The following people were arrested by the Genesee County Sheriff’s Office during the Van Halen Concert at Darien Lake Performing Arts Center on Tuesday.

Michael L. Mawk Jr., 22, of Stellane Drive, Angola, is charged with criminal trespass, 3rd, after allegedly climbing over a fence and entering the concert venue.

James H. Munt, 37, of Robinson Street, North Tonawanda, is charged with criminal trespass, 3rd, after allegedly reentering the concert venue after being ejected and told not to return.

Codie J. Taylor, 21, of Greenwood Place, Angola, is charged with criminal trespass, 3rd, after allegedly climbing over a fence and entering the concert venue.

Donald H. Gardener, 29, of Briggs Avenue, Bronx, is charged with criminal trespass, 3rd, after allegedly reentering Darien Lake property after being ejected and told not to return.

Thomas J. Scheurlein, 25, of Chili Avenue, Rochester,  is charged with trespass after allegedly reentering the concert venue after being ejected and told not to return. 

Van Halen performed last night at Darien Lakes PAC and lead singer David Lee Roth was back in action on stage with some entertaining moves. Roth missed the first show from the band's second leg of their U.S. tour in Hershey, Pa., this past Sunday night due to illness.

The crowd of approximately 9,000 people were entertained by classics like "Dance the Night Away," "Ain't talkin bout Love," "Panama," and "Running with the Devil."

This is the band's first time back to WNY since the group played a North American tour in 2012 at the First Niagara Center, Buffalo. Van Halen did not disappoint the crowd and still packed a punch to their lineup with additional tunes like "Hot for Teacher," "Jump," "Unchained," and "You Really Got Me."

Two solos were performed through the show: Alex Van Halen on drums; and Eddie Van Halen with guitar near the end.

A sold-out Chris Brown show at Darien Lake Performing Arts Center kept emergency responders busy for hours last night, but other than making for a long, tiring night, it wasn't that bad, said Chief Deputy Gordon Dibble, Genesee County Sheriff's Office.

There were no serious fights and there are no reports of serious injuries, and while there were 16 arrests at the show, they were mostly for run-of-the-mill offenses, from trespassing to unlawful possession of marijuana.

"Generally, it was a very pleasant crowd," Dibble said. "They were polite, for the most part, even when caught in traffic coming in, they mostly had a good attitude. Some of these people coming in waited a long time and for the most part they were very nice. They just wanted to get to the show like everybody else."

The traffic tie-ups were not unexpected, Dibble said. The traffic jams around the park were typical of a sold-out concert on a weekday night, when everybody gets off work and heads to the show instead of coming in over the course of the day, like on a Saturday or Sunday.

Traffic started to back up shortly after 5 p.m. and traffic jams slowed down concertgoers coming in from all directions. Three or four minor traffic accidents caused some blocked lanes and tollbooth workers at times had a hard time keeping up, causing traffic to back up on the Thruway.

"So many of the roads were built when that place was a swimming hole, a hot dog stand and a couple of lifeguards," Dibble said. "Those are the same roads then as they are today."

Dibble is aware there are still people who advocate for a return of private parking around the venue, but that's not the answer Dibble said. Those lots, he said, create more problems than they alleviate.

"I'm under the opinion after my many, many years out there that congestion on Sumner makes it worse," Dibble said. "You have masses of people walking on Sumner and mixing pedestrians and traffic isn't good. This is much safer. And then you had people pulling into private lots dickering with the people taking the money and backing up traffic. There's no way I want to go back. Darien Lake has the space available to handle the parking."

There's been talk for years about how to open up more entrances and exits to the lots, but there's no easy answer, Dibble said.

Colby Road isn't the answer because of the configuration of the roadway.

"Exiting, that would be good, but the topography of that road, the hills and blind spots, make that difficult and very dangerous," Dibble said.

Dibble noted that Cherry Hill Campground continues to accept concert parking and that doesn't really help matters.

"They get them in there and then abandon them there and that's a problem for us when it's time to leave," Dibble said.

Early in the evening, local emergency responders were overwhelmed by the sheer volume of medical calls, mostly for alcohol-related illnesses. That was a combination of the alcohol and the heat, Dibble said.

The county needed backup units from Erie and Orleans counties and patients were transported to multiple hospitals so no one hospital became overwhelmed.

Live Nation had two doctors in the venue, as is now standard practice for sold-out shows.

"There are a lot of things they're able to take care of right on property instead of transporting them," Dibble said.

Dibble didn't have a count yet on how many citations were issued for underage drinking, but they were numerous.

"Each band has its own personality and its own following and this particular band attracted a the type that was younger and there was a lot of underage drinking," Dibble said.

The early-evening enforcement of ABC violations helps cut down on problems later in the night, Dibble said.

"For the number of people there, it was really a good night, actually," Dibble said.

The following people were arrested by the Genesee County Sheriff’s Department during the Chris Brown concert at Darien Lake Performing Arts Center on Wednesday.

Matthew J. Norton, 22, of South Main Street, Evan Mills, is charged with harassment, 2nd, after allegedly punching a security officer in the face. Norton was arraigned in Darien Court and jailed in lieu of $750 bail.

Ashley Ginter, 27, of East Main Street, Alleghany, is charged with disorderly conduct after allegedly causing a disturbance in the parking lot. Ginter was arraigned in Darien Court and jailed in lieu of $500 bail.

A 16-year-old of Kline Road, Niagara Falls, is charged with harassment, 2nd, after allegedly punching another patron in the face.

Curtis W. Brock, 19, of Hedgewood Drive, Williamsville, is charged with trespass after allegedly reentering the concert venue after being ejected and told not to return.

Katie A. Hamilton, 21, of Marvel Lead Drive, Greece, is charged with criminal trespass, 3rd, after allegedly reentering the concert venue after being ejected and told not to return.

Brett M. Dechent, 23, of Hamburg Turnpike, Lackawana, is charged with criminal trespass, 3rd, after allegedly reentering the concert venue after being ejected and told not to return.

Joshua B. Reed, 22, of Church Street, Medina, is charged with criminal trespass, 3rd, after allegedly reentered the concert venue after being ejected and told not to return.

Haley L. Filippone, 19, of Salt Road, Clarence, is charged with trespass, criminal trespass, 3rd, after allegedly reentering the concert venue twice after being ejected and told not to return. Filippone allegedly provided another subjects identification on the initial trespass. Additional charges are pending.

Christopher F. Weber, 18, of Ransom Road, Lancaster, is charged with criminal trespass, 3rd, after allegedly reentering the concert venue after being ejected and told not to return.

A 16-year-old of Chili Avenue, Rochester, was arrested for unlawful possession of marijuana after allegedly being found in possession of marijuana.

Ronald J. Minni, 23, of Wheeldon Drive, Rochester, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Justin M. Ferraraccio, 19, of Chestnut Ridge, Rochester, is charged with criminal possession of a controlled substance, 7th, and unlawful possession of marijuana after allegedly being found in possession of codeine and methylphenidate and marijuana.

Lisa R. Occhipinti, 20, of Balla Drive, North Tonawanda, arrested for unlawful possession of marijuana after allegedly being found in possession of marijuana.

The following people were arrested by the Genesee County Sheriff’s Office during the Zac Brown Band concert at Darien Lake Performing Arts Center on Sunday.

Lindsay J. Snodgrass, 19, of Park View Drive, Pittsford, is charged with criminal possession of a forged Instrument, 2nd, and false personation after allegedly providing a false date of birth and being in possession of two fraudulent Maryland driver’s licenses. Snodgrass was arraigned in Darien Court and jailed in lieu of $1,500 bail.

Maxwell A. Pigeon, 19, of Hoerner Avenue, Cheektowaga, is charged with criminal possession of a forged instrument, 2nd, obstructing governmental administration, 2nd, grand larceny, 4th, resisting arrest, tampering with evidence  and harassment, 2nd, after allegedly grabbing his fraudulent Pennsylvania driver’s license from a deputy, pushing the deputy and running away. Pigeon was arraigned in Darien Court and jailed in lieu of $2,000 bail.

Griffin J. Ryan, 19, of Shamrock Court, Hamburg, is charged with criminal trespas, 3rd, after allegedly reentering the concert venue after being ejected and told not to return.

Allison R. Sherman, 39, of Brace Road, Victor, is charged with felony aggravated DWI, child less than 16 in vehicle, aggravated DWI, DWI, endangering the welfare of a child and reckless endangerment, 2nd, after allegedly striking a Darien Lake Security Officer in the leg pinning him between two cars. The investigation revealed Sherman was allegedly intoxicated and had her 13 year old son in the vehicle.

Jason M. Mittelstaedt, 42 of Tracy Street, Mittistaedt, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Edward N. Cleveland, 18, of Shamrock Avenue, Port Colborne, Ontario, Canada, is charged with trespass after allegedly attempting to reenter the concert venue after being ejected and told not to return. Cleveland was arraigned in Darien Court and jailed in lieu of $250 bail.

Arunas M. Gecas, 28, of Van Voorhis Avenue, Rochester, is charged with criminal trespass, 3rd, after allegedly running past the ticket takers and entering the venue without a ticket. Gecas was arraigned in Darien Court and jailed in lieu of $500 bail.

Jessica L. Pychel, 20, of Claremount Circle, Welland, Ontario, Canada, is charged with resisting arrest and three counts of harassment, 2nd, after allegedly kicking, pushing and biting deputies and security officers. Pychel was arraigned in Darien Court and jailed in lieu of $2,000 bail.

Sean P. Biggie, 22, of Jane Drive, Syracuse, is charged with harassment, 2nd, after allegedly grabbing a deputy's wrist trying to pull a deputy to the ground. Biggie was arraigned in Darien Court and jailed in lieu of $250 bail.

Adam R. Penney, 33, of Sylvan Hill Road, Echo Bay Ontario, Canada, is charged with disorderly conduct and harassment, 2nd, after allegedly punching windows on a van and then punching a Darien Lake security officer in the face. Penney was arraigned in Darien Court and jailed in lieu of $500 bail.

The summer line-up for the Darien Lake Performing Arts Center is starting to take shape, with Kelly Clarkson the latest star announced by Live Nation for a show at the amphitheater next to Darien Lake Theme Park.

The Clarkson show is at 7:30 p.m., July 21. Tickets go on sale at 10 a.m., March 14. Also on the bill, Pentatonix and Eric Hutchinson.

Also on the schedule so far are some Darien Lake regulars, such as Brad Paisley, Kid Rock, Def Leppard, Zac Brown and Nickelback.

The Van's Warp tour is also returning.

Those shows are listed on the Live Nation Web site.

Darien Lake's site also lists Toby Keith, Tim McGraw, Jason Aldean and Rascal Flatts.

The first upcoming show is Debby Ryan and the Neverending at 6 p.m., May 23.

Other acts scheduled are Shawn Mendes, Fallout Boy, Train, Slipknot, Florida Georgia Line, and Darius Rucker.

If Craig Lawson had been properly escorted from the concert venue the night Kid Rock played Darien Lake a year ago July, alleges a Buffalo attorney, he never would have been able to deliver a devastating, life-altering sucker punch to Jason McNeil.

The punch took away the life Jason and his wife Pamela and their two children once knew in Tuscaloosa, Ala.

McNeil, 44, needs constant care after suffering serious head trauma as a result of the punch.

And he wasn't even Lawson's intended victim.

A federal lawsuit filed on behalf of the McNeils will attempt to determine to what degree concert promoter Live Nation and concert host Darien Lake Theme Park is responsible for that punch.

The McNeils are seeking $150 million in damages.

The suit alleges other factors that contributed to McNeil's injuries, said attorney Donald Chiari, but at the heart of it is how Live Nation security handled Lawson after the decision had been made to eject him from the venue for being drunk and disorderly.

Lawson was taken to the concert venue gate (possibly the one known as South PAC), but the guard never completed the task of actually getting Lawson out the gate, Chiari said. If he had, there were security guards in place to keep him out of the venue.

There also would have been a fence between Lawson and the VIP gate, where McNeil was exiting the concert with Pamela.

While a Live Nation guard was taking Lawson to the gate, a person he had been in a confrontation with Lawson inside the venue was supposed to be leaving through the VIP gate.

That person wasn't McNeil.

With Lawson allegedly left unattended for a couple of minutes inside the concert venue, the 34-year-old Canadian ran over to the VIP gate, and in a case of mistaken identity, cold-cocked McNeil.

The punch delivered to a person he had no prior contact with is a fact Lawson admitted during his sentencing Aug. 18. He's currently serving a year in the Genesee County Jail on the assault charge.

McNeil was knocked out before his head hit the ground. He was in a coma by the time he arrived via Mercy Flight to ECMC and has required several surgeries and extended hospitalization since. He has suffered loss of speech; ability to read and write; and comprehend what people are saying; and the ability to walk.

The same security guard who allegedly failed to get Lawson out of the gate was one of the first on scene after the punch was thrown, Chiari said.

"The guard got there and said, 'Oh, my God, I was just throwing you out two-and-half minutes ago,' Chiari said, "that's literally in his statement."

It's not unusual -- as anybody knows who regularly reads arrest reports from concerts at Darien Lake -- for patrons to be ejected from the venue and then later try to return. There are frequent trespassing arrests at Darien Lake concerts. 

Chiari said the unique issue in this case is the alleged failure to follow through on getting a disorderly patron out of the concert venue so other patrons are properly protected.

"No premise's owner or any security is an absolute insurer of safety of third parties, but they still have to do what is reasonable," Chiari said.

The suit names as defendants Live Nation in its at least 10 various incorporations, Darien Lake (by three different corporate names), Craig Lawson, and the company, Contemporary Services Corporation, Live Nation contracts with for security personnel and training.

Not named in the suit is Kid Rock or the Genesee County Sheriff's Office.

Chiari said there is no plan to include the county in the suit.  

Live Nation pays for Sheriff's deputies to provide law enforcement on concert nights, but deputies do not enter the concert venue and from Chiari's description of events, it appears everything leading up to the punch happened within the venue.

The Washington Post recently published a story about the growing rowdiness and disorderly behavior at country music concerts nationally. It's not just a Darien Lake thing. Many contemporary music acts seem to encourage excessive drinking and concerts are often preceded by tailgate parties were copious amounts of booze are consumed.

The suit also names as co-defendants SMG Food and Beverage, and Aramark Sports and Entertainment Services, stating those companies were the vendors of alcoholic beverages the night of the concert. The suit alleges the vendors unlawfully sold alcohol to an already intoxicated Craig Lawson.

This afternoon, The Batavian requested comment from both Live Nation and Darien Lake and have not as of yet received a response.

The following people were arrested by the Genesee County Sheriff's Department during the Tom Petty Concert at Darien Lake Performing Arts Center on Sunday.

Jennifer L. Bishop, 26, of Harmony Avenue, Niagara Falls, Ontario, Canada, is charged with criminal trespass, 3rd, after allegedly getting evicted from the concert venue and advised not to return, then reentering the concert venue. Bishop jailed on $100 bail.

Charles T. Diorio, 30, of Brookwood Drive, Derby, is charged with trespass after allegedly getting evicted from the concert venue, advised not to return, then was said to be climbing the fence to get back into the venue. Diorio was jailed on $500 bail.

A 16-year-old, of Country Road 12, Andover, is charged with possession of a loaded rifle in a vehicle and unlawful possession of marijuana after allegedly possessing a loaded .22 rifle in his vehicle and possessing a quantity of marijuana.

Louis E. Sorendo, 57, of East Albany Street, Oswego, is charged with trespass after allegedly reentering the concert venue after being ejected from the concert and advised not to return.

Daniel A. Howe, 50, of Astor Drive, Rochester, is charged with criminal possession of a controlled substance, 7th, after allegedly possessing a quantity of cocaine.
