Law and Order: Another shoplifting arrest at Kmart

Tracy Lynn Damato, 47, of Horsehoe Lake Road, Batavia, is charged with petit larceny. Damato is accused of stealing $19.99 in merchandise from Kmart.

Jordon Elizabeth Prescott, 19, of Ellicott Street Road, Bethany, is charged with criminal trespass, 3rd, and criminal contempt, 2nd. Prescott is accused of being at College Village after being barred from the property. She is accused of violating an order of protection by coming into contact with the security guard that was on duty at College Village.

Travis S. Bartz, 37, of Alexander, is charged with a violation of probation and criminal contempt, 2nd. Bartz was allegedly located at a residence on Route 98, Town of Attica, Wyoming County, by State Police in violation of probation conditions and a current stay-away order of protection.

Kimberley A. Smith, 36, of Alexander, is charged with felony DWI, felony driving with a BAC of .08 or higher and failure to stop at stop sign. Smith was arrested at 6:27 p.m. Wednesday on Brookville Road, Alexander, by State Police. Following her arrest, she was released to a third party.

Lamar Iteef Randall, 28, of Spruce Avenue, Rochester, is charged with criminal possession of a controlled substance, 5th. Randall was arrested on a warrant out of Stafford Town Court upon his release from Monroe County Jail where he was being held on an unrelated charged. He was jailed on $5,000 bail.

I don't condone theft, and I have nothing against K-Mart, I shop there. But, uh to anyone who is thinking of shop lifting, you should go to a crowded store. K Mart in Batavia almost never has more than 20 people in it. Your chances of getting caught have to be higher. Also, if you're going to risk getting busted, $19.95 really isn't worth it.

I agree with Dave.
However, I am commenting on those who are violating protection/stay-away orders. Are the lawyers who represent these folks not making it clear to them what an order of protection actually means? Or are these folks just gambling on not getting caught? The proof required to put these folks in jail over it is incredibly small.

Don't shoplifters get it that BIG BROTHER is watching - EVERYWHERE????? You will be on camera everywhere you go unless you are inside your own home (probably!) They will catch you scratching your butt or picking your nose so don't try to steal anything. Plus Dave O. is right if you are actually going to sit for stealing something - you should make it worth the sit! BTW-not trying to encourage anyone to shoplift.
I used to work at a Kmart (many, many moons ago!) back then they would routinely catch at least 4 or 5 people a day and that was just using their eyes. Can't imagine how many they grab today.
Use your brains people.

I must be in the minority here in Genesee County, I could never have my grand children OR great grandchildren :) read about "Gwate Gwompa" getting arrested for anything at all. I would think they would hate me for the rest of their lives for bringing shame upon the family name & THAT I could never live with at all.. But, Like the old adage says, If you can't do the time, don't bother doing the crime..

People are under the misconception that cameras are monitored at places like Kmart and such. They really arent and if they are its very minimal. Its still the employees and such that nail the shoplifters. All the cameras do is confirm the theft after the fact and provide evidence for prosecution.

I believe retail also receives a discount on insurance for the business for having them in place.
