Grand Jury Report: Registered sex offender accused of sending explicit texts to teenage girl

Marlek E. Holmes is indicted on charges of failure to register change of address, failure to personally verify his address, disseminating indecent material to a minor, 1st degree, and endangering the welfare of a child. Holmes, a registered sex offender, is accused of not notifying authorities of his new address after relocating from 516 E. Main St., Batavia, on Feb. 19. Holmes is also accused of sending sexually explicit text messages to a 16-year-old girl in December 2010. 

Chester Dortch is indicted on a charge of aggravated unlicensed operation, 1st. Dortch is accused of driving on the Thruway in Batavia on Nov. 20 while knowing his license was suspended. Dortch reportedly had 10 prior suspensions for failure to answer and failure to pay fine.

Joshua Carney and Holly Carney are indicted on 11 counts of offering a false instrument for filing, 1st, and grand larceny, 3rd. The Carneys are accused of filing false statements related to Joshua's employment in order to receive food stamps and Medicaid. The Carneys are accused of stealing $7,453 in food stamp assistance and $6,564.14 in Medicaid.

Tonya M. Weber is indicted on a felony DWI charge and aggravated DWI, also a felony, for having a child under 15 in the car and endangering the welfare of a child. Weber is accused of driving drunk Nov. 29 in the Town of Oakfield.

Grand Jury Report: Batavia man indicted on charge of rape 1st

Patrick J. Donahue is indicted on a charge of rape in the first degree. Donahue is accused of engaging in sexual intercourse with another person by forcible compulsion on Jan. 10, 2010.

Frank J. Bieniek is indicted on charges of grand larceny, 3rd, and criminal possesion of stolen property, 3rd. Bieniek is accused of stealing a .45-caliber flintlock rifle from the Holland Land Office Museum on Dec. 10, 2010.

Jorge Portugal-Pineda is indicted on charges of felony DWI, felony driving with a BAC of .08 or greater and a felony of aggravated unlicensed operation. Portugal-Pineda is accused of driving drunk on Dec. 28, 2010 on Transit Road in the Town of Byron.

Grand Jury Report: Pair charged in alleged timber thefts

Donnie Hendrickson is indicted on charges of grand larceny, 4th, 23 counts of timber trespass, grand larceny, 3rd, and scheme to defraud, 1st. Hendrickson is accused of cutting and stealing timber from property in Le Roy between Jan. 9 and Feb. 14, 2010 with an estimated value in excess of $1,600. The timber trespass charges each stem from alleged removal of specific trees, including sugar maple, red oak trees and hickory trees. He is also accused of removing trees from property in Stafford, specifically swamp white oak and soft maple trees. He is also accused of cutting and removing timber from a property in Stafford with a value in excess of $18,000. He is also accused of fraudulently trying to acquire the trees.

David Isabell is indicted on charged of two counts of grand larceny, 4th, three counts of grand larceny, 3rd, issuing a bad check, 22 counts of timber trespass, petit larceny, theft of services and scheme to defraud, 1st. Isabell is accused of stealing timber from a property in Le Roy with a value in excess of $1,000. He's also accused of stealing $6,250 from a person in Bergen. He's also accused of stealing timber from a property in Le Roy with a value in excess of $3,000. He's accused of writing a bad check to a person in Le Roy with a value of $5,600. He's a accused of removing timber from a property in Stafford with a value in excess of $450. He's accused of removing timber from a property in Le Roy with a value in excess of $1,000 The alleged timber removed from these properties includes sugar maple, red oak, hickory and swamp white oak. The theft of services charge comes from an allegation that Isabell failed to pay for hotel rooms in Batavia. 

Randall W. McKeown is indicted on a felony charge of DWI, felony driving with a BAC of .08 or greater and aggravated unlicensed operation. McKeown is accused of driving drunk on Nov. 7 while in the Town of Batavia.

Grand Jury Report: Four people charged with DWI

Joanna M. Morgan is indicted on charges of DWI, driving with a BAC of .08 or greater, endangering the welfare of a child and a felony count of DWI (DWI with a child in the car, or "Leandra's Law"). Morgan is accused of driving drunk with a child under 15 in the car on Dec. 12 in the Town of Le Roy.

Ricky D. Newbould is indicted on charges of felony DWI and felony driving with a BAC of .18 or greater. Newbould is accused of driving drunk on Dec. 18 while in the Town of Elba.

Tamara L. Butler is indicted on charges of  DWI, driving with a BAC of .18 or greater and aggravated unlicensed operation, 1st. Butler is accused of driving drunk on Aug. 7 in the Town of Oakfield.

Charles W. Wilder is indicted on charges of felony DWI and felony driving with a BAC of .18 or greater. Wilder is accused of driving drunk on Oct. 24 in the Town of Oakfield.

Grand Jury Report: Woman faces 25 counts for using stolen gift cards

The following indictments were issued by the Genesee County Grand Jury:

Deanna Leach is indicted on 25 counts. Of those, 19 are for forgery, 2nd, a class D felony. Five are for petit larceny, a misdemeanor. And one is for falsifying business records, 1st, a class E felony.

She is accused of illegally using gift/debit cards valued at $50 each at a store in the Village of Le Roy on or about Jan. 6, 15, 21, 26 and on about Feb. 7 and 21, all in 2010.

As for the petit larcenies, she is accused of stealing gift/debit cards from the same store on multiple occasions.

Lastly, she is accused of falsifying business records at the same store by not making "a true entry in the business record" that a gift/debit card had been activated.

David W. Wells is indicted on two counts, both class E felonies. He is accused of driving his Chevy Silverado while intoxicated on or about Sept. 17 on Byron Holley Road in the Town of Byron. He is also accused of aggrevated driving while intoxicated, with a BAC of .18. He was convicted of DWI in August in the Town Court of Bergen.

John T. Reagan is indicted on one count of driving while intoxicated, a class E felony. He is accused of driving his Audi while intoxicated on or about Aug. 27 on Sumner Road in the Town of Darien.

James Kosiorek is indicted for assault, 2nd, a class D felony, stemming from an incident on or about Oct. 13 in the Village of Le Roy. He is accused of intending to cause serious physical injury to another person and then causing serious injury to that person by means of a dangerous instrument (which in this case was his sneakers).

Peter S. Brigzna is indicted for driving while intoxicated, a class E felony. He is accused of driving his Ford Tempo on Bank Street Road in the Town of Byron while intoxicated on or about Nov. 12.

Grand Jury Report: Man accused of trying to steal drugs

Adam R. Kopp is indicted on charges of burglary, 2nd, criminal possession of a controlled substance, 5th, and petit larceny. Kopp is accused of entering a residence on Bloomingdale Road, Alabama, on Jan. 12, with the intent of committing crimes once inside. On that date, he is accused of possessing hydrocodone and acetaminophen. He is accused of stealing on that date hydrocodone and acetaminophen tablets.

Shawn R. Hugar is indicted on charges of DWI as a misdemeanor, driving with a BAC of .08 or greater and aggravated DWI ("Leandra's Law"). Hugar is accused of driving drunk on Aug. 23 in the Town of Darien while a child less than 15 years old was in the vehicle.

Lynn A. Hertweck is indicted on charges of DWI as a felony and driving with a BAC of .18 or greater as a felony. Hertweck is accused of driving drunk on Oct. 3 on Route 19, Town of Bergen.

Grand Jury Report: A DWI indictment

Chelsie R. Dibble is indicted on a felony charge of DWI and a felony charge of driving with a BAC of .18 or greater. Dibble is accused of driving drunk Sept. 19 on Hopkins Road.

No other grand jury indictments were released this week.

Grand Jury Report: Level 3 sex offender indicted on new charges

Ronald A. Smith is indicted on charges of failure to register change of address and three counts of sexual abuse, 1st. Smith is a convicted sex offender and registered at an address on Thorpe Street and on or about Oct. 31 allegedly failed to registered a change of address. Count two of the indictment accuses Smith of holding a victim less than 11 years old in his arms and subjecting the victim to sexual contact at the Thorpe Street address some time between Oct. 28 and Jan. 7. Counts three and four are similar. (Previous Report)

Jacob C. Gerevics is indicted on a charge of criminal possession of marijuana. On Oct. 19, at 446 Broadway Road, #5, Darien, Gerevics was allegedly found in possession of more than 16 ounces of "one or more preparations, compounds, mixtures or substances containing marijuana."

William A. Andrews is indicted on a charge of criminal contempt, 1st. On Dec. 9, in violation of an order of protection, Andrews is accused of stating to a protected party "I'll make you a bloody mess!" and "I'll stab you and burn you all!"

Grand Jury Report: Woman indicted on three assault charges for shooting

Jolene J. Goodell is indicted on a charge of forgery, 2nd. She is accused of altering a prescription for Vicodin in the Town of Le Roy on Sept. 18.

Ryan J. Pittinaro is indicted on three charges relating to an incident in the Town of Alexander on Aug. 14. The first is a misdemeanor charge of DWI. He is accused of driving his 2001 Acura while intoxicated. The second charge is a misdemeanor for having a BAC of .08 or greater. The third charge is aggravated unlicensed operation in the first degree.

Patricia Hardesty is indicted on three assault charges relating to a shooting incident in the Town of Darien on Aug. 1. The first is assault in the first degree for allegedly shooting Robert Hardesty Jr. in the leg with a .22 rifle. She is also indicted on two charges of assault in the second degree for allegedly "recklessly causing serious physical injury to another person by means of a deadly weapon or dangerous instrument" and intending to do so.

Jennifer M. Riggi is indicted on a charge of Grand Larceny, 3rd. Riggi is accused of stealing $6,227.74 between April 15 and Aug. 10 from a location in the Town of Le Roy. (Initial Report)

Kevin A. Hutzler is indicted on charges of DWI and driving with a BAC of .08 or greater. Hutzler is accused of driving drunk Sept. 3 on Colby Road, Darien.

Bernard A. Buckenmeyer Jr., is indicted on charges of DWI and driving with a BAC of .08 or greater. Buckenmeyer is accused of driving drunk Sept. 5 on Hunn Road, Alexander.

Grand Jury Report: Man accused of having drugs for sale at College Village

We only recently received the October indictments from the Genesee County Grand Jury:

Charles J. Porreca is charged with unlawful possession of marijuana, criminal possession of a controlled substance, 5th, criminal possession of marijuana, 4th, and criminal possession of a controlled substance, 7th. On May 6, Porreca is accused of possessing marijuana while in a vehicle at 8123 Prole Road Extension. On the same date, he is accused of possessing psilocin and psilocybin contained in mushrooms with the intent to sell in a room at College Village. At the same address, he is accused of possessing more than two ounces of marijuana along with hydrocodone.

Robert Thigpen III, is charged with burglary, 1st, menacing, 2nd, and criminal mischief, 4th. Thigpen is accused of entering and remaining unlawfully in a dwelling at 111 State St., Apt. 3, Batavia, on Aug. 30, with intent to commit a crime. Allegedly, Thigpen used a knife to threaten another person. He is also accused of damaging a lock.

Amy L. Brown is charged with grand larceny, 3rd, and eight counts of offering a false instrument for filing, 1st. Brown is accused of stealing from the Department of Labor from Sept. 21 through Nov. 16, 2008. She is accused of filing false records with the Department of Labor.

Robert J. Van Pelt is charged with vehicular assault, 1st, DWI and aggravated DWI. Van Pelt is accused of driving a motor vehicle on May 2, Sandhill Road, Town of Alabama, and causing another person to be injured. His BAC was allegedly above .18.

Christopher J. Matusak is charged with DWI as a felony, aggravated DWI, three counts of criminal mischief, 3rd, and three counts of reckless endangerment, 2nd. Matusak is accused of driving drunk on May 31 with a BAC of .18 or greater, and in Town of Le Roy damaging the property of another person. The property is described as a 2007 Hyundai, a 1998 Lincoln and a 1996 Cadillac. He is accused of intentionally striking the Cadillac, which allegedly had three passengers at the time.

Shannon V. Albano is charged with a felony count of DWI and driving with a BAC of .08 or greater. Albano is accused of driving drunk on April 19 in the Town of Darien.

Autumn M. Connolly is charged with grand larceny third. Connolly is accused of stealing about $4,200 from a family member between March 27 and April 13.

Grand Jury Report: Two burglary charges filed

The following indictments were filed last week by the Genesee County Grand Jury.

Nicholas S. Dellarocco is indicted on charges of burglary, 3rd, criminal mischief, 4th, and petit larceny. Dellarocco is accused of entering a business at 3 West Ave., Le Roy, on May 3 with the intention to commit a crime. He allegedly damaged doors and a cash register in the building. He also allegedly stole cash from the business.

Alan J. Delano is indicted on charges of burglary, 2nd, petit larceny, and three counts of criminal possession of stolen property, 4th. Delano is accused of entering a residence at 61 Myrtle St., Le Roy, with the intent to commit a crime. He is accused of stealing a flat-screen TV and a vase along with $30 cash on March 13. He is accused of possessing a credit card, a debit card and a public benefits card belonging to another person.

Crystal L. Goodrich indicted on charges of felony DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation of a vehicle. Goodrich is accused of driving a 2003 GMC on a public road in Pavilion on May 3 while intoxicated.

Grand Jury Report: Man accused of raping girl in Batavia

Philip E. Kroft Jr., is indicted on ten counts of rape, 2nd. Kroft is accused of being 18 years of age or older and engaging in sexual intercourse with a person 15-years-old or younger. The alleged encounters occurred between Sept. 29 and Nov. 10, 2008, in the City of Batavia.

Kenneth R. MacGregor is indicted on three counts of criminal possession of a forged instrument, 2nd, and one count of aggravated unlicensed operation of a vehicle. MacGregor is accused of writing a forged check on June 4 in the Village of Corfu for $482.12, and on June 7 for $477.18 and on June 7 for $892.43. He is also accused of driving a car with his privileges suspended on June 7 in the IGA parking lot, Village of Corfu.

Javonie E. McKinney is indicted on one count of DWI and one count of aggravated unlicensed operation of a vehicle. McKinney is accused of operating a 2009 Kia on Bank Street, Batavia, on April 17 while intoxicated.

Grand Jury Report: DWI charge and a 'no bill' on a burglary charge

Andrew S. Novak is indicted on a felony count of DWI and a felony count of driving with a BAC of .08 or greater. Novak is accused of driving drunk on March 14 on Linwood Road in the Town of Le Roy.

Ronald Carney received a "no bill" from the Grand Jury on charges of burglary, 2nd, and criminal trespass, 2nd. The charged stemmed from an incident in Le Roy on Jan. 23. A "no bill" means the Grand Jury found insufficient evidence to sustain the charges.

Grand Jury Report: Woman accused of stealing from bank in Batavia

Michelle A. Parker is indicted on four counts, including grand larceny, 3rd, petit larceny, grand larceny, 4th and perjury,1st. Parker is accused of stealing in November 2006 from a bank branch in Batavia and making a false statement related to the case. The amount of the alleged thefts exceed $4,000.

Gerardo Pineda-Sanchez is indicted on a count of assault, 2nd, a Class D felony. Sanchez is accused of stabbing a victim with a knife April 28 in Elba.

Theodore R. Cooper is indicted on one count of grand larceny, 3rd, a Class D felony. Cooper is accused of stealing property valued in excess of $3,000 sometime between Dec. 30 and Feb. 3 from a Batavia resident.

Scott Stine (aka Scott Campbell) is indicted on a count of DWI. Stine is accused of operating a motor vehicle while intoxicated on Lovers Lane Road, Batavia, on May 1.

Ami L. Blackmore is indicated on three counts related to driving while intoxicated. Blackmore is charged with DWI, driving with a BAC of .08 or greater and driving with a BAC of .18 or greater. Blackmore is accused of driving a car while intoxicated on Bloomingdale Road, Alabama, on Jan. 22.

Jamie R. Montgomery is indicted on two misdemeanor counts and one felony count related to an alleged DWI. Montgomery is charged with a misdemeanor count of DWI and a misdemeanour count of driving with a BAC of .08 or greater. She is charged with a Class E felony of aggravated unlicensed operation. Montgomery is accused of driving intoxicated on Route 5 in Stafford on March 17.

Grand Jury Report: Bank teller indicted on grand larceny, other charges

Tracy L. Smith, is charged with 12 counts resulting from an alleged scheme to steal money from the Bank of Castile in Le Roy.

The counts:

  • Grand larceny, 3rd, for allegedly stealing $20,000 from a Brinks delivery some time between Sept. 13, 2005 and June 12, 2008.
  • Forgery, 2nd, for allegedly altering a savings withdrawal slip of a bank customer on Nov. 16, 2009.
  • Grand larceny, 3rd, for allegedly stealing $7,000 from the same bank customer.
  • Forgery, 2nd, for allegedly altering a check written by a bank customer on Nov. 19, 2009.
  • Grand larceny, 4th, for allegedly stealing $3,000 from the same bank customer.
  • Forgery, 2nd, for allegedly altering a check written by a bank customer on Nov. 19.
  • Forgery, 2nd, for allegedly altering a deposit slip written by the same bank customer on Nov. 19.
  • Falsifying business records, 1st, for allegedly making a false entry in the daily night deposit log on Nov. 30, 2009.
  • Grand larceny, 3rd, for allegedly stealing $10,000 on Dec. 16, 2009.
  • Falsifying business records, 1st, for allegedly using a bank instrument illegally on Dec. 16, 2009 to withdraw $10,000.
  • Falsifying business records, 1st, for allegedly making a false vault inventory log on Dec. 16, 2009.
  • Grand larceny, 3rd, for allegedly stealing $5,000 some time between Sept. 14 and Dec. 22, 2009.

Stuart P. Newbould, is indicated on a felony count of DWI and with  a felony count of driving with a BAC of .08 or greater. Newbould is accused of driving drunk on Jan. 8, 2010, on South Holley Road, Byron.

Darryl J. Lippert is indicated on felony count of DWI and a felony count of driving with a BAC. of .08 or greater. Lippert is accused of driving drunk on Jan. 2, 2010 on Route 20 in Alexander.

Grand Jury Report: Three counts of burglary brought against Le Roy man

Bryan M. Hargrave is indicted on three counts of burglary, 3rd, criminal mischief and petit larceny.

Hargrave is accused of the following crimes:

  • On Sept. 23, breaking into Pavilion Drainage, 6630 Route 63, Pavilion, and stealing $60.
  • On Sept. 23, breaking into B.W.'s Bar, 11070 Perry Road, Pavilion, and stealing an iPod, laptop computer and money.
  • On Sept. 23, breaking into the Willow Bend Inn, 3489 W. Main Street Road, Batavia, and stealing $75 and two bottles of liquor.

Carl Rivers is indicted on one count of grand larceny, 3rd. Rivers is accused of stealing a 2000 Chevrolet Silverado on March 19, 2009, in Oakfield.

Grand Jury Report: Woman accused of stealing more than $3,000 from Tonawanda

Jessica L. Culver (a.k.a Jessica L. Langmaid) has been indicted on a charge of grand larceny, 3rd. Culver is accused of stealing property between Oct. 29, 2008 and March 17, 2009 from Tonawanda Valley Federal Credit Union with a value in excess of $3,000.

Amanda J. Richardson is indicted on two counts for falsifying business records, 1st, and two counts of petit larceny. Richardson is accused of falsifying a money order record and of stealing $54 from the Mother Goose store in Elba on July 14. She's also accused of falsifying a deposit envelope and stealing $100 on July 24.

Grand Jury Report: Man indicted for allegedly stealing car from Tonawanda reservation

The following indictments have been handed down by a Genesee County Grand Jury:

Jeffery M. Wisinski, 38, of 7484 Lake St., Vienna, seven counts: Burglary, 2nd; petit larceny; burglary, 3rd; grand larceny 3rd; criminal mischief, 2nd; criminal mischief, 3rd; and, grand larceny, 4th. Wisinski is accused of breaking into a garage at 510 Bloomingdale Road, Alabama, on or about Sept. 10 or 11 and stealing a 2007 Dodge Charger and a credit card. Jason John Reed, 33, of 33 Sunset Parkway, Oakfield, four counts: driving while intoxicated as a class E felony; driving while intoxicated with a BAC of .08 or greater; aggravated unlicensed operation; and endangering the welfare of a child. Grand Jury Report: Indictment in Days Inn drug case

The Grand Jury has issued a two-count indictment against Lekisha M. Avant. Avant is charged with criminal possession of a controlled substance 3rd and criminal possession of a controlled substance 4th. The indictment alleges that on Feb. 8, 2005, Avant, while at the Days Inn, 200 Oak St., Batavia, did knowingly and unlawfully possess a narcotic drug, cocaine, with the intent to sell it. The indictment further alleges that on Dec. 29, 2009, Avant was again at the Days Inn and knowingly and unlawfully in possession one or more preparations, compounds, mixtures or substances containing a narcotic drug (cocaine) having an aggregate weight of one-eighth an ounce or more. The Grand Jury also issued a two-count indictment against Charles Brown. Brown is charged with aggravated unlicensed operation 1st and aggravated unlicensed operation 2nd. The indictment accuses Brown of driving on Aug. 20, 2009, on the Thruway through Le Roy when he knew, or had reason to know that his license was suspended. Brown allegedly was operating with 10 or more suspensions imposed on at least 10 separate dates. The alleged suspensions date back to Feb. 6, 2003.
