Woman accused of adultery for alleged sex in park plans legal challenge

posted by Howard B. Owens in batavia, crime, adultery, Suzanne Corona.

BATAVIA, NY -- Suzanne M. Corona, the 41-year-old Batavia mother accused of engaging in a public sex act in Farrall Park last Friday afternoon intends to challenge the constitutionality of the adultery charge leveled against her.

Asked after a brief court appearance at Genesee County Court today, Corona said she would "absolutely" challenge the legality of the charge once she retains a private attorney.

City Court Judge Robert Balbick gave her until June 22 to hire an attorney. He did not require her to enter a plea today to the adultery or public lewdness charges filed against her.

"I think the adultery charge is extremely unfair and uncalled for," Corona told assembled media before entering the courthouse. "My husband is standing beside me. He called the D.A. himself this morning and wants it dropped."

Joseph Corona said he loves and supports his wife of six-and-a-half years.

"I just want it on public record that I forgive her fully," Joe Corona said. "I wish that the charges were dropped so that we could resolve this as a man and wife, more of a private matter."

His wife called her behavior Friday "inappropriate" but denied doing anything that a child could see or be harmed by.

"If you were a passerby you would not see anything was going on," she said. "We were fully clothed. His pants were on. His shirt was on. My clothes were on."

At 5:15 p.m., Friday, Farrall Park reportedly had a number of parents with their children in the playground less than 30 feet from where the pavilion full of picnic tables sits. But Corona said she and her alleged paramour, 29-year-old Justin Amend, of Oakfield, were well away from any children. She said, at most, Amend's genitals were exposed through a pants' zipper while she sat on his lap.

"Yes, it was a sexual act," she said.

Amend was also charged with public lewdness. His case was continued to June 30. He also did not enter a plea today.

She apologized to the mothers, but said, "I've not heard from these mothers. I'd like to see something from the mothers that an offense occurred, because there was nothing, nothing that would have endangered a child, to hurt a child by any means."

Her husband complained that police never consulted him before filing the adultery charge.

"If they considered me the victim, they just left me out in the open," he said, adding that he felt "sad" about the whole situation.

"I'm hurt by all this," he said. "But I'm 41, but I've got 40 some more years to spend with my wife. I'm not going to throw it all away over one incident. This is something that is going to pass and life is going to go on. It's going to be forgotten. I'm going to love her and spend the rest of my life with her."

can't help but laugh at them calling this a private matter...should have considered that when your having sex in front of a playground in a public park at 5pm on a Friday.

If they drop the adultery charge then I would make this couple renew their wedding vows in FARRALL PARK in that pavilion,in private and let life go on.

This is crazy. I can understand his being hurt, and wanting to keep it a private matter. Especially since he intends to stay with her. But she needs to be charged. Even if he wasn't the victim, those children were. I wish him luck that this is not a one time incident, but will expect to see a divorce decree before that 40 years is up. However, so these children weren't directly between her legs front row witnessing two GROWN peoof act so vulgarly with no consideration to CHILDREN! We have all had moments of passion, even moments when we did not use our best judgment. But for crying out loud, this is appalling. Had i been one of the mothers in that park, i would surely sue for punitive damages. I wish those mothers luck to somehow explain and detract the undoubted damage it caused. Next time, try the movie theater, at least it's dark in there. One other question that tumbles in my mind, what exactly about a childrens park, with playing children that turned these two on so much they couldn't drive to a cheap motel room. Right let's not charge her, so the next time some perv plays with himself ( under his shirt ) he can use the excuss, he caused no harm. Fricken Joke!

I agree Dave but I know it won't happen so I suggested she contact the ACLU because of the stupidity of the adultry charge.

Public lewdness absolutely. Adultery is not the business of ANY court and as I stated this state is light years behind most of the rest of the country. Adultry is a sin not a crime. If she can be charged with adultery than the rest of this town should be in court for all their BLATENT sins. The relationship between this husband and wife is not our business. The public lewdness is. Just for your information Liz Batavia is home to many perversions such as sexual slavery, yes it is underground but never the less this town is not as clean and pure as you would have us believe. There are some very real and dangerous activities going on that the people of Batavia turn their eyes away from and allow every day. I should know I worked in this system for quite awhile and was privy to much of it.

"Right let's not charge her, so the next time some perv plays with himself ( under his shirt ) he can use the excuss, he caused no harm." Liz, a perv playing with himself would not be charged with adultery. Anyone else reminded of Mrs. Lovejoy? ;)

No one has said she should not be charged. She should be charged but not with adultry. Maybe she should even have some kind of sex offender status but adultery is not the business of the court.

I didn't say she should be charged with Adultery. I said she should be charged. Also i did not claim this city to be clean. In any sort. But if we allow one go, we allow them all. But how is her act, and a perv fondling himself any different? Because instead she had another party fondling her? She needs to take responsibility. Yes their marriage in none of our concern, but her public act, especially when in front of our children, is. Period.

"If you were a passerby you would not see anything was going on," LOL I guess Mrs. Corona forgot that it was a park passerby that called the police. I find it interesting that she is willing to self-incriminate, especially with that lewdness charge. She admits to performing a sexual act in a public place. Whoever her lawyer ends up being will not be happy with those quotes.

Why not charger her? If she had sex were people didn't see her none of this would have happened. She made it public knowledge so the police have every right to charge her by law. I am sure this isn't the first time that she has freely exposed herself in public. She likes to also show of her fake breasts. If she can act like this in public imagine how she is at home. I feel for the kids.

Weird that this was just posted about 2 weeks ago...hmmmmmmm... Posted by terry paine on May 27, 2010 - 8:49am ...There's also a law against adultery in NYS when I asked a police officer about that law (while he and I were playing an illegal poker game)he laughed and told me he'd have to arrest half the police force. Since its impossible for any of us to read all the new laws written every year I'll just stick with the natural law of not harming anyone i.e. no victim no crime.

If you think for a minute I would listen to that CRAP you obvioulsy do NOT KNOW ME. I hate the radio and detest TV just so much more. You listen to it and pollute your own mind. I can't believe you people. Besides I lived in California for 30 years and you think anything this pitiful little state has happening surprises me? NOT. My surprise is with the so called loving, caring, honest, upstanding citizens in this place. I choose to spend my time serving the poor, the adulterers, the people that live every day in the reality of lack and need and not in contributing to the disgusting appetites of others. This whole thing has made me well aware of why I do what I do and helped me stand even stronger in my own convictions.

Liz, the article thread that you are posting on is, “Woman accused of adultery for alleged sex in park plans legal challenge to penal code.” You wrote: “But she needs to be charged,” without specifying a particular charge. Apparently it was presumptuous of me to assume you meant the charge of adultery, even though that’s all everyone has been discussing since Friday, and it’s the topic of this thread. “But how is her act, and a perv fondling himself any different? Because instead she had another party fondling her? She needs to take responsibility.” And he doesn’t? Ms. Corona did not act alone; however, Mr. Amend was not charged with adultery. That’s one of the reasons why people are discussing this incident…she was charged with adultery; he wasn’t.

I don't believe half the stuff said in the interview. But riddle me this....if she...suzanne is sooo embarrassed and is wearing sunglasses...why did she take them off during some of the interview because I have seen photos with her sunglasses removed. I smell a balloon boy here. Just my opinion...

Roxanna, I find your smugness in running down my adopted home town just a little offensive. You've made several comments along those lines. I was born in California. I lived there until I was 45 years old (San Diego, Ventura and Bakersfield). Batavia is 10x a much better place to live than anywhere in California. It's got its problems, but so does California. They're just different problems. The people here are nice, hardworking, caring people and I wouldn't trade them for friends and neighbors and business associates for any place else you can name.

Bravo, Howard, Bravo...could not have said it better. I have traveled to California a couple times on business trips and could not wait to get back to WNY! The houses on top of houses, the homeless people, the horrible traffic, the insane people in the traffic, the smog and pollution. Yeah, I'd sure miss all of that. I did see one thing that really warmed my heart. I was walking to my hotel one night and a business man was ahead of me...as he walked down the street I saw him giving homeless people money.

Lori you just proved my point! You love it and you are just the kind of person I have been writing about for the last few days. I am telling all of you that I will NEVER join this rediculous, brainless thoughtless, pointless conversation again. Lori a little volunteer work with some of Batavias crossdressers might do you some good but I bet you don't have it in you :)AS far as over reacting you have no idea who you are talking to.And by the way don't you dare to presume to tell me not to over react or belittle me when you have no clue who I am or what I do or for that matter why I do it. If I had over reacted no one would have had to guess about it especially YOU! PEACE/OUT

Thank you Howard. Lori, i by all means feel he needs to be charged also. But little to nothing is being said about him here. I have not yet heard that he denys or is fighting the allegations against him. She however obviously is. Whether her husband is a cross dresser or not, whether she was married or not, the act she committed was vulgar and embarrassing to more than just her family. If he was to go to the news and proclaim his "false arrest" BS that she is, i would absolutely be demanding that he take responsibility as well. However, at this moment, that is not the case. It will be interesting come trail (or w/e it will be) to hear just how different their stories will be.

To answer the question earlier, about Mrs.Lovejoy... I think Julie was referencing a character on "The Simpsons". She is Reverend Lovejoy's gossiping wife, that always cries out "Oh won't somebody PLEASE think of the CHILDREN!", whenever there is public outcry over something.

Somebody just got a little heated...not sure where that came from, but wow, makes you wanna think before you write. I guess I too am left guessing how that digressed... I stayed away from this sight all day as I worked some long hours and had to mow, besides after driving by the court facility today it about made me wanna puke. Can we get on to another topic? There wasn't even any mention about the Jim Kelly Golf Tournament, yet all this sex stuff. Augh!

If Adultry wasnt a crime then she wouldnt have been charged with it. I liked how she told the News that no one could see anything. Then why were the cops called? She just keeps digging herself deeper. As for the guy getting charged with adultry, if he isnt married how would that law obtain to him?

I'm not surprised that the conversation has deteriorated so much. That being said, I'd like to throw some gasoline on the fire. First...Roxanna, why would you think that cross dressers or transgendered people need anyone to "work with them?" If they have decided to go public, then they are comfortable with themselves and don't want or need anyone working with them. Also for Roxanna, your particular brand of Christianity is exactly what turns people off to listening to anything you have to say. I'd much rather be in the company of the people here who don't proselytize. For Howard...you do a great job. Please continue. I don't always agree with you, but your articles state the facts or at least quote others' points of view. I can't fault that one bit! For Autumn...Adultry should not be a crime in my opinion. If you had read all the comments you'd have seen that other states are working to have similar laws stricken from the books. I think the officer should not have charged Mrs. Corona. He should have used better discretion when invoking this archaic law. Lastly, Genesee County is one of the most beautiful places on earth. I have met some wonderful people while living here. By the way, I will be 66 in August.

Roxanna Yaeger- if you hate WNY so much, WHY STAY?? I am sure that there are plenty of souls to be saved and soothed in California. San Pedro, Long Beach, south central LA all could use your "Christianity" more than we need your self righteous indignation. We must be in the presence of someone totally lacking in sin. Why else would you cast stones at the other sinners? I certainly look forward to your lack of input on The Batavian, and I hope I run into you at one of your care-a-van functions. Always wondered what a person without sin looked like.

I'm pretty sure Roxanna Y. isn't associated with the Care-A-Van in Batavia, NY. I remember her from when she worked at the Mental Health Association in Genesee County and then I think she got married, and from what her posts say moved to California. Just don't want Care-A-Van inadvertantly wrapped up in this judgmental posting. They do wonderful work in our community.

I find this whole thing to be nothing more than a prime example of stooping to the lowest level, having sex in front of kids playing at the park. I love the fact that she tries to act like it was some sort of hidden sex even though it was at a public park in front of people. I feel bad for the husband and he will go down in history as master sap guy for putting up with this. Not only are you humiliated for life your sense of worth is slowly vanishing for not sticking up for yourself which makes me truly believe they are swingers. This is definitely swinger behavior I mean come on. Bottom line is that before this I took my daughter to that park every day, now this park goes down in history for this only, and this act is all that it will now be remembered by for life. This really isn't funny at all, it's just sick and creepy.
