Samuel Christopher Dilcher, 31, of Lewiston Road, Oakfield, is charged with assault, 3rd. Dilcher is accused of punching a patron in the face at the Stumblin Inn in Elba causing the person to require medical attention, including several stitches. Dilcher was issued an appearance ticket.

Justin David Moscato, 21, of Riddle Road, Lockport, is charged with driving while impaired by drugs and uninspected motor vehicle. Moscato was arrested following a citizen complaint of a person staggering around a vehicle at 12:55 p.m. Wednesday at a location on Hopkins Road, Pembroke.

Alexander 28, Holley 0. On homecoming night, the Trojans shut down Holley and scored 28 points. The scoring started with a punt return for a TD by Sam Browne. Browne also had two receptions in the game for 110 yards and a TD.  LB Derrick Busch scored on a 20-yard dash after scooping up a blocked punt. Busch also had a 30-yard TD reception. Jared Browne made both TD tosses. Zach Shilvock was 4-4 on PATs. Tristan had 10 carries for 82 yards. Defensively, LB Tyler Laird had 8 tackles.  LB Cody Trezcieski had 7 tackles.  LB Jake Wozniak had an interception as did DB Tristan Aldinger, who now has 2 picks on the season.  Alexander is 2-1 in the GR and 2-2 on the season.

Notre Dame 28, Pembroke 18. The Fighting Irish spoiled Pembroke's homecoming by erasing a 12-7 deficit in the second half. Joe Zickl was 3-7 passing for 45 yards and a TD for Notre Dame. Jack Sutherland rushed for 74 yards on 12 carries and Peter Daversa had 47 on 18. Zickl and Jacob Weatherwax both scored on the ground. Josh Johson had a TD reception and gained 52 yards on three catches. For Pembroke, Mitch Lewter was 5 for 12 passing for 63 yards and a TD. Dakota Swimline had 81 yards on 15 carries and a TD. Cal Neurohr rushed for 77 yards on 23 attempts and scored a TD.  Swimline also had five catches for 63 yards and a TD.  On defense, Zickl had 13 tackles.

Le Roy 61, Cuba-Rushford, 13. The Oatkan Knights continued to pound its way through its regular season schedule with its fourth straight big-margin victory. Ryan McQuillen scored four touchdowns, with two on punt returns, along with a TD on the ground and one through the air. He had a total of 184 yards gained on the night.  Tom Kelso rushed for 165 yards on nine carries, including longs of 58 and 61 yards. Nick Egeling had 13 carries for 72 yards and a TD. Brian Hodges scored a TD. Mike McMullen only completed three passes on 10 attempts, but all three were for scores (42, 43 and 15 yards). Kelso had eight tackles, Egeling six, along with an incerceptions and fumble recovery. Luke Hogle had six tackles and McMullen and McQuillen had five each. McMullen also had a fumble recovery.

Batavia 31, Dansville 17. The Blue Devils improved to 3-1. Greg Mruczek 10-18 passing for 165 yds and four touchdowns. Ahdeosun Aiken had 6 carries for 51 yards and a touchdown.  Jarrett Laskett had three receptions for 66 yards and a touchdown. Anthony Gallo caught three passes for 55 yards and racked up 190 yds in kick returns. James Cryer had 9 tackles. Trevor Rittersback, 8 tackles. Devon Koepp had 7 tackles. Gunner Rapone, 6 tackles. Dominick Mogavero, 5 tackles. Dansville is now 2-2.

Denise Kay Kumpf, 46, of Roberts Road, Alabama, is charged with grand larceny 4th degree. Kumpf, who was a night manager at Flying J Travel Center, is accused of loading $1,000 onto a NetSpend prepaid card without placing money for it in the cash register.

Joseph D. Summers Jr., 27, of 103 West Main Street, B-3 A-6, Le Roy, is charged with endangering the welfare of a child. Summers was charged after children ages 2 and 3 were found wandering unattended, away from their residence, on Sept. 16.  Police allege this is the third time this year in which children under the care of Summers were found wandering unattended.

Kasiem Marquis Burks, 18, of Trina Circle, Syracuse, is charged with trespass. Burks is accused of being on College Village property after being banned from the property.

Daisha Monet Spence, 18, of Batavia Stafford Townline Road, Batavia, is charged with petit larceny. Also charged, Naja Frances Adams, 18, of Batavia Stafford Townline Road, Batavia, and Shantina Marie Brewer, 19, of Batavia Stafford Townline Road, Batavia. Spence, Adams and Brewer are accused of shoplifting at Walmart. Allegedly the trio grabbed $441.73 in merchandise and fled the store. Their vehicle was later located by deputies Joseph Graff and Chad Minuto.

Stephen Michael Esposito, 25, of Folsomdale Road, Cowlesville, is charged with criminal possession of stolen property, 4th, and falsifying business records. Esposito allegedly stole a Spectra Precision Model 412 Laser from his employer in Stafford and then pawned it in Batavia, signing a document at the time stating he owned the property.

Robert W. Plantiko Jr., 29, of Thorpe Street, Batavia, is charged with burglary, 1st, robbery, 1st, menacing, 2nd, assault, 3rd, and criminal mischief. Plantiko was arrested on a warrant stemming from an alleged incident Sept. 5 at 105 Watson St., Batavia. Plantiko was jailed without bail. Plantiko was also charged with harassment, 2nd, for allegedly punching another person during an alleged altercation at 7:09 p.m. Thursday at a residence on Ellicott Street, Batavia.

A 16-year-old resident of Roanoke Road, Pavilion, is charged with obstructing governmental administration and hindering prosecution, 2nd. The youth is accused of not allowing police into a residence on Thorpe Street at 10:06 p.m., Friday, when police showed up with a felony arrest warrant for Robert Plantiko. The youth was observed by Officer Frank Klimjack allegedly trying to hide Plantiko inside a kitchen cupboard.

Samuel Gene Coughlin Jr., 18, of Pratt Road, Batavia, is charged with unlawful possession of marijuana. Coughlin was charged after police were dispatched at 2:53 a.m. Thursday to the parking lot on Jefferson Square on a suspicious condition complaint. A 17-year-old resident of West Main Street Road, Batavia, was also charged.

Aaron L. Klein, 43, of Harvester Avenue, Batavia, is charged with DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation, 1st. Klein was arrested following an investigation by Officer Marc Lawrence into a property damage accident reported at 2:57 p.m. Sunday at 34 Clinton St., Batavia.

Bobby L. Mobley Jr., 29, of Bank Street, Batavia, is charged with criminal possession of marijuana over eight ounces. Mobley turned himself in on an alleged incident from Sept. 14. He was allegedly found in possession of more than eight ounces of marijuana during a traffic stop on Jackson Street.

Maleak Hakeem Green, 21, of South Main Street, Batavia, is charged with failure to obey a court order. Green allegedly violated a court order of protection.

David W. Zengulis, 51, of Ellicott Street, Batavia, is charged with DWI and driving with a BAC of .18 or greater. Zengulis was stopped at 9:06 a.m. Friday on Ellicott Street, Batavia, by Officer Frank Klimjack. Zengulis submitted to a breath test and allegedly registered a BAC of .30.

Mckayla J. Kosiorek, 20, of South Jackson Street, Batavia, was arrested on a warrant. Kosiorek was located at an address on Hutchins Street while police investigated an unrelated matter. Kosiorek was allegedly found to have a warrant for failure to appear.

Mark T. Zdrejewski, 61, of Meyer Road, North Tonawanda, is charged with four counts of issuing a bad check. Zdrejewski allegedly issued bad checks to a local business. He was arrested on a warrant.

Ty’ree D. Winkfield, 16 of Washington Avenue, Albion, is charged with criminal possession of stolen property, 3rd, a Class D felony, and unlawful possession of marijuana. Winfield was stopped by Le Roy PD for an alleged traffic violation. Upon investigation, it was determined the vehicle he was driving was allegedly stolen from Albion. Winkfield was released under supervision of Genesee Justice.

Charles F. Chidsey, 28, of Clay Street, Le Roy, is charged with unlawful possession of marijuana. Chidsey was arrested following a complaint of loud music.

Brian Wilson Herke, 29, of Townline Road, Byron, is charged with DWI, driving with a BAC of .18 or greater and drinking alcohol in a motor vehicle. Herke was stopped at 11:24 p.m. Sunday on Townline Road, Byron, by Deputy Joseph Corona.

Shannon M. Malone, 42, of Route 98 Road, Varysburg, is charged with petit larceny. Malone is accused of shoplifting at Walmart.

Arthur Wayne Adner, 66, of Cobblestone Court, Holley, is charged with possession or transport or offer for sale of unstamped cigarettes. Adner was stopped at 11:26 a.m. Sept. 16 on Judge Road, Alabama, by Deputy Joseph Corona. Adner allegedly possessed 1,800 untaxed cigarettes.

Mitchell Andrew Cummings, 23, of Byron Road, Batavia, is charged with unlawful possession of marijuana and a seat belt violation. Cummings was stopped at 11:43 p.m. Friday on Byron Holley Road, Byron, by Deputy Joseph Corona for allegedly driving without a seat belt.

Amanda Rose McDonald-Mruczek, 32, of Pringle Avenue, Batavia, was arrested on a warrant for an attempted petit larceny charge. McDonald-Mruczek was arrested following an appearance in City Court for alleged failure to appear on an attempted petit larceny charge. She was jailed on $250.

Timothy S. Spiotta, 46, of Oakfield, is charged with DWI, driving with a BAC of .08 or greater and speeding. Spiotta was stopped at 9:20 p.m. Wednesday on Farnsworth Avenue, Oakfield, by State Police.

Roger W. Little, 47, of Byron, is charged with criminal mischief and harassment. Little was arrested by State Police. No further details released.

Smoke is reported in the basement at 2462 Pratt Road. It smells as if something electrical is burning. Pembroke Fire Department is responding.

To whatever degree the Pembroke Dragons might have had a chance against the Oakfield-Alabama Hornets on Friday night, too many scoring opportunities were snuffed out by turnovers.

Most of the Dragon's possessions ended with a fumble or interception.

"We're always emphasizing creating turnovers," said O-A Head Coach Brian Palone after the Hornet's 33-6 win on their home field. "We work on it a lot. So I was happy to see that we were able to execute."

The Hornets are now 2-1 and Pembroke falls to 0-3.

On offense, the Hornets were pretty much able to have their way.

QB Alan Chatt was 16 for 19 passing and 199 yards. He tossed touchdown completions of 55, 17 and two yards. He also rushed for 85 yards and a TD on eight carries.

Ryan Emery rushed for 33 yards and a TD on eight carries and Jon Harris gained 47 yards on five carries.

Receiver Reice Woodward had a big night with two touchdowns on four receptions for 85 yards.

Defensively, Pat Caprio had six tackles, Harris, five, Jake Valletta and Tyler Hamm, four each, Chatt had two interceptions, Casey Arnold, two sacks, Trent Stack, an interception and Emery had a sack.

Collin Scheiber was one for three on point after attempts. His make was the first of his kicking career.

"I'm very proud of way we finished the game," Palone said. "We talked all week about finishing, especially after last week. We weren't able to finish and we let it get away from us, but tonight they were really focused for four quarters of football. They really finished. I'm proud of the way they executed at the end."

Next up for O-A, Elba/Byron-Bergen, who takes a 2-0 record into today's match up with Notre Dame (0-2).

Pembroke will host Notre Dame next week.

Baybhann Osman Tagber, 38, of North Almond Drive, Beverly Hills, was arrested as a fugitive from justice. Tagber was being held at the Buffalo Federal Detention Center on a possible immigration issue. While in custody, authorities learned of a warrant in the City of Los Angeles. Tagber was wanted on a burglary charge. Tagber is being held in the Genesee County Jail pending an extradition hearing.

Gary William Bird, 60, of Vine Street, Batavia, is charged with stalking, 4th. Bird is accused of contacting a person at their place of employment while knowing that such contact was unwanted and would cause alarm and annoyance.

Carrie A. Stewart, 34, of Attica, is charged with conspiracy, two counts of criminal trespass and petit larceny. Stewart was arrested at Walmart by State Police at 10:10 p.m., Sunday. No further details released.

Timothy M. Ryan, 20, of East Pembroke, is charged with burglary, 2nd. Ryan is accused of entering the residence of a family member and taking more than $600 worth of electronics. The items were sold to a pawn shop. Ryan was released under supervision of Genesee Justice.

A fun family Harvest Festival in the country will debut from 10 a.m. to 5 p.m. on Saturday, Oct. 11, at the Kozy Kabin at 922 Genesee Street (Route 33) in Corfu.

Hosting are the property owners, Charles and Lenora Kohorst, who started the business three years ago. They build custom cabins and sheds of all sizes, with delivery, and custom-made polywood outdoor furniture, plus a colorful array of mums for the Fall season.

Why the festival?

"We have seen businesses in Corfu and Pembroke diminish these past few years, unfortunately, and have lost some great businesses -- The Market, IGA, Burling Drug, and more," Lenora said. "We see the need to come together as businesses and promote what the Corfu and Pembroke area has to offer the public. iI's a great place to live and visit (Darien Lakes)."

The scarecrow is the fest's theme.

Corfu and Pembroke area businesses are invited to participate in a scarecrow display that allows them to show off what they offer. They can dress it in any way that best shows the attendees their business with all their business information (addresses, contact info, specialties, etc.) also displayed alongside the scarecrow. Scarecrows will be displayed along the roadside (Route 33), craft vendors will have them at their booths, and they will be along the hayride that will go around the property.

There will be a bounce house, food vendors, craft vendors, kettle corn, hayrides, alpacas from Alpaca Delights, homemade desserts for sale, mums, pumpkins for sale. Browse Kozy Kabin, listen to live music, "needle in a haystack" game, face painting, balloon man.

There will also be a cabin raffle. First prize is a 10' x 20' cabin with a porch, or choice of $3,000 cash. Second, third and fourth prizes are a polywood folding Adirondack chair in the color of the winner's choice. Tickets are $5 or three for $10. Rain or shine. There will be tents.

Daniel C. Frey, 50, of Oakfield, is charged with unlawful growing of cannabis and criminal possession of marijuana, 4th. Frey was arrested by State Police at 12:57 p.m. Friday on Klossen Road, Alabama. No further details released.

Jason A. Perry-Murray, 20, of Jackson Street, Batavia, was arrested on warrant for an unpaid parking ticket.

Juan A. Roman, 36, of Portland Avenue, Rochester, is charged with criminal contempt. Roman is accused of violating a stay away order of protection.

Caitlin A. Hayes, 26, of Dellinger Avenue, Batavia, was arrested on a warrant for failure to appear on a parking ticket. Hayes was arrested following police contact on an unrelated incident.

Elliot R. Sandoval, 38, of Spencer Court, Batavia, is charged with harassment, 2nd. Sandoval is accused of kicking another person in the back while that person was walking down a flight of stairs.

Joseph J. Kostanciak, 24, of unspecified address, is charged with petit larceny. Kostanciak is accused of shoplifting at Walmart.

Sanders A. Kelsey, 27, of Batavia, and Michelle L. Franks, 33, of Batavia, are charged with petit larceny. Kelsey and Franks are accused of shoplifting at Walmart.

Carol A. Bartucca, 55, of Stafford, is charged with DWI and driving with a BAC of .08 or greater. Bartucca was stopped at 10:16 p.m. Saturday on Horseshoe Lake Road by a trooper.

Jeremy D. Eck, 27, of Hornell, is charged with DWI, driving while impaired by drugs and unlawful possession of marijuana. Eck was stopped by State Police at 10:27 p.m. Sunday on Route 20 and Browns Mill Road, Alexander.

Lawrence E. Rutkowski, 50, of Orchard Park, is charged with DWI and driving with a BAC of .08 or greater. Rutkowski was stopped at 12:11 a.m. Monday on Route 20, Alexander, by State Police.

Brett F. Dieter, 36, of Basom, is charged with criminal obstruction of breathing. Dieter was arrested following an investigation of an alleged incident at 8:10 p.m. Sept. 1 on Lewiston Road, Alabama.

Michael R. Sigl, 21, of Batavia, is charged with petit larceny and possession of a hypodermic instrument. Sigl was arrested by State Police following an incident report at 3:32 p.m. Sunday. No further details released.

Lindsey N. Burdick, 32, of Pavilion, is charged with DWI and driving with a BAC of .08 or greater. Burdick was stopped by State Police at 11:29 p.m. Sunday on Route 20, Alexander.

Todd L. Frocione, 50, of Syracuse, is charged with DWI and driving with a BAC of .08 or greater. Frocione was stopped by State Police at 11:51 p.m. Sunday on Route 20, Alexander.

A woman from out of the area died today after being struck by a box truck pulling in for diesel gas at the Flying J off Route 77 in Pembroke.

The woman had apparently just left the restaurant at the travel plaza and was heading back to her truck when she was hit.

She was traveling with her husband, who was not injured.

The box truck is from Aberstar Freight.

The driver apparently did not see the woman.

She was pronounced dead at the scene by a county coroner. 

Pembroke and Indian Falls fire departments were dispatched at about 12:15 p.m. with a report of a woman struck by a vehicle who was unconscious. Mercy Flight was put on ground standby, but never dispatched. Dispatchers were told that Mercy Flight wouldn't be needed, once a chief arrived on scene.

UPDATE: The deceased is identified as Carolyn V. Baltzell, 61, of Hot Springs, Ark. The driver is identified as Serge Guindon, 56, of Dorval, Quebec, who was driving a 2012 Peterbuilt box truck. The investigation is on going, but not charges are pending at this time. The investigation is being handled by Deputy Joseph Corona, Deputy Dana Richardson, Sgt. James Meier and Investigator William Ferrando.

A pedestrian is down and unconscious in the parking lot of the Flying J Travel Center after being struck and injured by a vehicle. Mercy Flight is on standby. Pembroke and Indian Falls fire departments are responding.

A van rolled over into the median of the eastbound Thruway at mile marker 399.7. Unknown injuries. Pembroke and Indian Falls fire departments and Mercy medics are responding.

UPDATE 4:21 p.m.: A person on scene reports two people are trapped inside the vehicle.

UPDATE 4:24 p.m.: One person is unconscious. Mercy Flight is put on ground standby.

UPDATE 4:30 p.m.: Mercy Flight 5 out of Batavia is going to the scene. East Pembroke fire is called in to provide mutual aid.

UPDATE 4:39 p.m.: One helicopter has landed. Mercy Flight 9 out of Buffalo is also responding to the scene. One of the two victims is a 30-year-old male with "multiple trauma."

UPDATE 5:43 p.m.: According to Alecia Kaus of the Video News Service, State Police have confirmed that one person died at the scene and another was transported with serious injuries via Mercy Flight to ECMC.

UPDATE: State Police photo. The driver is identified as Jacqueline J. Hayes of Plover, Wis., who was declared dead at the scene. Passenger Richard R. Hayes was flown to Erie County Medical Center by Mercy Flight. He is listed in critical condition.

Pembroke Head Coach Dick Dimincuco has been working hard all pre-season to get the Dragons ready to take the field in 2014 and what he sees two days before opening kickoff against Elba is a team that's still a work in progress.

But the emphasis is on the word "work."

"We have nice group of kids who work hard and come every day and try to get it done," Dimincuco said. "Obviously, that's a strength. We need to get a little better at what we do on the field, and they're going to do that because they work hard and listen."

The Dragons are coming off a 2-6 season and the program hasn't had a winning record since 2010 (5-3).

The team will rally around QB Mitch Lewter, a senior in the role of offensive field manager for the first time. He won't be without weapons. Senior Dakota Swimline returns to wide out and running back and senior Cal Neurohr will share backfield time as well as play linebacker.

The offensive and defensive lines will be anchored by 6-foot, 225-pound junior Jack Thomas.

"He's a big tackle and good football player," Dimincuco said. 

Three men from Syracuse have been charged with third-degree burglary in Genesee County for allegedly breaking into a pair of local businesses.

The trio are also suspected of burglaries and thefts in Erie and Livingston counties.

They were picked up following a traffic stop in Wayne County last week and deputies spotted what they thought might be stolen material in the vehicle.

Upon questioning by investigators in Wayne County, the men admitted, according to Chief Deputy Jerome Brewster, to heists in Genesee County.

Investigator Kris Kautz took a trip to Wayne County and questioned the men and gathered the evidence, working with Deputy Brad Mazur, to file local charges.

Charged are brothers William H. Kelly III, 44, and Robert P. Kelly, 43, and Michael J. Correia, 58.

Additional charges may be pending.

The three men are accused of breaking into a Kutter's Cheese building, and stealing items from a residential construction site on East Main Street, Batavia, some time during the early morning of Aug. 27.

They were allegedly found with more than $3,000 in material, including brass plumbing components and copper wire.

They are being held without bail.

A tractor-trailer has reportedly hit the guard rail on the westbound lane of the Thruway in the area of mile marker 403.1.

The two drivers reportedly involved in an ATV crash Sunday night have both been arrested and charged with driving while intoxicated.

Charles R. Chatley, 26, of 2392 Kilian Road, Corfu, was also charged with unlawful operation of an ATV on a public highway.

Stephen R. Smelski, 35, of West Main Street, Batavia, is also charged with unlawful operation of an ATV on a public highway and leaving the scene of a personal injury accident.

Witnesses say Smelski was the most seriously injured of the four people involved in the accident and he's the one victim still hospitalized, though he's listed in good condition at ECMC.

An East Pembroke Fire Department 1st assistant chief and Genesee County emergency dispatcher, Smelski was reportedly taken by private vehicle to UMMC following the accident and later transported to ECMC.

The accident was reported at 11:09 p.m. Sunday in the area of 2069 E. Main St., East Pembroke.

Also injured were passengers Kristina Rumble, 26, and Brenda Smelski, 37.

Brenda Smelski was treated and released at ECMC, as was Chatley.  Rumble, who was transported to ECMC by Mercy Flight, was released from the hospital two days ago.

Chatley is a 2nd assistant chief with East Pembroke.

The accident occurred the same date as the annual East Pembroke Mud Races, hosted by the fire department, but the accident was hours after the event ended and at least a mile from the mud pits. 

The accident was investigated by deputies Jason Saile and James Diehl and Sgt. Eric Seppala.

The Genesee County Sheriff’s Office has released the names of those involved in an ATV crash that sent four to the hospital late Sunday night.

Just after 11 p.m. Sunday, two ATVs – each carrying a passenger -- collided on Route 5 in the Town of Pembroke. Deputies say the two ATVs were riding eastbound, side-by-side, near Cleveland Road when the collision occurred, ejecting all four riders.

The driver of the first ATV, 26-year-old Charles Chatley, of Kilian Road, Pembroke, allegedly crashed into the second ATV, causing his vehicle to flip. He is the second assistant chief of the East Pembroke Fire Department.

His passenger, 26-year-old Kristina Rumble, was taken to ECMC by Mercy Flight. 

The driver of the second ATV was 35-year-old Stephen Smelski, who is East Pembroke fire's first assistant chief and a dispatcher for Genesee County Emergency Dispatch Center. Contrary to other reports, he was NOT transported by Mercy Flight.

Stephen Smelski's passenger, 37-year-old Brenda Smelski, and Chatley were taken to ECMC by ambulance.

The Sheriff’s Office says charges are pending.
