Today's Poll: Should a town supervisor be involved in a lawsuit against his town?

as long as he recuses himself from voting on anything that relates to the lawsuit, I don't see anything wrong with it. Being a public official doesn't mean you have to give up your rights.

hmmm So far he hasnt recused himself from anything, not to mention that he is now supervising over the expenditures on this. And judging from his reluctance to talk about it. It feels like he doesnt care about anything else but keeping this project from happening.

look at this... The Batavian left phone messages for Barbeau on Wednesday of last week and again this afternoon. He has not returned our calls.

While it is the town's planning board that is being sued -- along with the Village of Le Roy and McQuillen -- as supervisor, Barbeau would normally be expected to have oversight over the expenditures related to a lawsuit and consult with the attorney.

In this case, McQuillen claimed, the town and village boards will need to hire outside council to represent them and the town's funds will come out of the budget Barbeau helps write and approve.

"The taxpayers shouldn't have to spend money defending a project that the town and village have already approved," McQuillen said.

Now how likely is it that Barbeau is going to consult w an attorney on behalf of the town while he is suing them, or him not participating in the oversight of the expenditures or the budget?

Its an either or situation and really Irene in the real world if you sue a company then get hired/elected to run the same company do you really expect to succeed at either? Its called burning a candle at both ends.

The election was in November.

The suit was filed Dec. 16 (should have included that in the story -- sorry).

He took office last week.
