Batavia man arrest for alleged rape of young teen girls in Ontario County

A 41-year-old Batavia man has been charged rape in the second degree after being accused of having sexual intercourse with two 14-year-old girls in West Bloomfield.

Ontario County Sheriff's deputies arrested Micheal Steven Lewis at his residence, 1 Prestige Crossing, Batavia, at 6:30 p.m., Tuesday.

The accusation stems from alleged incidents in October 2011 in West Bloomfield.

Lewis was jailed in Ontario County on bail, but the amount of bail was not released by the Ontario County Sheriff's Office.

Not to say that the guy is innocent or guilty, but how does a person defend their self against accusations like this? Is it possible for any person to go to the police and just say "he or she had sex with me" and then the police arrest the accused leaving it up to them to prove their innocence? This supposedly happened 8 or 9 months ago so what kind of proof would there be..............unless there was video.

Whenever I read news reports like this one, I come up with a few hundred questions I'd love answers to. I'm guessing there was a confession if there was an arrest.

was thinking the same thing doug....but was wondering if a comment like that would be harshly critisized on such a touchy subject...i guess time will tell if these accusations have been fabricated or he really is a pedophile

I think both of you have a very valid point. Without some kind of proof like pictures, emails, videos, how would anyone prove this kind of a case? Wouldn't it come down to a he said/she said scenario?

I don't relish adding supposition to supposition, but it is likely that the individual charged contacted the girls via the internet. If such is the case there may have been emails, chat logs, etc. that were investigated prior to executing an arrest warrant. Despite this person being innocent until proven guilty, there is no option for a consenting adults defense between two fourteen-year-olds and someone over twenty-one. Also, unless the girls are Siamese twins, it is highly unlikely this could be construed as a May-December romance.

There are three things I've learned as a crime reporter: Some people get arrested when they shouldn't be; some people get arrested when they're guilty as hell, and they still get acquitted; and with any arrest, the police always have more evidence than is available in an initial press release.

While Mr. Lewis may be 100 percent innocent, it's safe to assume the Ontario County Sheriff's Office has more evidence than just the girl's say-so. Any prosecutor -- and this arrest would have been run through the OC DA's office before the arrest -- isn't going to want to take a case to grand jury on just the statements of 14-year-old girls.
