Crash in front of Pembroke High School, one person may have concussion

A motor-vehicle accident is reported in front of Pembroke High School at 8750 Alleghany Road. Law enforcement on scene says one person may have a concussion. Pembroke and Indian Falls fire departments are responding, along with Darien ambulance.

Grand Jury: Three men indicted for first-degree gang assault

Terrance M. Schramm, Terrence D. Johnson, and Leonard A. Johnson III are indicted for the crime of first-degree gang assault, a Class B violent felony. On April 29 in the area of 27 Holland Ave., it is alleged that these three men, with intent to cause serious physical injury to another person, and when aided by two or more other persons actually present, caused serious physical injury to a third person. In count two, the defendants are accused of the same crime, by means of a dangerous instrument -- footwear and/or brass knuckles or some other handheld hard object.

Kerri Lynn Forsberg is indicted for the crime of second-degree attempted assault, a Class E felony. It is alleged that on July 6 at United Memorial Medical Center in the City of Batavia, Forsberg, with intent to cause physical injury to a registered nurse, attempted to cause such injury while the nurse was performing an assigned duty.

Eric R. Westermeier is indicted for the crime of driving while intoxicated as a Class D felony. He is accused of operating a 2004 Dodge on March 8 on Erie Street in the Town of Darien while intoxicated. In count two, he is accused of having a BAC of .08 or more at the time as shown by a breath analysis. In count three, he is accused of driving while his ability to do so was impaired by the combined influence of any drug or drugs and alcohol, as a Class D felony. In counts four and five, he is accused of first-degree aggravated unlicensed operation for knowing or having reason to know that his driver's license was suspended, revoked or otherwise withdrawn by authorities, and yet he was driving a motor vehicle and doing so under the influence of alcohol or a drug.

Brock T. Barry is indicted for the crime of driving while intoxicated, as a misdemeanor. He is accused of operating a 2013 Jeep on March 22 on Route 77 in the Town of Pembroke while intoxicated. In count two, he is accused of driving while intoxicated, per se, as a misdemeanor, for having a BAC of .08 or more at the time. In count three, Barry is accused of aggravated unlicensed operation in the first degree, a Class E felony, for knowing or having reason to know that at the time his driver's license was suspended, revoked or otherwise withdrawn by authorities, and yet he was driving a motor vehicle and doing so under the influence of alcohol.

Batavia Downs says more weenie dogs needed for Sunday's big Family Fun Day race

Representatives from Batavia Downs announced today that there's a dearth of dachshunds to race in Sunday’s Family Fun Day Wiener Dog Race.

Each year 80 wiener dogs vie for glory after live racing is completed on Family Fun Day. Pony rides, face painting, sand art and other family activities take place from 2-4 p.m. on Sunday, Aug. 23rd with Wiener Dog Races beginning a little after 4 o'clock.

“With Family Fun Day being a little earlier than last year we’re hoping that last year’s racers and anyone new hoping to get in this year didn’t forget about it,“ said Ryan Hasenauer, director of Marketing at Batavia Downs.

“All entered dogs receive a Doggie Gift Bag courtesy of Genesee Feeds and the owners of all race winners, and the top three in the final race, receive free play for the gaming floor.

City fire hydrant flushing Thursday and Friday announced

The City of Batavia Fire Department will be flushing fire hydrants on Thursday, Aug. 20, and Friday, Aug. 21, from approximately 9 a.m. to 3 p.m. in the general area South of West Main Street and West Jackson Street, including Walnut Street, Pearl Street and South Main Street. Homes and businesses nearby will be affected.

These tests may result in a temporary discoloration of water in that area. As in the past, please do not attempt to wash any clothing if your water appears discolored. If you do experience a discoloration of your water, run cold water for about five minutes or until clear.

Crafters and vendors wanted for event to benefit Byron Ladies Auxiliary

Found: Female chihuahua, this morning at Summit and North streets, Batavia

This female chihuahua was found this morning at the corner of Summit Street and North Street in the City of Batavia. She is extremely friendly, has a pink Aztec-design collar, but no dog tags. Hazardous weather outlook in effect, showers and thunderstorms expected

A hazardous weather outlook for portions of Western New York, including Genesee County, has been issued by the National Weather Service in Buffalo.

An "upper-level disturbance" is moving across the region today and will generate some showers and thunderstorms, some of which will include slow-moving downpours.

Since there will be the risk for multiple slow-moving downpours over the same area ("training storms"), there will be an increased risk for localized flash flooding.

By Thursday, a slow-moving cold front will cross Western New York and numerous showers and thunderstorms will occur along and ahead of this cold front, which will likely produce significant rain.

Darien Town Justice awarded scholarship for course on 'Drugs in America Today'

Darien Town Justice Gary A. Graber has been awarded a scholarship from the National Judicial College to attend the course "Drugs in America Today: What Every Judge Needs to Know" in Reno, Nev., Aug, 25-27.

Drug abuse is an ever-present issue that will appear with increasing frequency in courts around the country. The use of drugs not only affects the user on a personal level, but also has a profound negative effect on those who are close to, and interact with the user. No matter the type of case, they all have the potential to involve a participant who is under the influence of drugs.

As such, it is important for judges today to recognize and understand the drug issues that plague many Americans today, and to find ways to effectively manage the issue, so as to reduce recidivism. This course will provide an in-depth analysis on the science behind drug addiction, and will offer practical solutions for the judge to manage these types of cases.

The course will start with an introductory session on basic brain chemistry, and then will move to a thorough analysis of the physiological and psychological effects of specific categories of drugs. In addition, the course will provide practical skills in order to determine which type of drug(s), if any, a user might be under the influence of, and will offer different types of treatment options, which will cover psychological, behavioral, and social aspects.

The course will address several special populations, such as juveniles, those with co-occurring disorders, and veterans, and will provide examples of effective management and sentencing strategies for each group. Finally, the course will offer examples of effective solutions to bring about positive change in the drug user, while also providing effective sentencing options.

Stafford Historical Society meeting to feature new exhibit 'Herstory' and a recap of July's Taste of Stafford

Cobble Beach dominates top class at Batavia Downs

John Cummings Jr. bought a ticket to ride and he didn’t care while winning the $9,500 Open pace feature with Cobble Beach ($6.80) at Batavia Downs on Saturday night (Aug. 15).

Cobble Beach flew off the wings and took the top before the quarter while post time favorite, Fireyourguns (Mike Caprio) took to the wood. After the leader passed the quarter in 27.1, Caprio wasted no time getting Fireyourguns in gear as he moved him to the outside in pursuit. Although it seemed like a good move in theory, the exercise was futile because there was no catching Cobble Beach tonight.

Cummings Jr. had the best view of the proceedings as his charge flew by the half in 55.3 and three-quarters in 1:23.2. Then he raised the lines, laid back in the bike and with a swish of the whip opened up four and was looking for more. The pair then proceeded to pace away to an impressive 1:52.1 win.

James Clouser Jr. owns and trains the 5-year-old altered son of Artiscape and his evenings efforts increased the horse’s annual earnings to $51,440.

Drivers scoring multiple victories on the card included Kevin Cummings and Dave McNeight III with three and Jim McNeight with two. Trainer Dave McNeight also registered a double.

Racing resumes at Batavia Downs on Sunday (Aug. 16) with a matinee card starting at 1:15 p.m.
