Man allegedly attacked girlfriend in car and at Batavia police station

An Oak Street resident is accused of assaulting his girlfriend both in her car and later at the Batavia Police station, where she had gone to report the first alleged attack.

Michael P. Gattuso, 28, of 108 Oak St., upper, was jailed on $1,000 bail after being charged with assault in the 3rd degree and criminal mischief in the 4th degree.

Gattuso is accused of punching out the windshield of his girlfriend's car, hitting her in the head and then following her into the police station after she drove there to report the crime. Once inside the police station, while his girlfriend was on the phone with Genesee County dispatchers, Gattuso reportedly started punching her in the head again.

The alleged attack occurred at 5:50 p.m. yesterday.

Several police officers responded to the station and took Gattuso into custody.

I am betting that the girlfriend is thrilled that the Batavia City Council voted to eliminate the police dispathers. If a dispatcher had been there, she could have immediately entered for safety. She did not enter the Police Station, merely the vestibule. The Police Station is only open M-F, 8:30 to 4:30. A dispatcher at the Police Station 24/7 vs the station being open 40 hours a week saved a couple of pennies on the tax rate.

I had $1000 bail for just giving a cop the middle finger allegedly.Oh and not passing out while handcuffed and being choked by Officer Davis is resisting arrest.Additionally I didnt allow my head to be smashed into the hood while handcuffed too.Will Judge Balbick threaten me again as I beg him to look at my wrists? The knowing look from the Officers was enough for the Judge.

I'm wondering if she would have gotten that second attack in the foyer if the door was unlocked and she could have gotten right in to see the officers. Instead she had to pick up a phone to get someone to open the door and be attacked while doing that. Good thing the suspect didn't have a gun or knife. I would hate to think what might have happened then.

Is there anything that can be done to ensure this won't happen to another person going for help while being attacked.

I think the police station being closed is ridiculous!!!
