Batavia man tells police he was shot while walking on Indian Falls Road

By Howard B. Owens

A 35-year-old Batavia man reported being shot and his wallet stolen as he walked down what he thinks was Indian Falls Road about 5:30 p.m., Saturday.

After being shot and robbed, Carlos Torres called a friend for assistance, who drove him to UMMC. He was transferred from UMMC to Strong Memorial Hospital by Mercy Flight, according to the Sheriff's Office.

He was in surgery at the time the Sheriff's Office released information on the incident at 11:23 p.m., Saturday.

Torres told officials, according to the release, that he believes he was walking on Indian Falls Road when a car pulled up behind him and somebody demanded his wallet. He was then shot in the back and his wallet was taken.

After the suspects left, he continued walking to Route 5, where he called a friend for help.

The Sheriff's Office says Torres was shot twice with a small caliber weapon. His injuries are not believed to be life threatening.

Anyone with information is asked to call the Sheriff's Office at 345-3000.

I'm a little surprised this post hasn't drawn a comment yet.

Not necessity to call into question the veracity of the guy's story, but the first question that popped into my mind was: Why not call 9-1-1?

You're shot and robbed ... but rather than call 9-1-1, you walk up the road a bit more. Now you use your phone. But you don't call 9-1-1. You phone a friend.

This isn't "Who Wants to be a Millionaire."

I thought somebody might have he same question.

perhaps the basis of the robbery was over something he didn't want the police involved in? or maybe he just has a general disdain for police? there is a strong anti - police and/or govt distrust that is quite prevalent near the reservation. once, twice, thrice bitten, forever resentful. can't blame them either. the truly wise never forgive injustices. they just simply prepare against for the next attempted instance. maybe, sadly, even in an insular society like batavia, folks have become numb to acts of random crime? darwinism is being accepted as a way of life more and more each day. wake up before it's too late. america - home of the red, white and billed.

Ya know Howard, I was thinking the same thing!

I didn't want to be the first to comment because what I was really thinking was "yeah right!" I guess there are a number of explanations, none of which seem to make much since, IE: he wasn't robbed at all...or like Kevin said, maybe he knows who robbed him and will get even his own way...or maybe he is (wait for it) an illegal alien...or maybe he "don't like them cops"
I didn't want to wager a guess so I just waited until somebody else got the ball rolling...however I am sure we will hear more about this story in the coming days!!

If he were undocumented, I think that would have been immediately known to law enforcement and would have been noted in the press release.

Chief Deputy Jerome Brewster responded to my e-mail. He said the investigation is continuing. Deputies were unable to locate the crime scene and conducted interviews in the area trying to gather more information.

The other aspect that doesn't add up to me: Car pulls behind and demands wallet. Suspect shot in the back. Suspects take wallet.

No information on what he did to provoke shooting. While random acts of violence happen, they are rare, especially in rural areas. It seems odd that a robber would demand wallet and before victim could respond, shoot him. Why shoot him in the back.

And apparently the guy was conscious following the shooting. How is it possible he didn't see the suspect vehicle or the assailants?

Now, it's possible there's a reasonable explanation for all of this, but there's something about it that doesn't pass the old smell test, either, if you ask me.

I'm sure the Sheriff's Office is doing their best to find out exactly what happened.

How could he not know what road he was walking down? I understand it was dark, but was he intoxicated, or on something? OR... not wanting to tell the whole story? Yes, the scenerio just doesn't add up.
