Grand Jury Report: Registered sex offender accused of failure to report change of address

Richard Stevens is indicted on two counts of failure to register change of address, a class E felony, and two counts of criminal obstruction of breathing or blood circulation, a class A misdemeanor. Stevens, a convicted sex offender, is accused of moving in April to 22 Tracy Ave., Batavia, without registering a change of address within 10 days. He's also accused of moving back to 22 Tracy Ave. from the Genesee County Jail in October and failing to register a change of address within 10 days. Stevens is also accused of trying to choke another person on two occasions, once in October and again in November.

Clenton J. Reese is indicted on a count of criminal contempt,1st, a class E felony. Reese is accused of violating a court issued stay-away order.

Grand Jury Report: Defendant accused of burglary and lying to cover up the crime

Trevon L. Armstrong is indicted on counts of burglary, 2nd, criminal possession of stolen property, 4th, two counts of criminal mischief, 4th, falsely reporting an incident, 3rd, six counts of forgery, 2nd, three counts of offering a false instrument for filing and tampering with a witness, 4th. Armstrong is accused of entering a residence on East Avenue on Oct. 9 with the intent to commit a crime inside the residence. Armstrong is accused of possessing stolen property, a 46-inch Hisense LCD TV, a HP laptop computer and two boxes of jewelry. Armstrong is accused of damaging a window at the East Avenue property, as well as a door. Armstrong is accused of falsely reporting a burglary at a neighboring residence. He is accused of falsely implicating another person in possessing the stolen property. He is accused of signing a fake name on a fingerprint card, a witness statement and a deposition, as well as other government documents. Armstrong also allegedly tried to keep another person from testifying before the grand jury.

Earl F. Sprague III, is indicted on a count of criminal solicitation, 2nd. Sprague is accused of trying to engage another person in a Class A felony, murder in the second degree.

Janet M. Brady is indicted on counts of felony DWI, felony DWI with a child under age 15 in the car. Brady is accused of driving drunk Aug. 9 in the parking lot of Darien Lake Theme Park, Darien.

Martin F. Jones is indicted on counts of felony DWI, two counts of aggravated unlicensed operation and criminal mischief, 4th. Jones is accused of driving drunk Oct. 9 in the City of Batavia in the parking lot of Settler's Restaurant and Hess Mart. He is accused of damaging property at Settler's Restaurant with a value that exceeds $250.

Dennis E. Hopkins is indicted on charges of burglary, 3rd, and grand larceny, 4th. Hopkins is accused of entering a residence in February on Lewiston Road, Batavia, with the intention of committing a crime inside. He is accused of stealing $2,000 in cash.

Guillermo Roman Roque is indicted on three counts of incest, 3rd. Roque is accused of having sexual relations with a person he knew to be a family relative.

Elaina J. Mead is indicted on counts of menacing a police officer, assault, 2nd, criminal possession of a weapon, 3rd, and obstructing governmental administration, 2nd. Mead is accused of placing a knife to the chest of a deputy while attempting to block the arrest of her son, Michael Mead Sr., on June 17. Mead is accused of intentionally injuring a Le Roy police officer with a knife. She is accused of unlawfully using a knife as a weapon. She is accused of attempting to prevent the arrest of another person.

James Smith Jr.,  is indicted on counts of criminal possession of a weapon, two counts of menacing, 2nd, and assault, 2nd. Smith is accused of using a weapon with the intent to injure another person. He allegedly displayed a knife. He allegedly injured another person using a knife on July 22.

Grand Jury Report: Convicted sex offender accused of not registering change of Internet access

The Grand Jury of Genesee County has issued the following indictments:

Kevin C. Johnson is indicted on a count of failure to register change of Internet access. Johnson, a convicted sex offender, is accused of not notifying authorities within 10 calendar days of a change in Internet access accounts.

James D. Ferguson is indicated on counts of DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation. Ferguson is accused of driving drunk May 28 in Pembroke while having a revoked license due to a prior conviction in Buffalo in 2011 of driving while ability impaired.

Xzavier A. Davis is indicted on felony counts of DWI, driving with a BAC of .18 or greater and aggravated unlicensed operation. Davis is accused of driving drunk May 13 in the Town of Darien. Davis has a prior DWI conviction in the Town of Cambria in 2012.

Shawn A. Johnson Jr., is indicted on four counts of criminal possession of a forged instrument, 1st. Johnson is accused of possessing forged $20 bills in the Town of Darien.

Robert L. Hizer is indicted on counts of felony DWI, aggravated felony DWI and robbery, 3rd. Hizer is accused of driving drunk June 23 in the Town of Le Roy while children under age 15 were in the vehicle. He is accused of, on that same date, stealing $138 and a pack of cigarettes from the Wilson Farms store at 13 Lake St., Le Roy.

Laszlo Szabo is indicted on counts of felony DWI and driving with a BAC of .18 or greater. Szabo is accused of driving drunk Sept. 23 in the Town of Le Roy. Szabo has a prior DWI conviction from 2005 in the Town of Greece.

Grand Jury Report: Man accused of violating court order, injuring and threatening woman

Robert P. Leiser Jr., is indicted on three counts of aggravated criminal contempt in the first degree, two counts of assault in the second degree, reckless endangerment in the second degree and criminal contempt in the first degree. Leiser is accused of causing serious physical injury to a person under protection of a court order on July 24 in the Town of Alabama. He is accused of hitting the person with a flashlight causing serious physical injury. He is also accused of driving in a reckless manner, at a high rate of speed and without obeying traffic devices, with that person on a motorcycle while the protected person was not wearing a helmet. He is also accused of threatening that person with a flashlight.

Bradley J. Broadbent is indicted on three counts of criminal mischief in the fourth degree, criminal trespass, burglary in the second degree and petit larceny. Broadbent is accused of damaging ceilings in three bathrooms and the sink in one bathroom at the Liberty Square office complex at between 3 and 3:30 p.m., July 6. On the same date, at 4:05 p.m., Broadbent is accused of damaging the door frame and door plate of an apartment on Hutchins Street. He is accused of entering that dwelling without permission. On the same date at 8:13 p.m., he is accused of damaging the exterior door of a residence on Tracy Avenue. He is accused of entering that residence with the intent of committing a crime once inside. He is accused of stealing a pair of shorts and a Buffalo Bills blanket from the residence.

Connie L. King is indicted on a misdemeanor charge of DWI, driving with a BAC of .18 or greater and aggravated unlicensed operation. King is accused of driving drunk May 28 on Dodgeson Road, Alexander. She was previously convicted of driving while ability impaired in June 2009 in the Town of Batavia.

The grand jury also returned a "no bill" (meaning, the grand jury found insufficient evidence to sustain the charges) in the case of Leeann Marchese, who was accused of burglary in the second degree. The charge stemmed from an incident in the Town of Stafford on April 3.

Grand Jury Report: Man charged in Le Roy burglary

John H. O'Shea is indicted on counts of burglary in the third degree and grand larceny in the third degree. O'Shea is accused of breaking into a residence on North Street in Le Roy and stealing items valued in excess of $3,000, including tools, brass fittings, copper wire, bronze manifolds, a galvanized garbage can, a tool bag and a camera.

Tammy M. Chojnacki is indicted on counts of felony DWI and felony driving with a BAC of .08 or greater. Chojnacki is accused of driving drunk March 24 on Route 33 and Pike Road, Batavia. Chojnacki was previously convicted of DWI in Attica in October, 2007.

Jason W. Wolf is indicted on counts of felony DWI, felony driving with a BAC of .18 or greater and aggravated unlicensed operation in the first degree. Wolf is accused of driving drunk on Route 77 on March 18. Wolf has a prior DWI conviction in Septermber, 2007.

Grand jury indicts church burglary suspect

A Batavia man allegedly caught in the act of burglarizing a local church and later accused of trying to escape from jail was indicted by a Genesee County Grand Jury today on seven felony counts and four misdemeanors.

John Anthony Cabrera, 22, is charged with two counts of burglary, 3rd, one count of grand larceny, 3rd, and two counts of grand larceny, 4th, and escape, 1st.

The highest felony charge is a Class D felony.

The misdemeanor charges include three counts of criminal mischief and petit larceny.

Cabrera is accused of breaking into St. Paul's Church at 31 Washington Ave., Batavia, on July 21 and stealing three credit cards and $6,095 in personal checks, $354.36 in cash, $1,160 in gift cards, various keys, checkbooks and documents from the church.

The escape charge comes from alleged escape attempt -- Cabrera was reportedly found outside of the confined jail area, but still in the same building, technically constituting the alleged escape -- on July 24.

The city suffered a series of church burglaries in the weeks prior to Cabrera's arrest, but Cabrera has not been charged in any other break-ins.

Detectives reportedly gathered some DNA evidence at some crime scenes, but no word yet on whether Cabrera can be linked to the other burglaries.

Grand Jury Report: Jail inmate accused of falsifying business records to place phone calls

The Grand Jury issued the following indictments:

Jayson M. Connolly is indicted on 13 counts of falsifying business records in the first degree. Connolly is accused of using the identify of another Genesee County Jail inmate in the jail's phone system when contacting a person who was protected from contact by court order.

Stephen D. Reamer is indicted on counts of felony DWI and felony driving with a BAC of .18 or greater. Reamer is accused of driving drunk March 23 in the Town of Le Roy. Reamer was previously convicted of DWI in December 2004.

Cody L. Osborn is indicted on counts of felony DWI, felony driving with a BAC of .08 or greater, aggravated unlicensed operation and criminal impersonation in the third degree. Osborn is accused of driving drunk March 4 in the Town of Le Roy. Osborn allegedly identified himself as a person employed by the Le Roy PD. Osborn was previously convicted of DWI in May 2009.

Jon N. Roblee is indicted on a count of criminal contempt 1st. Roblee is accused of placing a phone call to a person protected by a court order and saying, "I am going to get you and him too, if it takes the rest of my life."

Grand Jury Report: Six felonies filed against man accused of stealing and using credit cards

Richard A. Crook Jr., is indicted on four counts of grand larceny in the fourth degree and two counts of forgery in the second degree. Crook is accused of stealing the credit and debit cards of another person and then using the credit cards to make purchases at Tops Market on two separate occasions of more than $300.

Anna M. Spencer is indicted on counts of custodial interference in the first degree and identify theft in the first degree. Spencer is accused of enticing a child from the child's lawful custodian and keeping the child for a protracted period of time at a location out of state. Spencer is also accused of using the identify of another person.

Luis A. Martinez is indicted on a charge of felony DWI. Martinez is accused of driving drunk Jan. 15 on Route 63 in the Town of Batavia. Martinez was previously convicted of DWI in October 2002.

Paul J. Doctor is indicted on counts of burglary in the second degree and two counts of grand larceny in the fourth degree. Doctor is accused of breaking into a residence on Jackson Street, Batavia, and stealing items from the residence.

Bryan K. Printup is indicted on a count of felony DWI, felony driving with a BAC of .08 or greater and aggravated unlicensed operation. Printup is accused of driving drunk Jan. 1 in the Town of Alabama. Printup was convicted of DWI in April 2009 and had his driver's license revoked for DWI convictions in September 1995 and June 1996.

Grand Jury Report: Alleged drug dealer indicted on four counts

Thomas L. Hill Jr., is indicted on four counts of criminal possession of a controlled substance, 3rd. Hill is accused of possessing cocaine with the intent to sell it Oct. 8 while at 335 Bank St., Batavia, and again on Jan. 7 at 174 Ross St.,  Batavia.

Albert A. Ackerman is indicted on a charge of felony DWI. Ackerman is accused of driving drunk Nov. 6 on Route 5 in the Town of Le Roy. Ackerman is accused of a prior DWI in 2009 in Florida.

Danielle Hendrickson is indicted on a charge of criminal possession of a forged instrument, 2nd. Hendrickson is accused of possessing, with the intent to defraud, a forged check in the amount of $50 drawn on the account of a local couple.

Shawn J. Scheg is indicted on a felony count of DWI and felony driving with a BAC of .18 or greater. Scheg is accused of driving drunk Jan. 8 while on West Sweden Road, Bergen. Scheg is accused of having a prior DWI conviction in the Town of Batavia in May 2002.

Grand Jury Report: Man accused of trying to injure state trooper with car

James A. Klotzbach is indicted on charges of attempted assault on a police officer, endangering the welfare of a child and driving while ability impaired by drugs. Following a pursuit by police, with a child in the car, Klotzbach allegedly attempted to drive his car into the patrol car of a state trooper with the intention to cause serious injury to the trooper. Klotzbach was allegedly under the influence of drugs at the time.

Gail P. Rumble, AKA Gail P. Montondo, is indicted on two counts of identity theft in the second degree, three counts of identity theft in the third degree and five counts of criminal impersonation in the second degree. Rumble is accused of using the identity and credit of other people to obtain services from Time Warner, National Fuel and National Grid.

Brent M. Semmler is indicted on a felony charge of DWI. Semmler is accused of driving drunk Dec. 18 in Le Roy.

Rusty E. Vanson is indicted on charges of felony DWI and felony driving with a BAC of .08 or greater. Vanson was arrested Oct. 23 in the Town of Alexander on Bowen Road for allegedly driving drunk.

Grand Jury Report: Predatory sexual act indictment filed

Stephen I. Stone is indicted on a charge of predatory sexual assault against a child, a Class A-II felony. Stone is accused of committing a sexual act against a child of less than 13 during the summer of 2011.

Brett A. Simcick is indicted on a count of felony DWI. Simcick is accused of driving drunk Sept. 4 on Munson Street, Le Roy.

Matthew C. Higgins is indicted on a count of felony DWI. Higgins is accused of driving drunk Oct. 21 in the Town of Le Roy.

Matthew R. Klump is indicted on counts of felony DWI and driving with a BAC of .18 or greater. Klump is accused of driving drunk Oct. 8 on Clay Street and Myrtle Street, Le Roy.

Grand Jury Report: Man accused of stealing $31K in material from Le Roy business

Tony R. Smith is indicted on a count of grand larceny, 3rd. Smith is accused of stealing property valued at about $31,000 from a business on Gilbert Street in Le Roy, including boxes containing brass draw lead nuts, copper draw lead terminals and aluminum blocks, between May and July 2011.

Roy K. Way is indicted on counts of felony DWI and and felony driving with a BAC of .18 or greater. Way is accused of driving while drunk on South Pearl Street and Brooklyn Avenue in Batavia on Sept. 12.

Sara K. McCabe is indicted on a count of felony DWI, three counts of aggravated DWI (driving drunk with a child 15 or under in the car) and one count of operating a motor vehicle without a required interlock device. McCabe is accused of driving drunk with children in the car in the parking lot of McDonald's in Le Roy on Aug. 25.

Grand Jury Report: Indictment filed for strangulation and assault

Michael A. Mistler is indicted on a charge of strangulation, 2nd, and assault, 2nd. Mistler is accused of obstructing the breathing and blood circulation by applying pressure to the victim's neck during an alleged incident July 22. Mistler is accused of trying to cause serious physical injury to the alleged victim.

Steven A. Mullen is indicted on charges of failure to register a change of address and offering a false instrument for filing. Mullen is a convicted sex offender and is accused of moving to a motel on West Main Street, Batavia, then he allegedly failed to register his change of address. Mullen allegedly filed a change of address with an incorrect address on the form.

Prosecutor's information: The Grand Jury declined to indict Thomas W. Sherman on a charge of assault, 2nd, but did charge Sherman with assault, 3rd. The case is referred back to the Town of Le Roy Court. Sherman allegedly assaulted a person in Le Roy on Jan. 23.

No Bill: The Grand Jury did not find sufficient evidence to indict Wyatt S. Penfold on charges of assault, 2nd, and attempted assault, 2nd. The charges stemmed from an alleged incident on July 22.

Grand Jury Report: Man accused of selling sawed-off shotgun and cocaine

Marcos A. Torres is indicted on one count of criminal sale of a firearm, 3rd, and two counts of criminal possession of a controlled substance, 3rd. Torres is accused of unlawful possession of a firearm and unlawfully selling that firearm on June 22. The firearm is described as a Remington Wingmaster Model 870 20-gauge shotgun having a barrel less than 18 inches in length. He is also accused of possessing cocaine with the intent to sell it.

Joshua G. Bachorski is indicted on three counts of possession of stolen property, 4th, two counts of forgery, 2nd, and three counts of petit larceny. Bachorski is accused of possessing stolen credit cards to use for himself without authorization of the cards' owners. Bachorski is also accused of signing other people's names to purchase agreements. Bachorski is accused of purchasing gift cards with the stolen credit cards.

Jeffrey A. Mooney is indicted on counts of DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation. Mooney is accused of driving drunk Sept. 15 on Route 98 in Elba.

James F. Webb is indicted on counts of criminal contempt, 1st, and five counts of criminal contempt, 2nd. Webb is accused of making multiple telephone calls to a person he was under court order not to contact, with the intent to harass, annoy, threaten or alarm the person.

Sharon L. Awall is indicted on charges four counts of grand larceny, 4th, and seven counts of petit larceny. Awall is accused of stealing three credit cards and a gift card belonging to another person. She is accused of stealing two gold wedding bands, a gold engagement ring with a 1/4-carat diamond, a gold engagement band with a diamond, a man's gold wedding band, a gold anniversary ring with five diamond chips and a wallet.

No Bill: The Grand Jury returned with no bill (no counts filed) against Carolyn M. Smith, accused of assault, 2nd.

Grand Jury Report: Man charged with first-degree Gang Assault

This week the Genesee County Grand Jury issued the following indictments.

Bradley A. Clark is accused of criminal mischief, 2nd, a class D felony, for allegedly intentionally damaging another person's property on May 22. He is alleged to have damaged a 2007 Ford Fusion in an amount exceeding $1,500. He is also accused of criminal contempt in the first degree, a class E felony, because he allegedly violated an order of protection in the City of Batavia on May 22 and caused property damage exceeding $250. In a separate indictment, Clark is accused of first-degree Gang Assault, a class B violent felony. On July 3, he allegedly intentionally caused serious physical injury to another person and was aided by two or more persons present. In count two of the second indictment, Clark is accused of using a dangerous instrument, his footwear, to seriously injure a person in the area of Center Street in the city. That is a class B violent felony -- first-degree assault.

Ronald L. MacGregor is accused of knowingly using a forged prescription for the drug Oxycodone on Oct. 1, 2010, in the City of Batavia. He is also accused of criminal possession of a forged instrument in the second degree. Between Oct. 5, 2010 and Sept. 28 of this year, he allegedly used a falsely altered prescription for Oxycodone in the Village of Le Roy. Both counts of the indictment are class D felonies.

Shannon M. Graham is indicted for a misdemeanor crime of driving while intoxicated. It is alleged that on June 9, in the Town of Alexander, Graham drove a 2001 Hyundai on routes 20 and 98 while intoxicated. In count two of the indictment, Graham is accused of aggravated unlicensed operation in the first degree, a class E felony. Graham, it says, should have known his license was suspended and that he had in effect three or more suspensions imposed on at least three separate dates for failure to answer, appear or pay a fine.

Jose L. Morales is indicted for burglary in the third degree, a class D felony, for allegedly knowingly entering a church in Bergen with the intention of committing a crime some time between Jan. 10 and Jan. 11. He is also accused of criminal mischief in the fourth degree, a class A misdemeanor, for allegedly intentionally damaging another person's property. This included a rear door, office doors, furniture and file cabinets. In the third count of the indictment, Morales is accused of petit larceny, a class A misdemeanor, for allegedly stealing money and postage stamps from a church in the Town of Bergen.

Grand Jury Report: Former employee accused of bilking her employer for more than $14,000

On Friday, the Genesee County Grand Jury issued indictments against four people as follows:

Michele A. Case is accused of grand larceny, 3rd, a class D felony, for allegedly stealing property in the City of Batavia which had a value in excess of $3,000. She allegedly took $14,207.67 from her employer for employee compensation for time and mileage to which she was not entitled.

Grant A. Sundown is accused of criminal mischief, 4th, a class A misdemeanor, after he allegedly grabbed a cell phone out of the hand of a person on April 22 while she was calling 9-1-1 and threw the phone outside of the residence.

In count two of the indictment, Grant Sundown is accused of criminal mischief, 4th, for alledgely ripping the phone cord out of the wall while the alleged victim was on the phone with 9-1-1.

In count three, he is accused of coercion in the first degree, a class D felony, for allegedly trying to stop the alleged victim from calling 9-1-1 by instilling fear in her, saying he would cause her physical injury.

In count four, he is accused of coercion in the first degree by trying to compel the alleged victim to not call 9-1-1, which is her legal right, saying he would attempt or cause her physical injury.

In count five, Grant Sundown is accused of criminal contempt in the second degree, a class A misdemeanor, alleging that on May 25, in the Town of Alabama, he violated an order of protection for the alleged victim.

In count six, he is accused of criminal contempt in the first degree, a class E felony, for allegedly violating a stay away order of protection for the alleged victim. On July 3, he allegedly drove a Ford Explorer into the exterior steps of her residence while she was on the steps in an attempt to hit her.

In count seven, Grant Sundown is accused of reckless endangerment in the second degree, a class A misdemeanor, for allegedly driving a Ford Explorer into the exterior steps of the alleged victim's residence on July 3 while she was on the steps in an attempt to hit her.

In count eight of the indictment, he is accused of criminal mischief in the fourth degree, a class A misdemeanor, for allegedly intentionally damaging the steps of the alleged victim's residence.

Paul F. Atkinson is accused of arson in the second degree, a class B felony, for allegedly intentionally damaging a building by starting a fire on June 13 at 3 Orchard Drive in the Village of Le Roy. According to the indictment, he allegedly did this when another person was inside the building.

Rachellyn G. Burek is accused of identity theft in the second degree, a class E felony. The indictment alleges that between December 2006 and August 2007 in the City of Batavia, she used Time Warner Cable services amounting to $965.41 by using the Social Security number of another person knowingly and with the intent to defraud.

In count two of the indictment, she is accused of attempted identity theft in the third degree, a class B misdemeanor. She allegedly tried to obtain Time Warner Cable services on Feb. 12 in the City of Batavia using the Social Security number of another person knowingly and with intent to defraud.

Grand Jury Report: Batavia resident accused of menacing police officers

Jody B. Gillett is indicted on two felony counts of menacing a police officer, one count of criminal possession of a weapon, 3rd, and two counts of menacing, 2nd. Gillett is accused threatening, with a knife, two members of the Genesee County Sheriff's Office during an incident July 24 at 8 Pine Hollow Road. He is also accused threatening, with a knife, two other people in the same incident.

Grant A. Sundown Jr., is indicted on a count of DWI and aggravated DWI, driving with a BAC of .18 or greater and three counts of aggravated unlicensed operation. Sundown is accused of driving drunk on Lewiston Road, Oakfield, on April 7.

Paul Wapniewski is indicted on a count of burlgary, 3rd, criminal mischief, 2nd, and petit larceny. Wapniewski is accused of breaking into Delavan's Restaurant, 107 Evans St., Batavia, on May 6.

Jose A. Torres is indicted on two counts of criminal possession of a controlled substance, 3rd. Torres is accused of possessing cocaine on March 28 with the intent to sell it.

Charles L. Muntz is indicated on a felony count of DWI. Muntz is accused of driving drunk on Griffin Road, Alabama, on April 16.

Grand Jury Report: Man stopped in Stafford allegedly a scofflaw with 10 or more fails

The Genesee County Grand Jury issued these indictments today:

Shonnon J. Jefferson is indicted on one count of aggravated unlicensed operation of a motor vehicle in the first degree, a Class E felony. Jefferson was stopped on Feb. 3 on I-90 in the Town of Stafford while driving a 1995 Dodge and allegedly had a revoked or suspended driver's license. Further, Jefferson had in effect 10 or more suspensions imposed on at least 10 separate dates for failure to answer, appear or pay a fine. To wit, in the Town of Irondequoit, on July 29, 2009. And the City of Rochester on: March 16, March 20 in 2006; Jan. 24, Sept. 7 and Oct. 31 in 2007; March 13, May 19 and June 2 in 2008; Feb. 12, April 8 in 2009; and Jan. 19 this year.

Andrew L. Dailey is indicted on one count of DWI and one count of aggravated DWI for allegedly driving with BAC of .18. Both are Class E felonies. Dailey is accused of driving a 2010 Hyundai on Roanoke Road in the Town of Stafford on April 3 while intoxicated.

Grand Jury Report: Couple accused of growing pot without a license

The Genesee County Grand Jury today issued these indictments:

Robert E. Knoefler is indicted on one count of driving while intoxicated, a Class D felony, after he was stopped May 15 in Darien driving his 1995 Dodge pickup on Route 238. He is also charged with one count of aggrevated driving while intoxicated, a Class D felony, for having a BAC or .08 or greater. In addition, he is charged with aggrevated unlicensed operation in the first degree. (Knoefler's driving privileges had been revoked or suspended following his conviction in Attica Village Court for driving while intoxicated, a Class E felony, on May 9.)

Nicholas A. Pleace and Susan M. Fincher are indicted on a charge of criminal possession of marijuana in the second degree, a Class D felony. On Aug. 8, 2010, they are alleged to have knowingly and unlawfully possessed marijuana with an aggregate weight of more than 16 ozs. at 2622 Pratt Road in the Town of Batavia. They are also indicted on one count of growing cannabis by an unlicensed person, a Class A misdemeanor, and one count of criminal possession of a controlled substance in the 7th degree.

The Grand Jury issued a "No Bill" in the matter of Greg A. Thomas after considering the evidence about incidents in the City of Batavia on April 23. He was accused of unlawful imprisonment, 1st, menacing, 2nd, strangulation, 2nd, and coercion, 1st. The charges were dismissed.

Grand Jury Report: Batavia man accused of sexually abusing person under 11

Anthony P. Dioguardi is indicted on four counts of sexual abuse, 1st. Dioguardi is accused of using compulsion for sexual contact with a child less than 11 years old.

Myron W. Hartford is indicted on a charge of grand larceny, 2nd. Myron W. Hartford and Marline A. Hartford are indicted on charges of grand larceny, 4th, and three counts of offering a false instrument for filing, 1st. Myron Hartford is accused of stealing more than $50,000 from an individual. Both Myron Hartford and Marline Hartford are accused of stealing more than $1,000 from the Department of Social Services. Both are accused of filing false instruments with DSS.

Rebecca A. Chatley is indicted on charges of grand larceny, 4th, and criminal possession of stolen property, 4th. Chatley is accused of stealing a gift card for WalMart belonging to another person. 

Andrew J. Rock is indicted on two charges of burglary, 1st, and one count of menacing, 2nd. Rock is accused of entering a residence on Washington Avenue, Batavia, on May 15, and brandishing a long gun.

Carlos A. Torres Jr., is indicted on three counts of criminal possession of a controlled substance, 3rd. Torres is accused of possession on April 2 of more than a half-ounce of cocaine with the intent to sell it.

Thomas M. Pillo is indicted on charges of felony DWI and felony driving with a BAC of .18 or greater. Pillo was allegedly driving drunk March 11 in the City of Batavia.
