Five people were injured Friday morning in an accident at the intersection of Route 63 and Batavia-Oakfield Townline Road when the driver of one car reportedly "forgot the stop sign was there."

Charles F. Monnen III, 24, of 1720 Hyde Park Blvd., lower, was reportedly driving westbound on Batavia-Oakefield when he allegedly failed to yield the right of way at Route 63.

His 2005 Ford sedan struck a car driven by Carmela A. Cling, 56, of 4528 Mack Road, Gasport.

The accident occurred at 7:13 a.m.

The drivers and all occupants of both cars were injured.

Susan M. Rozanski, 19, was transported by ground ambulance to Erie County Medical Center.

The other four patients were taken to UMMC.

Also reportedly injured were Kelsey McGill, 18, and Celena M. Grossman, 18.

Rozanski, McGill and Grossman were all passengers in Monnen's car.

The accident was investigated by Deputy Brad Mazur.

Limited visibility because of snow apparently contributed to an accident in Elba yesterday that sent four people to UMMC for treatment of minor injuries.

Marth G. Horton, 48, of East Branch, stopped at the intersection of Route 262 and Norton Road and then proceeded to cross 262. Her car reportedly struck a vehicle driven by Kathleen M. Kowalczyk, 35, of 30 Farnsworth Ave., Oakfield.

Horton was cited for alleged failure to yield right-of-way.

Also transported to UMMC were 77-year-old Catherine M. Horton and three-year-old Erin C. Lincoln.

The accident was investigated by Deputy Chad Minuto.

A two-car accident with minor injuries is reported at West Main and South Lyon in the City of Batavia.

City Fire and Mercy EMS are responding.

Mercy EMS is being dispatched to the toll both at the Oak Street exit of the Thruway to attend to a woman with a head injury from a motor vehicle accident.

The car is in the parking lot at the exit.

No word on where the accident occurred.

UPDATE 9:49 p.m. Town of Batavia Fire just dispatched.

A driver who spun out after hitting a patch of snow on Route 98 in Alexander yesterday was transported to UMMC complaining of neck pain.

Thomas R. Hakes, 17, of 2680 Merkle Road, Attica, was northbound on Route 98 near Cookson Road in a 1996 Ford pickup when he hit a snowdrift on the roadway. His car spun out and hit an embankment.

The accident occurred at 12:08 p.m.

No other vehicles were involved.

No citations were issued.

Deputy Brian Thompson investigated the accident.

A 40-year-old woman from Wyoming suffered a concussion in an automobile accident yesterday on Route 20 in Alexander.

Her infant was uninjured.

Eleen M. Campbell, of 11005 East Road, Wyoming, was taken by ground ambulance to Strong Memorial Hospital following the 9:24 a.m. accident.

Campbell reportedly lost control of her vehicle and it spun around several times before entering the eastbound lane of Route 20 where it was struck by a tractor-trailer. Her estimated speed prior to losing control was 45 mph. She was cited for unsafe speed for conditions.

The driver of the truck was Donald E. Patton of Willis, Texas. He was not injured in the accident.

Deputy Brian Thompson investigated the accident.

Elba Fire is on scene of a two-car accident at the intersection of Norton and Ford roads.

Four minor injuries, including an infant's, are reported.

Mercy EMS is in route.

UPDATE 3:12 p.m.: More manpower requested. An extrication will be required. A first responder warned others coming to scene to be careful coming over the hill on Route 262. "Complete white-out conditions," he said.

UPDATE 3:30 p.m.: All victims extricated.

A Jeep has struck a tree at Meadville and Council House roads in Alabama.

A woman in the Jeep was reported unconscious. She has been extracted from the Jeep and is in a passerby's car. She is semi-unconscious but responsive to stimulus.

Mercy Flight is grounded due to weather.

Alabama Fire has been dispatched.

UPDATE 8:15 a.m.: There are reportedly three children who were in the Jeep and have minor injuries.

The driver of a truck involved in a fatal accident on the Thruway the morning of Dec. 12 was allegedly operating on little sleep and viewing porn on a laptop computer at the time of the accident.

Thomas Wallace, 45, of Brook Park, Ohio, has been charged with manslaughter 2nd and jailed on $50,000 bail or $200,000 bond.

Julie Stratton, 33, of Synder, was driving in the passing lane of the Thruway in Pembroke when her car struck a deer and became disabled. She managed to call 9-1-1 before a tractor trailer plowed into her car. Several cars and trucks reportedly managed to avoid hitting her vehicle, which immediately raised questions about how Wallace was apparently unable to avoid striking the car.

Wallace is accused by the State Police of keeping a falsified log book and working a 27-hour shift at the time of the accident. He allegedly had slept only four hours in the previous 24.

State Police also say he had a computer in his lap that was streaming pornography at the time of the accident.

Wallace was reportedly driving for Millis Transfer out of Blackriver Falls, Wis.

Stratton was the mother of two young children.

One lane of Ledge Road in Basom is closed after a gas truck carrying 8,500 gallons of fuel jackknifed.

The truck remained upright and no gas was spilled.

No injuries are reported and there are apparently no other vehicles involved.

There are reportedly no injuries, but a person is trapped in a car that has turned on its side on Sumner Road, just outside the employee entrance of Darien Lake.

There was initially a report of a three-car accident with injuries at mile marker 395 of the Thruway.

Then there was a report of an accident at marker 392, but the first responder could not locate that accident.  He did proceed to the accident at 395.

East Pembroke Fire and Mercy EMS have been dispatched.

UPDATE 10:26 p.m.: East Pembroke back in service.

An accident on Route 20 involving a car and truck on Route 20 in Alexander has been reported.

A woman is reportedly in and out of consciousness and there was a child in the car.

As a precaution, dispatch checked on the availability of Mercy Flight, but Mercy Flight is grounded due to weather.

Extrication will be required.

UPDATE 9:34 a.m.: First responder reports no serious injuries.

Bergen Fire and Mercy EMS are being dispatched to a reported motor vehicle accident on Route 33 and Dublin Road.

There is reportedly an injury and at least one person is trapped in a car.

No word on how many vehicles involved.

A construction worker who was trapped inside a partially collapsed trench at a construction site in Stafford has been extricated. He has a possible broken leg and an emergency crew is taking him to the hospital.

Mercy Flight was called but was unavailable due to weather conditions.

The construction site is on Fargo Road, just south of Route 5.

If Defense Attorney Thomas Burns wants the mobile phone records of the occupants of a Toyota in which one of the passengers was killed in an accident, he will need to subpoena them himself.

Judge Robert C. Noonan denied Burns' motion to require the prosecution to produce the records.

In his ruling, Noonan noted that the defense can obtain the records subpoena duces tecum, which means "bring with you under penalty of punishment."

Asked whether he would issue such a subpoena, Burns responded:

The Court has decided that the items sought can be independently secured by the defense. Of course there are a number of hurdles to acquire the information necessary to issue an appropriate subpoena to acquire them. The defense merely sought the assistance of the prosecution in providing that information. Since the ruling requires the defense to independently acquire such information we will do just that. The irony is that in a civil proceeding the discovery mechanisms provide for almost unlimited disclosure from the opposing party, by use of depositions etc., these things are not available to a criminal defendant. Nor does a prosecution witness have any obligation to speak to a criminal defendant's attorney or investigator. However, it is my intention to take whatever steps are necessary to secure records of all occupants of the vehicle. The remaining issue is that of relevance. For a jury to be informed of the content of such information the Court would need to be convinced that such information is relevant and probative on a material issue in the case.

Burns is defending Ronald J. Wendt, a 24-year-old Alexander resident who faces numerous felony charges following the accident that took the life of Katie Stanley, 18, of Dansville. Criminal enhancements sought by District Attorney Lawrence Friedman could lead to as much as a 25-year sentence. Wendt allegedly had a BAC of .08 at the time of the accident.

The dirver of the Toyota, Rachel L. Enderle, 27, also of Dansville, was named in a lawsuit filed last month in Rochester by one of the occupants of the car, Michael A. Enderle.

There were apparently no skids marks left by the Toyota prior to hitting Wendt's pickup truck.

Wendt is in jail on $250,000 bail after he reportedly violated the terms of his previous release by riding a motorbike to work.

An 85-year-old driver damaged several mailboxes and other property Wednesday when he apparently lost control of his car in the area of 7575 Pearl St. Road, Oakfield.

Earl S. Smith Jr., of 15 Sunrise Parkway in Oakfield, was not seriously injured in the 4:20 p.m. accident.

Property damage was reported to mailboxes, trees and the yards of five different homes.

After reportedly driving off the right shoulder, striking a mailbox, a bush and a tree, Smith reportedly tried to drive back onto the roadway before his car became stuck on the opposite shoulder.

Smith was cited for failure to stay in his lane of travel.

Town of Batavia Fire and Mercy EMS are at the scene of a rollover accident on the Thruway near the Batavia exit.

Injuries are reportedly minor. One vehicle is on its roof.

A State Trooper has been requested to the scene.

An Alexander man who was taken to Strong Memorial Hospital by Mercy Flight yesterday following a motorcycle accident was treated and released, according to a patient information clerk at Strong.

Landen P. McCormick, 21, was northbound on Sandpit Road in Alexander when he reportedly failed to negotiate a curve and struck a guard rail, according to State Police.

McCormick was ejected from the motorcycle and according to reports yesterday, suffered a possible head injury.

No tickets were issued.
