, however, how far this will all go. In fact, the plethora of fee hikes, aid cuts and tax increases—not to mention the "attrition" of state workers—smacks of a clever bit of strategy. It's hard to believe that the flabbergasted media reaction was not anticipated. I'm no political schemer, but it's almost as if Paterson's crew had the idea to try every trick possible. Bombard the enemy with all that you've got, and one or two are sure to slip through the cracks, breach the walls. Cut everything that can be cut. Increase the cost of very specific products and services—say, haircuts sneakers and back massages. Vow to weed out hundreds of "needless" jobs. Oh, and the day before all this is announced, sign a law that will surely miff the state's Indian population... Do you follow? It's as if Paterson is trying to get everyone up in arms. That way, while all the bigger, louder special interest groups are making all the noise and dominating the media coverage, some of these cuts and hikes and freezes will go under the radar and actually get passed. Hmm.

News roundup: County budget passed

The Genesee County Legislature approved next year's budget with little comment last night, according to WBTA's Dan Fischer. The property tax rate will remain the same at $9.82 per $1,000 of assessed value.

Investigators are citing an overheated furnace as the cause of a fire that gutted a home on Fisher Park yesterday morning. The total damage was figured at $85,000.

The Salvation Army's Red Kettle Campaign in Batavia has a little more than halfway to go to reach its fundraising goal for the season. So far, the group's volunteers have taken in $31,000. They have two weeks left to reach $65,000.

News roundup: County keeps tax rate

After several weeks of tweaking the proposed budget by County Manager Jay Gsell, the Genesee County Legislature has whittled the tax rate back down to $9.82 per $1,000 of assessed value, according to WBTA's Dan Fischer. That's the same rate as this year.

An official vote on the budget will be made on December 10. You can see the salary increases proposed for county officials at the WBTA Web site. A vote on those will be made with the vote on the budget.

Genesee County already prepared for potential state cuts in video-lottery aid

A proposal to cut community funding for towns and counties that host video-lottery-gaming facilities failed to pass the state Legislature earlier this year. But it is being brought up again by Gov. David Paterson and could take effect April 1, if it is passed. From the Democrat & Chronicle:

Towns and counties with video-lottery-gaming facilities would go bust under a plan by Gov. David Paterson to slash their aid by 50 percent as a way to trim the state's growing budget deficits.

If passed, the cuts could mean a drop from about $14 million to about $7 milion for counties across the state, including Genesee, Erie and Ontario.

Some local governments said they have prepared for a reduction in aid and didn't budget any of the money in the 2009 fiscal year, which for counties runs on calendar year. Aid to municipalities that have racetracks with the slot-machine-like devices started in 2006 under former Gov. George Pataki.

"We never programmed that money until it actually arrived," said Ontario County administrator Geoffrey Astles. Finger Lakes Gaming and Racing is located in Farmington, Ontario County.

The county would get its aid lowered from $844,533 to $422,267, while Farmington would see its aid sliced from $2.5 million to $1.3 million.

Genesee County Manager Jay Gsell told us this morning that the county has already planned for the cuts. In fact, he said, they do not perceive the drop in aid as a budget cut. "We look at it as there will be an inclusion of about $140,000," he said. That amount is compared with about $240,000 from the previous year.

The town of Hamburg stands to see a much more significant drop in their aid. From WNED:

The $1.2-million the town currently gets from Fairgrounds Gaming is supposed to cover the costs of having the gambling operation in Hamburg. Supervisor Steven Walters has asked town department heads to look at possible cuts in case the governor's proposal to cut the state share to $600,000 takes effect.

Will our new guy break through the divisiveness in Albany? Let's ask him...

Earlier this week, Robert Harding of the Albany Project posted his suggestions on how to tackle the state's budget crisis: Cut taxes, cap spending and tax millionaires. As always, Harding makes a great case for each, whether or not you're willing to go along with him on it or not.

Meanwhile, at the capitol, leading state legislators bickered and taunted and mocked one another at a special session that cost tax payers in excess of $100,000 and saved them nothing. Nor was anything acheived from the meeting. Outside, more than a thousand protestors gathered to decry any cut in revenue for whatever special interest group they happened to represent.

In short, New York proved yet again that it is more than worthy of the epithet: the nation's most dysfunctional legislature.

So I thought, OK, we've heard over and over again, every day this week, more about the dysfunction, and how nothing is getting done, yet this nothing is costing us more than ever. Well, we've got a few new faces that will soon be heading to Albany. One of them is our own Mike Ranzenhofer, representative of the 61st District. All eyes will certainly be upon him. He ran a solid, hard-fought campaign and got elected to represent us. We will now wait for him to deliver.

But isn't that a lot of pressure? Can Ranzenhofer really change things in Albany, home to the hulking, ineffectual organism that is our state Legislature?

Well, I called to ask those very questions. Here's what he had to say.

"One of the things I've always been able to do is... I'm able to work with members on both sides of the aisle," said Ranzenhofer.

He went on to explain that many new members will be heading to the Legislature at the beginning of the year.

"I'm hoping these members will prevail on some of the more established members to stop all the bickering and finger pointing and come to the realization that changes need to be made," he said. "We're in unprecedented times. We need to encourage members of looking at new ways of doing things."

Ranzenhofer had an inciteful response to just how one goes about getting the otherwise recalcitrant members of the Legislature to "look at new ways." He described the situation as being similar to someone who is going through a "personal" problem.

"First, you have to acknowledge that the problem exists, then be able to adopt strategies to deal with it," he said. "A lot of people in Albany are in denial. They don't realize there's a problem. We first need to identify the problem."

One such problem: We just don't have the revenue to support the amount of spending that has been approved.

Ranzenhofer has talked about his plan a lot before: cut spending across the board.

"I don't think this should be dictated by the governor or by the Assembly," he said. "We need to go to the workforce, go to the department heads and ask them about where they think cuts need to be made."

What's more, he said, we need to consider that it is "not acceptable" for anyone to say: 'Hey, it's this other department that's the problem, not mine.'

So, the real question, though, is how would Ranzenhofer—or any state representative, for that matter—make the case to his constituents, to the people of the 61st, that he's doing his absolute best to get things done, even if the atmosphere in Albany doesn't change. Bringing home the pork has been the standard mode of conduct. But shouldn't we start expecting more than just a gift of Christmas lights to smooth over the utter failure of our state representatives to run things with at least a modicum of efficiency? What if establishment rule carries the day, and no matter what you do, the stalemate, the bickering, the political charades—what if all that continues, despite your efforts? How do you let your people know: 'Hey, I'm still doing my best.'

"There are several things you (such a representative, that is) can do to tell them (the constituents) what's going on," he said. "It really involves communication: through venues such as your own or newsletters or telephone calls or town hall meetings. It's important to let people know that you're trying to make the changes. It's important to communicate with the people you represent in your district."

"I think I've done a good job of that in the (Erie County) Legislature, communicating the efforts I put forth trying to make changes. There are no guarantees. But you certainly have to have the energy, the vigor and the attitude that you're not going to give up."

Batavia Daily News for Thursday: No home yet for the Pavilion post office

Pavilion residents do not yet have a replacement for their post office which was destroyed by fire several weeks ago, according to the Daily News. But those who used to pick up their mail from the post office at least have an alternative to driving to Le Roy to get it. Residents can now head to the Pavilion Fire Hall once a day in the middle of the day to pick up mail.

A spokesperson for the U.S. Postal Service told the Daily that there has not yet been a decision on whether to replace the post office in Pavilion. About 200 people pick up their mail direct from the post office.


In other news, Genesee County legislators continue to make the changes needed to the county budget to keep the tax rate from increasing. An original budget proposal called for a tax rate of $10.23 per $1,000 of assessed value. Legislators hope to reduce that to the current rate of $9.82 per $1,000.

"Something else": New Yorkers' solution to the current state budget crisis

For those of us who didn't wake up to two feet of snow this morning, our news channels and radio waves likely included a bit on the ongoing scuffle in Albany over the state budget. Everyday, this brouhaha over the budget resembles more and more the raucous cloud of dust that signals a barroom brawl in a Warner Bros. cartoon. If you look closely enough, you can see a foot or a black eye or a projectile mug—but we won't know anything about the winners and the losers until the dust settles, and by then, it will already be time for another skit.

Nor do we, the people of New York, even know who we're rooting for.

It seems that New York's legislative leaders really do reflect the views of their constituents, according to the latest Siena Research Institute poll.

The poll, released Monday, found that 75 percent of registered voters want spending cuts instead of tax increases (which are favored by 10 percent) or borrowing (9 percent) to address the state's budget gap.

But when asked what they want to cut, voters won't get specific: 44 percent opted for "something else" when offered a list that also included health care (6 percent), education (7 percent), transportation and infrastructure (18 percent) and aid to local governments (23 percent).

Health care and education are the biggest components of the state budget, with local aid coming in third. Localities, of course, often choose to make up the shortfall that results from state cuts with increases to property taxes.

"Something else"—isn't it always something else? Didn't the pollsters know what they were doing when they included "something else" as an option? Didn't they know that people would invariably opt for the intangible unknown for the very reason that it can't be specified and therefore isn't much of a threat?

Well, members of some groups that have already been named as potential losers under the cuts proposed by Gov. David Paterson have some ideas about what that something else could be. And why wouldn't they? Something else, for them, necessarily implies something other than themselves.

Groups who would suffer the most from the $2 billion dollars in cutbacks that Governor Paterson has proposed are urging the legislature to consider alternatives, before saying yes to the governor's ideas. In interviews, and at a series of hearings by the Assembly, they listed a number of options that they say the governor has so far ignored.

State worker unions, who met with the governor a few weeks ago, say they offered numerous suggestions, which did not become part of Paterson's proposals. Ken Brynion, President of the Public Employees Federation, says the state could save hundreds of millions of dollars by eliminating private contractors, and letting state workers perform the tasks, like inspecting bridges, promoting tourism, or offering IT advice.

"It's a complete waste of money," Brynion said.

Other ideas include revamping the state's costly economic development programs. Critics have long contended that companies do not have to prove they actually create jobs with the funds from Empire Zones or Industrial Development Agencies. Many have mentioned enforcing laws that require the collection of sales tax on cigarettes sold on Indian lands.

Fran Turner, with the state worker union CSEA, joins others in saying that perhaps personal income taxes should be restructured to extract more money from the state's wealthiest.

Meanwhile, back at the capitol, while busloads of protestors unload to decry the potential cuts, things took a turn for the anticlimactic.

As of Monday evening, it seemed likely today's session will result in very little progress. In a 9 p.m. press conference from the Red Room, Paterson announced that he would meet with legislative leaders at 12:30 p.m. today to discuss the immediate future of his proposed cuts.

Earlier in the evening, Senate Republicans had said the chamber would vote on Paterson's proposals, designed to close an expected $1.5 billion gap brought on by the collapse of Wall Street, but they are almost certain to turn it down.

So where to next? What's your something else?

Batavia Daily News for Wednesday: County budget is a big wait and see

Genesee County Legislature Chair Mary Pat Hancock cautioned that the proposed county budget that was filed yesterday "gives a whole new meaning to the word 'tentative'," according to the Daily News. Hancock told reporter Paul Mrozek that so much hinges on what will happen at the state level—"Will there be mandate relief? Will there be mandates that are unfunded?"—that it's tough to say just what the county can afford.

That means the legislature will likely wait until December to vote on the budget, hoping that at least some answers will come from Albany by then. For more details on the budget, check out our post on Mrozek's story from yesterday.


In other news, Virginia Kropf has an interesting article in today's paper. She writes:

I just want to sound off about people who hang up on me when I call about a story. It has happened several times lately and I find it hard to understand. It seems people (and businesses) want the publicity when things are good, but think the public is not entitled to the news when it's not so good.

Kropf then recounts a couple particular instances, such as when she tried to inquire about the rumors that Pizza Hut was planning to close some of its area restaurants, and she was told by a fellow at the district office that "he had no idea what (she) was talking about"—and then he hung up on her.

It's fine, writes Kropf, if someone "can't comment now," but "don't hang up on us." That seems like a fair enough request. But it also seems like par for the course for any reporter who is digging in someone's dirty laundry pile—a real complement for any journalist of the investigative stripe.

What do you think? Do reporters deserve more courtesy? What about the other glaring issue here: folks did not only hang up on Kropf, they flat out lied to her? Sure, the fellow at Pizza Hut's district headquarters may have been rude in hanging up the telephone instead of answering Kropf's question. But what about the big fat lie that he didn't know what was going on. Listen to what Kropf says here:

I mentioned I had seen a sign on the counter of the Albion store which read, "Due to our closing, we are out of the following..." He told me it was news to him and he guessed he'd have to call and tell them to take it down.

Then, the very next day, Pizza Hut issued a news release about the closing of the stores. So why lie? Is this a simple case of a hush-hush corporate policy getting tangled up in a situation that no one can deny?

One thing is for sure: I can sympathize with Kropf. As a reporter, I've had a few phones slammed in my ear—often to the great delight of the other person.

But it's going to happen.

Let's now have a talk about our rights as "the" public. As Kropf says, the same folks who seek out press coverage of their goodness will often nevertheless act as if "the public is not entitled to the news when it's not so good." So, what are we entitled to? Do we deserve to know that Pizza Hut is closing? The employees certainly should. But do we? If we call to ask, can the management just tell us to buzz off?

What about the time I called Ponderosa to ask about a recent burglary and I was told that there was no burglary only to read the next day in the paper that there was, in fact, a burglary? Should they have told me the truth? Are they required to talk to me at all?

Where is the line drawn for what the public deserves to know? Or how about we start with this: what does the public "want" to know?

At the Legislature: First impressions

Last night, I had the privilege of attending a meeting of the Genesee County Legislature. It was not only my first visit, but the first session attended by the 4-H local government interns—check back with us this afternoon to hear more about that and hear their first impressions.

Before the meeting kicked off, I had a few minutes to chat with Legislator Charles Zambito. We talked about the upcoming county budget determinations and the worries over what will happen at the state level, since state funds make up such a huge portion of county funds. Zambito told me that this was not only a worry in Genesee County, but in counties all over the state. A minor budget cut at the state level becomes amplified for the counties, and some services and programs could face extinction if the cuts get severe. Nevertheless, he said, they will do their best to preserve.

Chairwoman Mary Pat Hancock spoke briefly about the recent meeting in Niagara Falls of the New York State Association of Counties. She was pleasantly surprised to see that so many folks could make it up to our neck of the woods. Many of those from downstate, it turned out, had never even been to the falls, let alone past the Hudson.

Hancock also spoke about the Genesee County Career Center, which lists jobs at all skill levels around the county. She mentioned a few last night for jobs such as machinist, office manager and nurse's aide. Right now, the Career Center posts its jobs on the America's Job Exchange site for New York, where you can search and apply for jobs all over the state.

This morning, I spoke with Jeanne Ianita at the Career Center, and we're going to see if The Batavian can host those job listings, as well. We'll let you know if that comes to pass.

As for the business portion of the meeting, all of the resolutions on the agenda were passed, including the approval of $15,000 for Mercy Flight for this past year's service. Mercy Flight has requested $20,000 for 2009.

News roundup: Two square off for town justice in Batavia

Republicans in the town of Batavia will head to the polls Tuesday to choose their pick for town justice, according to the Daily News. Roger Muehlig put together a solid, straight-to-the-facts piece on the contenders: Thomas Williams and Dennis Rider.

Williams, 48, is a Batavia native who has a bachelor's degree from Hamilton College and a law degree from Columbia Law School. He is married and works in a law practice with his father in the city.

Rider, 55, is a Genesee Community College graduate who worked in security at GCC, then spent 10 1/2 years as a Genesee County sheriff's deputy before becoming a city police officer in 1987.

Williams already occupies the justice position. He was appointed in March when Joseph Filio retired. Rider is still a police officer but plans to retire whether or not he wins the primary. Williams is also listed on the Conservative line, so he will be an option in the general election regardless of the outcome of the primary.


Genesee County's proposed 2009 budget "for the county's self-insured workers compensation program" could go up 8 percent to $1.8 million. That an increase would mean about $60,000 more coming from "participating governments and school districts." I would suggest checking out the article by Paul Mrozek for the details on this. It's a complex topic—for me, at least. That increase in contributed funds does not necessarily mean an increase from all contributing parties. Batavia City Schools, for example, will contribute $750 less, while Pembroke will contribute $13,000 more.

All of the school districts and municipalities in the county are members of the plan, with the exception of the city of Batavia. The city withdrew from the program several years ago.

Each government and school district is assigned an "assessment," which is the amount of money it contributes toward the compensation fund.


A local veterans group is looking for ways to better assist veterans returning from the war in Iraq who may "run afoul of the law." Hal Kreter, director of the Genesee County Veterans Service, wants to look at setting up a "veterans diversion initiative" that would work much the same way as a drug court. Mrozek writes:

The goal of drug court ... is to provide a criminal defendant the opportunity to resolve a case by getting treatment for substance abuse. If the defendant is successful in rehabilitation, the judge has the option of reducing the underlying criminal chrages.

Kreter said the veterans returning from active service "are overmedicating themselves with alcohol and drugs" and often end up doing "something stupid." Many of them may suffer from undiagnosed post traumatic stress disorder.

One of the key components of Kreter's proposal is to provide the defendants with a mentor who also has seen active duty. Most combat veterans will only trust other combat veterans.

Hopefully we will see more information about this in coming months and maybe even see if some progress is made.


Another neighborhood clean-up has been scheduled for Saturday, September 13, from 10:00am to 1:00pm at the property of an elderly woman at 14 Warren St. Volunteers from God's Helping Hands/Project Hope will be on hand to remove debris from the yard. Anyone can join. Pauly's Pizza will provide refreshments for all the workers.

GCC looks for more from the county

WBTA reported this morning that Genesee Community College is asking the county for an additional $50,000 in support. Also in store for the next academic year is a tution increase of about $50 per full-time student per semester.

We asked the college why they needed the extra funds and just what would be funded and found a brief, slightly more detailed explanation of the increase on the college's Web site (published May 13):

A proposed $50,000 increase in support, from $1,836,374 to $1,886,374 from Genesee County, sponsor of the College. Genesee County support would be 6.1% of the total operating budget, the lowest percentage of support in the history of the College. Genesee County’s sponsor support during 2006-2007 was $966 per full-time-equivalent student, the lowest sponsor support ratio of any of SUNY’s 30 community colleges.

We're waiting to hear from the college about how long the increase would last. GCC's Web site implies that the increase is only included in the 2008-2009 budget.

By way of an explanation for the increase:

The budget ensures that Genesee will maintain program excellence and affordability, President Stuart Steiner told trustees. “Our commitment is to provide extraordinary education to our students, and to do so as cost-effectively as possible,” Dr. Steiner said. “For well over a quarter-century, we have maintained operating costs lower than those of our peers, yet we have developed a reputation across New York State and beyond for excellence and innovation.”

Overall, the total budget for GCC for the next year is up about 4.5 percent, from $29.5 million to $30.8 million.
