Walmart greeter, age 70, seriously injured after allegedly being punched by 26-year-old woman
CORRECTION: The employee allegedly assaulted was a cashier, not a greeter.
A 70-year-old greeter at Walmart suffered fractures on the left side of her face Christmas Eve after a 26-year-old woman allegedly punched her after being asked for her receipt for items in her shopping bag.
The young woman reportedly ran from the store and, according to witnesses and several customers, chased her and surrounded her car, preventing her from leaving until police arrived.
"One of the biggest things to note is that the community actually stood up and did not let this person get away with what she did," said one witness, who asked to remain anonymous. "Even on this busy shopping day, dozens of people stayed behind and made police reports."
Charged with two counts of assault in the second degree -- one for alleged attempt to cause serious injury and another for allegedly injuring a person 65 or older -- is Jacquetta Simmons of 106 Ellsworth Ave., Batavia.
Simmons was arraigned in Town of Batavia Court by Justice Michael Cleveland and committed to Genesee County Jail on $20,000 bail or $40,000 bond. She's scheduled to reappear in court Jan. 23.
The injured woman was taken to UMMC with a swollen face and multiple facial fractures.
Witnesses say the woman is a longtime employee of Walmart and loved by many.
The employee was reportedly working near the front doors of Walmart when Simmons tried to exit carrying a bag of merchandise. The victim asked Simmons for her receipt. It's unknown if there was any other conversation, but it was at this point that Simmons allegedly punched the victim, who was knocked to the floor.
Simmons then reportedly ran from the store, chased by other customers.
Batavia police arrived on scene first, but Walmart is outside of the city, so State Police took over the investigation once on scene.
In comments on The Batavian's post yesterday, Michelle Wheatley, a witness, said, that as she was leaving she saw the suspect "standing by the police car in handcuffs with a big smile on her face."
UPDATE: Simmons posted $40,000 bond and was released from jail pending her next court appearance.
Where's the mug shot of this suspect? I wonder if she's smiling in it also..... now this older lady has to suffer pain for the next few months because of this jerk. Someone mentioned the greeter's name in the other story here,just wish I could remember which lady it is.
I hope this person gets jail time out of this and I don't mean 30 or 60 days

I'm so proud of my fellow Batavians, and soo disheartened that the person who did this is horrible act is also a Batavian. I suppose it is easier to think that someone who doesn't have ties in our community would do this.
If any good can come out if this hopefully it will be that we as a community, continue to be proactive and our reputation as such will spread both near and far.

I just confirmed with the jail, she did post $40K bond.
If the money came from a bondsman, I understand they have a business to run... but this isn't a crime of one idiot against another idiot. I wish they'd have refused to offer it since the crime was against a harmless and helpless senior citizen.

This is definately the most talked about story in Genesee County right now. It's what everybody was talking about when we went out yesterday evening and I've gotten a good number of emails and phone calls on it.
While there is no sympathy from any quarter for Ms. Simmons, and the victim is widely loved and admired in the community, I need to remind everybody that we have a no-naming calling rule, no personal attack rule. No matter how reprehensible a suspect's alleged conduct, the person is still a suspect until found guilty.
Please keep comments civil and within our guidelines.
Even though none of the accounts state that she actually was stealing anything, one would have to assume that you don't punch a greeter and flee the scene just because you are offended by being asked for your receipt. How is it the someone feels compelled to steal items from a discount store when in a matter of hours she or someone who must care about her can put up that kind of bail on her behalf? If she was in need of money, there was apparently a source available to her that didn't require theft and punching a 70 year old woman trying to do her job.
Just one more reason why i shop at Target.
The elderly woman involved is my friend's grandmother. She is such a sweet lady, and I can't imagine her ever doing anything to deserve this. I hope Jacquetta gets what she deserves. She sent a poor, sweet lady to the ER for hours on end yesterday.
I think ANOTHER part of the problem here is that Walmart's GREETERS ( as in greet people when they come into the store ) are being used as SECURITY GUARDS ( as in check for shoplifting on the way OUT of the store ) !!!!! They're using LITTLE OLD LADIES as SECURITY against shoplifting ???? Disgraceful.
Subsequent to the original post I learned she had paid for everything in her bag. She had no stolen items on her person, or so I am told.
Maybe something the suspect purchased set off the alarm when she was walking out of store-one of the items she purchased might not have been deactivated.That does get annoying,but nothing that would warrant striking a person so hard to fracture facial bones.
Just one more reason why i shop at Target ... cause so far Suzanne hasn't thrown a punch.

Sorry Marc.....again lets deal with reality here, the only people who know exactly what happened is the victim and the assailent. But facts are 1) After hitting the 70+ year old woman hard enough to cause facial fractures, she fled, seems to me if she had "a hand put on her" then she would have stayed and defended her actions. 2) After hitting this woman one of the contributing factors to her flight was most likely the fact that there were dozens of witnesses, something that wouldn't allow her to twist the truth to her benefit. 3) Something happened between the two that obviously riled enough people witnessing the altercation to follow her out to the parking lot and actively block her vehicle from leaving until the police arrived. Not a very common occurance and blocking a vehicle is pretty dangerous to those trying to prevent it from leaving, 4)adding to this the fact that after she was arrested, dozens of witnesses were willing to spend time giving authorities their statements, on Christmas eve nonetheless when almost all of them probably had purchases to get home and wrap or further shopping to do. Even under normal circumstances, people dont usually stick around for that even if they helped apprehend, human nature usually leads people to say police have it under control now I can get back to what I need to do.
So it''s nice Marc that you want to put all these what ifs and maybes into the incident, but it is what it is. Also before you start making assumptions about how our comments are helping Jaquetta, Mr. Price like you and I live in the US where freedom of speech and expression is a right guaranteed by the Constitution and since slander is defined as "defamation by oral utterance rather than by writing, pictures, etc. Since this is a written media, slander is not possible. And the wording of Mr. Prices statement was if I am not mistaken a comment on what he felt would be an appropriate punitive measure for her actions, not a statement about her character or a defamation. Your right though.....ignorance on here really doesnt make things any better at all. But venting to like minded people or arguing with someone who wants to defend ignorant actions with suppositions and whimsical what if scenarios does make most feel better. I wish the weather had been a little more seasonal, maybe Jacquetta would have fallen on an odd patch of ice (several times) and been in the hospital handcuffed to a bed rather than processed and released on bail but hey theres still time before she goes to court. How did this turn into a racial debate? Bob Price, why did you make the statement about a welfare check? A young woman punched a 70 year old woman in the face and was then chased into the parking lot by other store patrons, period. We really don't know many other details so how did you jump to the welfare conclusion?
When the door greeter asks to see your receipt, they are just doing what they've been instructed to do. It's part of their job and they're never pushy about it. They've asked to see my receipt when my hands are full and I've politely declined by saying: "No thanks, I'm not putting everything down, have a nice night/day." They have never chased me or sent out a loss prevention employee to confront me so I don't understand why Jacquetta found the need to punch a woman in the face, especially one who posed zero threat.
I'm pretty sure with all the statements given, the severity of the injuries and assuredly the attack being unprovoked, Jacquetta will be given real prison time.
About the $40,000 bond, people seem to be confused about how a bond works:
When a bail bondsman, working with a bail bonding agency, puts up a fee for the release of a suspect on bail, the bondsman charges a fee of usually about 10% of the amount of money that is required to pay the bail. This initial fee is not refundable, even if the case is thrown out after the suspect posts bail.
The bail bondsman will take out a security against a defendant’s assets in order to cover the cost of the bail. If the defendant does not have enough assets, then the bondsman might take out securities against individuals that are willing to assist, such as relatives and friends. When a security is taken out, a bondsman often requires that 10% cash payment in addition to the mortgage on a person’s home that would equal the full amount of the bail bond money owed.
In the event that a defendant does not arrive in court on trial day, the bondsman can not only hire a bounty hunter to track the defendant down, but the bondsman then has a right to sue the defendant for money that was given to the court for the defendant’s bail bond. The bail bond agency may also recover any unpaid money by claiming assets that were owned by the defendant or those individuals that signed a contract to financial assist the defendant.
That means if you're busted and someone offers equity in their home as security collateral for the bond, if you skip bail, that person could lose their home when the bondsman comes to collect the money they're out.

Doug, I don't think most people are racist. I think that people just react to what they observe. And in case you didn't notice, it's not usually a Swede or an Oriental that does these kinds of things. Just reporting what I observe.
Scott, here's what I've observed in my lifetime. Recently, the people who have been busted for shoplifting at Walmart and Kmart have predominantly been white, not black. The assaults and domestic incidents I've read about in the paper have mostly been committed by white people.
I used to own a house on Mohawk St in Rochester and the neighborhood was predominantly black. I lived there for 13 years and when my house was broken into, it wasn't black people that did it. The people who broke in were Puerto Rican ages 12, 14 and 17. Their 35 year old uncle was waiting in a car on the next street over with the trunk open. Rochester's largest crime problem right now is black on black crime, not black on white crime. I actually never had problems with any of my black neighbors. My biggest concern was getting caught in the nightly gunplay crossfire I could hear right outside my window. My point is that your skewed perception is not fact based.
When I tired of city life and decided I needed a change of scenery, I moved to Genesee county and within a few years my 4-wheeler was stolen right from my driveway, trailer and all. As far as I know it has never been found but I can almost guarantee with certainty that it was white people that stole it. The police told me that what happens is, stolen 4-wheelers often end up in hunting camps in southern counties where they're used for dragging deer, or whatever. Have you ever heard the term "redneck?" Well, I'm more concerned with my thieving, white, redneck neighbors than I am with my black neighbors. Just sayin!
I've been around..I grew up in Tyre, NY (Seneca Falls). It's farm country, whitey-ville. I grew up podunk. I then moved to Rochester for the culture shock of my life and lived there from February of 82 to July of 2003. For the last 29 years I've worked in and around the Rochester area. Since July of 2003 I've lived in East Bethany. The point I'm trying to make is that I think I have a clue, based on experience that I have actually lived through. I read people very well.

This is no defense to the welfare check statement, but the comment could have been in reference to anyone that shops at Walmart, since their stereotype is that they have the lowest prices so only the poor shop there, which in itself can be offensive, since I shop there once and awhile and have never collected any form of welfare in my life.
I don't understand why the greeter would have touched the defendant, I have never in my times going there have ever seen them even go towards a shopper unless it was to help them if they dropped something or to check their receipts if they are returning something.
Doug, your four wheeler was stolen and you just make the assumption that it had to be white folks who took it? I once lived in the inner city. My vehicle was broken into. The only thing taken was a pair of fancy shoes that I owned. I didn't see who took them. What assumption should I then make as to the race of the thief? Can an assumption me made upon indirect observations? And what would be the relative chance of such an observation being correct? Ten percent? Ninety percent?

When you live in an area where the majority of the population is white, the people committing the crimes are probably white! It's easy for people to say something such as "See! Those damn black people are all criminals!" when one of them is arrested in a predominantly white area.
Nice examples there Marc but let me enlighten you a bit, first of all I'm a realist which means I believe in seeing things as they really are (my definition) a realtor is a person who buys and sells real estate which I really dont do and doesnt fit the context you are using it in. If you look at reports color is used where it is appropriate, your examples are useless in these circumstance as the are reports of crimes and criminals that have been apprehended ie shoplifting crimes. In this case Howard was making a report from a scanner call in which officials use a persons color and sex to indicate to the officers whom they are looking for in case the unsub (I love using that phrase) flees the scene as they approach. Then a witness came in and corrected Howard's error by telling him it was a black woman not a black man. You objected to her use of the term black. I object to your requiring us to be politically correct and racially sensitive.

I read a comment made by Pat Buchanan (with who's politics I disagree with mostly) in response to Obama wanting to have a discussion about race relations.... It seems appropriate here in this conversation. There is a kernel of truth in this statement don't you think so? With all respect for Doug, I can understand his position as I have also had a wide range of exp in places I have lived I went from Brockport to Rochester (a few doors down from franklin high) to the navy. When I came back I lived in Syracuse's South Side right off Salina St. Then moved to Ithaca then to here. I consider myself pretty open minded but very outspoken when I see people take a valid issue like racism and manipulate it to their own ends. Thats what I felt I saw in your tirade on Michelle.
And I give a nod to Doug on the having a clue comment. Seems like people like us kinda have a learned insight on reading people. I'm sure you hear from your friends as I do how uncannily people like us peg people's true character even through the roles they play and masks they wear (figuratively speaking) in public.

Marc, I believe I said once a person is found (arrested or not), the description, including race, is no longer relevant. We don't use race at that point and every professional news outlet I know applies the same standards -- unless there is some compelling reason that makes race relevant.

I had a friend who was black, and one day while discussing pedos, he made a remark that caught me a little off balance, he stated we should always be sure to let everyone know that someone is a pedo. He then stated, I wake up everyday and see that I am a black man. I should have questioned his meaning, but again, the remark caught me off gaurd.
I hope he wasn't saying he was ashamed, or uncomfortable with being black, or that he felt it was a disadvantage to be black. I wish I would have asked him for a better explaination.
Being a white male, I have no way of fully understanding what it would be like to be a black male. Is there really a huge difference, either real or perceived?, I don't know.

Well I was writing books on here just trying to make my point, I think he removed it because, well I'm not sure and doubt I should speculate. But his 2nd to last post he claimed to be a witness to the incident, which I had my doubts about as it seems like something that would have been mentioned here much earlier, and over on the other site where we discussed witnesses as well. But I think I made my points as did Doug and others. In my viewpoint I just felt thathis comments to Michelle's post were overboard and unbalanced.
