James R. Kosiorek, 18, of Myrtle Street, Le Roy, is charged with assault, 2nd. Kosiorek is accused of punching and kicking another person in the head, causing physical injury to that person by means of a dangerous instrument. The alleged incident occurred on Friday. Kosiorek was jailed on $5,000 bail.

Kenneth Michael Burns, 53, of South Lake Avenue, Bergen, is charged with criminal contempt, 2nd. While incarcerated at Genesee County Jail, Burns allegedly violated an order of protection by contacting the protected person by phone.

Justin J. Pryzybyl, 21, of 8411 Peachy Road, Bergen, is charged with DWI, driving with a BAC of .08 or greater, making an unsafe start and not wearing a seat belt. Pryzybyl was stopped at 2:10 a.m., Saturday, on Clay Street by Le Roy Police Sgt. Michael Hare.

Benjamin Louis Monna, 21, of Florendin Drive, Henrietta, is charged with operating a motor vehicle impaired by drugs, criminal possession of a controlled substance, 7th, unlawful possession of marijuana and speeding. Monna was allegedly spotted speeding on the Thruway (83 in a 65 mph zone) and was located a short time later on the side of the road at the Pembroke off ramp. He was allegedly found in possession of Ritalin without a prescription, a small amount of marijuana and was allegedly driving under the influence of drugs. He reportedly refused a blood test. Monna was taken into custody at 8:45 a.m., Friday, by Deputy Brian Thompson.

Mark Jacob Mutka, 29, of Ganson Avenue, Corfu, is charged with DWI, driving with a BAC of .08 or greater and speeding (84 in a 55 mph zone). Mutka was stopped at 4:08 a.m., Sunday, on Genesee Street, Darien, by Deputy Howard Carlson.

A Batavia man who tried to outrun law enforcement from Avon to Le Roy will serve one- to three-years in state prison, Judge Robert C. Noonan ruled this morning.

Randy S. Rumble, 27, of State Street, entered a guilty plea at the end of August to felony DWI and aggravated unlicensed operation. On Aug. 1, Rumble led cops from Avon and deputies from Genesee County on a high-speed chase until he ran out of gas and was taken into custody by a Le Roy police officer.

Defense attorney William Tedford described Rumble as the nicest client he has represented.

He's a nice guy who makes poor decisions when he drinks," Tedford said.

"I have no reason to think you’re not a nice guy, but as people in court have heard me say 100 times, if you get killed by a drunk driver it doesn’t matter if it's Mother Teresa or Charles Manson at the wheel," Noonan said.

"You're lucky you're not standing here responsible for the deaths of other people or buried in the ground yourself. This conduct is way beyond anything that’s acceptable in this society."

Assistant District Attorney Melissa Cianfrini argued for a stiff prison sentence.

"It was a dangerous situation," Cianfrini said. "He only stopped when he ran out of gas. He didn't stop voluntarily. He then ran into a hedgerow, further hampering law enforcement."

As for a statement to Noonan, Rumble apologized.

I respect whatever sentence you give me," Rumble said, then hung his head. "And that’s it."

Rumble will also be required to pay a $2,000 fine and have an interlock-ignition device on whatever vehicles he has access to upon his release from prison.

Gena Lorane Ellis, 24, of West Ridge Road, Brockport, is charged with petit larceny. Ellis is accused of stealing $124.13 worth of merchandise from Target by hiding the items under her child in her shopping cart.

Amanda Darlene Clemons, 26, of Ridge Road, Holley, is charged with petit larceny. Clemons is accused of trying to steal $211.86 worth of clothing, boots and other merchandise from Target by hiding the items under a blanket in her shopping cart.

David M. Saylor, 26, of 9431 Summit St. Road, Le Roy, is charged with DWI, aggravated DWI with a BAC of .18 or greater, failure to keep right, no seat belt and unsafe tires. Saylor was allegedly involved in an accident on North Street. He is accused of striking a parked car at 12:26 a.m. and causing significant damage to both vehicles.

A 41-year-old Covington man already facing charges out of the Town of Batavia for allegedly trying to pass himself off as a federal law enforcement agent was arrested by Le Roy Police on Monday on a similar charge.

Nikko C. Gambino, of Morrow Road, Convington, was arraigned in Le Roy Town Court and jailed on $750 on a charge of criminal impersonation, 2nd.

Gambino is accused of entering a Le Roy business some time in September allegedly dressed as a federal agent and directing an employee of that business to make a phone call under his pretend authority.

Three weeks ago, Gambino was arrested by the Sheriff's Office for allegedly attempting the same ruse in Walmart. A search of his residence reportedly found articles of clothing with law enforcement markings and a metal badge.

Chief Deputy Jerome Brewster said it isn't really clear why Gambino has allegedly attempted to enter retail outlets and pass himself off as a federal agent.

"He's refusing to talk, but we we think it is some sort of diversion," Brewster said. "He wants to draw attention to himself while his accomplice attempts to steal something. We haven't been able to confirm that with surveillance tapes and nothing has been reported stolen. At this point, it's just a guess."

On the arrest out of the Town of Batavia, Gambino was charged with two counts of criminal impersonation, 2nd, and one count of falsely reporting an incident.

He was initially jailed on $5,000 bail.

Le Roy Police say a 37-year-old Leicester woman stole from her employer earlier this year by creating forged cash cards.

Deanna L. Leach, of 5576 Gibsonville Road, Leicester, faces 11 felony counts of forgery, 2nd.

Det. John Condidorio said Leach allegedly altered 11 cash cards worth $50 each while employed as a manager at the business. Leach reportedly failed to log the cards in order to cover up her alleged crime.

Austin W. Smith, 24, of Batavia, is charged with DWI and aggravated DWI. Smith was reportedly involved in an accident at 8:24 p.m., Saturday, on Route 262, Town of Elba. The accident was investigated by State Police. (initial report)

Steven M. Keaton, 38, of 50 Gilbert St., Le Roy, is charged with three counts of criminal contempt, 2nd. Keaton is accused of violating an order of protection by being with the protected person on three different occasions.

Cassandra Kay Dembik, 18, of Pratt Road, Batavia, is charged with unlawfully dealing with a child. Dembik is accused of hosting an underage drinking party.

Lawrence Joseph Owczarczak, 55, of West Point Drive, East Amherst, is charged with harassment, 2nd. Owczarczak is accused of grabbing a young man by the arm on Friday evening.

David N. Taplin, 33, of 16 Skyline Circle, Brockport, is charged with criminal contempt, 2nd. Taplin reportedly turned himself in at Batavia Police headquarters in regard to a bench warrant.

Jerry T. Saddler Jr., of 112 State St., Batavia, is charged with criminal contempt, 2nd. Saddler is accused of violating an order of protection by allegedly contacting a woman he was barred from contacting.

Gregory Seppe, 52, with no permanent address, is charged with criminal trespass, 2nd. Seppe is accused of entering a dwelling on Columbia Avenue without permission. Seppe was jailed on $1,000 bail.

Nicholas A. Antonucci, 23, of 4192 Broadway Road, Alexander, is charged with disorderly conduct and unlawful possession of marijuana. Antonucci is accused of repeatedly shouting obscenities at 10:45 p.m., Friday, while in a parking lot at 214 E. Main St., Batavia.

Jodi L. Reed, 38, of 7428 Pearl St. Road, Oakfield, is charged with possession of a forged instrucment, 2nd, and petit larceny. Reed is accused of passing a forged check at a local bank on Aug. 3.

In Cal-mum and Leroy's 77th game against each other, Cal-mum defeated Leroy 42 to 0. Since it was Leroy's homecoming game, the stands were filled with excited fans and school attendees. Unfortunately for them, Leroy took a hard loss.

From the files of unsolved murders and mysterious deaths:

Bill Fickel, 2005: Chief Deputy Jerome Brewster believes he has a suspect, but needs more evidence to make a case. Brewster is looking for a second person he believes was outside Fickel's Oakfield home when Fickel was shot to death. Brewster's potential suspect is Steven Patrick Rebert, a former Oakfield resident who is a suspect in a double homicide in Pennsylvania. Brewster is hoping the second person will come forward and provide the additional information investigators may need to make the case.

"If we're going to get a conviction, we need more than a belief that this is the person who did it," Brewster said.

Kisha Sullivan, 2002: We spoke with Brewster about the Sullivan case in July, and Brewster said the eight-year-old cold case had recently become active He said there was a person identified who could be Sullivan's killer. Not much has changed since July. There is a man in Rochester that Brewster suspects killed Sullivan. He has reportedly told associates he did it, but nobody will come forward and help investigators put together a solid case. "Everybody is afraid of him," Brewster said. The Rochester police are aware of the suspect and the investigation and doing what they can to help.

Deborah Maniace, August 2010: Maniace's body was found next to the train tracks under the Route 33 bridge in Stafford. We asked Brewster about rumors that Maniace had information about meth dealing in Batavia and that this may be tied to her death. He laughed and said, "(Rumors) are just that." The rumors were checked out, Brewster said, and came to nothing. As recently as last week, investigators questioned Maniace's boyfriend, whom Brewster described as cooperative and somebody investigators are still looking at.

All available manpower from the Pavilion Fire Department is responding as mutual aid to York to fight a structure fire at 2905 Simpson Road.

Le Roy Fire Department is filling in at the Pavilion hall.

UPDATE (1:10 p.m.): Bethany Fire Department is called to fill in at the Le Roy fire hall.

UPDATE (1:33 p.m.): All Genesee County firefighters are ordered out of the structure. The fire chief reports they are already out and were the last ones out on the second floor.

Saturday, the DeFelice family hosted their annual Autumn Gathering for friends and family at High View Farm in Le Roy. Besides food and music, there were games, a hay ride and Gasper DeFelice's farm equipment on display as well as the stock cars of Gasper and Christopher DeFelice.

An apparently abandoned car was found smoking at Hanson Aggregates, 7875 East Main Road, Le Roy. The car may be on fire.

Law enforcement and Le Roy Fire are being dispatched.

Robert P. Leiser, 41, of Lockport Road, Oakfield, is charged with trespass, criminal possession of marijuana, 4th, and unlawful possession of marijuana. State Police and Sheriff's deputies came into contact with Leiser on Lockport Road, Oakfield, when responding to a report of a fight at 10:54 a.m. There was reportedly a warrant for his arrest on a trespass charge as well as a warrant out of Monroe County on the marijuana charges. No charged were filed in connection with the fight call.

Donna Marie Kowsky, 35, of Byron Holley Road, Byron, is charged with DWI, driving with a BAC of .18 or greater and following too closely. Kowsky was charged after reportedly being involved in a motor-vehicle accident at 7:58 p.m., Tuesday, in the area of 6112 Byron-Holly Road, Byron. Kowsky was allegedly tailgating.

Gregory Allen Jones, 31, of Main Street, Le Roy, is charged with criminal contempt. Jones is accused of contacting a person he was barred from contacting by court order.

Brandon M. Weig, 22, of Batavia, is charged with menacing, 2nd, criminal possession of a weapon and endangering the welfare of a child. State Police responded to an unspecified incident at 3:34 p.m., Monday, and arrested Weig. No further details were released.

Le Roy Police are looking for a person who broke into a residential garage and moved several items Sunday at a Lake Street address.

The burglary was interrupted when the resident heard a dog barking at the rear of the house and went outside to investigate. The resident spotted a man in the garage; the suspect ran into a wooded area.

He is described as a male wearing a red baseball cap, a yellow checkered short sleeve shirt and jeans.

This is the second garage burglary in the past month. A previous burglary occurred on East Main Street on Aug 6. It is unknown if these two incidents are related.

A witness was found who said that a person matching the suspect's description was seen walking the railroad tracks behind 101 W. Main St. shortly after the burglary. Police think it's possible the suspect lives in the area of West Main Street.

Anyone seeing a person wearing the same colored clothing or having information pertaining to this crime is asked to contact the Le Roy Police Department at 768-2527.

High winds blew live electrical wires onto a roof at 9418 Roanoke Road in Stafford. It's smoking and the fire has spread to the kitchen. It's now a second-alarm fire.

Stafford, Bethany, Le Roy, Town of Batavia and Pavilion are responding to fight the fire and control traffic. National Grid has been notified.

The location is between Sweetland and Westacott roads. The homeowner is outside with fire personnel.

UPDATE (3:12 p.m.): All available manpower in the area is called to the scene. There are three areas on fire inside the home. More traffic control is called for.

UPDATE (3:28 p.m.): Wyoming County is asked to standby in their own quarters with a full crew in case they are needed. Tankers, pumpers, hydrants are all being used and at the ready to fight the fire. Countywide, more crews are called to stand in at the responders' stations. Caledonia is called to help out. National Grid is at the scene. Power inside the house is out. The fire has spread to the garage.

UPDATE (3:40 p.m.): This is now a three-alarm fire. Firefighters were ordered out of the garage, which was "buckling" due to fire damage. There are four fire sites inside the structure now. It has spread to the second floor.

UPDATE (3:46 p.m.): A thermal-imaging camera is requested at the scene. Fire is now in the attic, too.

UPDATE (3:53 p.m.): Inside fire crews are getting out of the structure. They will be fighting it now from the outside only.

UPDATE (4:48): Fresh crews have been called in to replace tired firefighters. The structure is still smoking. The Wyoming County Correctional Facility Fire Brigade is being contacted to aid with equipment, we believe additional lengths of fire hose. Refreshments for the firefighters are requested. The modest, brick home appears to be a total loss. It was built in 1823 and for the past 40 years it has been the home of Terry and Betty Smart.

UPDATE 7:33 p.m.: All units back in service.

The treasurer of a Le Roy nursery school is being accused of using the school's ATM card to make unauthorized withdrawals and purchase.

The total of the alleged misappropriated funds is more than $6,200.

Jennifer M. Riggi, 29, of 47 Lake St., Le Roy, is being charged with grand larceny.

Riggi was arrested by Le Roy detective John Condidorio following an investigation that started Aug. 16.

Nursery school officials contacted Le Roy Police after checking bank statements and reportedly finding unusual activity.

After being arraigned in Le Roy Town Court, Riggi was released on her own recognizance.

He wasn't caught until he ran out of gas, but a Batavia man who led several area law enforcement agencies on a pursuit and search will likely serve one to three years in state prison after pleading guilty today to a DWI charge.

Randy S. Rumble, 28, of State Street, Batavia, admitted in court this morning that he was intoxicated at the time he was spotted driving his car on Morganville Road, where he ran out of gas.

The chase started in Livingtson County, but an Avon Police officer had to break off the pursuit as Rumble's car entered Genesee County.

The car was later spotted by Le Roy Police at a gas station in Le Roy, and apparently Rumble left the station before refueling.

Because Rumble had a DWI in Alexander in 2005, and he was driving on a revoked license, he was charged with a felony DWI in this case.

Sentencing is set for Oct. 14. He is being held in Genesee County Jail on $5,000 bail.

Christopher Patrick Ball, 28, of Ellicott Street Road, Batavia, is charged with robbery, 3rd, and criminal possession of a controlled substance, 7th. Ball was arrested following an investigation into an alleged domestic incident at 9:55 a.m., Sunday. Ball is accused of stealing the victim's purse. Upon further investigation, Ball was allegedly found in possession of hydrocodone.

Misael O. Rodriguez, 27, of North Clinton Avenue, Rochester, is charged with unlawful possession of marijuana. Rodriguez was reportedly found at 3:33 p.m., Sunday, by security officers at Darien Lake in a parking lot rolling a joint.

Daniel Lee Ward, 23, of West State Street, Albion, is charged with unlawful possession of marijuana. Ward was stopped  for an alleged traffic violation at 9:54 p.m., Thursday, on Route 98 in Batavia by Deputy Patrick Reeves.

Lloyd Peter Parsons, 49, of Broadway Road, Darien, is charged with unlawful possession of marijuana. Parsons was arrested on a warrant out of Orleans County. At the time of his arrest by Deputy Patrick Reeves, he was allegedly found in possession of marijuana.

Michael Joseph Valtin, 25, of Church Road, Bennington, is charged with endangering the welfare of a child. Valtin is accused of having unwanted physical contact with a child while visiting a campground.

Richard B. Smith, 21, of 4753 East Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Smith was stopped at 2:28 a.m., Sunday, by Sgt. Michael Hare of the Le Roy Police Department on West Main Street, Le Roy.

Elizabeth Anne Geddes, 53, of Stepping Stone Lane, Orchard Park, is charged with DWI, driving with a BAC of .08 or greater, driving while impaired by drugs, driving while ability impaired (alcohol and drugs) and criminal possession of a controlled substance. Geddes was stopped by Deputy Chad Minuto at 7:04 p.m., Saturday, in the parking of Darien Lake during the Tom Petty concert.

Chad Michael Wolter, 39, of Mountain Road, Gasport, is charged with harassment, 2nd. Wolter is accused of throwing his girlfriend to the ground, spitting on her and throwing a beer can at her. The alleged incident occurred at 11:10 p.m., Saturday, at 1575 Sumner Road.

Glenn K. King-McDade, 24, of Somers, is charged with DWI, driving with a BAC of .08 or greater and speeding. King-McDade was stopped at 11:17 p.m., Saturday, by Sgt. Michael Hare of the Le Roy Police Department on Clay Street. King-McDade is accused of driving 53 mph in a 35-mph zone.

Joseph Arthur Julyan, 46, of West Bain Street, Albion, is charged with assault, 3rd, and criminal mischief, 4th. Julyan was allegedly involved in a domestic incident where he pushed, grabbed and twisted another person's shoulders. He also allegedly grabbed the other person's mobile phone when the person attempted to call police. Julyan also allegedly violated the terms of his parole by being out of his county of supervision and drinking. He was jailed on $10,000 bail. New York State Parole was notified.

Jayme Roland Lang, 37, of Lewiston Road, Alabama, is charged with computer tampering, 4th. Lang is accused of changing the password on a woman's computer, denying her access to the computer.

Jose L. Rodriguez, 36, of 28 Voss Street, Rochester, is charged with DWI, driving with a BAC of .08 or greater, and failure to maintain the driving lane. Rodriguez was stopped at 2:02 a.m., Saturday, by Officer Kevin DeFelice on Oak Street, Batavia.

Eli R. Graves, 20, and Zachary J. Bourque, 20, both of East Aurora, are charged with burglary, 3rd. They were arrested by State Police for an alleged incident in Darien reported at 10:09 p.m., Friday. No further details were released.

James F. Hemmer, 49, of Elba, is charged with criminal mischief. Hemmer was arrested by State Police at 91 South Main St., Elba, for an alleged incident reported at 11:10 a.m., Thursday. No further details were released.

John T. Reagan, 28, of Cheektawoga, is charged with DWI with a conviction in the previous 10 years. Reagan was stopped by State Police on Sumner Road, Darien, at 11:53 p.m., Thursday.

Timothy D. Moore, of Geneseo, is charged with DWI, driving with a BAC of .08 or greater and failure to stop at a stop sign. Moore was stopped by State Police at 10:14 p.m., Wednesday, on Route 63 and Perry Road, Pavilion.

A motorcycle rider was taken by Mercy Flight to Strong Memorial Hospital yesterday after a van, whose driver thought a Route 19 intersection was clear, allegedly pulled out in front of the rider.

Daniel B. McMurdy, 46, of Westside Drive, Rochester, has been discharged from Strong as of this morning.

The 4:11 p.m. accident occurred at Route 19 and Vallance Road, Le Roy.

McMurdy was ejected from his bike, hitting the van's windshield, before falling to the pavement.

Cited for alleged failure to yield right-of-way at a stop sign was Michael Marmurek, 53, of Maxwell Street, North York.

The accident investigation was handled by Deputy Chad Minuto.

The following indictments were filed last week by the Genesee County Grand Jury.

Nicholas S. Dellarocco is indicted on charges of burglary, 3rd, criminal mischief, 4th, and petit larceny. Dellarocco is accused of entering a business at 3 West Ave., Le Roy, on May 3 with the intention to commit a crime. He allegedly damaged doors and a cash register in the building. He also allegedly stole cash from the business.

Alan J. Delano is indicted on charges of burglary, 2nd, petit larceny, and three counts of criminal possession of stolen property, 4th. Delano is accused of entering a residence at 61 Myrtle St., Le Roy, with the intent to commit a crime. He is accused of stealing a flat-screen TV and a vase along with $30 cash on March 13. He is accused of possessing a credit card, a debit card and a public benefits card belonging to another person.

Crystal L. Goodrich indicted on charges of felony DWI, driving with a BAC of .08 or greater and aggravated unlicensed operation of a vehicle. Goodrich is accused of driving a 2003 GMC on a public road in Pavilion on May 3 while intoxicated.

A one-car accident with an injury has been reported off Route 19, in the eastbound on ramp to the 490, in Le Roy.

Le Roy Fire and ambulance are responding.

The call came into Monroe County. Genesee County Emergency Dispatch has not received any calls about the accident

One person may have suffered a head injury. A person is reported at the side of the road holding another person.

UPDATE 8:50 p.m.: No accident was found. A fire chief spoke with a trooper who had been patrolling the area and the trooper had seen a disabled vehicle pulling a trailer and a person was beside the road working on the vehicle. Perhaps that's what the caller saw. Monroe County received only one call. Le Roy Fire and ambulance are clear.
