Jan Gilbert is hoping the legions of eagle-eyed readers of The Batavian, with their vaunted capability to locate any untold number of missing pets over the years, will pull through yet again and spot Cali.

This petite 7-year-old female feline lives in Bergen and is named, rather obviously, after her coat. Her moniker is not shorthand for California, a word more likely to be used by people who aren't from there. (There being where the publisher and editor of The Batavian hail from.)

Graced with a face that probably accrues charm the more you see it, Cali looks quite distinctive. "Elle est belle, n'est-ce pas?" A pixie with effiminate van-Dyck-meets-blotch-and-smudge colorations.

Jan says she's been missing from the area of Route 33 and West Bergen Road for a whopping six weeks.

This is hard for the family, whose members have stuffed mailboxes in the vicinity with fliers about their lost pet. They miss her lovableness and her little furry presence lolling about.

She's an indoor-except when-she wants-to-be-outdoor-cat. (T-shirt: Cat with all four paws splayed and gripping a screen door. Text: "Cat wants in. Cat wants out.") Adopted as a feral kitten, Cali feels naturally at home in both worlds, and likes to hunt and prowl when the mood strikes. She's shy, unless she's stalking in the savanna, then she's sly.

"She's always come home," Jan says. "She's stayed out overnight before, but always comes back in a day or two. But not this time."

She was possibly spotted by a neighbor a couple of weeks ago, but the neighbor's snarky little dog chased her off those premises and she has not been seen since. Although a few people have reported seeing a cat like Cali, alas, none were actually her.

So, take a good look. There's only one cat in Bergen who looks like that. And if you see her, call Jan Gilbert at 585-967-9042.

Nicholas Ronald Schramm, 18, of Byron Holley Road, Byron, is charged with criminal mischief, 4th. Schramm is accused of damaging property of another person while at a residence, not his own, on Byron Holley Road, Byron, on Monday. He was jailed on $5,000 bail or $10,000 bond.

Connor D. Gardner, 18, of Kemp Drive, Macedon, is charged with criminal possession of a controlled substance, 7th, criminal use of drug paraphernalia, 2nd, and unlawful possession of marijuana.

Justin Daniel Pursel, 28, of North Street, Le Roy, is charged with DWI, driving with a BAC of .08 or greater, failure to keep right, and leaving the scene of a property damage accident. Pursel was allegedly involved in an accident on Batavia Elba Townline Road at 1:30 a.m. Saturday. The accident was investigated by Deputy Mathew Clor and Deputy Andrew Mullen.

Kyle J. Stack, 32, of Medina, is charged with DWI, unlawful possession of marijuana, and obstruction of governmental administration. Stack is accused of driving drunk in the Town of Bergen at 11:11 p.m. Tuesday though he was arrested by State Police in the Village of Medina. He was ordered held on cash bail. No further details released.

Quinton V. Holmes, 27, of Churchville, is charged with driving while impaired by drugs, failure to keep right, and speeding. Holmes was stopped by State Police on Buffalo Road, Bergen, at 3:43 p.m. Saturday.

Jennifer L. Blake, 44, of Elba, and Christopher W. Blake, 44, of Byron, are charged with trespass. The two people were arrested by State Police for allegedly trespassing on property in Byron at 7:45 p.m. Thursday. No further details released.

Jay R. Howcraft, 58, of Rochester, is charged with DWI and driving with a BAC of .08 or greater. Howcraft was stopped by State Police at 8:21 p.m. Friday on Pratt Road, Town of Batavia.

Bergen Mayor Anna Marie Barclay has “put her foot where her mouth is,” so to speak.

After years of seeking grants for downtown revitalization and urging business owners to spruce up their properties, the mayor and her husband David have purchased one of Bergen’s downtown buildings and begun renovation.

“We decided it was our turn to give downtown a boost,” Anna Marie said.

The building on the southwest corner of South Lake Street and Buffalo Street is on the National Register of Historic Places, as is most of downtown Bergen. The first thing the Barclays did after becoming owners was to contact the Landmark Society for the name of an architect familiar with historic buildings. They were referred to architect Rick Hauser, of Perry.

Until two years ago, the building housed Grace Baptist Church, until the owners took it back by default.

The Barclays purchased it in June and had to do a site plan for a change of use.

Anna Marie said the inside of the building is in pretty good shape, so they are going to work on the outside first.

The Barclays already have a potential tenant who wants to set up his studio upstairs, artist David Burke. Burke painted the murals on the back wall of the Byron-Bergen Public Library and the old fire hall.

Anna Marie said the village has applied for a Main Street grant at least 10 times and was turned down. She isn’t giving up, however, and has submitted another application this year. She is optimistic about their chances this year, as she said they had more input from building owners than in the past.

“We also have a technical grant under our belt, which allowed us to do drawings of our facades,” she said.

If they get the Main Street grant, it would include all the buildings on the west side of the street from the Masons’ building north to the railroad tracks, except the Tully Building, which houses village offices and has been restored.

“Getting the grant would be a plus, but even if we don’t, there are two buildings downtown that will have considerable work done on them,” Barclay said, referring to her building and the one across the corner being restored by Phillip and Brette-Ashley Wilcox.

Michelle Ann Case, now 50, and twice convicted of stealing money from her former employer, HomeCare & Hospice, has yet to pay back any of the more than $14,000 she took by falsifying business records.

The former Bergen resident was back in County Court today for a restitution hearing, which consisted primarily of her attorney, Public Defender Jerry Ader, and District Attorney Lawrence Friedman providing Judge Charles Zambito reams -- one of the four folders was three-inches thick -- of reading material.

The folders contained trial transcripts, transcripts of the 2012 restitution hearing, and documentation of the falsified reports.

By law, Case will be required to pay at least $3,000, the amount specified by the language of the statute in penal law she violated, but only a judge, after reviewing evidence, can order a defendant to pay more than that statutory amount.

Legal troubles for Case go back to at least 2010 when she was arrested and accused of stealing more than $35,000 from two elderly patients. Those charges were dismissed with no explanation from Judge Robert C. Noonan and the case files were sealed.

In 2011, Case was arrested again, this time accused of submitting false claims for hours worked and miles driven to HomeCare & Hospice. She was convicted March 1, 2012, and sentenced to four months in jail and probation.

Nearly two years later, an appeals court overturned her conviction and ordered a new trial.

The jury again returned a guilty verdict in July 2014.

At her sentencing in August 2014, Case told Noonan, she had done nothing wrong and said the real criminals were the executives at HomeCare & Hospice.

"These rules were new and used retroactively to make my legitimate paid time into unpaid time in an attempt by Hospice to claim I stole from them and in effect steal themselves," Case said. "They then fraudulently submitted their so-called losses to insurance and filed a false report to the police."

Noonan sentenced Case to probation.

But that left the matter of restitution unresolved. 

Friedman argued that there had already been a restitution hearing on the same facts and Case had been ordered to pay $14,000 in restitution. An appeals court saw it differently and ordered a new restitution hearing. Fortunately, Friedman said, it was unnecessary this time to call all the witnesses in again. The transcripts are all Zambito needs to review the case and render a decision.

Zambito will review the documents over, at least, the next 30 days, perhaps longer, before issuing a decision.

A Bergen native whose family dates back to the 1800s is writing a new chapter in her family’s (and Bergen’s) history.

Brette-Ashley Wilcox Schmitt, the great-granddaughter of the late Harris Wilcox, and her husband Phillip Schmitt have recently purchased the Victorian c. 1904 building near the corner of North Lake Street and Rochester Street.

The couple plans to renovate the building and use the downstairs as a new photography studio for Brette-Ashley.

Brette-Ashley has been a full-time photographer for eight years, having started as a wedding photographer. Phillip is director of finance at Roberts Wesley College.

When Brette-Ashley decided to focus on doing only portraits, she was looking for a building to rent, she said.

“I had been doing free-lance work, so this is my first brick and mortar studio,” she said. “My business has grown to where I really need a building to call home.”

Bergen Mayor Anna Marie Barclay is thrilled the building is going to see new life. It had been a law office at one time, and then a landscaper bought it, and it sat empty for several years, she said.

The Schmitts said they could see the potential in the building when they bought it at auction.

“We knew it would be a lot of work, but Phillip and I feel tremendously blessed to have such hardworking and generous people helping us with this project,” Brette-Ashley said.

A village of people have helped encourage her to follow her dreams, she said.

Since starting renovation they have had a “lot of good surprises,” such as getting the floors down to the original hardwood, Brette-Ashley said. They also are going to preserve one wall of exposed brick.

They plan to do the work in phases and hope to be ready for her to open her doors before Thanksgiving.

“It feels so nice to be doing business in my hometown,” Brette-Ashley said. “Harris had such a positive impact in this community.”

She fondly recalls how Harris would invite her to his farm every week during the summer, teaching her to ride a horse and giving her advice for the future.

“He was such a busy man, yet he took the time to invest in me,” Brette-Ashley said. “His involvement in this community was tremendous, and if I can follow in his footsteps just a little bit, I will be happy. He was such a role model.”

Brette-Ashley said she is excited for their new journey and she can’t wait to open her doors and bring her business to her home town of Bergen.

Christina Louise Wass, 45, of McKenzie Street, Bergen, is charged with endangering the welfare of a child. She was arrested at 8 p.m. on Aug. 21 following a complaint in the Village of Bergen. It is alleged that Wass had a minor under age 17 in her care and custody and that she left the child alone without proper supervision, and that child was under age 5. She was arraigned in Town of Le Roy Court and jailed in lieu of $1,000 cash bail or $3,000 bond. She is due in Town of Bergen Court on Sept. 5. The case was handled by Genesee County Sheriff's Deputy Howard Wilson, assisted by Sgt. Jason Saile.

John David Meiler, 33, of Reinhardt Road, Alden, is charged with: driving while ability impaired by drugs; aggravated unlicensed operation in the first degree; DWI; and operating a vehicle withcKeout an ignition interlock device. On Aug. 21 at about 7:48 p.m., Genesee County Sheriff's deputies responded to 358 Bloomingdale Road in Alabama for a property damage accident. Meiler, whose driver's license has been revoked, was arrested at the scene on the charges. He was issued appearance tickets and is due in Town of Alabama Court on Sept. 26. The case was handled by Deputy Erik Andre.

Mark David Humel, 26, of Main Road, Pembroke, is charged with: driving while ability impaired (DWAI); aggravated unlicensed operation in the first degree; DWAI -- combined drugs and alcohol; used a vehicle not equipped with an ignition interlock device; and leaving the scene of a property damage accident. On Aug. 20 at about 3:37 p.m., Genesee County Sheriff's deputies responded to 8330 Lewiston Road in the Town of Batavia for a report of a property damage accident. Following an investigation, Humel, whose driver's license is revoked, was arrested on the charges. He was issued appearance tickets and is due in Town of Batavia Court on Sept. 24. The case was investigated by Deputy Erik Andre, assisted by Deputy Howard Wilson.

Marshall A. Silvernail, 31, of Asbury Road, Le Roy, was arrested on Aug. 12 for trespass, a violation. Le Roy Police Department responded to a residence located in the Village in the early morning hours of July 29 after receiving a complaint that there was an unwanted subject on the property. Upon arrival, patrols allegedly located Silvernail on the property attempting to enter the premises. After a brief investigation, it is believed that Silvernail had previously been told he was not allowed on the property and charges were later brought for his arrest. He was due in Le Roy Town Court Aug. 13 to answer the charge.

Ramon S. Gilliam, 43, of Main Street, Le Roy, was arrested on Aug. 16  by the Le Roy Police Department and with charged with attempted identity theft in the third degree, a Class B misdemeanor. This charge stemmed from a complaint that officers received and after an investigation it is alleged that Gilliam did in fact, attempt such crime. Gilliam was taken into custody and processed without incident and issued an appearance ticket for Sept. 20 in Le Roy Town Court to answer the charge.

A Bergen daycare has stepped up to offer services to children whose daycare closed unexpectedly.

When Amy Hathaway, owner of Little Guppies Daycare, heard that Grandma’s Luv’n Care on Clinton Street Road in Batavia was closing Aug. 31, she contacted the owner and asked what she could do.

Hathaway said she believed Grandma’s Luv’n Care was forced to close because of the increased minimum wage.

“I asked what I could do to help with this transition,” Hathaway said. “I decided to offer one week’s free tuition to any families who enrolled with our center. I know this has to be extremely stressful and hopefully, I can help ease families’ stress. I always wanted to give back to my community and I’m hoping my offer does that.”

Hathaway has owned her own daycare center for seven years. Her mom ran a daycare out of her home, so she is no stranger to the business, although Hathaway went to college for accounting. She worked at Paychex but realized teaching kids was more fun and started taking care of six children at her house.

She next advanced to group daycare, which allows 12 children in one home.

“Once I had a waiting list, I knew I had to get bigger,” Hathaway said.

When space in Arlington Manor, the former school in Bergen, came up for lease on Craigslist three years ago, Hathaway contacted the owner and signed a lease agreement, putting a daycare on the ground floor.

Hathaway hired Morgan Piccini, of Hamlin, as a schoolteacher, and last year made her assistant director.

“I love it here and can’t imagine doing anything else,” Piccini said.

As part of Hathaway’s desire to give back to her community, the daycare is planning more activities for the community this year.

They will have breakfast with Santa, an Easter egg hunt and a lot of outside events for families.

Hathaway has made some long-lasting friends since she has been in the business, such as 9-year-old Cameron Tomai, who has been coming to her daycare since he was in preschool. Another child has been coming since the age of 3 months.

“I really like it here,” Cameron said. “It gets me out of the house and I like to hang out with Miss Amy.”

Little Guppies Daycare offers breakfast, a morning snack, lunch and an afternoon snack.

Hours are from 6:30 a.m. to 6 p.m. Monday through Friday.

They accept school-age children 5 to 12; preschoolers 3 to 5 years; toddlers 18 months to 3 years; and infants 6 weeks to 18 months.

Dustin Wayne Bogue, 36, no permanent address, is charged with: second-degree attempted assault -- attempt to cause injury to officer/fireman/EMT/hospital staff; criminal mischief, intentionally damaging property; and third-degree criminal tampering. Bogue was arrested at 3:01 p.m. on Aug. 7 after he allegedly initiated a physical altercation with Mercy EMS paramedics at UMMC. He was arraigned and jailed without bail and will appear in City Court at a later date. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Officer Frank Klimjack.

Kelly M. Howell, 32, of Monclair Avenue, Batavia, is charged with: endangering the welfare of a child; possession of a hypodermic instrument; second-degree criminal use of drug paraphernalia; and criminal possession of a controlled substance, 7th. The charges stem from an incident 6:07 p.m. on Aug. 14 in which narcotics and narcotics equipment were allegedly found inside this female's residence on Monclair Avenue, where three children under the age of 17 had the ability to gain access to them. Howell was jailed in lieu of $10,000 cash or bond and was due in City Court on Aug. 15. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Christopher Camp.

Robert M. Sindon, 37, of West Genesee Street, Clyde, is charged with: DWI -- with a BAC of .08 percent or more; DWI; Leandra's Law DWI -- passenger less than 16 years of age. Sindon was stopped at 5:37 p.m. on Aug. 6 on East Main Street in Batavia following an investigation into a traffic complaint. It was alleged that he was driving a vehicle while intoxicated with two children under age 15 as passengers. He was jailed without bail and was due in City Court on Aug. 7. The case was handled by Batavia Police Officer Stephen Cronmiller, assisted by Officer Christopher Lindsay.

Kevin M. McCoy, 51, of Central Avenue, Batavia, is charged with: third-degree criminal mischief -- property damage greater than $250; second-degree criminal use of drug paraphernalia; and second-degree harassment -- physical contact. McCoy was arrested on East Main Street in Batavia on Aug. 13. Police were called to an address there at 12:38 a.m. after McCoy allegedly broke an apartment window. McCoy had fled the scene but showed back up there awhile later. After attempting to elude police again, he was eventually apprehended and arrested. He was arraigned in City Court and jailed without bail. He is due in court again on Aug. 23. The case was handled by Batavia Police Officer Nicole McGinnis, assisted by Officer Felicia DeGroot.

Paul J. Doctor, 40, of Oak Street, Batavia, is charged with: criminal possession of a controlled substance, 7th; second-degree criminal use of durg paraphernalia; unlawful possession of marijuana; and speeding. He was arrested at 10:15 p.m. Aug. 5 on Clinton Street in Batavia following a traffic stop for speeding. He was allegedly found to be in possession of a crack pipe, chore boy, plunger with drug residue and marijuana. He was due in City Court on Aug. 14. The case was investigated by Batavia Police Officer Jason Davis, assisted by Officer Christopher Lindsay.

Jason M. Frens, 47, of Griffin Road, Basom, is charged with second-degree criminal use of drug paraphernalia and seventh-degree criminal possession of a controlled substance. Frens was arrested on the charges following a traffic stop at 10:15 p.m. on Aug. 5 on Clinton Street in Batavia. He was a passenger in the vehicle that was stopped and allegedly was found to be in possession of a crack pipe, chore boy, and plunger with drug residue. He was due in City Court on Aug. 14. The case was investigated by Batavia Police Officer Jason Davis, assisted by Officer Christopher Lindsay.

Andrew M. Cerrillo, 27, of Stony Point Road, Grand Island, is charged with: felony DWI -- previous conviction offense within 10 years; speeding; no turn signal; and expired 2017 10-day inspection. He was arrested at 3:35 p.m. on Aug. 14 on Main Road in Stafford after he was stopped for speeding. He was jailed on $5,000 cash or $10,000 bond. The case was handled by Genesee County Sheriff's Sgt. John Baiocco, assisted by Deputy James Stack.

Alexandria Claire Pisarek, 25, of Maple Avenue, Oakfield, is charged with seventh-degree criminal possession of a controlled substance. She was arrested at 5:08 p.m. on Aug. 15 following a transport to GC Jail. She was allegedly found to be in possession of 20 small bags of heroin. She is due in City Court to answer the charge on Oct. 16. The case was investigated by Genesee County Sheriff's Deputy Joshua Brabon.

Patrick S. Rumble, 31, of Hutchins Place, Batavia, is accused of first-degree criminal contempt, third-degree robbery, and fourth-degree grand larceny. Rumble was arrested then arraigned in City Court on Aug. 9. He was arrested on a warrant for the charges. On Aug. 1, he allegedly stole a cell phone from an individual's hand and that person had a stay away order of protection against Rumble. During the course of the crime, Rumble allegedly pushed and struck the victim, all in violation of the court order. He was jailed in lieu of $5,000 cash and $10,000 bond and was due in court today (Aug. 16). The case was handled by Batavia Police Officer Jamie Givens.

Jeffrey Michael Johnson, 30, of Jackson Street, Batavia, is charged with second-degree harassment. He was arrested at 8:18 p.m. on Aug. 5 at 101 Jackson St. in Batavia after he allegedly pushed a female during an incident. He was due in City Court on Aug. 14. The case was handled by Batavia Police Officer Mitchell Cowen, assisted by Officer Stephen Cronmiller.

Andrew J. Duckworth, 39, of Monclair Avenue, Batavia, is charged with first-degree criminal contempt and fouth-degree criminal mischief. Duckworth was arrested at 6:04 p.m. on Aug. 13 following a domestic incident on Montclair Avenue in which he allegedly damaged property and violated a court order of protection. He was jailed without bail and was due in City Court on Aug. 14. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Officer Christopher Lindsay.

Ahdeosun R. Aiken, 20, of Ellicott Avenue, Batavia, is charged with second-degree criminal contempt. At 8:19 p.m. on Aug. 3 Aiken was arrested on Walnut Street in Batavia for allegedly violating a stay away order of protection. He is accused of being at the protected party's residence during an incident. He was released on his own recognizance and was due in City Court on Aug. 6. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Jamie Givens.

Carrie L. Hensley, 41, of Highland Park, Batavia, is charged with: DWI; aggravated unlicensed operation of a motor vehicle in the third degree; and DWI with a BAC or .08 percent or more. She was arrested at 12:16 a.m. on Aug. 13 on Central Avenue in Batavia after she was allegedly found to have driven a motor vehicle while intoxicated. She was issued appearance tickets and is due in City Court on Aug. 22. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Felicia DeGroot.

Steven D. Clattenburg, 58, of Washington Avenue, Batavia, is charged with: not wearing a seat belt; DWI; DWI -- with a BAC or .08 percent or more; and unlawful possession of marijuana. Clattenburg was arrested at 7:37 p.m. on Jefferson Avenue in Batavia following a traffic stop for no seat belt. He was issued appearance tickets and is due in City Court on Aug. 22. The case was handled by Batavia Police Officer Stephen Cronmiller, assisted by Officer Christopher Camp.

Kyle A. Scheuerlein, 25, Leyland Lane, Aurora, Ill., is charged with: DWI -- first offense; refusal to take a breath test; and failure to stop at stop sign. He was arrested at 1:16 a.m. on Clinton Street in Batavia on Aug. 4. He was issued tickets and released. He is due in court on Aug. 22. The case was handled by Batavia Police Officer Matthew Wojtaszczyk.

James R. Tillery, 46, of Farwell Drive, Batavia, is charged with second-degree harassment -- physical contact. He was arrested at 1 a.m. on Aug. 11 on Farwell Drive following an incident in which he allegedly struck someone. He was issued an appearance ticket and was due in City Court on Aug. 14. The case was handled by Batavia Police Officer Marc Lawrence, assisted by Officer Kevin DeFelice.

Justin T. Gladney, 29, of North Spruce Street, Batavia, is charged with petit larceny. He was arrested at 4:30 p.m. on East Main Street in Batavia and is accused of stealing a bicycle. He was issued an appearance ticket and was due in City Court on Aug. 14. The case was handled by Batavia Police Officer Christopher Lindsay, assisted by Officer Chad Richards.

Austin B. Nelson, 22, of Thomas Avenue, Batavia, is charged with petit larceny. At 7 p.m. on July 5, he allegedly stole money from the place of business where he was employed on East Main Street, Batavia. He was arrested and issued an appearance ticket and is due in Batavia City Court on Aug. 28. The case was investigated by Batavia Police Officer Jamie Givens.

Isaiah James Alfred Munroe, 28, of Liberty Street, Batavia, is charged with fourth-degree criminal mischief. He was arrested following the investigation into an allegation that he damaged a door to a residence on Liberty Street in the city at 4:45 p.m. on Aug. 11. He was processed at police headquarters, issued a computer-generated appearance ticket and released. He was due in City Court on Aug. 14. The case was handled by Batavia Police Officer Kevin DeFelice, assisted by Officer Matthew Lutey.

Danny D. Williams, 29, of Pearl Street, Batavia, is charged with disorderly conduct. He was arrested at 8:34 p.m. on Aug. 10 at 107 Watson St. in Batavia. His arrest came after a disturbance on Watson Street; Williams allegedly would not disperse and continued to attempt to fight another male at the location. Williams is due in City Court on Aug. 21. The case was handled by Batavia Police Officer Mitchell Cowen, assisted by Officer Chad Richards.

Dylan Richard Brandt, 25, of Larrowe Street, Cohocton, is charged with trespass. He was arrested at 8:15 p.m. on Aug. 11 at Darien Lake Theme Park after he allegedly reentered the park after having been ejected for shoplifting merchandise from a gift shop. A 17-year-old resident of Le Roy is charged with second-degree harassment following an incident on Main Street in Batavia at 6:14 p.m. on July 13. It is alleged that this female engaged in a physical altercation with a subject at a restaurant. She was issued an appearance ticket for City Court on Aug. 22. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Mitchell Cowen.

A 17-year-old who resides on Sheridan Road in Bergen Riga is charged with being in Austin Park on Jefferson Avenue in the City of Batavia after hours. The female was issued a ticket at 11:47 p.m. on Aug. 2 and is due in City Court on Aug. 21. The case was handled by Batavia Police Officer Peter Flanagan, assisted by Officer Christopher Camp.

A 16-year-old resident of Batavia was arrested for littering at 7:46 a.m. on West Main Street in Batavia. The male allegedly dumped garbage onto property at the Speedway and did not pick it up after he was asked to do so by store employees. He was issued an appearance ticket for Aug. 21 in City Court. The case was handled by Batavia Police Det. Eric Hill, assisted by Officer Frank Klimjack.

Two 17-year-old males who resident on Pearl Street in Batavia are charged with unlawful possession of marijuana. The charges stem from an investigation into a vehicle located in a city park after hours. It is alleged the two males had marijuana in their possession at the time -- 8:49 p.m. on Aug. 9. Both were issued appearance tickets and are due in City Court on Aug. 21. The case was handled by Batavia Police Officer Chad Richards, assisted by Officer Mitchell Cowen.

Antonio Diego Dames, 42, of Knowlesville Road, Oakfield, is charged with: DWI; driving with a BAC of .18 or greater; aggravated unlicensed operation, 1st; driving without an interlock device; and moving from lane unsafely. Dames was arrested following an investigation by Deputy Travis DeMuth into a one-car accident reported at 4:28 p.m. Thursday on Lewiston Road in Alabama.

Yahaira Ann-Marie Brown-Diaz, 19, of Bethany Center Road, Bethany, is charged with driving while ability impaired by drugs, unlawful possession of marijuana, and speeding. Brown-Diaz was stopped at 8:28 a.m. Friday on Maple Avenue, Bergen, by Deputy Ryan DeLong. Brown-Diaz was transported to the Sheriff's Office where she was evaluated by a Drug Recognition Expert.

Genna Lynn Miller, 33, of Center Street, East Aurora, is charged with DWI, driving with a BAC of .18 or greater, failure to comply with traffic control officer, and failure to keep right. Miller was stopped at 12:16 a.m. Saturday on Alleghany Road, Darien, by Deputy Patrick Reeves after her vehicle's mirror allegedly struck a traffic control officer in the arm.

Matthew Paul Sunseri, 33, of Harlem Road, Rochester, is charged with DWI and driving with a BAC of .08 or greater. Sunseri was charged following an investigation by Deputy Mathew Clor into a disturbance reported at 10:50 p.m. Sunday in the parking lot of Darien Lake Theme Park.

A 17-year-old resident of Buffalo is charged with unlawful possession of marijuana. The youth was allegedly found in possession of marijuana by State Police in the Village of Corfu at 11:05 a.m. on Aug. 5.

Walter B. Hale, 65, of Oakfield, is charged with: felony DWI; felony driving with a BAC of .08 or greater; failure to keep right; and moving from lane unsafely. Hale was stopped by State Police at 1:40 a.m. Sunday on Route 98 in Elba.

Casandra E. Holloway, 25, of Newfane, is charged with: DWI; driving with a BAC of .08 or greater; no headlights; failure to keep right; moving from lane unsafely and drinking alcohol in a motor vehicle. Holloway was stopped by State Police at 11:01 p.m. Friday on Colby Road, Darien.

Scott P. Rammacher, 42, of Lockport, is charged with DWI and impeding traffic. Rammacher was stopped by State Police at 6:35 p.m. Thursday on Route 77, Darien, for allegedly driving too slow.

Christian A. Dangelo, 28, of Rochester, is charged with unlawful possession of marijuana. Dangelo was stopped by State Police at 9:44 p.m. Thursday on Route 33, Bergen.

Kyle J. Howard, 29, of Basom, is charged with criminal trespass. Howard was arrested by State Police for an alleged incident reported at 1:30 p.m., Aug. 6.  No further details released.

As time winds down for the 2018 Jenny Kuzma 5K race, organizers are fearful this could be the last year for the race, which has earned the reputation as one of the most competitive races in Western and Central New York.

Started more than 25 years ago as the Bergen Swamp Race, it was renamed the Jenny Kuzma Memorial 5K race to honor the Byron-Bergen eighth-grader who died of leukemia in June 1990 at the age of 13.

Eric Boyce has chaired the race for the last 12 years, assisted by Joe Chimino, a senior lineman with the Village of Bergen until his retirement in May.

Boyce, however, has moved to Canandaigua, and since Chimino’s retirement, he doesn’t have access to the village equipment needed to set up for the race and handle traffic control. Because of these factors, both men have decided this will be their last year chairing the event.

Both Boyce and Chimino are hoping someone else will come forward to chair and organize the race, which has drawn some pretty impressive participants.

Boyce, who used to run the race and won it several times, became involved in organizing it when Paul Thomas, his former cross-country coach at Byron-Bergen High School, was chairman. Boyce was eventually instrumental in raising the race to the status of a USA Track and Field qualifying race 10 years ago.

“If you look at race statistics in Western New York, this one sticks out,” Boyce said. “Besides promoting healthy lifestyles and community involvement, we’ve had some pretty neat highlights along the way. Several people got engaged at the finish line; the second fastest 5K run by a woman was at this race in 2014, and a man from Kenya set a course record here after riding on a bus all night from Nyack to get here.”

The race begins at 8:30 a.m. Saturday on Parkview Drive in Hickory Park.

Early registration ended Wednesday, but racers can still register for $30 from up until 6:15 p.m. today at Medved Running and Walking Outfitters, 3400 Monroe Ave., Rochester; or they can register the day of the race up until 8:30 a.m. for $35.

Proceeds from the race fund a scholarship for an eighth-grader at Byron-Bergen School and Camp Good Days.

Boyce said he doesn’t know what’s going to happen in the future, but he hopes someone will take over.

“We’ve been contacted by several groups who are interested, but most don’t realize how much is involved behind the scenes,” he said. “This event is good for the village and the community.”

If someone is willing to take it over, Boyce said he might possibly be able to help.

John M. Brabowski, 40, of Fisher Road, Oakfield, is charged with third-degree rape. He was arrested on July 24 and arraigned at 9:11 p.m. in Batavia Town Court. It is alleged that he engaged in sexual intercourse with a female victim under the age of 17 on July 23 at a location on Fisher Road in Oakfield. He was jailed on $100,000 bail and is due in Oakfield Town Court on Aug. 6 to answer the charge. Additional charges are pending. The case was investigated by Genesee County Sheriff's Investigator Joseph Loftus, Youth Officer Howard Carlson and Sgt. Bradley Mazur.

Anthony D. Micucci, 24, of Main Street, Alexander, is charged with third-degree assault, third-degree menacing, and endangering the welfare of a child. He was arrested at 3:25 p.m. on July 25 on Main Street in Alexander following a domestic incident in the village. He is due in Town of Alexander Court on Aug. 8. The case was handled by Genesee County Sheriff's Deputy Joshua Brabon.

Joshua M. Gaudioso, 29, of Genesee Street, Le Roy, is charged with criminal possession of a weapon because he is a convicted felon. He was arrested and arraigned in Bergen Town Court at 9 p.m. on July 26. He was jailed in lieu of $10,000 cash or bond. He is accused of possessing a shotgun on July 20 at a location on North Bergen Road, Bergen. The case was handled by Genesee County Sheriff's Deputy Andrew Mullen, assisted by Deputy Chad Minuto.

Kevin Wayne Howard, 18, Bank Street, Batavia, is charged with unlawful use of a motor vehicle in the third degree. He was arrested at 4 a.m. July 26 on Griswold Road in Le Roy following a complaint. It is alleged that the defendant took a motor vehicle without the consent of the owner. He was issued an appearance ticket for Town of Le Roy Court and is due there Sept. 3. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong, assisted by Batavia Police Sgt. Dan Coffey.

Damien Anthony Weir, 37, of Branch Lane, East Stroudsburg, Pa., is charged with unlawful possession of marijuana. The defendant was charged after a traffic stop on Veterans Memorial Drive in Batavia at 10:28 a.m. on July 24. He was issued an appearance ticket for Batavia Town Court and is due there on Aug. 14. The case was handled by Sheriff's Deputy Lonnie Nati, assisted by Deputy Ryan DeLong.

Samantha L. Wroblewski, 29, of Medina, is charged with driving while impaired by drugs, DWI, criminal possession of a controlled substance, 7th, and moving from lane unsafely. Troopers were dispatched to a report of a property-damage accident on Route 33 in Stafford and Wroblewski was allegedly found asleep at the wheel with a hypodermic needle in her arm. Wroblewski allegedly admitted to possession of heroin and additional needles. She was arrested after failing to pass multiple field sobriety tests and she submitted to a chemical test.

Tyler Austin Stoddard, 23, of Meiser Road, Corfu, is charged with bail jumping, 3rd. Stoddard was located in Indian Falls and taken into custody. He allegedly failed to appear in Integrated Domestic Violence Court on Nov. 18. He was ordered held in jail.

Amanda K. Shufelt, 31, of Locust Street, Lockport, is charged with petit larceny. Shufelt allegedly stole merchandise from a gift shop at Darien Lake Theme Park.

Brandon L. Kenney-Westfall, 25, of Bergen, is charged with unlawful possession of marijuana. Kenney-Westfall was stopped by State Police at 8:18 p.m. Saturday in Bergen.

Cynthia M. Mack, 51, of South Swan Street, Batavia, is charged with third-degree criminal possession of a weapon and second-degree criminal assault. She was arrested at 8 p.m. on July 20 on South Swan Street after she allegedly struck another person with an ashtray, causing injury. She was jailed without bail and was due back in City Court this afternoon (July 23). The case was investigated by Batavia Police Officer Matthew Wojtaszczyk, assisted by Officer Nicole McGinnis.

Amy Marie Guiles, 47, of North Main St., Warsaw, is charged with second-degree harassment. The defendant was issued an appearance ticket following a report of a physical distrubance at an address on Route 19 in the Village of Bergen at 12:30 a.m. on July 7. The defendant allegedly struck the victim multiple times with closed fists. She is due in Town of Bergen Court on Aug. 15. The case was handled by Genesee County Sheriff's Deputy Ryan DeLong.

Katlyn Marie Buzzell, 18, of Burke Drive, Batavia, is charged with fourth-degree grand larceny. She was arrested at 2:17 p.m. on July 20 at a discount department store on Veterans Memorial Drive, Batavia. It is alleged that she stole property exceeding $1,000 while employed there. The case was investigated by Genesee County Sheriff's Deputy Travis DeMuth, assisted by Deputy Chad Minuto.

Lisa Darline Ayres, 52, of Garfield Street, Newark, is charged with: felony DWI -- with two prior convictions with the last 10 years; felony DWI -- operating a motor vehicle while having a BAC of .08 percent or more; aggravated unlicensed operation in the firt degree; operating a motor vehicle without an interlock device; and refusing to take a breath test. Ayres was arrested following a traffic stop on McGregor Road in the Town of Darien at 11:06 p.m. on July 21. In addition, she is charged with: unsafe turn without signal; interferance with safe operation when passing on the left, and failure to yield the right on way on a left turn. She was arrainged in Town of Darien Court and jailed in lieu of $5,000 cash or $10,000 bond. Ayres is due in Town of Darien Court on July 24. The case was handled by Genesee County Sheriff's Deputy Eric Meyer, assisted by Deputy Christopher Parker.

Kaitlin Marie Penko, 22, of Ocean Reef, Willoughby, Ohio, is charged with: DWI; aggravated DWI with a BAC of .18 percent or more; failure to dim headlights; obstructed plate, stopping or standing on a highway. She was arrested at 11:35 p.m. on July 22 on Colby Road in Darien following an investigation into a vehicle stopped on the roadway. She was issued an appearance ticket and is due on Town of Darien Court on Aug. 21. The case was handled by Genesee County Sheriff's Deputy Eric Meyer, assisted by Deputy Kevin Forsyth.

Ricki Leigh Nersinger, 66, of Ireland Road, Brockport, is charged with DWI, operating a motor vehicle with a BAC of .08 percent or more, and following too closely. Nersinger was arrested after deputies responded to Route 5 in the Town of Pembroke at 10:22 p.m. on July 21 for a property damage accident. The defendant was issued an appearance ticket and is due in Town of Pembroke Court on Aug. 28.

Jonathan Chris Shirley, 36, of Council House Road, Tonawanda Indian Reservation, is charged with two counts of second-degree criminal trespass. Shirley was arrested at 6:29 a.m. on July 21 following the complaint of a trespasser at an address on Bloomingdale Road. The defendant allegedly entered a dwelling twice unlawfully without the property owner's permission. The defendant was arraigned in Town of Alabama Court and jailed in lieu of $2,500 cash or $5,000 bond. In addition, an order of protection was issued on behalf of the victim. The investigation was conducted by Genesee County Sheriff's Deputy Ryan DeLong, assisted by Deputy Ryan Young, Deputy Eric Meyer and Investigator Chad Minuto.

Jessica L. Deridder, 30, of 160 State St., Batavia, is charged with resisting arrest. She was arrested, arraigned and jailed without bail at 10:20 a.m. on July 17. It is alleged that on Ellicott Street in Batavia she ran from a Batavia Police Officer, knowing she was wanted for another crime. The case was handled by Batavia Police Officer Catherine Mucha, assisted by Officer Frank Klimjack.

Andre L. Dupra, 49, of Rochester, was arrested by troopers out of SP Batavia at 10:55 p.m. on July 21. He is charged with DWI, refusal to take a breath test, aggravated unlicensed operation in the second degree, and numerous traffic violations. Troopers stopped Dupra on Swan Street in the City of Batavia for failing to yield to oncoming traffic, a loud muffler, and no passenger side headlight. While speaking to Dupra, the operator, troopers allegedly detected the odor of an alcoholic beverage. Dupra was placed under arrest after failing multiple SFSTs and transported to SP Batavia where he refused to provide a breath sample.
Dupra was arraigned in the City of Batavia Court and released on his own recognizance. Dupra is to return to the City of Batavia Court later in July.

Christina M. Kowalcyk, 48, of Fairway Drive, Batavia, is charged with DWI -- first offense, and operating a motor vehicle with a BAC of .08 or more. She was arrested at 1 a.m. on West Main Street, Batavia. She was allegedly driving a vehicle that had a flat tire while she was intoxicated. A concerned citizen initially reported this to police. She was issued an appearance ticket and released. She is due in City Court on Aug. 8. The case was handled by Batavia Police Officer Matthew Wojtaszyzyk

Patricia L. Gertis, 58, of 48 Mt. View Drive, Arcade, is charged with petit larceny. She was arrested at 12:25 p.m. on July 21 at Tops Friendly Market in Batavia. She was issued an appearance ticket and is due in City Court July 24. The case was handled by Batavia Police Officer Catherine Mucha, assisted by Officer Frank Klimjack.

A 16-year-old resident of Oak Street in Batavia was arrested and charged with petit larceny at 3 p.m. on July 13. It is alleged that the youth stole money from a cash register while working at Walmart. The defendant is due in Batavia Town Court on July 30 to answer the charge. The case was handled by Genesee County Sheriff's Deputy Chad Minuto, assisted by Deputy Travis DeMuth.

Jennifer Ann Roskey, 37, of South Main Street, Oakfield, is charged with second-degree criminal contempt. It is alleged that at 5:18 p.m. on July 19 on South Main Street in Oakfield that the defendant violated a mandate of the court -- a stay away order of protection. She was issued an appearance ticket. The case was handled by Genesee County Sheriff's Deputy Travis DeMuth.

Jason A. McFollins, 40, of Union Street, Batavia, was arrested on a bench warrant and arraigned in City Court at 8:15 a.m. on July 22. He was jailed on $1,000 cash or bond and was due back in City Court this afternoon (July 23). The case was handled by Batavia Police Officer Matthew Wojtaszyzyk.

Dekota Leiser, 26, of an unspecified address in Batavia, was arrested July 18 on a Wyoming Superior Court warrant after turning herself in at the Genesee County Jail in Batavia. She was transported back to Warsaw and put in Wyoming County Jail with no bail until the next court session for her arraignment. The case was handled by Wyoming County Sheriff's Office Investigator Aaron Anderson.

Tracy A. Battaglia, 47, of Ellicott Avenue, Batavia, is charged with owning an unlicensed dog and dog running at large. Battaglia was charged after her dog ran loose and bit another dog and two people attempting to intervene (initial report).

Thomas E. Brenkus, 50, of East Main Street, Batavia, is charged with forcible touching and first-degree sex abuse. Brenkus is accused of touching a female acquaintance by force for the purpose of sexual gratification. He was jailed without bail.

Cameron David Majewski, 19, of South Swan Street, Batavia, is charged with harassment. Majewski allegedly punched another person during a disturbance on South Swan Street at 1:30 p.m. March 25. He was jailed on $1,000 bail.

Kerry Ann Dudek, 43, of Fisher Road, Oakfield, is charged with petit larceny. Dudek is accused of stealing $54.63 worth of merchandise from Tops Friendly Market.

Darien L. Rhodes, 25, of Dellinger Avenue, Batavia, is charged with criminal obstruction of breathing, criminal possession of a controlled substance, unlawful imprisonment, menacing, 2nd, criminal possession of a weapon. Rhodes was charged following an incident reported at 1:09 a.m. July 12 at a location on Dellinger Avenue.

Deborah S. Rodriguez, 50, of Farnsworth Avenue, Oakfield, is charged with DWI and driving with a BAC of .08 or greater. Rodriguez was charged following an investigation into a disturbance on Pearl Street, Batavia, at 3 a.m. July 5, by Officer Matthew Wojtaszczyk.

Thomas A. Griffin II, 31, is charged with South Swan Street, Batavia, is charged with endangering the welfare of a child and harassment, 2nd. Griffin is accused of trying to take a child out of the arms of another person and striking the person in the face in an incident reported at 4 p.m., Monday. Griffin was jailed on $2,500 bail.

Shawn Brent Springsteen, 53, of Fitchett Street, Poughkeepsie, is charged with criminal contempt, 1st. Springsteen was allegedly found in the presence of a person protected by a complete stay away order at 4:48 p.m. Wednesday at a truck stop on Route 77, Pembroke.

Andrea Marie Gray, 40, of Lake Street, Le Roy, is charged criminal mischief, 4th. Gray is accused of damaging property at 5130 E. Main St., Batavia, at 2:15 p.m. July 10.

Maurice Devon Doleman Sr., 49, of Killian Road, Pembroke, is charged with DWI, driving with a BAC of .08 or greater, illegal signal, driver's view obstructed. Doleman was stopped at 11:07 p.m. Tuesday on Killian Road, Pembroke, by Deputy Eric Meyer.

Jacob Wyatt Klotzbach, 26, of Walnut Street, Batavia, is charged with petit larceny. Klotzbach is accused of stealing $22.67 in merchandise from Tops Friendly Market in Batavia.

Ryan D. Bell, 19, of Henrietta, is charged with unlawful possession of marijuana and driving a vehicle without an inspection certificate. Bell was stopped at 9:32 p.m. Wednesday on Route 77 in Darien by State Police. Also charged with unlawful possession of marijuana is Jason A. Batterson, 33, of Walworth.

Jennifer A. Roskey, 37, of Oakfield, is charged with menacing, 2nd, acting in a manner injurious to a child, and criminal possession of a weapon, 3rd. Roskey was charged following an incident reported at 8:23 p.m. Wednesday, at 39 S. Main St., Oakfield, by State Police. Roskey was ordered held on bail. No further information released.

Domonique T. Smith, 26, of Rochester, is charged with DWI, Felony DWI, endangering the welfare of a child, and driving while impaired by drugs. Smith was stopped at 2:03 p.m. June 27 on South Lake Road, Bergen, by State Police.

Trisha R. Santora, 35, of Batavia, is charged with conspiracy, 5th, grand larceny, 4th, and falsifying business records. Santora is accused of a theft at Home Depot reported at 1:37 p.m. Monday. Santora was arrested by State Police. No further details released.

A motor-vehicle accident with injuries is reported at Buffalo Road and South Lake Road, Bergen.

Michael J. Piasta Jr. is indicted for the crime of second-degree robbery, a Class C violent felony. It is alleged that on March 25 at the Arby's restaurant in Batavia, located at 212 W. Main St., that the defendant forcibly stole property and in the course of the commission of a crime or in the immediate flight from it, he allegedly displayed what appeared to be a pistol, revolver or other firearm. In count two, he is indicted for third-degree grand larceny, a Class D felony, for allegedly stealing property on that date that had a value exceeding $3,000. In count three, Piasta is accused of criminal possession of a weapon in the third degree, a second Class D felony, for allegedly possession an imitation pistoal with the intent to use it unlawfully against another person. In Special Information filed by the District Attorney, Piasta is accused of having been convicted of: third-degree burglary, a Class D felony, on Dec. 20, 2010, in Genesee County Court; petit larceny, a Class A misdemeanor, on Sept. 7, 2010, in City of Batavia Court; attempted petit larceny, a Class B misdemeanor, on Jan. 18, 2011, in Town of Batavia Court; attempted failure to pay for service, based on stealth, a Class B misdemeanor, on May 1, 2002, City of Batavia Court; petit larceny again, on July 19, 2001, in City of Batavia Court; and criminal mischief in the fourth degree, a Class A misdemeanor, on April 5, 2001, in City of Batavia Court. These convictions form the basis for Count Three in the current indictment.

Lamont L. Crimes is indicted for the crime second-degree assault, a Class D violent felony. It is alleged that on May 28 in the Town of Elba that, with intent to cause physical injury to another person, Crimes caused injury to another person using a dangerous instrument -- a knife. In count two, the defendant is accused of the same crime involving a second victim.

Jaomi Delgado is indicted for the crime of criminal possession of a controlled substance in the third degree, a Class B felony. It is alleged that on Dec. 20 in the City of Batavia that Delgado knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing a narcotic -- cocaine -- and these were of an aggregate weight of one-half ounce or more.

Katelyn M. Bennett is indicted from the crime of driving while intoxicated as a Class E felony. It is alleged that on April 11 in the Town of Bergen that Bennett drove a 2011 Chevrolet on state routes 33 and/or 19 while intoxicated. In count two, she is accused of aggravated DWI, per se, as a Class E felony for allegedly having a BAC of .18 or more at the time. In counts three and four, the defendant is accused of criminal possession of a controlled substance in the seventh degree, Class A misdemeanors, for allegedly knowingly and unlawfully possessing, respectively, concentrated cannibas and alprazolam (Xanax). In count five, Bennett is accused of unlawful fleeing a police officer in a motor vehicle in the third degree, another Class A misdemeanor. It is alleged in count five that she knew she had been directed to stop by a police officer or marked police vehicle and she attempted to flee at speeds which equaled or exceeded 25 mph above the speed limit, or she engaged in reckless driving (VTL 1212). In Special Information filed by the District Attorney, Bennett is accused of having been convicted of operating a motor vehicle while impaired by drugs, as a misdemeanor, on Dec. 20, 2011, in the Town of Gates and that conviction was within 10 years of the crimes alleged in the current indictment.

Brent J. Chapman is indicted for the crime of driving while intoxicated as a Class E felony. It is alleged that on May 11 in the Town of Le Roy that Chapman drove a 2006 Lincoln on I-90 while intoxicated. In Special Information filed by the District Attorney, the defendant is accused of having been convicted for misdemeanor DWI on March 8, 2016, in the Town of Greece, and that convicted is within 10 years of the crime alleged in the current indictment.

Paul D. Fields Jr. is indicted for the crime of driving while intoxicated, as a misdemeanor. It is alleged that on Feb. 7 in the Town of Pembroke that Fields drove a 2002 Saturn eastbound on Indian Falls Road while intoxicated. In count two, he is accused of DWI, per se, as a misdemeanor, for allegedly having a BAC of .08 or more at the time. In count three, Fields is accused of aggravated unlicensed operation in the first degree, a Class E felony, for knowing or having reason to know that his driver's license was suspended, revoked or otherwise withdrawn by authorities at the time. In Special Information filed by the District Attorney, Fields is accused of having been convicted of DWI on April 10, 2006, in City of Batavia Court. That conviction forms the basis for Count Three of the current indictment.

The Genesee County Economic Development Center (GCEDC) approved incentives for two projects at the agency’s July 12th board meeting. The combined projects are anticipated to create 20 new jobs and approximately $7.6 million in capital investment.

J. Rental is receiving sales, mortgage and property tax exemptions of approximately $723,000 to build a new 60,000-square-foot facility on 19.5 acres in the Apple Tree Acres business park in Bergen. The $6.3 million project will create 15 new jobs. For every $1 in public benefit, the company is investing $14 into the local economy.

Lancor Development Corp. is proposing to invest $1.3 million to build a 12,000-square-foot facility in the new Le Roy Food and Technology Park. The project would create five new jobs and retain seven jobs. Lancor is receiving sales and property tax exemptions of approximately $122,000. For every $1 of public benefit, the company is investing $28.5 into the local economy.

The board also accepted an application from Pearl Solar LLC for the construction of two 2MW community solar farms for a combined total of 4MW at 2901 Pearl Street Road. Both projects have the same address but would have separate parcel tax map numbers. Pearl Solar LLC would make an approximate $6 million investment and is seeking approximately $288,000 in sales and property tax exemptions.
