Melvin Huntley

Melvin A. Huntley, 40, of Wilkinson Road, Batavia, is charged with rape 1st, sex abuse 1st, and predatory sexual assault with two or more victims. Huntley, accused previously of being a child sex predator and later charged with additional felonies, has been charged again as the result of further investigation by detectives Howard Carlson and Kevin Forsyth. An additional alleged victim was identified.  There are no known additional victims.  There are allegedly four victims total. Huntley is accused of multiple incidents of sexual assault over a seven-year period.  He remains in the Genesee County Jail being held without bail.

Brian Michael Raphael, 33, of East Main Street, Batavia, is charged with criminal possession of a controlled substance 7th and conspiracy 6th. Raphael was allegedly found in possession of cocaine following a traffic stop in the Town of Bergen at 11:15 p.m., June 7, by Deputy David Moore.  He was issued an appearance ticket and is scheduled to return to court Oct. 13.

Daniel Joseph Davis, 55, of Hollymount Road, Rochester, is charged with DWI, driving with a BAC of .08 or greater, reckless endangerment, improper passing, failure to obey traffic control devices, failure to obey police officer, speed not reasonable and prudent for conditions, and moving from lane unsafely. It's alleged that Davis tried to avoid a traffic safety checkpoint by leaving his lane of travel and proceeding into the oncoming traffic lane nearly striking law enforcement officers and then fleeing the checkpoint before being stopped by a patrol vehicle a short distance from the checkpoint on  Clinton Street Road, Stafford. Davis was arraigned in Town of Stafford Court and released on his own recognizance.

Katie Lee Winnie, 27, of Martin Road, Akron, is charged with driving while impaired by drugs and criminal possession of a controlled substance 7th. Winnie was located at 3:06 a.m., July 8, on South Lake Road, Bergen, by Deputy David Moore, after the Sheriff's Office received a complaint of a woman slumped over the wheel of a vehicle parked at a convenience store.  Winnie was arrested this week after the office received the results of a lab test.  She was released on an appearance ticket.

The Genesee County Sheriff’s Office is asking for the Public’s assistance in locating Marc C. J. Cook.  Mr. Cook is wanted on multiple Warrants including Criminal Possession of a Firearm, Criminal Possession of a Weapon 3rd and Bail Jumping 2nd, all Felonies in Alabama Town Court.  He is also wanted by Batavia City Court for Criminal Possession of a Controlled Substance 7th, Criminal Use of Drug  Paraphernalia 2nd, Possession of a Hypodermic Needle, and three counts of Bail Jumping 3rd, all Misdemeanor charges.  If anyone knows his whereabouts, please contact the Genesee County Sheriff’s Office at 585-343-5000.

Jason Doohan, 38 of Batavia, pled guilty to one count of petit larceny and was sentenced to a one-year conditional discharge in Batavia Town Court on September 21, 2021.

Doohan was originally charged with one count each of Offering a False Instrument for Filing and 4^th degree Grand Larceny after an investigation by Genesee County Department of Social Services Investigator Robert Riggi revealed that he failed to report income from scraping metal.  He subsequently received $1464 in benefits he was not entitled to.

Doohan has made full restitution to the Genesee County Department of Social Services, in addition to the reduced charges and conditional discharge.  He is also disqualified from receiving benefits for one year.

Fletcher M.  Royce, 33, of Dunham Road, Varysburg, is charged with criminal possession of a  controlled substance 3rd, driving while impaired by drugs, and DWI. Royce was located on Galloway Road in Pembroke after deputies received a suspicious condition complaint at 2:24 p.m., Sept. 17, and taken into custody by Deputy Trevor Sherwood and Deputy Erik  Andre. 

Jesslyn Faustine Bigelow, 25, of West Main Street Road, Batavia, is charged with harassment 2nd.  Bigelow is accused of harassing another resident of the apartment complex at 3727 West Main Street Road, Batavia.  Bigelow was issued an appearance ticket.

Cole Ryan Booth, 31, of Blasdell, is charged with criminal mischief and petit larceny. Booth is accused of damaging a vehicle and stealing its license plates in the parking lot of Darien Lake on Aug. 14.  He was arraigned in  Darien Town Court and released on his own recognizance. 

Alex Dumbleton, 28, of East Main Street, Batavia, is charged with attempted assault 2nd. Dumbleton,  being held at the Genesee County Jail on prior charges, allegedly attempted to kick a corrections officer.  Dumbleton was issued an appearance ticket.

On August 28, 2021, at approximately 1:45 a.m. officers from the City of Batavia Police Department were dispatched to a residential location on South Main Street for the report of potential gunfire.   Officers arrived on the scene and found that shots were fired at a residence and that no one was hurt.  Officers believe that the victim was the target of the crime, and this was not a random act. There were no gunshots fired yesterday evening following a traffic stop near Mill Road on State Route 33 in Stafford after the driver ran into a cornfield -- either by the suspect or by law enforcement.

What was initially reported as gunfire turned out to be a wildlife scare cannon -- it emits loud blasts fueled by propane -- to deter birds and other wildlife from damaging crops.

The incident began at 6:04 p.m. when Howard Owens, publisher on  The Batavian, reported a silver Pontiac sedan heading west on Clinton Street Road being driven in an erratic manner.  

Near Mill Road, a Deputy was positioned in a laneway in a farm field waiting for the vehicle to pass.

The deputy initiated a  traffic stop across from a  sweet-corn-for-sale stand and a cornfield. As soon as the sedan stopped, the driver bolted from the vehicle and ran south into the cornfield.  The deputy initiated a foot pursuit but backed off when he reportedly saw the suspect remove a handgun from his waistband.

The deputy detained a female passenger in the vehicle,  placing her in handcuffs and returning her to the vehicle.

At that moment, there was a muffled boom, and Owens and the deputy took cover behind their respective vehicles.  The deputy reported, "shots fired."

Over the next 15 minutes or so an additional three blasts were heard.  During that time additional deputies and Batavia police officers arrived on the scene and Route 33 was closed in both directions. Owens was then evacuated from the scene by two deputies in a patrol vehicle.

Over the next few hours, additional law enforcement arrived from Monroe County and the State Police.  SWAT units on scene included one from Monroe County, one from the State Police, and the Genesee County Emergency Response Team. The DEC K-9 unit also responded.

Law enforcement had a preliminary identification of the suspect based on statements from the female passenger. 

The NYSP Aviation Unit helicopter was dispatched to assist and it coordinated with NYSP drone operators to search the area.  Also assisting were the Monroe County Sheriff's Office drone operators.

The suspect was located shortly after 11:20 p.m. in an area about one mile to the northeast of the original location near Westbrook  Road. He was attempting to seclude himself in a wooded area.

He was taken into custody without further incident. 

Law enforcement did recover a handgun during a search of the area where the suspect had initially fled. 

Taken into custody was Arthur J. Brown, 44, of Lake Street, Le Roy.  He was charged with:

• Criminal possession of a weapon 2nd
• Menacing a police officer
• Tampering with physical evidence
• Obstruction of governmental administration 2nd
• Criminal  possession of a controlled substance 7th
• Driving while impaired by drugs
• Failure to keep right

Brown was arraigned in Town of Stafford Court and jailed without bail.

The passenger of the vehicle was identified as Breanna A. Smith, 29, of Lexington Avenue, Rochester. Smith reportedly had an active warrant in Florida but Flordia officials declined to extradite Smith.  She was charged with criminal possession of a controlled substance 7th and issued an appearance ticket.

Amanda Lynn Huber, 39, of Main Street, Batavia, is charged with petit larceny.  Huber is accused of switching price tags to make items appear to cost less at the time of purchase while at a store on Veteran's Memorial Drive, Batavia. She was issued an appearance ticket. 

Joshua Lanair Webster, 34, of West Main Street, Le Roy, is charged with harassment 2nd. Webster is accused of having physical contact with a victim during an incident reported at 12:51, Aug. 27, on East Main Street in the Town of Batavia. Webster was released on his own recognizance.

Kelly Grace McCoy, 27, of Cambell Street, Rochester, is charged with driving while impaired by drugs and failure to keep right. McCoy was stopped at 1:23 a.m., Sunday, in the area of 5236 Clinton Street Road, Batavia, by Deputy Kenneth Quackenbush. McCoy was processed at the Genesee County Jail and released on an appearance ticket.

William Cappiello, 62, of Batavia, was arrested on a warrant, arraigned in City Court, and released on his own recognizance. There was no information was released on the reason for the warrant. 

McKenzie N. O'Connell, 18, of Rochester, is charged with three counts of endangering the welfare of a child. O'Connell is accused of encouraging/exposing children between the ages of twelve and fifteen to engage in sexual behavior.  Her bail status was not released.

Winston A. Lockhart, 26, of Batavia, is charged with criminal contempt 2nd. Lockhart was allegedly found in the company of a protected party in violation of a stay-away order.  He was issued an appearance ticket and turned over to the Albion Police Department on a warrant.

Rachil J. Oliver, 49, of Le Roy, is charged with DWI,  driving with a BAC of .08 or greater, and failure to stop at a stop sign. Oliver was stopped by a Batavia police officer at 2:37 a.m., Sept. 12, on Otis Street in Batavia. She was released on an appearance ticket.

Marlena M. Burrus, 34, of Batavia, is charged with owning/harboring an unlicensed dog.  Burrus was arrested at her home in Batavia after allegedly being found with an unlicensed dog on Sept. 14. She was issued an appearance ticket.

Brock Orion Doberstein, 28, of Cattaraugus, is charged with criminal mischief 2nd and petit larceny. Doberstein allegedly damaged a vehicle and stole its license plates on Aug. 14 while at Darien Lake. He was arraigned in Darien Town Court and released on his own recognizance.

Kyle Allen Hawley, 31, of East Main Street, Batavia, is charged with endangering the welfare of a child. At approximately 3:38 a.m., Aug. 26, while at a residence on Spring Street in Bergen, Hawley allegedly overdosed on a narcotic analgesic while in the presence of a child less than 17  years old.  Hawley was reportedly revived by medics with the use of Narcan and transported to a local hospital. He was released on an appearance ticket.

National Grid customers and local law enforcement are reporting utility billing and payment scams across upstate New York. The company is asking its customers to beware and know the signs of a scam.

Imposters claiming to be from National Grid may tell customers that they have past due balances on their utility bills, even promising a savings on their next bill. Customers who reported the scams, say they were contacted by telephone and email, and in some cases automated recordings.

The scammers threaten that service will be shut off immediately unless the customer purchases a prepaid debit card in a specific amount, such as a Green Dot card, and provides the caller with the card’s account number, or in the case of business customers, by way of a Western Union money transfer. Imposters also may ask for a Social Security number and a National Grid account number. These calls are not officially from National Grid and instead are from scammers who are looking to obtain personal information and payments.

The scenario can change, but the goal of the scammer remains the same: scare customers into making hasty decisions that often include large payments.

National Grid does contact customers with past due balances by phone to offer payment options, but never demands direct payment through the use of a prepaid debit card and never accepts payment through these cards.

Scammers have become increasingly sophisticated in replicating National Grid’s recorded messaging and directions for phone prompts, even spoofing the phone number on caller ID, making it more difficult to differentiate an actual National Grid call from an imposter’s call. Similar scams have been reported across the U.S. by other utilities.

Customers who believe they have fallen victim to the scam should contact local law enforcement officials immediately. If you are provided a phone number that does not match numbers on the billing statements, it is likely that the call is a scam.

National Grid reminds customers to know the red flags and offers the following tips:

• Be vigilant. If you believe you are current on your National Grid account, it is highly likely a call seeking payment is a scam.

• Protect yourself. Verify you are speaking with a National Grid representative. Ask the caller to provide the last five digits of your National Grid account number. If the caller doesn’t know your account number and phishes for help, take charge and hang up immediately.

• Do not take the bait. Scammers will not have access to your account information, social security number or other personal details and you should never offer that information if asked. National Grid representatives will know your account number.

• Scammers also may contact you by email and attempt to lure customers into clicking on a link, visiting a malicious website, revealing account information, or calling a phone number.

• While National Grid may ask for a payment to be made over the phone, the payment method will be left to the customer’s discretion.

• Do not fall for scare tactics and threats. National Grid will not contact customers demanding immediate payment by wire transfer, Green Dot Money-Pak or any other prepaid card service.

• Do not cave to pressure. Never -- under any circumstances -- offer personal or financial information to someone who you cannot identify.

• Every National Grid employee carries a photo ID card, and contractors working for the company are also required to carry ID. If someone requesting entry into your home or business does not show an ID card, don’t let that person in, and call National Grid or local law enforcement.

Spike C. Pope, 18, of Haywards Heath, England, is charged with petit larceny and trespass. Pope is accused of stealing a U.S. flag from a residence on Bank Street.  State Police assisted in the investigation because of reports of other flags being stolen on Bank Street Road, Town of Batavia.  Last week, State Police announced the arrest of an unidentified 18-year-old on charges of petit larcenies.  Previously: Flag thefts, including assemblyman's, reported in Batavia

Niasia S. Jiggets, 30, of Batavia, is charged with two counts of criminal contempt 1st and endangering the welfare of a child. At 2 p.m., July 28, Jiggets allegedly violated an order of protection causing injury to the subject of the protective order, a child, during a visitation. Jiggets was previously convicted of violating an order of protection involving the same child. Jiggets was previously convicted of assaulting the child on multiple occasions and causing serious physical injury.  She is on probation as a result of the conviction. She was ordered held on $1,000 bail, $2,000 bond, or $4,000 partially secured bond.

Jonathon Allen Kent, 33, of East Main Street Road, Batavia, is charged with harassment 2nd. Kent is accused of pushing a person into a door frame.  He was arraigned in City Court and released on his own recognizance. 

Katie Marie Preedom, 33, of Roberts Road, Alabama, is charged with DWI, driving with a BAC of .08 or greater, speeding, and unlicensed operation. Preedom was stopped at 2:30 a.m., Sunday, on Clinton Street Road, Bergen, by Deputy Morgan Ewert.

Nichole Donna Hall, 32, of Marlow Avenue, Blasdell, is charged with criminal mischief 4th. Hall was arrested in connection with an incident reported on South Pearl Street in Oakfield at 6 p.m., Sept. 8. She was issued an appearance ticket and released.

Kay E. Dilker, 31, of Albion, is charged with harassment 2nd. Dilker was arrested on a warrant in connection with an incident reported in Batavia at 11:45 a.m., July 6,  arraigned in City Court, and released on her own recognizance with an order of protection issued.

Antonio Goodson, 31, of Batavia, is accused of failure to appear. He was arrested on a warrant and arraigned in City Court and released under supervision of Genesee Justice.

Loretta A Knapp, 46, of Batavia, was arrested for allegedly failure to appear in court. She was issued an appearance ticket.

Anthony Underwood, 21, of Buffalo, is charged with harassment 2nd. Underwood allegedly pushed another person during a dispute. He was arraigned in City  Court and released on his own recognizance.

Ray S. Saile, 19, of the Tonawanda Indian  Reservation, is charged with criminal contempt 2nd.  Saile allegedly violated a stay-away order of protection. After police responded to a local hotel, Saile was allegedly found in a  room with the protected party.  He was issued an appearance ticket.

Heather M. Davis, 44, of Batavia, is charged with trespass. Davis allegedly went to the residence of a person on Ellsworth Avenue and started a bonfire on the property without permission while waiting for the person.  She was issued an appearance ticket.

Dean M. Conboy, Sr., is indicted on two counts of attempted aggravated assault upon a police officer, two counts of menacing a police officer, attempted assault in the second degree, unlawful imprisonment in the first degree, two counts of criminal possession of a weapon in the fourth degree, resisting arrest, and menacing in the second degree.  On June 11, 2021, Conboy allegedly threatened police officers and intended to cause serious injury to police officers using a dangerous instrument. He also allegedly restained another person and exposed that person to the risk of serious physical injury. He allegedly possessed a knife during these incidents.

Andrew C. Aldrow is indicted on counts of felony DWI, refusal to submit to a breath test, consumption of alcoholic beverages in a motor vehicle, and moving from lane unsafely. Aldrow was stopped on Feb. 26 in  the Town of Le Roy.

Stephen L. Hegel is indicted on two counts of grand larceny in the third degree and one count of grand larceny in the fourth degree. On Oct. 8, in the City of Batavia, Hegel allegedly stole property with more than $3,000.  On Oct. 22,  he allegedly stole property with a value of more than $1,000. On Oct. 14, he allegedly stole property valued at more than $3,000.

With a large contingent of family and friends present in the court room, Colleen L. Nelson, 50, of Alabama was sentenced to a determinate sentence of 3 1/2 years in state prison and 5 years post release supervision during her sentencing on Wednesday afternoon in Genesee County Court. The maximum sentence Nelson could have received was 7 1/2 years.

Nelson stabbed a male co-worker during an attack at a candy production facility on S. Main street in Elba on July 29, 2020. Nelson came up behind her co-worker and started stabbing him with a large knife. The 59-year-old victim suffered non-life-threatening injuries in the incident.

Nelson pleaded guilty to attempted assault first degree, a class C felony, in July, waiving her right to a defense of mental defect. She has been confined to the Wyoming County Jail since her arrest last July. She has served over 400 days up until sentencing today. She was originally facing an attempted murder charge where she could have been sentenced to 25 years in prison.

According to District Attorney Larry Friedman, Nelson had declined psychiatric services previous to this incident and cancelled her appointment.

“She committed a very violent crime, she says she didn’t mean to injure her co-worker, its luck he was not injured more seriously,” says Friedman.

Nelson’s attorney, Greg Colavecchia told the court that his client is remorseful and is being responsible.

“No one is here to minimize the effect this crime has had on the victim,” says Colavecchia.

Colavecchia says his client has never been in trouble before, she is happily married with two adult sons and she is missing her family.

“The victim says the why is bothersome, we will never know the answer to that. It is self-evident in reports that my client was distant and had a medical issue, but this does not minimize the incident.”

Before Judge Zambito imposed his sentence, Nelson told the court how deeply sorry she was.

“I hope he(the victim) can recover from this terrible incident; this is not my normal character. I know God was there that day looking over both of us, I hope that you can forgive me,” Nelson said.

The victim was able to view the sentencing today virtually, but was not allowed to record the court proceeding or speak. According to Judge Zambito, the victim did not feel comfortable being in the court room with Nelson present. District Attorney Larry Friedman says the victim is suffering emotionally after the incident.

Acknowledging Nelson’s time in jail since the incident last year, Zambito felt that Nelson was showing an acceptance of responsibility, along with paying restitution.

“This didn’t have to happen,” said Judge Zambito. “The victim was in the wrong spot at the wrong time. You intended to harm him; this was no accident.”

Zambito told Nelson her suffering from untreated psychiatric issues played a role in the incident.

“Today you may be fine, but if you don’t address the mental health issues this will happen again. Seven 1/2 years won’t guarantee that this won’t happen again.”

An order of protection was served and will remain in effect until September 2033.

Nelson also paid restitution in the amount of $2,698.14 to the victim.

Michael Robbins, 61, of Batavia, is charged with burglary 3rd and grand larceny 4th. Robbins is accused of entering a building and stealing various items in the early morning of Aug. 1.  He was arraigned in City Court and ordered held in jail.

Ray S. Saile, 19, of Judge Road, Alabama, is charged with criminal contempt 2nd. While on duty at Labor Daze, deputies were asked to assist the Oakfield Fire Department with an incident involving Saile and his girlfriend. Saile allegedly violated an order of protection by being with his girlfriend.  He was arrested and released on an appearance ticket.

Steven Stuart Johnson, 57, of South Lake Avenue, Bergen, is charged with criminal possession of a weapon 3rd, criminal possession of a controlled substance 7th, DWI/Drugs, and headlight out. Johnson was stopped at 3:15 a.m., Sept. 2, on South Lake Avenue, by Deputy Jacob Gauthier for an alleged traffic violation.  During a search of Johnson, he was allegedly found in possession of cocaine.  The vehicle was inventoried prior to being towed and deputies reportedly found brass knuckles in the center console. Johnson was issued an appearance ticket.

Adam Altobelli, 40, of East Rochester, was arrested on a warrant for alleged failure to appear. He was arraigned in City Court and released under supervision of Genesee Justice.

Travon Armstrong, 36, of Batavia, is charged with petit larceny. Armstrong is accused of stealing a bicycle.  He was issued an appearance ticket.

Destiny Green, 25, of Batavia, is charged with burglary 2nd and criminal contempt 2nd. Green allegedly stole an item from a protected party's residence. Green was reportedly found inside the residence. Green was arraigned in City Court and released under supervision of Genesee Justice.

Amanda Havens, 39, no permanent address, is charged with endangering the welfare of a child. Havens is accused of leaving two children under age seven unsupervised leading to the children roaming the streets without supervision. The children were found by patrols near a local business at 3:30 a.m., Aug. 17.  Officers could not contact Havens until she turned herself in later that day.  She was arraigned in City Court and released on her own recognizance.

Jadeyn Goras, 18, of Batavia, is charged with criminal mischief 4th. Goras is accused of throwing a rock through the rear window of a vehicle park in the driveway of a residence in the City of Batavia.  He is also accused of throwing a stone from a garden and throwing it through a window of a door leading into the residence.

David Klotzbach, 41, of Batavia, is charged with dog running at large.  Klotzbach's dog was allegedly running at large at 8:10 a.m., Aug. 27.  He was issued an appearance ticket.

Robert Goodwill, 28, of Batavia, is charged with DWAI/alcohol. Goodwill was reportedly found driving erratically from South Main Street Road to UMMC.  Goodwill was issued traffic tickets and released.

Nicholas Kingdollar, 25, and Kayleen Laird, 25, both of Batavia, are charged with endangering the welfare of a child. Kingdollar and Laird allegedly failed to provide adequate supervision of a child at a residence on Jackson Street, Batavia, the evening of Aug. 30.  The child was reportedly able to climb out a second-story window and onto the roof.

An unidentified 18-year-old from Batavia is charged with three counts of petit larceny. The youth was arrested by State Police at 9:25 a.m., Sunday.

 

It started last weekend, Assemblyman Steve Hawley says he was out mowing his lawn when he noticed his flag, which was at half-mast in honor of those who lost their lives in Afghanistan, was missing. Hawley says the flag was stolen sometime last Saturday, Aug. 28.

On his Facebook page, Hawley asked for his flag's return. "Please return it, no questions asked. This is a time for respecting our country and what it stands for," Hawley wrote.

Since then, Hawley says a neighbor from down the road replaced his flag with a new one, also installing a light to the display. 

However, on Saturday morning State Police were called to another residence in the 8000 block of Bank Street Road in the Town of Batavia for another flag theft. The homeowner there said his flag was stolen sometime between 9:30 Friday evening and 6:30 a.m. on Saturday. His flag was also displayed on a pole. 

Hawley said his replacement flag was also stolen in the overnight hours, Sep. 3 into Sep. 4.

State Police are now investigating the incidents and have a few leads. The City of Batavia Police have also looked into several complaints in the area recently.

Hannah Rose Roberts, 18, of Ontario Street, Fulton, and Talana Jay Savery, 22, of Emery Street, Fulton, are charged with trespass. Roberts and Savery are accused of being on property on Bethany Center Road, Bethany, at 4:49 a.m., Aug. 29, without permission.  Both were issued an appearance ticket.

Breeda Marry Kobler, 57, of Hutchins Raod, Rochester, is charged with DWI and refusal to take breath test.  Breeda was stopped at 5:56 p.m., Wednesday, on North Lake Road, Bergen, by Deputy Kenneth Quackenbush.
