Hawley to pistol owners: 'Preserve the Second Amendment by keeping your pistol certified'

In his ongoing efforts to preserve our Second Amendment rights, Assemblyman Steve Hawley (R,C,I-Batavia) today reminded pistol permit holders to recertify their permits by Jan. 31 in order to prevent them from becoming invalid.

If your pistol permit was issued before Jan.15, 2013, you must recertify your permit before Jan. 31. If your permit was issued on or prior Jan. 15, 2013, the deadline is five years after the date the permit was issued.

“Unfortunately, this is a new mandate on pistol permit holders in New York and the first year that owners have to recertify,” Hawley said. “The deadline is coming up and many New Yorkers may be unaware of these new requirements.

"As much as we may disagree with the unconstitutional Safe Act, if we come out in droves to recertify it will send the message to state leadership that we cherish our Second Amendment right to bear arms, and will not be silenced by any big government policies, as frustrating as they might seem.”

How about this IDEA--> MOVE Out of NY Like I did to a FREE state ! [WV] where we do NOT need Permits and your guns are never listed on Any government Permission papers ! NO GUN Bans -NO Magazine Limits ,,Open Carry And ,,CCW Carry No Permission needed and Low crime rates !!! Your Vote has No Voice in NY you are Out Numbered !! We Live in FREEDOM !!

Yes we have Drugs--Every state does ! Batavia is infested with drugs -just read the Stories here in the Batavian . That said we have a wonderful life here ,,and I encourage all gun owners to seek living places outside the new England Gun control states ,, Its truly a wonderful feeling when you taste Freedom ,,, Kinda Like a Person who escapes from communist countries and lands in FREE USA !!! they kiss the flag ! Oh yea is 40 degrees and sunshine - NO salt on the roads rotting my truck -Hows the snow melting up there !? [he smiles ]

All you fun totin, law abiding citizens just follow the law and register your handguns as the law calls for?
Seems pretty simple to me.

I strongly disagree with the New York Safe Act. I’m a Life NRA Member and a member of Scope. Recertify now. Don’t wait until the last minute to flood the system as a protest. That may backfire. If you fail to recertify, your handguns will be confiscated. Your rifles and shotguns will be confiscated. Good luck getting them back. Due process will come after the fact assuming you can afford the court costs.

The forms are clear and straightforward. I suggest you send them Certified Mail-Return Receipt. You can track Certified Mail on the internet.

There is a line at the top of the recertification form requiring your New York State Drivers License ID Number. Unlike the banned rifles, where the State has no database, the County of Issuance has all our information. Subtract the people who recertified, and you have the Pistol Permit Holders who haven’t.
I surmise the County will first send you a letter to voluntarily surrender your Permit and handguns to the Sheriff. You’ll need a good attorney. SCOPE and the NRA can help you with attorneys who specialize.

If you reach that point and choose to comply(too late), you may still surrender them to a Gun Shop, FFL holder, assuming he or she will take them. The FFL holder can legally put them on consignment for sale. You will incur more criminal charges for not registering the banned rifles should they discover you have them.

Randy, I have to disagree with you. I think New York is a much better place to call home than West Virginia.

West Virgina ranks 49th in life expectancy, only behind Mississippi. You can expect to live 75.4 years if you are white in West Virgina, while in NY, the same person could expect to make it to 80.5, which happens to be the 6th best in the country. (Wikipedia).

West Virginia currently ranks 3rd as the state with the highest level of obesity. It has an obesity rate of 34.1%. Only Louisiana (34.35) and Mississippi(35.3%) are fatter. Meanwhile NY is nowhere near the top.

As Tom mentioned, let's look at the drug overdose rate. West Virginia leads the nation by far in this category. In 2015 (even before the opiate crisis kicked in full swing) the overdose rate was 41.5 deaths per 100,000 people. Meanwhile New York was only beat by Virginia and Georgia in this category. New York's overdose rate iwas 13.6 per 100,000 people. West Virginia is more than 3 times higher in this area! (USA Today)

Finally, let's take a look at deaths at the hands of guns. In 2015 there were 849 gun deaths which is a rate of 4.2. This is only behind Hawaii (3.6) and Massachusetts (3.0). Meanwhile, your beloved West Virgina had a rate of 14 which put it solidly near the most dangerous place to live.(CDC)

So West Virgina really doesn't seem all that great to me. I could go on and on about the environment and lack of infrastructure and so on but you probabkly would not agree.

The bottom line is, New York is a pretty decent place to live, and by almost every measure it beats West Virginia.
