Governor Kathy Hochul and U.S. Senate Majority Leader Charles Schumer today announced the start of construction on the first phase of the $319 million Edwards Vacuum dry pump manufacturing facility, located in the Genesee County town of Alabama. 

The British-based global leader in vacuum and abatement equipment for the semiconductor industry, part of the Atlas Copco Group, chose the Western New York Science & Technology Advanced Manufacturing Park in Genesee County as the location for its new U.S. dry pump manufacturing facility. 

The technology produced at the new facility is a vital component to controlling the highly sensitive environment of semiconductor manufacturing processes. Edwards Vacuum's decision to invest in New York State followed the passage of the federal CHIPS and Science Act, New York’s Green CHIPS legislation, and the domestic semiconductor industry growth the complementary programs have spurred, including Micron's unprecedented $100 billion commitment to Central New York, which is expected to create nearly 50,000 jobs.

Construction on the $127 million first phase of Edwards Vacuum's 240,000 square-foot campus will include manufacturing, warehouse, and administration facilities, with a capacity to produce 10,000 dry pumps per year. The all-electric facility will strive for LEED certification, with a majority of the power generated via hydroelectricity.

Edwards’ commitment to build in the U.S. comes after significant investments by the Biden Administration to increase domestic chip manufacturing, and the passage of the federal CHIPS and Science Act and New York’s Green CHIPS legislation, as well as a growing need to support its customers in North America. Edwards dry pumps are currently manufactured in Asia. By bringing manufacturing to New York, Edwards customers – including Micron and GlobalFoundries in New York, and Intel in Ohio – will experience shorter wait times, improved responsiveness and reduced CO2 emissions from an American-made product. Edwards estimates that when phase one is operational, it will reduce CO2 emissions by 13,000 tons per year.

Empire State Development has awarded Edwards Vacuum up to $21 million through a combination of performance-based Excelsior Jobs Tax Credits and Investment Tax Credits in exchange for 600 jobs, and an additional $1 million to support workforce development efforts and the training of a diverse and inclusive workforce. Additionally, the New York Power Authority is supporting the project though a 4.9-megawatt (MW) low-cost Niagara hydropower allocation and a 2.1 MW of High Load Factor power allocation that NYPA will procure for Edwards on the energy market. Low-cost Niagara hydropower is available for companies within a 30-mile radius of the Power Authority's Niagara Power Project or businesses in Chautauqua County.

The industry directly employs over 277,000 people in the U.S. and supports more than 1.8 million additional domestic jobs. Semiconductors are a top five U.S. export, and the industry is the number one contributor to labor productivity, supporting improvements to the effectiveness and efficiency of virtually every economic sector — from farming to manufacturing.

Governor Hochul has taken significant action to ensure that New York plays a vital role in the reshoring of the semiconductor industry including New York's nation-leading Green CHIPS program that is attracting top semiconductor manufacturing businesses to the state and securing commitments to good-paying jobs, sustainability, and community benefits. Additionally, Governor Hochul created the $200 FAST NY program in 2022 to support the preparation and development of sites across the state. This program was designed to jumpstart New York's shovel-readiness and increase its attractiveness to large employers, such as semiconductors and clean tech and high-tech manufacturing companies. Since the program’s inception, ESD has awarded $175 million to 20 sites across every upstate region, including the Science & Technology Advanced Manufacturing Park (STAMP), to develop more than 2,500 acres. Governor Hochul also created the Governor’s Office of Semiconductor Expansion, Management, and Integration (GO-SEMI), which leads statewide efforts to develop the chipmaking sector.

In the FY 2025 Enacted Budget, Governor Hochul doubled down on her commitment to establish New York as a global hub for semiconductor research and manufacturing, including:

$100 million in funding for additional rounds of the FAST NY program.

$500 million for NY CREATES’ Albany Nanotech Complex – with a total State investment of $1 billion – to jumpstart a $10 billion partnership that will bring the future of advanced semiconductor research to New York’s Capital Region by creating the nation’s first and only publicly owned High NA EUV Lithography Center.

$200 million to establish One Network for Regional Advanced Manufacturing Partnerships (ON-RAMP) – a network of four new workforce development centers to prepare New Yorkers for the jobs of the future created by companies like Micron and Edwards Vacuum.

The bipartisan CHIPS and Science Act creates an Investment Tax Credit for semiconductor manufacturing facilities and supply chain partners such as Edwards Vacuum as well as a first-of-its-kind $52 billion in federal incentives, which Edwards is pursuing, to spur American semiconductor research, development, manufacturing, and workforce training to bring good-paying jobs back from overseas, strengthen national security, and reestablish America's technological leadership. The bill requires recipients of these incentives to make significant worker and community investments that support broad-based economic growth.

Once, when she was lieutenant governor, Kathy Hochul was dispatched to Genesee Community College to deliver then Gov. Andrew Hochul's message to local leaders on that year's state budget.

Now as governor, Hochul has assigned state department heads to deliver the budget message in Genesee County.

On Tuesday, state Department of Labor Commissioner Roberta Reardon told a couple of dozen people attending the briefing that the governor's proposed 2024-25 state budget will not add a fiscal burden to New Yorkers, and that the budget is balanced while increasing spending on fighting crime, ensuring New York's economic competitiveness, fixing broken infrastructure, fighting climate change, supporting education, addressing the migrant crisis, making advancements on housing, and improving access to mental health care.

Assemblyman Steve Hawley (R, C - Batavia) recently criticized Gov. Hochul’s proposed cuts to local roads and bridges in her 2024-25 Executive Budget proposal. 

Hawley is joined by his Republican colleagues in the Senate and Assembly in his opposition to Hochul’s proposed $60 million cut for the Consolidated Highway Improvement Program (CHIPS), the state’s main source of funding for repair and maintenance of local roads, bridges, and culverts. 

For local communities, taxpayers, and motorists, CHIPS is essential to maintaining safe road conditions and using tax dollars as efficiently as possible. The group also criticized Hochul for failing to be fair and partial in her priorities for upstate and downstate infrastructure. 

Hawley and his colleagues are calling on the governor to restore the $60 million cut to CHIPS base aid and increase the CHIPS base funding level by $200 million to a total of $798.1 million.

Since 2013, Assemblyman Hawley has worked closely with local transportation advocates on the “Local Roads Are Essential” advocacy campaign. The campaign is sponsored by the New York State County Highway Superintendents Association (NYSCHSA) and the New York State Association of Town Superintendents of Highways, Inc. (NYSAOTSOH) and brings hundreds of advocates to Albany each year to support local infrastructure. Hawley will also be meeting with local County, Town and Village Highway Superintendents on Friday, Feb 23rd to discuss these proposed cuts. Hawley hopes this initiative will bring meaningful change and provide much-needed funding for local roads and bridges.

“The proposed cuts to funding for local roads and bridges shows a complete lack of understanding of basic economics,” said Hawley. “While the price to pave, maintain and upkeep infrastructure is rising, localities are not given the funding they need year after year. The Majority’s politically driven spending is now burdening upstate communities with less aid for schools and now unreasonable cuts for their roads and bridges all to make an impossible attempt to balance an already bloated budget. Prosperity for New Yorkers begins at the local level. If the governor wants to reverse the trend of record-high outmigration, that starts with taking care of local infrastructure instead of turning a blind eye to the needs of upstate communities.”

Congresswoman Claudia Tenney (NY-24) today joined Congressman Marc Molinaro (NY-19) and New York’s Republican Congressional Delegation in introducing a Congressional Resolution condemning New York Governor Kathy Hochul for defunding schools across New York State and prioritizing increased funding for migrants.

The Governor’s budget reduces funding for hundreds of schools across New York State while providing $2.4 billion to provide undocumented immigrants with legal assistance, housing, transportation, healthcare, and jobs. If Governor Hochul’s cuts to schools go through, schools could be forced to make up the difference by shuttering special education and disability services, cutting mental health resources, and more.

"Once again, Governor Kathy Hochul and Albany Democrats are putting illegal migrants and their progressive agenda ahead of New York’s children," said Congresswoman Tenney. "Hochul's misguided decision to cut critical funding from taxpayer-funded schools threatens students' learning, especially as they continue to recover from COVID-related learning loss and their access to valuable disability services and mental health resources. Assemblyman Steve Hawley (R,C-Batavia) attended a press conference yesterday to address the governor’s decision not to “Hold Harmless” school district regarding foundation aid in the state budget. 

Gov. Hochul released her state budget proposal early last week and did not keep her promise to local school districts that they would not see a decrease in their foundation aid funding from the previous year. 

This comes as the state has put more regulations on school districts such as last year’s mandate requiring all school buses to be electric by 2035. Hawley is frustrated that upstate rural and suburban school districts will not receive the funding they need.

“Gov. Hochul is at it again,” said Hawley. “It’s ridiculous our schools should have to take a back seat while the governor continues to hinder them with less funding and more regulations. The governor should remember her promise to ensure foundation aid for local school districts would not decrease and give them the resources they need. I cannot and will not vote for any state budget that does not put the education of our children first.”

“Anyone hoping that Governor Hochul’s State of the State message would chart a bold plan for turning around New York State’s affordability and public safety crises has been left disappointed in today’s address.

The worst-in-the-nation outmigration of our residents is a problem that threatens our future. It requires more than new affordable housing units, as the governor suggests. New York State’s combined state and local tax rates are the highest in the nation. Numerous polls have found that this crushing tax burden is the primary reason people are leaving New York. We heard no plans to tackle that issue.

New Yorkers also cite declining public safety as their other top concern. While the governor praised a recent decrease in gun violence, the truth is that crime rates are still significantly higher now than they were before the reckless bail changes took effect. In New York City alone, index crimes are a staggering 33 percent higher now than in 2019. Proposals to combat retail theft, domestic violence and hate crimes are a step forward, but the leftists in the legislature will fight these proposals. Tough talk won’t be enough. She will need to muster the political will to fight and win these battles.

New York’s business community was overlooked in this address. Rather than investing precious resources trying to market our state as an A.I. hub, we should be taking steps to support and boost our longstanding employers in the manufacturing and agriculture sectors who have been hurt by careless mandates and heavy taxes. Small businesses are still struggling under the weight of the unemployment insurance debt that the state unfairly placed on them. These New York State born-and-bred businesses were ignored.

The most glaring omission was any plan for dealing with Democrats’ self-created migrant crisis, which is draining billions of taxpayer dollars and shows no signs of slowing down. Simply throwing more money at this problem isn’t an answer.

The mental health priorities the governor outlined are initiatives that I support. Expanding both inpatient and outpatient treatment are sorely needed changes. However, again, she will need to be willing to go to the mat with the legislature for key items in this agenda, particularly stronger inpatient treatment.

I look forward to receiving more details on these proposals in the Executive Budget. Governor Hochul was right when she said ‘We all want our state to succeed.’ However, to get there will take more than talk, it will take political courage.”

Senator George Borrello and 14 of his Republican colleagues in the Senate have sent a letter to Governor Hochul requesting that she rescind the electric bus mandate for public schools or commit to fully funding the conversion.

The electric bus mandates were passed in the 2022-23 state budget to help the state meet the lower emissions targets of the Climate Leadership and Community Protection Act (CLCPA). The requirements are that new school bus purchases be zero emission by 2027 and all school buses in operation be zero emission by 2035.

“School officials in my district are all sounding the alarm about the state’s unfunded electric bus mandate and the crushing financial costs it will mean for districts. With the first deadline in just three short years, school officials are deeply concerned about their ability to afford the electric buses and infrastructure upgrades that will be necessary,” said Sen. Borrello.

A new, full-size electric bus costs $400,000 - $450,000 - triple the price of a conventional bus which is approximately $130,000. With 45,000 school buses in the state, full conversion by 2035 will cost approximately $20 billion. The cost over and above what school districts already pay for replacement buses is projected to cost between $8 billion and $15 billion statewide.

“While $100 million in grant funding for electric buses was just announced, that amount will cover 250 buses. With over 800 school districts in the state, that isn’t even one bus per district. Even the remaining $400 million that will be allocated in future rounds won’t make a dent in the costs of converting school bus fleets statewide,” Sen. Borrello added.

“Local property taxpayers must not be hit with the bill for this politically driven mandate. New York’s property taxes are already among the highest in the nation and are a key factor in our outmigration of residents. If the governor and legislative leaders won’t take the common-sense step of eliminating the mandate, they must commit to fully funding this transition,” said Sen. Borrello.

He explained that school officials are also raising concerns over logistical considerations that aren’t accounted for in the electric bus requirement.

“It is well known that frigid temperatures have a significant impact on traveling range, which could affect school transportation in the coldest parts of the state. There is no flexibility for rural schools in this situation. Similarly, there are bridges in rural communities which are not rated to handle the increased weight of electric buses,” said Senator Borrello.

“Just like the state’s entire climate agenda, the electric bus initiative has been long on virtue signaling but short on crucial details, none more glaring than how schools are expected to pay for this exorbitantly expensive transition.”

“Governing by edict, without gathering input from those on the ground who must implement these plans, is a recipe for disaster,” Sen. Borrello added. “It is time to course correct by either lifting the mandates or committing the funding. The ‘magical thinking’ that has characterized this entire climate agenda is going to bankrupt our state unless state leaders face reality and adjust their unworkable policies.”

“I am disappointed that a longstanding news service like the Associated Press (AP) has abandoned its responsibility to accurate and unbiased reporting as evidenced by today’s article, “New York Gov. Kathy Hochul is not trying to create ‘quarantine camps.’

Their so-called ‘fact check’ of the basis for Borrello et. al. v. Hochul is nothing but a political cover for the administration’s blatant separation of powers violation, a breach which was confirmed in a State Supreme Court decision in July 2022.

While the term ‘quarantine camp’ isn’t used in Rule 2.13 per se, the language in the regulation is very clear when it says the Commissioner of Health or local health department can issue an isolation or quarantine order, at whim, without proof of infection, and can force someone to remain in their home, or send them to ‘other residential or temporary housing… or other locations as the public health authority issuing the order deems appropriate.’ 

Call it whatever you like – quarantine camp, detention facility, field hospital, etc. – the bottom line is that Rule 2.13 authorizes the government to take such an action, which would be a gross abuse of due process and New Yorkers’ civil rights.

The article incorrectly states that the rule only clarifies powers the state already has. As Judge Ronald Ploetz cited, the rule, as written, ‘actually contravenes the [isolation and quarantine] procedures set forth in PHL 2120’ which was established by the New York State Legislature in 1953. The governor and the Department of Health cannot unilaterally change that law. Only the legislature possesses that power.

During the pandemic we saw governments around the world, and our own, overreach in ways we never could have imagined prior to March 2020. Those actions set a terrible precedent that will require us to remain constantly vigilant against constitutional abuses. That was the premise at the core of this court challenge. By focusing on sensational semantics, the AP’s article did a disservice to their readers and missed an opportunity to educate New Yorkers about what is at stake in this case.”
