Following Rascal Flatts concert, 38 people in trouble with the law

The following people were arrested during the Rascal Flatts concert at Darien Lake Performing Arts Center on Saturday.

Kelly D. Roth, 23, Hamilton Road, Jamesville, is charged with criminal trespass, 3rd, and disorderly conduct after allegedly reentering the concert venue after being ejected and told not to return and then causing a disturbance in the parking lot. Roth was jailed on $500 bail.

Christopher A. Shoemaker, 21, Ogden Road, Syracuse, is charged with disorderly conduct after allegedly causing a disturbance while being escorted off Darien Lake property. Shoemaker was jailed on $200 bail.

Brandon R. Innes, 18, Stoughon Lane, Orchard Park, is charged with criminal trespass, 3rd, disorderly conduct after allegedly reentering the concert venue after being ejected and told not to return and then causing a disturbance in the VIP parking lot. Innes was jailed on $1,200 bail.

Jessica A. Turner, 19, Taylor Road, Eden, is charged with disorderly conduct after allegedly causing a disturbance while being escorted from Darien Lake property.

Trevor B. Berberian, 19, State Route 80, Tully, is charged with disorderly conduct after allegedly causing a disturbance while being escorted from Darien Lake property.

Kassandra R. Kerves, 24, North Greece Road, Rochester, is charged with disorderly conduct after allegedly causing a disturbance while leaving the concert venue.

Danielle A. Schulik, 22, Alfonso Drive, Rochester, is charged with disorderly conduct after allegedly fighting in the parking lot.

BrittaA. Schulik, 25, Alfonso Drive, Rochester, is charged with disorderly conduct after allegedly fighting in the parking lot.

Daniel R. Clever, 20, Bear Lake Road, Stockton, is charged with disorderly conduct after allegedly fighting with security while being escorted from the concert.

Adam E. Kress, 21, Haseley Road, Gasport, is charged with disorderly conduct after causing a disturbance in the parking lot.

Crystal J. Spurling, 20, Strouts Road, Elba, is charged with unlawful possession of marijuana and possession of alcohol under 21 after allegedly being found in possession of marijuana and alcohol.

Timothy M. Lincourt, 65, Rush-Lima Road, Honeoye, is charged with DWI after allegedly being found operating a vehicle in the parking lot while impaired by alcohol.

Anna M. Jones, 19, Victoria Boulevard, Kenmore, issued a citation for allegedly possessing another’s license after being found in possession of another person's NYS driver's license.

Emily H. Thomson, 17, Kent Street, Queenston, Ontario, Canada, issued a citation for allegedly possessing a fraudulent driver’s license after allegedly being found in possession of a fake British Columbia driver's license.

Eric S. Bagne, 20, Main Street, Walworth, issued a citation for possession of another’s license and possession of alcohol under age 21 after allegedly being found in possession of another person's NYS driver's license and alcohol.

Six Maroon 5 fans accused of fighting with guards or deputies

The following people were arrested during the  Maroon 5 Concert at Darien Lake Performing Arts Center on Wednesday.

Emily L Simmons, 21, North Central Avenue, Springville, is charged with two counts of second-degree harassment after allegedly grabbing a security guard by the head and then kicking several deputies and security guards. Simmons was jailed on $250 bail.

Patrick P. Sheridan, 45, Via Cimato Drive, Clarence Center, is charged with second-degree harassment and resisting arrest after allegedly pushing a security guard and then resisting arrest by refusing to be taken into custody.

David J. Irwin, 49, Pinyon Court, Clarence Center, is charged with two counts of second-degree harassment after allegedly pushing a security guard and then pushing and hitting another security guard in the face.

Joseph M. Ciliberto, 42, Pine Terrace, Orchard Park, is charged with second-degree harassment after allegedly striking a deputy during an investigation. Ciliberto was jailed on $250 bail.

Kara M. Balog, 22, Cochran Avenue, Springville, is charged with second-degree harassment after allegedly pushing a deputy after repeatedly being told to leave the venue. Balog was jailed on $200 bail.

Amanda N. Hayden, 21, Hefner Drive, Webster, is charged with disorderly conduct and second-degree harassment after allegedly causing a disturbance in the venue and then punching a deputy in the chest after being instructed to leave the concert venue. Hayden was jailed on $300 bail.

Amanda C. Snyder, 20, Woodhaven Circle, Hamburg, issued a citation for using another’s license.

Four arrests at Goo Goo Dolls concert at Darien Lake

The following people were arrested by the Genesee County Sheriff’s Office during the Goo Goo Dolls Concert at Darien Lake Performing Arts Center on Saturday.

Matthew S. Conover, 28, Green Forrest Court, East Amherst, is charged with DWI, aggravated DWI and aggravated unlicensed operation, 3rd, after allegedly operating a motor vehicle while intoxicated and with a blood alcohol level of .18% or higher. Conover allegedly drove into a ditch inside the concert venue parking lot. Conover’s license to operate a motor vehicle was also suspended. Conover was jailed on $500 bail.

Antho G. Serrano Jr., 19, Dodge Road, Getzville, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Riley T. Munger, 19, Greiner Hall, Buffalo, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Ty T. Buczkowski, 20, Wellington Road, Cheektowaga, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

One arrest reported at Allman Brothers concert at Darien Lake

The following person was arrested Friday at the Allman Brothers concert at Darien Lake Performing Arts Center.

Joseph M. Trippi, 18, of Meigs Street, Rochester, is charged with criminal trespass after allegedly jumping a fence to reenter the concert venue after being ejected and told not to return. Trippi was jailed on $250 bail.

County star Jason Aldean at Darien Lake means, of course, lots of arrests

The following people were arrested or issued citations by the Genesee County Sheriff’s Office and NYS DMV Investigators during the Jason Aldean Concert at Darien Lake Performing Arts Center on Aug. 17:

Jaime Barzey, 30, of Carroll Place, Bronx, is charged with criminal trespass, 3rd, after allegedly being found on Darien Lake property after being ejected several times on previous dates and told not to return. Barzey was jailed on $1,000 bail.

Ryan C. Jenks, 24, of Upper Alley Road, Holley, is charged with disorderly conduct after allegedly fighting in the concert parking lot. Jenks was jailed on $250 bail.

Shawn R. Schottmiller, 21, of Vandervoort Street, North Tonawanda, is charged with two counts of harassment, 2nd, after allegedly hitting two Darien Lake security guards. Schottmiller was jailed on $500 bail.

Craig D. Gingerich, 22, of Fish Hill Road, South Wales, is charged with attempted petit larceny, resisting arrest and harassment, 2nd, after allegedly attempting to take money from a food stand cash drawer and then while being placed under arrest, Gingerich allegedly bit a Genesee County Sheriff’s deputy in the hand. Gingerich was jailed on $750 bail.

Adam M. Logue, 23, of Jackson Road, Webster, is charged with disorderly conduct after allegedly fighting in the concert venue entrance. Logue was jailed on $250 bail.

Brandon M. Hallock, 23, of Happy Hollow Road, Olean, is charged with disorderly conduct after allegedly engaging in a fight in the concert parking lot. Hallock was jailed on $250 bail.

Joseph E. Flanagan, 21, of Upper Holley Road, Holley, is charged with disorderly conduct after allegedly engaging in a fight in the concert parking lot.

Thirty-six people arrested or issued citations at John Mayer concert at Darien Lake

The following people were arrested by the Sheriff's Office during the John Mayer Concert at Darien Lake Performing Arts Center on Tuesday.

Robert M. Murphy, 34, Brixton Trail, Webster, is charged with two counts of assault, 3rd, after allegedly causing two Live Nation security guards injuries while he was being ejected from the venue. One security guard sustained a broken finger and the other Security Guard sustained a severe laceration to his head. Murphy was arraigned in Darien Court and remanded to jail in lieu of $500 bail.

Christian R. Amering, 18, Landing Road, North Rochester, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Nine arrests reported at Uproar Festival at Darien Lake

The following people were arrested during the Uproar Festival at Darien Lake Performing Arts Center on Sunday.

Zachary T. Pabst, 19, Ryan Street, Buffalo, is charged with DWAI drugs and unlawful possession of marijuana after allegedly operating a motor vehicle entering the concert parking lot while under the influence of a drug. He was also found in possession of marijuana.

Louis R. Lopez, 18, Williams Street, Cheektowaga, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Hannah J. Eisenbaum, 19, Oak Wood Avenue, East Aurora, is charged with unlawful possession of marijuana and possession of alcohol under age 21 after allegedly being found in possession of marijuana and alcohol being under age 21.

Koree A. Hubbard, 19, Wellington Drive, Derby, is charged with unlawful possession of marijuana after allegedly being found in possession of marijuana.

Photos: Uproar Festival at Darien Lake Performing Arts Center

The turnout for the Uproar Festival at Darien Lake Performing Arts Center was moderate -- something over 6,000 paying customers, but those who did make their way to the venue surely weren't disappointed. There was plenty of quality music for the punk/grunge/heavy rock fan.

There were also activities and merchant booths to amuse concertgoers between acts.

While some might think all the of the action was on the main stage, the secondary change may actually have been more entertaining. The bands there were Cry to the Blind, the Chuck Shaffer Picture Show, Dead Daisies, Middle Class Rut, New Politics and Walking Papers.

The Dead Daises are an interesting act -- kind of a super group, though most fans would readily recognize the names of band members, they've all performed on hit records. The Dead Daisies are billed on the band's Web site as a project of former Guns and Roses guitarist Slash, but performing on lead guitar in Darien on Sunday was Richard Fortus, who has also taken on lead guitar duties with Guns and Roses.

Walking Papers was another experienced, tight band that knows how to put on a live show.

Definately in the up-and-coming category is the Chuck Shaffer Picture Show. 

New Politics was entertaining, to say the least, and has a bit of an old-school British Punk vibe to their music.

On the main stage there was Circa Survive, Coheed & Cambria, Jane's Addiction and Alice in Chains.

Great performances all the way around, of course, but it was something special to see Dave Navarro (guitarist, Jane's Addiction, top photo) perform live.

You won't see photos of Alice in Chains here. The band's management insists on pre-publication approval of photos. I won't sign such an agreement. My deal is, I won't tell you what songs to play and you don't tell me what photos to shoot.

Lil’ Wayne fans keep deputies busy during concert at Darien Lake

The following people were arrested during the Lil’ Wayne Concert at Darien Lake Performing Arts Center on Tuesday.

Sophia P. Frank, 19, Kraig Road, Pittsford, is charged with trespass after allegedly refusing to leave the concert venue after being told numerous times to leave. Frank was jailed on $250 bail.

Joan M. Schrier, 36, of Howard Avenue, Lockport, charged with harassment, 2nd, after she allegedly shoved another concert patron in the neck causing small abrasions to her neck. 

Zachary A. Webber, 20, of Route 39, Arcade, charged with unlawful possession of marijuana and issued a citation for possessing alcohol being under, 21 after allegedly being found in possession of alcohol and marijuana.

Weather halts Bon Jovi concert at Darien Lake

A strong thunderstorm that has moved into the area has brought a halt to Bon Jovi's show at Darien Lake Performing Arts Center.

Heavy rain, lightening and thunder hit the Darien area in the middle of Bon Jovi's performance, according to Tweets from fans at the show.

The National Weather Service issued a special weather statement warning that the storm has the potential to become severe.

Localized flooding is possible.

UPDATE 9:41 p.m.: The concert is restarting in five minutes.

Fifteen arrests at Toby Keith concert Sunday at Darien Lake

The following people were arrested by the Sheriff's Office during the Toby Keith concert at Darien Lake Performing Arts Center on Sunday.

Jeremy M. Perez, 24, of Ayrault Drive, Amherst, is charged with DWI, driving with a BAC of .18 or greater and aggravated unlicensed operation, 3rd, after allegedly operating a pickup truck in the concert parking lot striking another car and leaving the scene. Perez allegedly had a revoked driver’s ID. Perez was jailed on $2,000 bail.

Joshua M. Perez, 21, of Ayrault Drive, Amherst, is charged with disorderly conduct after allegedly causing a disturbance in the concert parking lot. Perez was jailed on $150 bail.

Angel L. Castro, 24, of Plymouth Avenue, Buffalo, is charged with trespass after allegedly refusing to leave the concert parking lot after being told to leave several times.

Judy L. McLaughlin, 44, of Park Lane South, East Aurora, is charged with harassment, 2nd, after allegedly pushing and punching security while being ejected from the concert venue.

Michael P. McLaughlin, 47, of Park Lane South, East Aurora, is charged with disorderly conduct after allegedly causing a disturbance inside the concert venue.

Mark A. Ritchie, 29, of Warden Avenue, Niagara Falls, Ontario, Canada, is charged with criminal trespass, 3rd, after allegedly reentering the concert venue after being ejected and told not to return. Ritchie was jailed on $500 bail.

Criminally speaking, fairly quiet night at Brad Paisley concert

Travis J. Sheldraky, 19, Burke Road, Dunville, Ontario Canada, is charged with disorderly conduct after allegedly causing a disturbance by pushing a security guard.  Sheldraky was arraigned and jailed on $250 bail.

Anna K. Rauber, 18, County Route 46, Dansville, charged with criminal trespass, 3rd, after allegedly being ejected from the concert venue and then being found within the venue after being told she could not reenter.

Ashley L. Shields, 24, Main Road, Akron, charged with harassment, 2nd, after allegedly striking another subject and throwing her into a vehicle fender.

Ian M. Emes, 20, Wayside Drive, Lewiston, charged with criminal trespass, 3rd, and possession of another person's license. Kid Rock apparently gives $5K to assist man in a coma after altercation

A $5,000 donation from Kid Rock is listed on the Web page set up at giveforward.com to raise funds for Jason McNeil, the former WNY resident who is in a coma after apparently being punched by another patron at the performer's concert at Darien Lake on July 6.

McNeil is still in a coma but making progress according to a Facebook page set up to keep people apprised of his condition.

The donation page says that so far 290 donations have been made totaling more than $30,000 with a goal of raising $20,000 more over the next 29 days.

The 43-year-old Alabama resident is originally from Alden, but reportedly is very involved in his community in Tuscaloosa and has lots of friends and supporters there. He is involved in several charities in the community and is a member of Kiwanis.

He's been in a coma since being taken by Mercy Flight to ECMC after allegedly being punched in the face by Craig Malcolm Lawson, 34, of Talbot Street, Courtland, Ontario, Canada.

Lawson is charged with assault, 3rd, a misdemeanor, and is out of jail on $1,000 bail.

While the Sheriff's Office is continuing its investigation, District Attorney Lawrence Friedman said his office will review the evidence as the case develops. It's possible Lawson could face a felony charge if there is sufficient evidence to sustain such a charge.

An upgraded assault charge would be assault in the second degree. In order to prove that charge, the prosecution would need to show that the defendant intended to cause serious injury.

Alleged assault case at Kid Rock concert grows more complicated with news of serious injuries

The suspect in the alleged assault following the Kid Rock concert July 6 at the Darien Lake Performing Art Center has probably learned by now that his alleged victim is in serious condition, but District Attorney Lawrence Friedman said he has no reason to believe the Canadian resident won't make his scheduled court appearance July 30.

Craig Malcolm Lawson, 34, of Talbot Street, Courtland, Ontario, Canada, was initially charged with just a misdemeanor, assault in the third degree, so bail was only set at $1,000.

Indications are, however, that Lawson, who according to sources has a good job in Canada, is taking the case seriously. He's hired a private attorney, who happens to also be a state senator, Michael Ranzenhofer.

"He has retained an attorney who has appeared on his behalf," Friedman said. "The defendant is scheduled to appear in court on July 30 and at this point I have no reason to believe that he won’t be there."

If Lawson were to fail to appear, the District Attorney's Office would need to work with Canadian authorities to obtain his arrest and extradition, which could delay progress of the case.

The alleged victim, Jason McNeil is in a coma, according to friends, at ECMC.

A few days ago, media in Alabama reported on the 43-year-old McNeil's condition and described the Tuscaloosa resident as a "prominent businessman." His coworkers set up a fundraising campaign on his behalf with a goal of raising $25,000 (now $50,000, with more than $18,000 raised so far). There's also a Facebook page set up for McNeil.

McNeil is the owner and operator of Synchronous Industrial Services and has a wife and two children. He's originally from the Alden area and besides going to see Kid Rock he was in WNY for a few days to visit with family.

The fundraiser and media coverage of McNeil's condition could likely alert Lawson that the case is more serious than he might have thought after his initial arrest, but Friedman said he believes Lawson will meet his obligation to appear in court.

"As I said, it appears to me that the defendant has retained counsel and will do the right thing and he will address these charges as he needs to," Friedman said. "I’m not going to speculate on any problems in that regard."

Last August, the District Attorney's Office went through a similar case, which is still pending, against Kelly L. Alcorn, who was initially charged with harassment for allegedly hitting another patron at the Jason Aldean concert.

The alleged victim went to Buffalo media and claimed she was more seriously injured than might warrant a misdemeanor charge. The woman sought a felony charge against Alcorn, a police officer in Niagara Falls.

Friedman's office reviewed the accounts of events, the available evidence and the medical records and eventually sought a grand jury indictment against Alcorn, who is now facing a charge of assault in the second degree.

The same process could be followed in the Lawson case, Friedman said.

"We need to get a handle on what occurred, statements of witnesses, police reports, things like that, and follow the victim's medical condition before we make any decision," Friedman said.

When Darien Town Justice Gary Graber arraigned Lawson the night of July 6, he was presented with a document called an accusatory instrument that specified the charge against Lawson -- the misdemeanor of assault, 3rd -- and a very brief narrative of what police believed happened. He also was given, in this case, two brief witness statements.

From the penal code:

A person is guilty of assault in the third degree when:
1. With intent to cause physical injury to another person, he causes such injury to such person or to a third person ...

The accusatory states that Lawson, "did punch Jason McNeil in the head with a closed fist causing him to lose consciousness and fall to the pavement."

There were also two witness statement's in Lawson's court file.

One witness, who said she is a cousin of McNeil's, said that as she was coming out of the concert, "some guy came up to my cousin, Jason McNeil, and punched him in the face with a closed fist. Jason proceeded to fall backwards and hit his head on the pavement and did NOT MOVE. Jason was not arguing with anyone and I have no idea why he was punched."

Another witness, a Depew resident working for the concert venue, also said he saw the alleged incident.

"I saw a man wearing a red tee shirt arguing with a male that was younger than him," he wrote. "The man in the red pushed the younger kid. The younger looking male was walking backwards and the male in the red pulled his arm way back and punched the younger looking kid. I heard the punch hit the kid in the face and I also heard the younger kid's head hit the ground."

At the time Graber set Lawson's bail at $1,000, he would have had no direct information on McNeil's condition or the fact that McNeil was taken by Mercy Flight to ECMC.

To sustain a charge of assault in the second degree, the prosecution would need to be confident that it could prove the defendant intended to cause serious injury. For example, the need to prove intent eventually lead to the dismissal of one of the felony counts against Jacquetta Simmons in the Walmart Christmas Eve assault case. Simmons was convicted by a jury of a single felony involving the assault on a person over age 65, rather than straight assault, 2nd.

Few arrests at Vans Warp Tour at Darien Lake

The Sheriff's Office announced the following arrests Saturday during the Vans Warp Tour at Darien Lake Performing Arts Center.

Charles W. O’Shea, 35, of 6972 W. Main Road, Le Roy, is charged with felony DWI, felony driving with a BAC of .08 or greater, aggravated unlicensed operation, 1st, and aggravated unlicensed operation, 2nd, after allegedly being found operating in an intoxicated condition in the campground area. 

Shalanda L. Darden, 24, of North Hampton Street, Rochester, is charged with unlawful possession of marijuana.

Jed T. Jastrzemski, 18, of Rumbold Avenue, North Tonawanda, was the only person cited for alleged possession/consumption of alcohol under age 21.

Alleged assault requiring Mercy Flight among arrests at Kid Rock concert

The Sheriff's Office made the following arrests during the Kid Rock concert Friday at Darien Lake Performing Arts Center.

Jordan J. Apps, 35 of Bertie Bay Road, Fort Erie, Ontario, Canada, is charged with third-degree criminal mischief after allegedly punching the window out of a vehicle. Apps was on $20,000 bail.

Craig M. Lawson, 34 of Talbot Street, Ontario, Canada, was charged with third-degree assault after allegedly punching another patron in the face knocking him unconscious. The victim was transported to ECMC by Mercy Flight. Lawson was jailed on $1,000 bail.

Brian R. Becker, 38 of Eastham Court, Webster, is charged with DWI, driving with a BAC of .08 or greater and operating with a suspended registration.

Patrick J. Gillen, 22 of Baywood Drive, Cheektowaga, is charged with unlawful possession of marijuana.

Jhon A. Polanco, 16 of North Clinton Avenue, Rochester, is charged with unlawful possession of marijuana.
