Matthew Charles Olcott, 33, of Overlook Drive, Batavia, is charged with unauthorized use of a vehicle and aggravated unlicensed operation. Olcott is accused of taking his wife's car and using it without permission. Olcott allegedly does not have a NYS license.

Lisa A. Fleming, 44, of Batavia, is charged with criminal contempt, 2nd, disobeying a court order and acting in a manner injurious to a child under 17 years of age; Anthony D. Alexander, 38, of Batavia, is charged with criminal contempt, 2nd, disobeying a court order. Fleming and Alexander were arrested by State Police as part of the same criminal investigation. The incident was reported at 1 p.m. on May 23. Fleming was arrested June 6 and Alexander was arrested Tuesday. No further details released.

A Batavia man tried to break up a fight between two girls in Attica on Tuesday night and wound up in the hospital with a head injury after the boyfriend of one of the girls allegedly hit him.

Grayson Stock, 20, was found semiconscious by EMS personnel and transported to an area hospital where he received stitches to his mouth and back of his head.

Taken into custody and charged with assault, 3rd, was Brandon B. Harrington, 17, of 2719 Humphrey Road, Varysburg.

The incident was reported at 10:30 p.m. at Main and Prospect streets, Village of Attica.

According to the Attica PD, Harrington hit Stock once and Stock fell backward hitting his head on the sidewalk.

Stock was initially transported to Wyoming County Hospital and later transferred to ECMC for observation.

Harrington was jailed on $1,000 bail.

Clifford Leo Regimbal, 33, of Oakfield, is charged with criminal possession of marijuana and unlawful growing of marijuana. Regimbal was a passenger in a vehicle that was stopped at 6:57 p.m. Monday on Route 77, Basom, and allegedly found in possession of a bag containing more than 25 grams of marijuana and a 2-foot tall marijuana plant. Also charged with unlawful possession of marijuana was Ashley Nicole Janikowski, 28, of Oakfield. The traffic stop was initiated by Depty Patrick Reeves.

Jamie R. Bachorski, 18, of Webber Avenue, Oakfield, is charged with endangering the welfare of a child. Bachorski is accused of smoking marijuana with a child May 29.

Amber Michelle Hufsizer, 21, of Newark, is charged with petit larceny. Hufsizer is accused of stealing merchandise valued at $90.89 at Darien Lake Theme Park.

Brad C. Doward, 22, of 10 Hall St., Batavia, is charged with criminal trespass, 2nd, criminal mischief, 4th, harassment, 2nd, and endangering the welfare of a child. Doward allegedly unlawfully entered the residence of a friend, damaged property, had physical contact with the resident, all while in close proximity to a child. The incident was reported at 4:30 p.m. Sunday, and Doward appeared at police HQ at 12:30 p.m. Monday.

Mark W. Nassivera, 21, of Rochester, is charged with criminal mischief, 3rd. Nassivera was taken into custody by State Police in connection with an incident reported at 10:03 p.m. Sunday in Alabama. Nassivera was jailed on an unspecified amount of bail. No further details available.

David L. O'Neil, 22, of 101 Elmwood Parkway, Tonawanda, is charged with DWI and driving with a BAC of .08 or greater. O'Neil was stopped by State Police at 12:29 a.m. Saturday in the Town of Pembroke.

Valerie Ann Parker, 32, of Parker Road, Basom, is charged with assault, 3rd. Parker was reportedly involved in a verbal argument with another woman when she allegedly head-butted the woman, breaking her nose.

Shawn MIchael Twardowski, 29, of Vine Street, Batavia, is charged with criminal contempt, 1st, and aggravated harassment, 2nd. Twardowski was taken into custody on a warrant out of Town of Oakfield Court and jailed on $2,500 bail.

Albert Andrew Ackerman, 47, of Silver Road, Bethany, is charged with harassment, 2nd. Ackerman is accused of grabbing, pushing and punching a woman during a domestic dispute. An order of protection was issued requiring Ackerman to stay away from the woman.

Jason Robert Sando, 45, of Walkers Corners Road, Byron, is charged with unlawful imprisonment, 2nd, and harassment, 2nd. Sando is accused of restricting a woman's movements and subjecting her to physical contact during a domestic dispute. He was jailed on $1,000 bail.

Tammy L. Price, 40, of 1526 Kingsley Road, Wyoming, is charged with DWI, driving with a BAC of .08 or higher, unsafe start and uninspected motor vehicle. Price was taken into custody by Le Roy PD after her vehicle was allegedly observed pulling out of a parking lot in an unsafe manner.

Joshua A. Mead, 27, of Downing Avenue, Buffalo, is charged with DWI, driving with a BAC of .08 or greater and following too closely. Mead is accused driving drunk at the time he was involved in a motor-vehicle accident at 12:04 a.m. Sunday on Route 77 in Darien. Mead was taken into custody by Sgt. Greg Walker. Terrance A. Falk, 47, of West Main Street, Le Roy, is charged with harassment, 2nd. Falk is accused of dumping a plastic tote filled with paper over his wife's head during a domestic dispute.

Ashley Allen Wayne, 46, of Rose Circle, Hamlin, is accused of being a fugitive from justice and was cited for no seat belt. Wayne was stopped on Route 237, Byron, for allegedly not wearing a seat belt. During the stop, Deputy Chris Parker discovered Wayne was wanted on a warrant out of Pennsylvania for allegedly endangering another person. Wayne was jailed pending extradition.

Daniel Gordon Vanderwalle, 33, of Stuart Avenue, Newark, was arrested on a bench warrant. Vanderwalle is accused of not appearing on a charge of petit larceny in Town of Batavia Court.

The 18-year-old Byron woman who is accused of causing the death of a friend entered a guilty plea today to negligent homicide and driving under the influence of drugs and alcohol.

Cortney L. Greene entered what is known as an "Alford Plea." The plea indicates she believes she would be convicted if the case went to trial, but does not admit factual guilt.

The District Attorney's Office agreed to the plea because Greene is facing a potential lawsuit in connect with the death of Zachary J. Rusin, 18, of Holley.

Assistant District Attorney Kevin Finnell recited the evidence against Green, which Green then agreed was sufficient for a likely conviction.

According to Finnell, Greene was operating all-black golf cart in the middle of northbound Route 237 just seven minutes after midnight, Nov. 26, when a car driven by Emmaleigh R. Odom, 19, of Pavilion, crested a hill near Warboys Road and stuck the golf cart.

Finnell said that with the hill and the lighting conditions, Odom had no time to react before her car struck the cart.

A blood alcohol test, Finnell said, found that Greene had a BAC of .04 and there were traces of marijuana in her blood.

Both Greene and Rusin were ejected from the vehicle. Rusin succumbed to his injuries two days later.

The maximum penalty for the homicide charge is four years in prison. Greene will also likely lose her driving privileges.

The plea did not include a sentence cap.

Greene will be sentenced Sept. 6.

The Sheriff's Office announced the following arrests in connection with the Drake concert at Darien Lake Performing Arts Center on Friday.

David Rivera, 22, of Bank Street, Bradford, Pa., is charged with trespass after allegedly refusing to leave Darien Lake after being told to several times to leave. Rivera was arraigned and jailed on $250 bail.

Matthew R. Gordon, 23, of Alcott Road, Rochester, is charged with disorderly conduct after allegedly screaming obscenities that instigated two fights in the parking lot. Gordon was arraigned and jailed on $300 bail.

Wadsworth K. Sykes, 19, of Hopkins Road, Canandaigua, is charged with public lewdness, trespass and possession of alcohol under age 21 after allegedly urinating in front of other patrons and refusing to leave the venue. Sykes was also found to be intoxicated. He was arraigned and jailed on $500 bail.

Darrin J. Lichy, 22, of Center Road, Salamanca, is charged with trespass after allegedly jumping a fence to enter the concert venue. Lichy was arraigned and jailed on $100 bail.

Chad J. Temperato, 20, of Karen Drive, Rochester, is charged with trespass and possession, of alcohol under age 21 after allegedly attempting to enter the concert venue after being told to leave and being intoxicated. Temperato was arraigned and jailed on $300 bail.

Jeffrey M. Civiletti, 24, of Beverly Heights, Rochester, is charged with criminal trespass, 3rd, after allegedly refusing to leave the inside of the concert venue. Civiletti was arraigned  and jailed on $350 bail.

Victor S. Bamberry, 17, of Cayuga Road, Ohsweken, Ontario, Canada, is charged with trespass after allegedly entering the concert venue without a ticket. Victor was released on $80 bail.

A Corfu police officer stopped a truck late this afternoon for having an obstructed license plate and found two alleged illegal immigrants inside.

The truck was impounded pending proof of ownership and the U.S. Border Patrol took the two suspected illegal immigrants into custody.

Officer Gene Nati said the truck's plate looked like it had been intentionally obstructed with black tar or a similar substance.

When Nati approached the truck immediately after he stopped it at 4:50 p.m., he found three male occupants. Two couldn't speak English and had foreign documents he didn't recognize, so he requested the Border Patrol to the scene for assistance.

The truck was hauling a storage shed purchased from a Batavia business by a Corfu resident, but the delivery originated with a company in North Carolina, Nati said.

"That company (from North Carolina) employed the illegal immigrants," Nati said.

The third man was in the country on a visa. He was taken to the Flying J and released.

The shed was also impounded and Nati said once the local company and the local resident who made the purchase produce proper documentation for the purchase, he will release the shed.

A fight is reported in Austin Park. City police are responding.

A proposal to decriminalize the nonviolent offenses of 16- and 17-year-olds could cost the county more than $1 million a year, County Attorney Chuck Zambito warned the Ways and Means Committee on Wednesday.

He called the proposed bills "a huge unfunded mandate."

Zambito said issue isn't the concept, just the lack of funding to go with it.

"It's a policy decision by the legislature and that's fine," Zambito said."I'm not necessarily against the philosophy. The problem is they're doing it without the considering the effect, what the changes are going to do to the current system, that's the problem I have with it. It's another example of an unfunded mandate. They implement it without considering the real cost for it. If they'll pay for it, then fine."

There are currently two bills under consideration. Both would take nonviolent offenses, including what are now considered nonviolent felonies, and move the prosecution of those cases out of the criminal justice system.

There would be a youth division court set up under the county court that would deal with youthful offenders and decide how to properly dispose of those cases, be it conditional discharge, probation, referral to the Department of Social Services or family court.

One proposal would require the County Attorney's Office to handle the cases, the other would put the responsibility in the District Attorney's Office.

Zambito said up and down the line, there would be additional costs for the county, from staff to handle the caseload in either his office or the DA's, to specialists handling the cases in probation and DSS.

There would also be an issue of housing youthful offenders arrested on a weekend who would be held until the youth division court opened the next business day. That cost is about $500 per day per offender.

Deputy County Attorney Durin Rogers said the drive for these bills is coming from NYS Chief Judge Jonathan Lippman.

Recently, in promoting the bills, LIppman said:

"Treating 16- and 17-year olds as adults flies in the face of what science tells us about adolescent development. The adolescent brain is not fully developed. Even older adolescents have a more limited ability to make more reasoned judgments and engage in the kind of thinking that weighs risks and consequences in a mature fashion."

Stephen A. Lewis, 31, of Corfu, is charged with disorderly conduct. Lewis is accused of fighting and violent behavior. The alleged incident was reported at 5:59 p.m., Tuesday, at 8132 Buffalo Road, Bergen. Lewis was held without bail.

Robert Lee Ealey, 26, of Phelps Avenue, Rochester, was arrested on a county court bench warrant. Ealey was released from the Monroe County Jail and turned over to the Sheriff's Office. Ealey was jailed pending arraignment.

Cody L. Amrhein, 20, of Alexander, is charged with assault, 3rd, and menacing, 2nd. Amrhein was arrested by State Police stemming from an alleged incident at 9:02 p.m., Tuesday. Amrhein was released on his own recognizance. No further details were released.

Regarding yesterday's accident on Route 98, the drivers involved where Daniel J. Dragon, 26, of Albion, and Wanda A. Pangrazio, 47, of Albion. The State Police Web site lists no citations issued nor arrests made. The Trooper who handled the investigation is out of the office today, so no further details are available.

A young Batavia mother who was among the first people in the state charged under Leandra's Law for driving under the influence with children in the car will spend a year in jail for violating probation by allegedly driving drunk again.

Michelle T. Crawford, 26, of 7963 Batavia Stafford Townline Road, sobbed throughout the court proceedings this morning and asked Judge Robert C. Noonan for another chance at rehabilitation.

Besides the violation of probation conviction, Crawford is still facing charges that she drove drunk March 8 and was involved in a rollover accident in Byron. Crawford was seriously injured in the accident and had her jaw wired shut for a period of time as a result.

Crawford was on probation, having recently completed one alcohol treatment program, at the time of the accident. While she wasn't convicted under Leandra's Law on the prior case, which was heard in Erie County, Crawford was found guilty of driving under the influence and three counts of endangering the welfare of a child.

In court today, Crawford's attorney said his client has a serious drinking problem and needs treatment, not jail time.

"Jail isn't going to fix Ms. Crawford," Attorney Louis P. Violanti said. "I realize society may demand jail time, but without treatment, she's going to end up doing life on the installment plan, one year at a time, three years at a time, until one day she wakes up and she's in her 60s and her life is gone and her children are grown."

Violanti said Crawford was recently accepted to an in-patient program and that her rehabilitation would be a long-term process.

When Crawford spoke, she cried through all of her statement.

"If I don't get this under my thumb, I'm never going to have my family," Crawford said. "Please let me be able to do this. Please from the bottom of my heart. I'm a good person. I just made poor choices and I just want to go home to my family and the people that I love. And I want to prove that I can be successful in life and not be harmful to anybody else, including myself."

Noonan said if Crawford was appearing before him for just the first time he would be a lot more sympathetic to her plea to be with her children, but Crawford promised Noonan once before, he said, to follow the orders of the court and then apparently violated them.

"You're very lucky you didn't kill a family or somebody else in your alcoholic stupor," Noonan said. "Now you must face the consequences.

"We're all very interested in doing something that will get Michelle Crawford going in the right direction in life," Noonan added, "but right now you must be punished."

The year in jail -- Crawford has already served about three months -- is the maximum penalty under the sentencing guidelines for her misdemeanor convictions.

Crawford still faces a misdemeanor DWI charge and a felony count of aggravated unlicensed operation.

Noonan said he and the attorneys are trying to come up with a plan for Crawford on those charges that will satisfy justice and get her help.

A 67-year-old Batavia man has been charged with public lewdness after allegedly being caught masturbating in the infants section at Kmart.

Michael John Liptak, of Pratt Road, was also charged with criminal mischief, 4th.

The incident was reported to the Sheriff's Office at 5:49 p.m., Monday.

Liptak was issued an appearance ticket on the charges.

A man is reportedly "touching himself inappropriately" in the infants' section of Kmart. Law enforcement is responding. He is described as an "older" person with red hair, having a "larger build," wearing jeans and a plaid hoodie. He is also believed to be intoxicated. The store is located at 8363 Lewiston Road in the Town of Batavia.

Rodney L. McKenzie, 47, of Orangeville, is charged with two counts of menacing, including a count that alleges the use of a weapon. McKenzie was arrested by State Police in connection with an incident reported at 11:20 a.m., Sunday, in the Town of Alabama. No further details were release.

Paul H. Burch, 32, of Townline Road, Byron, is charged with DWI, driving with a BAC of .08 or greater and speeding. Burch was stopped by Le Roy Police Saturday in the Village of Le Roy.

Roger K. Rumble, 27, of Lake Street, Le Roy, is charged with DWI, aggravated DWI, aggravated unlicensed operation, refusal to take a breath test and speeding. Rumble was stopped by Le Roy Police Saturday in the Village of Le Roy.

Marche La'Shon Brown, 26, of Doran Street, Rochester, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Brown was stopped at 3:15 a.m. Sunday on Route 98, Batavia, by Deputy Matt Fleming.

Coretta Melissa Pitts, 44, of Swamp Road, Byron, is charged with criminal contempt, 2nd. Pitts was allegedly at the residence of a person she was ordered not to contact.

Jeffery M. Johnson, 24, no permanent address, is charged with menacing, 3rd. He was arrested by State Police for an incident reported at 11:27 a.m. Sunday in Oakfield. Johnson was held in jail.

Jerod P. Norcross, 33, of Batavia, is charged with criminal mischief. Norcross was arrested by State Police in connection with an incident reported at 3:50 p.m., April 11, in Alexander.

Michael J. McCarthy, 24, of Pembroke, is charged with DWI, driving with a BAC of .08 and inadequate plate lamp. McCarthy was stopped by State Police at 2:35 a.m. Saturday in the Town of Batavia.

A Southside resident says a suspicious character came to his back door at 1:30 in the morning Saturday and claimed to be a detective investigating a report of a robbery at that address.

The resident, home alone watching TV, said the man was wearing a black hat, trench coat and carrying a cheap flashlight.

The resident called police and multiple units responded to the area but did not locate the suspect.

Det. Todd Crossett said the man did the right thing in calling 9-1-1.

"If we show up, we're going to be carrying identification and we don't wear hats," Crossett said. "We don't wear trench coats. When somebody shows up at your house at 1:30 in the morning, use extreme caution."

Crossett said when you get unexpected visitors in the middle of the night and you don't recognize them, can't see them, or don't see a car outside that your recognize, it's best not to open the door and to call emergency dispatch.

"Absolutely, give us a call," Crossett said. "We'll check it out. If it's a legitimate person who is trying to get ahold of you, well, then, OK, but absolutely give us a call."

The potential victim said the man told him, "I'm here to investigate a burglary. You need to let me in."

When the resident told the man he was calling 9-1-1, the man responded, "I am 9-1-1."

A Wichita, Kan., resident was convicted Friday in federal court of one count of enticing a teenage girl to send him sexually explicit photos of herself.

The teen was from Batavia and Det. Todd Crossett and Office Jay Andrews helped bring the man to justice.

"He was definitely a sexual predator," said Crossett, who, along with Andrews, was in Wichita last week to testify at the trial. "He had a past history of doing this sort of thing and he does it again soon after he gets out of prison. That indicates the kind of person he is."

The man, Shane M. McClelland, 26, faces a mandatory minimum sentence of 25 years in federal prison, and perhaps a life sentence.

The 14-year-old girl from Batavia testified at the trial and identified McClelland as the man she had seen in Web cam pictures.

According to prosecutors, McClelland over the course of days, pressured and persuaded the girl to email him nude photos.

Crossett testified about the chain of evidence and his exchange of text messages with McClelland while posing as the 14-year-old girl.

The case, Crossett said, that in this day-and-age, sexual predators are always close by.

"This is an example of what can happen if kids and parents aren't careful," Crossett said.

A local business owner has been charged with two Class A misdemeanors after allegedly making a phone call to a property owner on Ellicott Street and impersonating a law enforcement officer in an attempt to intimidate her from renting the property to a potential competitor.

Jason Lang, 28, is charged with criminal personation, 2nd, and aggravated harassment, 2nd.

Sgt. Ron Lobur said Lang turned himself in to State Police, was cooperative and was released on an appearance ticket.

According to Lobur, Lang allegedly called a property owner and left a phone message saying he was a State Police "detective" and warned her that a business she may be renting to has a reputation for selling synthetic marijuana and bath salts.  He allegedly warned her that she might not want to rent to this business.

Lobur noted that the State Police do not employ detectives. Rather, their detective work is done by investigators.

Lang, a Liberty Street resident, owns The Laughing Buddha on Ellicott Street and has admitted in the past to selling synthetic marijuana.

Deputies responded Thursday to a report in Darien of gunshots being fired in a residence and found that a man there had allegedly caused $1,500 in damage to the house.

David William Wiepert, 54, of Darien, is accused of threatening another person and damaging personal property.

He is charged with coercion, 1st, a felony, and a felony count of criminal mischief.

The case was investigated by Deputy Patrick Reeves and Sgt. Greg Walker.

Wiepert was arraigned in Darien Town Court and jailed on $20,000 bail.

A 33-year-old resident of Flint, Mich., is being accused of dealing crack cocaine in Batavia.

John "Solo" Sumlin III, was stopped today by members of the Local Drug Enforcement Task Force as he was riding a bike on Porter Avenue.

Sumlin's arrest is the result of a month-long investigation that included undercover agents allegedly purchasing crack on two occasions.

During the course of the investigation, task force members identified Sumlin as an individual wanted in Michigan on a possible parole violation.

When Sumlin was stopped today, he allegedly gave investigators a false name in an attempt to conceal his warrant from local law enforcement.

Following arraignment in Batavia City Court, Sumlin was jailed without bail.

The third member of a trio caught with drugs in a Batavia hotel room nearly a year ago entered a guilty plea to a drug possession charge in county court today, but has a chance to have his plea reduced if he successfully completes a drug program.

Benjamin Santiago was arrested with Justin Barker and Derick Barker on June 1 after the three men allegedly refused to leave the hotel after not paying the bill. When police arrived they found a quantity of drugs in the room.

The Barker brothers were later accused of plotting a conspiracy to kill Santiago.

Justin Barker later admitted to his role in the plot and was sentenced to two to six years in prison.

Santiago was charged with two counts of criminal possession of a controlled substance, 3rd. As part of a plea deal, Santiago entered a guilty plea today to criminal possession of a controlled substance, 5th.

His case is being sent to Batavia Drug Court, where he'll be given a chance to complete a drug treatment program. If he successfully completes the program, he can return to county court, withdraw his guilty plea and plead guilty to a Class A misdemeanor.

He could still be sentenced up to a year in jail under that plea, but if he doesn't complete drug treatment successfully and comply with all of the other terms of his release, Santiago could facing from two and a third to seven years in prison.

Derick Barker, who previously entered a guilty plea to possession of a controlled substance and strangulation (stemming from an attack on an inmate in the Genesee County Jail), is currently serving a sentence that could stretch to eight years.
