Andrew Pierre Schneider, 42, of Millersport Highway, Amherst, is charged with: felony aggravated driving while intoxicated -- with a BAC of .18 percent or more; DWI common law -- with a previous conviction within 10 years; and failure to keep right. Schneider was arrested Aug. 29 following an investigation of an accident that occurred at 1:01 p.m. July 31 on Harlow Road in Darien. Schneider was issued appearance tickets and is due to return to Darien Town Court on Sept. 15. The case was investigated by Genesee County Sheriff's Deputy Andrew Mullen, assisted by Deputy Howard Wilson.

Jennifer Lynn Bobzin, 50, of West Bergen Road, Bergen, is charged with: aggravated driving while intoxicated -- with a BAC of .18 percent or more; DWI -- first offense; and following too closely. At 6:58 p.m. on Aug. 30, Genesee County Sheriff's deputies responded to a report of a two-vehicle accident on West Bergen Road in Bergen. Bobzin was arrested at the scene and released with appearance tickets for Bergen Town Court. She is due there on Oct. 7. The case was handled by Deputy Kenneth Quackenbush, assisted by Deputy Erik Andre.

A two-car collision is reported in Darien at Broadway and Harlow roads. One of the vehicles went off the roadway and into the woods. Unknown injuries. Darien fire and EMS are responding.

UPDATE (By Howard) 1:34 p.m.: Two vehicles, not blocking, minor MVA with no injuries, a first-responder reports.

A driver is unresponsive in Darien after an accident at 10805 Harlow Road. The caller to dispatch says the vehicle is off the roadway; a first responder says it's partially blocking traffic. Darien fire and ambulance and Mercy medics are responding. Mercy Flight is on ground standby.

UPDATE 1:12 p.m.: EMS on scene reports the operator is possibly intoxicated. Mercy medics and Mercy Flight put back in service. A Sheriff's deputy is responding.

UPDATE 1:24 p.m.: Darien ambulance is put back in service.

Park police have requested the assistance of a state trooper at Darien Lakes State Park to help with a raccoon that won't stop trying to get into a camper's tent at site #17.

A barn fire with a lot of smoke and some flames showing is reported in Darien at 9796 Harper Road. No people are believed to be inside the barn, but there are probably farm animals inside.

No propane tanks can be seen near the building, according to the caller to dispatch. The location is between Sumner and Richley roads.

Darien Fire Department is dispatched along with Mercy medics and mutual aid from Corfu and Alexander fire departments.

UPDATE 2:39 p.m.: According to a first responder on scene, the fire is contained to one bale of hay inside a small one-story metal shielded structure. The structure is not on fire and they are pulling out the bale of hay that is ablaze.

UPDATE 2:42 p.m.: Now the fire is going into the 30 by 50 foot structure and command says firefighters "should be able knock it down quickly" with a single line.

UPDATE 3:06 p.m.: The fire was extinguished about 10 minutes ago. No structural damage. The assignment will be back in service soon.

A two-vehicle accident is reported at Route 77 and McVean Road in Darien. One of the vehicles rolled over. Unknown injuries. Darien Fire Department and EMS are responding.

  • Colby Road bridge (just south of CSX railroad) in the Town of Darien will be reopening on Monday, June 29.
  • McClernon Road bridge over the Black Creek in the Town of Bethany will be closing Monday, June 29 for major repairs. The bridge is expected to be closed for four to five weeks.

Luis A. Ramos-Mercado (inset photo left), 35, of Ellicott Avenue, Batavia, is charged with: attempted burglary in the first degree -- use or threatened use of a dangerous instrument; criminal possession of a weapon in the third degree -- previous conviction; menacing in the second degree -- with a weapon. Ramos-Mercado was arrested on a Batavia City Court warrant for an incident that occurred at 2:30 a.m. on Jan. 30 on East Main Street in Batavia. He was released under supervision and is due back in city court on July 9. The case was handled by Batavia Police Officer Austin Hedges, assisted by Officer Wesley Rissinger.

Trevawn Oral Wright, 19, of Highland Park, Batavia, is charged with two counts of second-degree harassment -- with physical contact. Wright was arrested after Batavia police responded to Highland Park for a report of a disturbance. After an investigation, it was found that Wright allegedly punched a male in the head and attempted to strike another male with a jug of water. He was issued an appearance ticket to be in Batavia City Court on July 21. The case was handled by Batavia Police Officer Nicole McGinnis, assisted by Officer Joshua Girvin.

Torre Steven Walls, 28, of Alleghany Road in Darien, is charged with fourth-degree grand larceny. Walls was arrested at 9:45 p.m. on May 29 after an investigation of a domestic incident that occurred on Alleghany Road in Darien. It is alleged that Walls stole his girlfriend's Ruger SR22 pistol following a verbal argument. He was issued an appearance ticket and is due in Darien Town Court on July 21. The case was handled by Genesee County Sheriff's Deputy Mathew Clor, assisted by Deputy James Stack.

Rae C. Cook, 31, Liberty Street, Batavia, is charged with second-degree criminal contempt. Cook was arrested at 5:43 a.m. on May 30 on Liberty Street following an incident in which she was allegedly found in the presence of a person protected by an order of protection. She was arrested then issued an appearance ticket for July 21 in Batavia City Court. The case was handled by Batavia Police Officer Stephen Cronmiller.

Dalton Joseph Rarick, 30, Whitfield Avenue, Buffalo, is charged with: aggravated driving while intoxicated -- having a BAC of .18 percent or more; DWI; and refusing a preliminary breath test. Rarick was arrested at 10:16 p.m. May 29 on West Main Street in Batavia. He was issued an appearance ticket and is due in Batavia City Court on July 15. The case was handled by Batavia Police Officer Samuel Freeman, assisted by Officer Christopher Lindsay.

Alan R. Murray, 74, Spencer Court, Batavia, is charged with operating a vehicle while having a BAC of .08 percent or more, and driving while intoxicated, with a previous conviction within the last 10 years. The case was handled by Batavia Police Officer Miah Stevens.

Brian Keith Dyer, 53, North Street, Batavia, is charged with second-degree harassment. Dyer was arrested at 9:50 p.m. on May 23 on Ross Street in Batavia after an investigation into a fight/disturbance there. He is due in Batavia City Court on July 21. Batavia Police Officer Arick Perkins handled the case.

Carrie L. Vargo, 35, of Tonawanda Creek Road, Clarence, is charged with second-degree criminal contempt. Vargo was arrested at 3:23 p.m. on May 14 after allegedly contacting a protected party on Summit Street in Batavia via email. Vargo was issued an appearance ticket and is due in Batavia City Court on July 14. The case was handled by Batavia Police Officer Alec Roberts.

Nikkia Marie Farias, 22, of Thorpe Street, Batavia, is charged with making unnecessary noise. Farias was arrested at 3:17 a.m. on May 26 following several noise complaints. The defendant was issued an appearance ticket and is due in Batavia City Court on July 14. The case was handled by Batavia Police Officer Peter Flanagan, assisted by Officer Adam Tucker.

Thomas James Leonard, 36, address unknown, is charged with petit larceny. Police were called to Dollar General on East Main Street in Batavia after it was reported that a male had stolen items from the store and was fleeing. Leonard was arrested and issued an appearance ticket to be in Batavia City Court on July 21. The case was handled by Batavia Police Officer Nicole McGinnis, assisted by Officer Joshua Girvin.

A minor teenager who lives on Halstead Road in Batavia was arrested for unlawful possession of marijuana at 4:36 a.m. on May 24 on State Street in Batavia after a domestic incident. The case was handled by Batavia Police Officer Peter Post, assisted by Officer Stephen Quider.

Three train cars of garbage caught on fire in Darien this afternoon and to enable volunteer firefighters to fight the blaze, the train was moved further up the track into Erie County.

Darien Chief Jeff Luker said given how tightly compacted the trash was in the cars, it was a hard fire to fight but the rain was expected to help.

Darien Fire Department along with Pembroke, Corfu, Indian Falls, and Alabama responded to the fire.

A train reportedly has six of its railroad cars on fire, with flames showing, on the tracks near Genesee Street and County Line Road. Darien fire and EMS are responding.

UPDATE 12:11 p.m.: Law enforcement is on scene. Pembroke's tanker is called to provide mutual aid.

UPDATE 12:12 p.m.: Corfu is also called to provide mutal aid to fight the fire.

UPDATE 12:30 p.m.: Erie County asks that Crittenden Road be shut down and law enforcement is responding to do that. Erie County fire police are also responding.

UPDATE 12:59 p.m.: Indian Falls and Alabama fire departments are called to the scene.

UPDATE 1:26 p.m.: The train was pulled into Erie County to provide firefighters with better access to entinguish the blaze. East Pembroke is called to their hall to stand by for all West Battalion calls.

State Police have released the identity of a 77-year-old man who apparently drowned on his property at a residence on Broadway Road, Darien, on Saturday.

David Scott reportedly had gone out to set up a pump in a retention pond. At about 12:27 p.m. his daughter found him partially submerged in the pond. 

Volunteers with the Darien Fire Department along with Mercy EMS personnel attempted to revive Scott but were unsuccessful.

A 77-year-old Darien resident was found yesterday afternoon by his daughter partially submerged in a pond on his property at 976 Broadway Road, according to State Police.

The victim could not be revived. State Police are refusing to release his name.

Emergency responders were dispatched to the residence at 12:30 p.m., yesterday.

A police source said investigators have yet to determine how he fell into the pond. The investigation is continuing into the cause of death.

From Tim Hens, superintendent, Genesee County Highway Department:

Genesee County Highway Department will be closing a bridge in Darien on Colby Road between Route 33 and Richley Road next week for a deck repair.

The bridge will not be open for any traffic during the repairs, which will last one to two weeks. The bridge is just south of the railroad tracks on Colby Road.

Jordin Michael Schultz, 22, of Main Road, Stafford, is charged with third-degree menacing and reckless endangerment in the second degree. It is alleged that Schultz spit at a nurse and public health official at 5:39 p.m. April 2 at a location in the 6200 block of Main Road in Stafford. The defendant is due to appear in Stafford Town Court at 9 a.m. on Tuesday, June 9. The case was handled by Genesee County Sheriff's Deputy Brock Cummins, assisted by Kyle Krzemien.

Ronald M. Refermat, 35, of Broadway Road, Darien, is charged with endangering the welfare of a child. At 11:30 a.m. on April 11, Genesee County Sheriff's deputies were dispatched to a residence on Route 20 in Darien for a reported domestic incident. An investigation allegedly reveal that the defendant endangered the welfare of a child. He was arraigned in Batavia City Court and released. The case was handled by Deputy Kevin McCarthy.

Luis J. Santiago, 31, of Buell Street, Batavia, is charged with second-degree criminal contempt. The arrested follows an investigation of a domestic incident that occurred on Edward Street in the City of Batavia at 2:49 p.m. on March 28. Santiago was released on an appearance ticket and is due in Batavia City Court on May 19. The case was handled by Batavia Police Officer Sean Wilson, assisted by Officer Jordan McGinnis.

A pole and wires are down in the roadway at 10797 Darien Alexander Townline Road, Darien. Contractors are on scene. The roadway is temporarily closed. Darien Fire Department was called, then asked to hold in quarters. The location is between Bowen Road and Route 238.

A field fire that is moving toward trees is reported in Darien at 10186 Harlow Road. Darien Fire Department is responding. The location is south of Broadway Road (Route 20).

UPDATE 2:31: Fire is out; it is advised that the field be sprayed down. Corfu Fire Department is asked to respond for mutual aid.

In response to the COVID-19 (coronavirus), the following preemptive action is effective as of 5 p.m. today, March 16th:

The Darien Town Hall will be closed to outside groups and functions until at least April 1.

Per NYS Office of Court Administration, Court operations are suspended for no less than 45 days.

Board meetings will not be affected at this time.

Devon A. Wright, 18, (inset photo, right) of Highland Park, Batavia, is charged with third-degree burglary; fourth-degree criminal mischief, and third-degree assault. Wright was arrested on March 12 as a result of an investigation into an incident which occurred at 12:50 p.m. on March 2 at the Sunoco Gas Station and convenience store at 100 W. Main St. in Batavia. It is alleged that he refused to leave the property, attempted to cause physical injury to an employee, then damaged property inside the business. He was arraigned in Batavia City Court and released on his own recognizance and was due to return to court March 13. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Sean Wilson.

Kyle A. Scheuerlein, 27, of Overlook Drive, Batavia, is charged with: criminal obstruction of breathing or blood circulation, criminal possession of a weapon in the fourth degree; and second-degree attempted assault. At 8:48 p.m. on March 8, Scheuerlein was arrested after a domestic incident at an apartment in the 300 block of Washington Avenue in Batavia. He was arraigned in Batavia City Court and is due back there on March 26. The case was handled by Batavia Police Officer Sean Wilson, assisted by Officer Miah Stevens.

Taylor L. Finnin, 27, of East Main Street, Batavia, is charged with second-degree criminal contempt and trespass. Finnin was arrested March 12 on a warrant out of Batavia City Court following an investigation into an alleged violation of an order of protection on Nov. 27 on South Main Street in Batavia. He was put in jail with (unspecified) bail. He was due to return to city court March 13. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Connor Borchert.

Taylor L. Finnin, 27, of East Main Street, Batavia, was arrested on a bench warrant out of Batavia City Court while outside on Swan Street in Batavia on March 12. The warrant was issued after the defendant allegedly failed to comply with a court-ordered program on Nov. 20. Finnin was put in jail with (unspecified) bail. The case was handled by Batavia Police Officer Connor Borchert, assisted by Officer Wesley Rissinger.

Karisa L. McKeown, 25, of Pavilion, is charged with driving while intoxicated, aggravated DWI -- with a BAC of .08 percent or more, and moving from lane unsafely. At 4:56 p.m. on Feb. 29, Wyoming County Sheriff's deputies responded to a one-car accident with injuries on Silver Lake Road in the Town of Covington. When deputies arrived, they observed Pavilion Fire Department treating a patient with minor injuries. Upon further investigation, McKeown was identified as the driver. The vehicle was traveling southbound when it left the roadway, striking a mailbox and a tree, before coming to rest in the bushes in front of a residence. She was transported to the Wyoming County Sheriff's Officer where a Datamaster breath test was administered. She was released with appearance tickets and is due in Town of Covington Court at a later date (unspecified). The case was handled by Wyoming County Sheriff's Deputy Austin Harding, assisted by Deputy Chance Sampson.

Eric Francis Borowski, 30, of Fontaine Drive, Buffalo, is charged with two counts of second-degree harassment. He was arrested on March 15 following a complaint at 4 p.m. March 11 on Alleghany Road in Darien. He was issued an appearance ticket and is due in Darien Town Court on April 7. The case was handled by Genesee County Sheriff's Deputy Joshua Brabon.

Carrie L. Hensley, 42, of West Main Street, Batavia, is charged with petit larceny. On March 11, Hensley was arrested after a shoplifting complaint at the Dollar General store on East Main Street in Batavia. She was released with an appearance ticket for March 24 in Batavia City Court. The case was handled by Batavia Police Officer Sean Wilson, assisted by Officer Wesley Rissinger.

Adrian R. Laird, 18, of Hutchins Street, Batavia, is charged with second-degree rape. Laird's arrest stems from an alleged incident on Hutchins Street in Batavia at 8 p.m. on Jan. 10. He was arraigned in Batavia City Court on Feb. 10 and is to return there at 9 a.m. on Feb. 13. The case was investigated by Batavia Police Detective Matthew Wojtaszczyk.

Gregory Seppe (inset photo, left), 61, of Pringle Avenue, Batavia, is charged with endangering the welfare of a child and second-degree burglary. He was arrested at 11:39 a.m. on Feb. 8 in the 100 block of State Street by Batavia Police Officer Peter Post after he allegedly pushed his way into a local residence while attempting to sell drugs. Seppe allegedly refused to leave after being asked to do so multiple times by the tenants. Seppe was released on an appearance ticket and is due in Batavia City Court on Feb. 13. Batavia Police Officer Stephen Quider assisted in the case.

Alexis V. Finnin, 31, of Washington Avenue, Batavia, is charged with endangering the welfare of a child. She was arrested after an investigation of an incident on East Main Street in Batavia at 8:38 p.m. on Sept. 14. It is alleged that at that time she was intoxicated/impaired to the point of not being able to adequately supervise a 5-year-old child, thereby subjecting the child to risk of physical, mental and moral harm. She was released on an appearance ticket and was due in Batavia City Court on Feb. 11. The case was handled by Batavia Police Officer Jason Ivison.

Tanya Lee Captain, 32, of Darien, is charged with: aggravated driving while intoxicated -- a BAC of .18 percent or more; DWI -- first offense; criminal mischief -- intentionally damaging property; and failure to stop at a stop sign. She was arrested at 11:57 p.m. Feb. 11 in Alexander after an incident was investigated that occurred on Pike Road in the Town of Batavia. She was issued an appearance ticket and is due in Alexander Town Court on Feb. 18. The case was handled by Genesee County Sheriff's Deputy Austin Heberlein, assisted by Deputy John Baiocco.

Michelle L. Sahr, 52, of North Main Street, Albion, is charged with second-degree harassment. She was arrested on a warrant out of Batavia City Court after she was located by Albion PD on an unrelated matter. She was processed at Batavia PD and released on an appearance ticket for Feb. 13 in city court. The case was handled by Batavia Police Officer Wesley Rissinger, assisted by Officer Miah Stevens.

Debra Lynn Mattoon, 40, of Batavia Oakfield Townline Road, Oakfield, was arrested and charged with petit larceny at 4 p.m. Feb. 7. It is alleged that she stole merchandise from Tops Friendly Market in Batavia. She was issued an appearance ticket and is due in Batavia City Court on Feb. 18. The case was handled by Batavia Police Officer Adam Tucker, assisted by Officer Mitchell Cowen.
