Police Beat: The case of the missing tires

Gorgon L. Montgomery, 50, of Batavia, allegedly thought he could get something for nothing. He is accused of taking four tires that had been chained to a residential tree and marked "for sale." The tires disappeared the night of April 1 and were allegedly found in the back of Montgomery's pick up truck yesterday. He is charged with criminal possession of stolen property in the 5th degree. He was issued an appearance ticket on the charge.

Gerald P Perkins, 77, of LeRoy, was reportedly stopped for driving a vehicle without break lights. Upon further investigation, the arresting deputy reports, it was determined that Perkins was allegedly driving while impaired by alcohol. He was charged with DWI and released to a friend.

Michael C. Mirabal, 36, of Batavia, is accused of taking and using another person's car with out permission. He is charged with one count of unauthorized use of a motor vehicle, a misdemeanor. He was issued an appearance ticket.

Wow! Great story about the "Case of the Missing Tires"! I kinda doubt that Fella is all that bad of a guy? Times being what they are, and all?
Did he "take the tires" or did he just have the tires? I suppose if you said he took 'em, it's gotta be so? Besides, who really cares about the facts when you can have the Almighty Opinion of the Media? You Guys can add that Color and Juice that makes reading these blogs so much fun! Thanks again!
You ever wonder how low you can hit when you stoop to what I think may be considered "LIABLE"?

G.L., there is nothing in what I posted that didn't come out of the press release from Batavia Police Department. No opinion, no accusation of guilt. I used the word allegedly twice as well as accused and charged. Nothing in the post says you actually did anything.

If you would like to tell your side of the story, you're more than welcome to do just that.

While there might have been an error, the report said the tires where CHAINED to a tree with a For Sale sign.

Do you have any additional information?

John, even when I read the press release, I wondered how police would prove that suspect is actually the one who broke the chains. It would be possible for a person to try to steal the tires and then ditch them in another person's truck with the hope of retrieving later.

But then I heard on WBTA, I think, that there were tire tracks at the scene that matched the truck where the tires were found.

I don't know.

Since G.L. wants to defend himself, I would love to hear his side of the story. Apparently, there's more to it than what was in the press release.

Guess I didn't make too good of a first impression either?
I've read alot of your things and yes, you do a fine job. But, then again, I've never been the Guest of Honor(???) either. Please accept this as my apology?
Mr. Roach, chained to a tree sounds like what I was told also. I would even take a gamble and say those tires may have, at least in part, come from a tree! (somewhere?)

Congratulations ! Just about any post is a good post as long as u dont attack other peops opinions. They must have been really good tires if someone broke chains for them. I used to be single minded til i started posting and reading other peops posts.

My side of the story? What the heck? You guys can yuk it up just like BPD did. Please refrain from eating or drinking anything that you could choke on while reading this...

I will keep it short and to the point.
The night of 4/1 or early morning of 4/2 I returned home from shopping for a few necessities at Wal Mart. Parked and locked my truck in my driveway, as usual. I retrieved my 2 bags of stuff from the store out of the back of my pickup. No tires present at this time. Proceeded to my apt., put my stuff away, brushed my teeth, said my prayers and hit the sack.
(Okay, okay! The teeth and prayin' thing was stretching it, just a bit.)
Next morning 4/2, late morning, I receive visitors from BPD. They requested my presence down in my driveway.
Got dressed, did say my prayers (sorta, in my own way) and went to see what they wanted. Walk out the door and I saw some tires heaped and sorta covered with something in the bed of my truck.?! I can't really explain what that was I was feeling, but it quickly evolved into fear then anger. Then to the realization that I wouldn't even buy this story! Four really nice truck tires and a couple of floormat carpet/rubber thing like in the entry to almost every business around... had found a place to spend the night! BPD says their city is missing 4 tires and these look like they could be the ones? I pretty much agreed that that may be so because "I ain't never seen those tires before!" And... "They were NOT in my truck when I got home! The rest is just what I expected that truth would get me. I just couldn't believe what I was seeing!
BPD couldn't have treated me better, well, consideration of my side of the story may have helped?
Really now!(directed to BPD & Co.)I could not make up a lie that lame?!?
Where would a vehicle leave tire prints on East Ave? Anyhow that was not mentioned to me?
I had no reserves about giving the tires to the Cops, or consenting to the search of my truck! (but that body cavity thing!) Just bustin' em! Like I said, They were very plesent.
You know, those was some real sweet tires, but 17" tires would fall right off my 16" rims!

I can't forget my "Secret Santa", who made this a nightmare-come-true... you know you lost something when you were here? Stop by and introduce yourself! I'll treat ya to coffee, and INTENSIVE CARE!

So, stupid as it sounds...

I have no reason not to believe you and I also did not automatically assume you were the same person who was accused.

Sounds like an April Fool's day nitemare ! Thank You for sharing this with us. It is an incredible story and quite believable. I would be suspicious of one of my friends that likes to pull pranks. I also hope that you get things cleared up too.
