Pavilion woman arrested on a Leandra's Law charge given 11 months to stay out of trouble prior to sentencing

A Pavilion mother caught twice drinking and driving, including once with her underage children, will be given 11 months to show to the court she can stay out of trouble.

Judge Robert C. Noonan gave Angela A. Kruse, 40, interim supervision until Feb. 6, when she will returned to County Court for sentencing.

Her sentence will be determined by her conduct over the next 11 months.

Kruse was arrested in June in Le Roy for driving while intoxicated with her children in her car, leading to a felony charge under Leandra's Law. She was arrested a second time following an accident in Covington in September. She reportedly had a child with her in the car at that time as well.

what is the sense of having these laws if judges like Noonan give out these breaks..This woman had two dwi and one involving a child..She should be headed too jail..Why give her 11 months to behave..This is why these laws mean nothing..

What are you taking about Mark, her sentence was delayed not trivialized

Just throwing everyone in jail is not always the answer, giving people a chance to straighten up is every bit a part of fair justice as a year behind bars. She may straighten up and receive a lighter sentence, or she might re-offend and get the book thrown at her, That choice is now hers, I say the judge did a fine job of tempering compassion and justice in this particular case.

Mark, if she were jailed as she should be, the community would be much safer. Are you aware of the history on these cases? She obviously didn't give a damn about the safety of others. What makes you think she does now?

If you want to call what amounts to a "conditional discharge" a fair sentence(on a second DWI with Children in the car), after she previously had a DWI with a child in the car(that should have straightened her out if she was serious about turning her life around). So what happens next after 11 mos? She behaves and pays her fine and all is well and dandy? Any reasonable person would believe that is a pretty lame sentencing for not one, but two felonies!

Mark someone has had her chance when she got her first DWI...She din't learn for that she did it again with children in the car..I would say she had her chance to prove her self..I hope that she doesn't have a license.I call this a third chance..

Playing devil's advocate here but, maybe Noonan is testing the waters so to speak. He could be a real dick on conditions and impose sentence just because she has police contact some weekend in an intoxicated state. Or he's pretty sure she will violate again then he can make an even longer sentence we just dont know. Perhaps this isnt her chance but a chance for her children... I agree with the opinions posted here but sometimes you have to open up and consider the why of the other side of things you form opinions of. Honestly sometimes giving people a chance like this just gives them a chance to dig their hole deeper.

This woman hasn't gotten away with anything. Her punishment has been delayed only to give her a chance to get her life in order, perhaps get into an alcohol abuse program, etc.

Her fate will be known in 11 months.
