Person spotted trying to take away pieces of crashed plane

A Sheriff's deputy is responding to a complaint that someone is attempting to remove parts from the scene of a plane crash that occurred in August off Brooksville Road in Alexander.

A pilot dusting a sweet cornfield spotted a wire stretched over the field and in an attempt to avoid it, he crashed his plane. Louis C. Christie, 48, of Stephentown, was unhurt.

The plane was a 1974 Piper Pawnee D Spray Plane. The fuselage of the plane was largely undamaged.

FAA inspectors were called to the scene and the accident was investigation by the FAA and the Sheriff's Office. Their findings have not been released.

UPDATE 11:48 a.m.: According to Chief Deputy Gordon Dibble, the plane's owner or a representative of the owner is at the crash site specifically to remove remains of the wreckage and law enforcement assistance/supervision was requested.

Law and Order: Batavia woman accused of cashing more than $5K in forged checks

Lori L. Mullen, 45, of 101 State St., Batavia, is charged with grand larceny, 3rd, and four counts of possession of a forged instrument, 2nd. Mullen is accused of taking the checks of an acquaintance, the forging the checks and cashing them. Mullen allegedly received more than $5,000. Mullen was released under supervision of Genesee Justice.

Cynthia Owens, 37, of 28 Buell St., Batavia, is charged with criminal trespass, 2nd, criminal mischief, 4th, harassment, 2nd and endangering the welfare of a child. Owens alleged forced her way into the apartment of an acquaintance on Ross Street, damaging the door in the process. She allegedly hit the resident in the presence of a child. Owens was jailed on $1,500 bail.

Shane Zimblis, 41, of Hutchins Street, Batavia, is charged with promoting prison contraband. Zimblis is accused of bringing "dangerous contraband" into the Genesee County Jail while serving a weekend sentence. No further information provided.

Ryan Nicholas Bartholomew, 18, of Adams Street, Batavia, is charged with trespass. Bartholomew allegedly entered private property on Kelsey Road, Batavia, without permission and caused car alarms to sound with the intent of disturbing the property owner. Also charged with trespass was Kyle James Bump, 19, of West Main Street Road, Batavia.

Jeremy Adam Schultz, 22, of Buffalo Street, Attica, is charged with criminal mischief, 3rd, and petit larceny. Schultz is accused of damaging an umbrella stand and stealing a security camera by prying it off a building on Attica Road in Alexander, damaging the camera and the wall.

Attorney told to expect upgraded charge against Niagara Falls cop accused of fighting in Darien Lake bathroom

A Niagara Falls police officer accused of hitting a fellow concertgoer inside a women's room at Darien Lake Performing Arts Center on Aug. 25 could face a Class A misdemeanor charge of assault in the third degree, according to her attorney.

Attorney Norm Effman, out of Warsaw, said he was retained today to represent Kelly L. Alcorn (top photo), a 23-year veteran of the police force, who was initially arrested on a Class B misdemeanor charge of harassment, 2nd.

A woman who claims she was the victim of Alcorn has reportedly contacted the District Attorney's Office requesting more serious charges be levied against Alcorn.

Elizabeth R. Dake, 45, of Farmington, reportedly told the Buffalo News that she suffered a concussion and bruises and that she missed nine days of work as a result of the confrontation.

The fight, according to court documents, appears to have involved at least four women and may have escalated after Dake intervened on behalf of a woman Alcorn was yelling at, according to her statement, for cutting in line.

Dake reportedly told Alcorn to relax and stop yelling.

Alcorn then allegedly turned on Dake and punched her and threw her into a bathroom wall. Dake fell to the ground and Alcorn allegedly began hitting Dake while she was down.

An uninvolved witness reportedly told Deputy Lonnie Nati that Alcorn was "flailing her arms like a windmill throwing wild punches."

Another witness reported seeing Alcorn use a closed fist to allegedly strike Dake.

Also arrested that night was Karen M. Walker, 35, of Niagara Falls, on a charge of harassment, 2nd. Walker allegedly hit another patron who tried to prevent Alcorn from allegedly hitting Dake.

Effman told Darien Town Justice Gary Graber that he was informed today that a new charge of third-degree assault could be filed against his client.

Outside of court, Effman said it's his understanding the investigation is still open, which means Alcorn may yet face a felony charge.

A felony charge, such as assault ,2nd, would likely jeopardize Alcorn's law enforcement career.

Effman said both the prosecution and defense are awaiting medical reports, which will provide details on the seriousness of the alleged injuries and determine the charge to file against Alcorn.

Assault, 3rd, requires only injury to the victim and assault, 2nd, requires serious physical injury.

Today, hours prior to Alcorn's appearance in Darien, District Attorney Lawrence Friedman said no decision has been made yet on what charges Alcorn may face.

In court, while waiting for her case to be called, Alcorn sat with Walker. After her case was over, Alcorn waited for Walker's case to be heard -- Walker also pled not guilty -- and the two women left the courthouse together.

Alcorn is scheduled to reappear in Darien Town Court on Oct. 23 and Walker on Sept. 25.

Asked if there are two sides this story as there are to every story, Effman said, "There’s always three sides to every story. It depends on how many people and how they view events. We don’t really know what’s going to happen. We haven’t seen any medical evidence. We’re simply at the beginning of the process. We’ve entered a plea of not guilty and that’s our position."

Man admits to second-degree rape in Batavia

A 22-year-old man admitted in Genesee County Court today to illegal sexual intercourse with a girl age 15 years of age or younger.

Jonathan Garcia entered a guilty plea to rape in the second degree with no sentence cap in satisfaction of charges that also included rape in the first degree (forcible rape) and sexual abuse.

Garcia faces a sentence of up to seven years in prison and will be sentenced Nov. 15.

When Garcia was asked to admit to factual allegations by Judge Robert C. Noonan, Garcia balked admitting to sexual intercourse on May 16.

"I was there, but there are witnesses who were there who said I didn't do it," Garcia said.

Under questioning, however, Garcia admitted to sexual intercourse with the girl at another, unspecified, time.

District Attorney Lawrence Friedman suggested the charging document be amended to cover the time frame of May through June rather than specifically May 16.

The crime took place in the City of Batavia.

Pavilion man arrested on multiple charges sent to prison for at least two years

A Pavilion man who was arrested multiple times in early spring will serve two to six years in state prison on a third-degree-burglary conviction.

Joshua Lanair Webster, 25, of 7882 York Road, Pavilion, admitted to the burglary charge June 28 and was sentenced in Genesee County Court on Monday.

Webster was identified as the suspect in one crime after a picture of him walking through Batavia Downs was posted on The Batavian.

In April and May, in various unrelated incidents, Webster was charged with aggravated unlicensed operation, 2nd, leaving the scene of a property damage accident and failure to yield right-of-way, burglary, 3rd, grand larceny and criminal mischief, 4th, and criminal possession of a controlled substance.

Victim seeks felony charges against off-duty cop from Niagara she says assaulted her at Darien Lake

UPDATED Tuesday, 8:36 a.m. with additional info from Sheriff's Office press release.

A Finger Lakes-area woman has reportedly written the District Attorney's Office and requested charges against a woman arrested at the Aug. 25 Jason Aldean concert be upgraded to a felony.

The suspect, 47-year-old Kelly Alcorn, is a 23-year veteran of the Niagara Falls Police Department, according to the Buffalo News.

Alcorn, of Town Hall Terrace West, Grand Island, was arrested at the concert for second-degree harassment, but Elizabeth Dake, 45, in a letter she sent to the News, describes a more serious attack.

Dake said she suffered a concussion and bruises and she missed nine days of work.

According to the News article, Dake accuses Alcorn of slamming her into a cement wall, punching her in the head, neck, arm and back.

A Sheriff's Office press release alleges that Alcorn punched a female in the face several times. Alcon was issued an appearance ticket returnable to Darien Town Court at 5 p.m. today.

Niagara Falls Police Superintendent John R. Chella said the department is awaiting a determination on whether the charges will be upgraded. A felony charge could cost Alcorn her job.

Law and Order: Duo accused of trying to cash stolen, forged check

Clarence E. McLeod, 55, of 19 Porter Ave., Batavia, is charged with criminal possession of a forged instrument 3rd, and Joshua A. Harris, 23, of 110 Walnut St., Batavia, is charged with petit larceny and forgery, 3rd. Harris is accused of stealing a checkbook and then forging the victim's name on a check and issuing the check to McLeod. McLeod allegedly passed the check knowing that it was stolen and attempted to cash the check at the Tonawanda Valley Federal Credit Union. The investigation was conducted by Officer Eric Hill and Deputy Brian Thompson.

Christopher P. Sullivan, 32, of 29 Tracy Ave., lower, Batavia, is charged with driving while ability impaired by drugs, leaving the scene of a property damage accident, unlicensed operation and unsafe lange change. Sullivan is accused of being in an accident in the parking lot of Northside Deli and then fleeing the scene. Witnesses reportedly followed Sullivan's vehicle and contacted police. Sullivan was arrested following an investigation.

Scott M. Forian, 44, of 8317 Slusser Road, Batavia, is charged with felony DWI and improper right turn. Forian was stopped at 11:34 p.m., Saturday, on Harvester Avenue, Batavia, by Officer Chris Camp. Forian was jailed without bail.

Dennis A. Edson, 48, of 17 Porter Ave., Batavia, is charged with disorderly conduct. Edson allegedly yelled obscenities repeatedly at officers who were investigating another complaint in the area.

Rae C. Cook, 23, of 121 Liberty St., Batavia, is charged with criminal contempt, 1st. Cook is accused of violating an order of protection with a prior conviction for criminal contempt, making this a felony charge.

Rosemary R. Waters, 26, of 2 Florence Ave., Batavia, is charged with criminal contempt, 2nd. Waters was arrested on a warrant for alleged criminal contempt after visiting an inmate in jail. Waters was jailed on $1,000 bail.

Rachell Onie Soggs, 24, of West Main Street, Batavia, is charged with petit larceny. Soggs is accused of shoplifting $29.12 in merchandise from Kmart.

Jeremy John Haynes, 36, of Church Street, Le Roy, is charged with felony DWI, felony driving with a BAC of .08 or greater, operating without an ignition interlock. Haynes allegedly drove to the Genesee County Jail at 7:16 a.m., Sunday, with a BAC of more than twice the legal limit.

Nicholas Adam Antonucci, 25, of Broadway Road, Alexander, is charged with two counts of attempted grand larceny, 3rd. On Jan. 6, 2010, Antonucci allegedly tried to steal two snowmobiles from the parking lot of the Beachhead Veterans Club in Alexander. One snowmobile was valued at $5,000 and the other at $4,000. Antonucci allegedly damaged the ignitions during the attempted theft. Antonucci is being held on the Wyoming County Jail on other charges.

Jason A. Klinkbeil, 24, of an unknown address in Le Roy, is charged with petit larceny. Klinkbeil was observed at Save A Lot allegedly shoving frozen food items and cans of beer into his backpack and then attempting to leave the store without paying for the items. Klinkbeil, who had been released from the Genesee County Jail the day before on unrelated charges, was jailed on $1,000 bail.

Possible shoplifter runs from Walmart after breaking a bottle of perfume

Law enforcement is responding to Walmart to help locate a possible shoplifter who fled the store after he reportedly dropped and broke a bottle of perfume while putting it in his backpack.

The subject is described as white, carrying a backpack and wearing a red hat.

He was last seen running to the west and jumping a fence.

Ten arrests at KISS concert at Darien Lake

The following people were arrested by the Genesee County Sheriff’s Department during the KISS concert at Darien Lake Performing Arts Center on Saturday.

Traci L. Bartlett, 43, of Beach Road, Syracuse, is charged with harassment, 2nd, and resisting arrest. When deputies attempted to arrest Bartlet she allegedly physically resisted being taken into custody. After being transported back to the security trailer, Bartlett allegedly kicked an officer that was walking past her. Bartlett was jailed on $500 bail.

Pamela Loughridge, 44, of Buffalo Street, Churchville, is charged with of harassment, 2nd, after allegedly fighting with a security guard. Loughridge allegedly bit the security officer and hit him in the throat. Loughridge was jailed in $250 bail.

Wes R. Schraufstetter, 39, of Niagara Street, Buffalo, is charged with of disorderly conduct. Schraufstetter allegedly engaged in disruptive and threatening behavior which was directed toward security officers and deputies. Schraufstetter was jailed on $250 bail.

Kyle J. Burdick, 23, of North Lyon Street, Batavia, is charged with of disorderly conduct. Burdick allegedly engaged in disruptive and threatening behavior which was directed toward his girlfriend, security officers and deputies. Burdick was jailed on $250 bail.

Bryan J. Sheridan, 31, of Reddick Lane, Rochester, is charged with trespass for allegedly refusing to leave the concert venue after being told to leave on several different occasions.

John A. Williams, 45, of 32nd Drive, Queens, is charged with trespass after allegedly jumping a fence in order to gain access to the concert venue.

Tracy A. Piller, 35, of Euclid Avenue, Bradford, Pa., is charged with trespass after allegedly refusing to leave the concert venue after being told to leave on several different occasions.

Brett M. Ferrington, 26, of Route 39, of Chaffee, is charged with of disorderly conduct. Ferrington allegedly engaged in disruptive and threatening behavior which was directed toward both security officers and deputies.

Michelle L. Shimburski, 24, of Genesee Street, Chaffee, is charged with of disorderly conduct. Shimburski allegedly engaged in disruptive and threatening behavior which was directed toward both security officers and deputies.

Michael J. Discipio, 43, of Bernhardt Drive, Amherst, is charged with of disorderly conduct. Discipio allegedly engaged in disruptive and threatening behavior which was directed toward both security officers and deputies.

Breaking: Heavy drill press stolen from Jackson Street and put on big garbage truck

Attention citizens! Police are on the scout for a large blue garbage truck with a heavy drill press in the back of it. The drill press was allegedly stolen about 20 minutes ago from 35 Jackson St. in the City of Batavia. According to the caller, the truck pulled up, winched up the drill press, put it on the big blue garbage truck and left. The caller then contacted the landlord and was told no permission was given to anyone to remove the equipment. So, the dispatcher said, "If you see a blue garbage truck, look for a drill press in the back." Then call the cops. The Thruway Authority is being notified to be on the lookout for the vehicle.

UPDATE 10:47 a.m.: No direction of travel was given and no information about whether there are any graphics -- lettering -- on the truck. There were a lot of blue garbage trucks making their rounds in the city today. The disposal service in Orleans County uses blue trucks, too, and if this vehicle was stolen from that company, an officer says dispatch should expect to be getting a call from them.

UPDATE 10:59 a.m.: The truck with the heavy drill press in back has been located. It's a PSI garbage truck, which will be returning to 35 Jackson St. to put back the drill press. The driver told authorities "he thought the item was trash because it was sitting next to the Dumpster." (Well, it's still bulk item pickup time in the city -- at least until Oct. 1.) Police are going to meet the driver on Jackson Street.

Drug dealer who assaulted fellow inmate sent to prison

A Batavia resident accused of dealing drugs after police found 44 glassine bags of crack cocaine in his car and then later got into a fight in jail, will serve up to seven years in prison.

Milton H. Simmons III, 29, of 75 Franklin St., Batavia, was sentenced in Genesee County Court on Thursday.

Simmons was originally arrested in April when police responded to the parking lot of a West Main Street business for a report of a fight involving a knife. A subsequent search of Simmons' uncovered the crack cocaine.

As police transported Simmons from the courthouse to the jail, Simmons allegedly tried to escape and had to be restrained with the assistance of deputies at the court facility.

In July, Simmons punched another Genesee County Jail inmate in the face causing the inmate's denture plate to break.

The sentence handed down Thursday covers the multiple charges against Simmons, which included criminal possession of a controlled substance, 3rd, attempted escape and assault.

Judge Robert C. Noonan sentenced Simmons to three years in prison on one charge, and two to four years on another charge, with the sentences to be served consecutively.

Law and Order: Grand larceny suspect charged with promoting prison contraband

Antonio Lester James, 21, of Avenue A, Rochester, is charged with grand larceny. James is accused of placing more than $2,400 worth of printer ink and electronic merchandise in a plastic tote while in Walmart and then running from the store. James was subsequently charged with promoting prison contraband, 2nd. While being processed into the Genesee County Jail, James was allegedly found in possession of a small amount of marijuana.

Matthew Thomas Allen Banks-Jubert, 18, no residence, was arrested on a warrant for alleged violation of probation. Banks-Jubert was interviewed by the Buffalo PD on an unrelated matter and arrested on a warrant out of Town of Batavia Court for alleged violation of probation. Banks-Jubert was jailed on $1,000 cash bail or $2,000 bond.

Samantha L. Johnson, 25, of Ellicott Street, Batavia, is charged with petit larceny. Johnson is accused of stealing more than $100 in merchandise from Kmart.

Todd Michael Sirianni, 43, of North Fraley Street, Kane, Pa., was arrested as a fugitive from justice from McKean County, Pa. Sirianni was being held in the Genesee County Jail and with his local case completed, he was arraigned on an alleged violation of probation charge out of McKean County in Town of Batavia Court and held pending extradition.

Joanne Jefferson, 53, of Gilbert Street, Le Roy, was arrested on a bench warrant for alleged violation of probation. Jefferson was arrested in the Village of Le Roy, arraigned in county court and released.

Pavilion mother faces second felony DWI charge under Leandra's Law

A Pavilion mother, charged just three months ago with driving drunk with children in her van, has been arrested again and charged with same crime.

Angela A. Kruse, 40, is again facing a felony DWI charge following a one-car rollover accident on Taylor Road in Covington on Sept. 8.

Kruse allegedly had her 5-year-old daughter in the vehicle.

In late June, Kruse was arrested in Le Roy after State Police received a tip that she was driving drunk with her child in her car. The felony DWI count, under Leandra's Law, is still pending in Genesee County.

Last week, State Police in Warsaw responded to the accident and were told a woman and a small child had fled the scene.

Kruse and the child were located at a residence on Morrow Road.

Both mother and daughter suffered minor injuries and were taken to Wyoming County Hospital.

Following arraignment in Covington Town Court, Kruse was jailed on $15,000 bail.

Child molester faces new child abuse allegation

A convicted child molester sentenced just last week to 15 years in state prison faces a new first-degree sexual abuse charge.

James Little Jr. was arraigned in Batavia City Court this afternoon on the single count.

Det. Kevin Czora said the new charge reflects the alleged discovery of a second child sexual abuse victim. The second alleged victim is elementary school age.

There is only the one charge now pending against Little and Czora does not anticipate any further charges, and to the best of his knowledge there are no further victims.

The alleged abuse took place in March, Czora said, which is the same time frame Little abused a toddler in the city.

Recently, Beverly Hensel, 53, of 8921 Alleghany Road, Pembroke, was arrested and charged with possession of a sexual performance of a child. In a deposition, Little said he first received a DVD of child pornography from Hensel in January 2009.

Little's case was set for a preliminary hearing at 11 a.m., Nov. 13. Little remains in the Genesee County Jail awaiting transfer to state prison.

Police searching for guy who allegedly stole a cartload of beer from Tops

Police are responding to Batavia Commons to search for a man who allegedly stole a whole grocery cart of beer from Tops Market. The suspect is white and wearing a football jersey. He has a red car, possibly a Firebird.

UPDATE 2:22 p.m.: The car is now believed to be maroon in color. The driver is further described as wearing a blue jersey with the number 5 on the back, denim shorts and white sneakers. He's with a female who is supposedly barefooted.

DNA links burglary suspect to pair of church break-ins in July

DNA test results have allegedly linked a Batavia man already suspected of stealing from a church with two more church burglaries over the summer.

John Anthony Cabrera Jr., 22, will be arraigned in city court today on two more counts of burglary in the third degree.

According to police, DNA samples gathered at the scene link Cabrera to break-ins at the First Baptist Church, 306 E. Main St., Batavia, and St. Mary's Church, 18 Ellicott St., Batavia.

Both burglaries occurred July 8.

Cabrera was allegedly caught in the act of burglarizing St. Paul's Lutheran Church on Washington Avenue on July 23.

Two days later, Cabrera allegedly escaped from the Genesee County Jail, but was apprehended before he could leave the building.

Grand Jury Report: Man charged in Le Roy burglary

John H. O'Shea is indicted on counts of burglary in the third degree and grand larceny in the third degree. O'Shea is accused of breaking into a residence on North Street in Le Roy and stealing items valued in excess of $3,000, including tools, brass fittings, copper wire, bronze manifolds, a galvanized garbage can, a tool bag and a camera.

Tammy M. Chojnacki is indicted on counts of felony DWI and felony driving with a BAC of .08 or greater. Chojnacki is accused of driving drunk March 24 on Route 33 and Pike Road, Batavia. Chojnacki was previously convicted of DWI in Attica in October, 2007.

Jason W. Wolf is indicted on counts of felony DWI, felony driving with a BAC of .18 or greater and aggravated unlicensed operation in the first degree. Wolf is accused of driving drunk on Route 77 on March 18. Wolf has a prior DWI conviction in Septermber, 2007.

Female 'jumped' at Jackson and Dawson in the city

A caller tells dispatch his girlfriend was "jumped" about 15 minutes ago by a man near Jackson Street and Dawson Place. The suspect then ran into some bushes. He is described as black, with a "salt and pepper goatee," wearing black shorts and a black sweatshirt. Police are searching for him now.

UPDATE 12:25 p.m.: The suspect was last seen headed eastbound on the railroad tracks. Mercy medics are responding to the scene for the victim's possible shoulder injury.

UPDATE 12:46 p.m.: The 24-year-old victim is very distressed and is being transported to UMMC complaining of shoulder pain and experiencing an anxiety attack.

Joint agency DWI checkpoint at county line on Route 77 nets three arrests

On Saturday, concurrent with the Zac Brown concert at Darien Lake, members of the State Police, Genesee County Sheriff's Office and Wyoming County Sheriff's Office conducted a joint DWI checkpoint on Route 77 at the county border.

The following arrests were made:

Timothy K. Toper, 26, of Newburn, NC, was charged with unlicensed operation, felony DWI and felony aggravated unlicensed operation. Toper allegedly tested for a .15 BAC. Toper allegedly tried to evade the checkpoint. He was arraigned in Darien Town Court and committed to the Genesee County Jail.

Elizabeth L. Gugino, 37, of Angelica, is charged with DWI. Gugino allegedly had a BAC of .11. Gugino was arraigned in Town of Bennington Court and released.

Paul S. Martinez, 33, of East Aurora, is charged with DWI and refusal of a breath test. Martinez was arraigned in Town of Bennington Court and released.

Law and Order: Alleged shoplifter accused of threatening Walmart employees with a knife

Andrew Zimba Perdock, 25, of 17 Holland Ave., lower, Batavia, is charged with petit larceny. Perdock is accused of shoplifting from Tops. He is also charged with menacing, 2nd, and attempted petit larceny. Perdock was observed allegedly putting merchandise in a backpack while inside Walmart. After Walmart were alerted to the situation, Perdock reportedly removed the items from the backpack. Perdock allegedly displayed a knife with the blade showing while in the presence of Walmart employees.

Brian J. Lambert, 30, of 1 Prune St., Batavia, is charged with petit larceny and trespass. Alert Cedar Street residents spotted a suspicious vehicle pull behind Arctic Refrigeration and observed an individual allegedly stealing scrap metal. Lambert was later located at his residence and the allegedly stolen property was recovered and returned.

Alexis A. Czaja, 30, no permanent address, is charged with petit larceny. Czaja is accused of shoplifting from Tops.

Kristine Szumigala, 38, of 260 Ross St., Batavia, is charged with petit larceny. Szumigala is accused of shoplifting from Dollar General.

Samantha A. Bowles, 22, of 33 Williams St., Batavia, is charged with disorderly conduct and resisting arrest. Batavia PD officers received a report of loud noise coming from a residence on Williams Street. On call back, the person making the complaint reported a physical altercation. Upon arrival, officers made contact with Bowles, who was described as agitated and irate. Bowles reportedly pushed past officers during questioning. Bowles reportedly physically struggled with officers while being taken into custody.

Steven N. Utter, 26, of Route 96, Waterloo, and Cory A. Miles, 34, of County Line Road 13, Shortsville, are charged with criminal possession of a controlled substance, 7th, and criminal possession of a hypodermic instrument. Utter and Miles were arrested following an investigation by Deputy Brad Mazur and Deputy Jason Saile into a suspicious vehicle at Wilson Farms on South Lake Road, Pavilion. Both men were jailed on $2,000 bail.

Joseph C. Wind, 42, of Horseshoe Lake Road, Stafford, is charged with grand larceny, 4th. Wind is accused of stealing $4,000 cash while employed at The Home Depot.

Brandy R. Douglas, 33, of South Main Street, Elba, is charged with petit larceny. Douglas is accused of shoplifting $48 in merchandise from Target.

Patrick D. Moore, 34, of Strouts Road, Elba, is charged with petit larceny. Moore is accused of shoplifting $29.99 in merchandise from Target.

Brett M. Doran, 21, of East Main Street, Le Roy, is charged with obstruction of breathing and harassment, 2nd. Le Roy PD responded to a report of a disturbance where a female was heard screaming to stop choking her. Doran is accused of kicking the female in her face and choking her during an argument. Doran was jailed on $500 bail.

Kyle Andrew Bilby, 22, of North Pearl Street, Oakfield, and Adam Andrew Dixson, 22, of Cary Avenue, Oakfield, are charged with criminal possession of marijuana, 5th. Bilby and Dixson were arrested after Deputy Patrick Reeves stopped to check on a suspicious condition at St. Cecillia Cemetery and allegedly found the defendants smoking, and in possession of, marijuana.

Darrel D. Smith, 56, residence not listed, is charged with criminal possession of a controlled substance, 7th, and DWAI. Smith was stopped by State Police at 3:16 a.m., Saturday, on Route 77, Darien.
