Shawn Robert Hugar, 24, of Vandermark Road, Scio, is charged with DWI, a felony count of driving with a child under 15 in the car, driving with a BAC of .08 or greater, aggravated unlicensed operation of a vehicle and unsafe backing. Hugar was located at  12:55 a.m., Monday, on Route 77, south of Sumner Road, Darien, after backing his car into a ditch. Upon investigation, Sgt. Greg Walker found Hugar to be allegedly intoxicated and driving with a child in his car (a felony violation of Leandra's Law).

Tina M. Whitbeck, 43, of Penn Yan, is charged with a felony count of DWI, criminal contemp, 2nd, and aggravated DWI (drivng with a BAC of .18 or higher). State Police responded to a call at 8:40 p.m., Sunday, of a car partially blocking Pearl Street Road. The driver was also reported to be acting strangely. Upon investigation, Whitbeck's BAC was allegedly found to be .22. Whitbeck is also accused of traveling with a passenger that she was ordered to stay away from.

Jason Cleveland, 27, of Leroy, is charged with DWI and failure to keep right. Cleveland was stopped at 10 p.m., Sunday, by State Police on Route 77, Darien. Upon investigation, Cleveland was allegedly found to be operating with a BAC of .10.

Lansing H. Gardner, 35, of Lyndonville, is charged with DWI and driving with a BAC of .15. Gardner was stopped by State Police at 9:32 p.m., Sunday, on Colby Road, Darien.

Eric J. Goodwin, 31, of Lockport, is charged with DWI and driving with a BAC of .13. Goodwin was stopped at 12:45 a.m., Monday, by State Police, on Route 77 in Pembroke.

James E. Leair, 19, of Depew, is charged with unlawful possession of alcohol by a person under 21. Leair was cited by State Police at 7:30 p.m., Friday, on Sumner Road, Darien.

Keith A. Harman, 50, of Lancaster, is charged with DWI and aggravated DWI. Harman was stopped at 10:39 p.m., Friday, by State Police on Sumner Road, Darien.

Three Batavia men were injured in a weekend accident in Alabama, according to State Police.

None of the injuries were life threatening, but the driver, 23-year-old Adam L. Durfree, of Bank Street, Batavia, was charged with DWI.

Sgt. Kurt Schmidt said investigators concluded the accident was the result of alleged speeding and drinking.

Durfree's car struck a tree at 6324 Knowlesville Road, Alabama, after he apparently lost control of it and it slid off the roadway.

Also injured were William Morgan, 18, of North Lyons, Batavia, and Anthony Ogden, 18, of Holland Avenue, Batavia.

The accident occurred at 5:47 a.m., Saturday.

Durfree was treated and released at UMMC. Ogden was taken to UMMC and Morgan was taken to ECMC by ground ambulance. Schmidt said Morgan suffered multiple cuts.

A 17-year-old from Ellicott Street, Batavia, is charged with disorderly conduct and resisting arrest. The youth allegedly became involved in a verbal argument with another person during "Summer in the City." When police officers approached, the youth allegedly yelled obscenities at the officers. When the officers, who were on foot patrol for the festival, attempted to arrest the youth, the youth allegedly resisted.

John Martin King, 34, of Cockram Road, Byron, is charged with harassment, 2nd. King allegedly placed his hands around a woman's throat during an argument. King was jailed without bail and an order of protection was issued.

Joshua Stanley Martaus, 26, of Overlook Drive, Batavia, is charged with menacing, 3rd, harassment, 2nd, and possession of a controlled substance outside its original container. Martaus is accused of striking a female family member several times and causing fear of serious physical injury. He also allegedly choked her. Martaus was jailed on $500 bail.

Elizabeth Leach, 19, of Le Roy, and Cassandra Majors, 18, of Le Roy, along with a 17-year-old from Stafford and a 16-year-old from Le Roy, are charged with criminal mischief, 4th. The four teenagers are accused of vandalizing park benches on Main Street in Le Roy.

Tyler Ewell, 18, of Le Roy, is charged with unauthorized use of a motor vehicle. Ewell is accused of borrowing a car and not returning it within the "short period of time" he agreed to borrow the car. He was jailed on $250 bail.

Jeffery J. Cervone, 42, of Trumbull Parkway, Batavia, is charged with disorderly conduct. Cervone is accused of making verbal threats toward another person. He was jailed on $750 bail.

Jose Lopez-Torres, 21, of Oak Orchard Road, Batavia, is charged with DWI, driving with a BAC of .08 or greater, illegal entry, speeding and unlicensed operation of a vehicle. Lopez-Torres was stopped at 9:21 p.m., Saturday, on Route 98, Batavia, by Sgt. Brian Frieday. Lopez-Torres was handed over to the Border Patrol following his arrest.

Phyllis Arlene Brew, 40, of 6741 Main Road, Stafford, is charged with harassment, 2nd. Brew was arrested following a report of a physical altercation between mother and daughter. Brew was jailed on $500 bail.

John Alfred Jensen, 43, of 5751 Little Canada Road, East Bethany, is charged with criminal possession of a controlled substance, 7th. Jensen was arrested following a report at 7:01 a.m., Saturday, of a man sitting in a car drinking on Federal Drive, Batavia. Upon investigation, he was allegedly found in possession of a controlled substance.

William Floyd Engle, 43, of Sackett Road, Bergen, is charged with DWI, driving with a BAC of .08 or greater, refused breath test and unsafe start. Engle was allegedly involved in a motor vehicle accident at 1:08 a.m., Sunday. He is accused of driving his motorcycle while intoxicated.

Brenda Lea Freida, 43, of Munger Road, Holley, is charged with DWI and unlawful parking on a highway. The Sheriff's Office received a report of an unresponsive woman in a vehicle in the parking lot of Batavia Downs at 4:05 p.m., Saturday. Deputies responded with Mercy EMS. Upon investigation, Sgt. Greg Walker concluded that Freida drove her 2000 Jeep to the parking lot in an intoxicated condition and parked in a driving lane. Freida also allegedly refused a chemical test.

William A. Muoio, 39, of Byron, is charged with a felony count of DWI, driving with a BAC of .08 or greater, failure to obey traffic control device, driving while using a mobile phone, and running a red light. Muoio was allegedly observed by Le Roy Police Officer Emily Clark talking on his phone while stopped at a green light. Clark then reportedly observed Muoio drive through a red light.

Kristina Marie Green, 22, of Buffalo Street, Attica, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Green is accused of being involved in a single-car accident on Alexander Road, Alexander, at 3:25 a.m., Saturday.

Robert C. Hinett, 22, of 5682 McPherson Point, Livonia, is charged with DWI, aggravated DWI - driving with a BAC of .18 or greater, and failure to yield right-of-way when entering roadway. Le Roy Sgt. Michael Hare reports that Hinett nearly hit Hare's patrol vehicle at 3:45 a.m., Saturday, when Hinett attempted to pull out in a lane of travel, causing Hare to break abruptly to avoid a collision. Upon investigation, Hinett was allegedly found to have a BAC more than three times the legal limit.

The following people were arrested in connection with the Disturbed concert at Darien Lake Performing Arts Center:

David D. Bull, 27, of West Avenue, Attica is charged with criminal mischief, 3rd, and criminal mischief, 4th. Bull allegedly damaged two vehicles parked in the concert venue parking lot. He was jailed on $500 bail.

Josua N. Roshia, 27, of Van Allen Road, Watertown, is charged with disorderly conduct. Roshia allegedly got into a fight with another patron in the concert area. He was jailed on $250 bail.

David P. Zimmer Jr., 24, of Chapman Parkway, Hamburg, is accused of pushing a security guard while inside the concert venue. Zimmer was jailed on $500 bail.

Michael J. Hayes, 25, of Berger Road, Port Byron, is charged with criminal possession of a controlled substance, 7th, and unlawful possession of marijuana.

Robert P. Albini III, 29, of Sunrise Drive, Amherst, is charged with disorderly conduct and trespass. Albini is accused of fighting with security while being ejected. Albini later allegedly returned to the concert venue, leading to the trespass charge.

Christina T. Anderson, 35, of Fry Street, Rochester, is charged with trespass. Anderson allegedly re-entered the concert venue after being ejected and told not to return.

David Leake, 45, of Strohm Street, Rochester, is charged with trespass. Leake allegedly re-entered the concert venue after being ejected and told not to return.

Patrick J. Brink, 36, of Janet Street, Auburn, is charged with trespass. Brink allegedly re-entered the concert venue after being ejected and told not to return.

James M. Quinlan Jr., 25, of Essex Street, Syracuse, is charged with trespass. Quinlan allegedly re-entered the concert venue after being ejected and told not to return.

Amanda K. Jutze, 23, of Allegheny Road, Darien, is charged with trespass. Jutze was reportedly told several times to leave the concert venue and allegedly refused to leave.

Jason W. Senik, 29, of Upper Mountain Road, Sanborn, is charged with disorderly conduct. Senik is accused of throwing a lit cigarette and striking a security guard with it.

Nicholas P. Miano, 20, of South Lane, North Tonawanda, is charged with false personation. Miano is accused of providing a false date of birth. He was also issued a citation for alleged possession of alcohol under age 21.

A 16-year-old, of Warner Avenue, North Tonawanda, is charged with false personation. The youth is accused of providing a false date of birth. He was also issued a citation for alleged possession of alcohol under age 21.

Ethan J. Young, 20, of North Road, Churchville, is charged with trespass. He is accused of returning to the concert venue after being ejected and told not to return. Young was jailed on $250 bail.

Stephen Masich IV, 27, of Broad Street, Tonawanda, is charged with disorderly conduct, harassment ,2nd, and robbery, 3rd. Masich allegedly pushed two females while inside the concert venue and stole a cell phone from another woman and threw it. Masich was released on $5,000 bail.

Emily M. Skotnicki, 22, of Sand Pebble Drive, Chili, is charged with disorderly conduct. Skotnicki allegedly yelled obscenities while being ejected from the concert venue.

James R. Phalen, 18, of Four Rod Road, Alden, is charged with harassment, 2nd. Phalen is accused of pushing a security guard to the ground while inside the concert venue.

Tristen L. Johnson, 26, of Cedar Grove Drive, Rochester, is charged with trespass for allegedly being found on the roof of the box office of the concert venue.

Kevin A. Olewniczak, 20, of Lockwood Drive, Lockport, is charged with trespass after allegedly re-entering the concert venue after being ejected and told not to return.

Citizen tips have led to the arrest of a suspect in an alleged hit-and-run accident on Richmond Avenue early Saturday morning.

David R. House, 28, of 140 Summit St., Batavia, is being charged with leaving the scene of a personal motor-vehicle accident, moving from lane unsafely and operating a vehicle without insurance.

House is accused of hitting a car that was legally parked on Richmond Avenue near VanDetta Stadium around 2:15 a.m., Saturday.

A woman who had attended an event at the stadium that evening was sleeping in the car.  She was injured in the accident.

On Monday, Batavia Police issued a statement to local media asking for information that might help investigators identify a suspect.

State Police assisted in the investigation.

Timothy V. Meyers, 17, of 2481 Walker Road, Darien, is charged with grand larceny, 4th. Meyers is accused of stealing a 2006 Yamaha Blaster four-wheel ATV from a house on Dodgeson Road, Alexander.  The ATV was recovered by Erie County law enforcement at a house in Clarence.

Jeffery Allen Good, 34, of Route 98, Alexander, was picked up on a bench warrant. The charges prompting the warrant were not released. Good was jailed on $500 bail.

Charles Anthony Smalls, 26, of Shefflen Avenue, Bronx, is charged with assault, 2nd. Smalls was a passenger in a car involved in a rollover accident on Route 33, Town of Batavia. Smalls reportedly left the scene of the accident and was located a short time later. When he was identified, deputies learned there was a warrant for his arrest from NYS Parole.

Matthew D. Derrick, 25, of 4036 West Main St., Batavia, is charged with criminal contempt. Derrick allegedly sent eight text messages to a person he was ordered not to contact.

Roger A. Laird Jr., 41, formerly of 11 Mix Place, Batavia, is charged with criminal contempt. Laird was found inside of a particular residence in alleged violation of an order of protection.

Deanna L. Virgo, 34, of Garibaldi Avenue, Oakfield, is charged with DWI and aggravated DWI (driving with a BAC of .18 or greater). Initially, the Sheriff's Office received a report of a woman in the Bergen Sugar Creek parking lot not wearing any pants. Upon arrival, deputies were unable to locate the woman. Later, the Sheriff's Office received a report at 5:30 p.m., Wednesday, of a disturbance at the Bergen Service Center, 8132 Buffalo Road, Bergen. There a customer was trying to talk to a woman who was in an apparent intoxicated condition in order to try and keep her from leaving. Upon investigation, deputies believe Virgo was the woman reported at the Sugar Creek without pants and that she drove to the Service Center and was drunk at the time. The incident was investigated by Deputy Chris Parker with back up from Deputy Corey Mower, Trooper Eric Daigler and Trooper Edward Chaney.

A 17-year-old from Alexander is charged with petit larceny. The youth is accused of stealing a case of Arizona Iced Tea worth $15 from a delivery truck while workers were unloading product at the Alexander Country Deli.

Lael Jacob Dylag, 24, of Cedar Street, Akron, is charged with harassment, 2nd. Dylag is accused of verbally and physically threatening another person at a location on West Main Street, Batavia.

Douglas Gene Swede, 62, of Perry Road, Pavilion, is charged with aggravated harassment, 2nd. Swede was reportedly unhappy with the scheduling of a planning board meeting and left a threatening message on the town supervisor's voice mail.

A Batavia man suffered minor knife cuts Tuesday night while visiting the Village of Pike when he became involved in an alleged fight on Main Street.

Josh Sumeriski, 25, of 17 Pringle Ave., was taken to an area hospital with superficial lacerations on his back.

Charged with assault, 2nd, was James L. Lathrop, 20, of 4685 Wilder Road, Warsaw.

The alleged fight was reported at 10:45 p.m.

Lathrop reportedly suffered a cut finger and an eye injury.

The Wyoming County Sheriff's Office did not report any charges against Sumeriski.

Lathrop was jailed on $500 bail.

Batavia Police acting on a tip of suspicious activity responded the Kwik Fill at Jackson and Ellicott streets just before 5 p.m. and conducted an extensive search of a red Chevy sedan parked next to a gas pump.

It turns out, there was nothing found and no arrest. The driver was cited for allegedly operating on a suspended license. That's it.

Duane Martin Bush, 61, of Silver Road, East Bethany, is charged with a felony DWI, aggravated DWI, aggravated unlicensed operation of a vehicle, 1st, failure to keep right and operating a motor vehicle without a license. A witness reported seeing a vehicle driving on Francis Road with a deteriorating tire at around 11:38 a.m., Tuesday. Deputy Brian Thompson responded and located a white van at 11145 Silver Road, East Bethany. Thompson would learn the van was allegedly driven by Bush, and that Bush had operated the van for about 11 miles without a right rear tire. Bush has allegedly been driving without a license since 1977. Bush allegedly drove with a BAC at least 3.5 times over the legal limit. Bush's license was reportedly revoked for a DWI conviction within the past 10 years.

Christopher D. Olin, 21, 679 E. Main St., Batavia, is charged with sexual misconduct. Olin is accused of having sexual intercourse with a person without her consent while at his apartment on May 26.

Thomas J. Torres, 47, of 113 Jackson St., Apt. 4, Batavia, is charged with unlawful possession of marijuana. Torres was cited at 1:17 a.m. today in the area of 40 Ellicott St., Batavia.

Richard Devan Westbrook, 22, of Clifton Street, Rochester, was picked up on an arrest warrant for alleged petit larceny. He was turned over to local law enforcement by the Monroe County Sheriff's Office. He was jailed on $1,500 bail.

Michael L. Jackson (pictured), 29, of Seneca Avenue, Batavia, is charged with two counts of criminal sale of a controlled substance, 3rd. Jackson is accused of selling prescription medication to an agent of the Local Drug Enforcement Task Force. Jackson was arrested Saturday and jailed without bail.

Jonathan Chad Sisk, 37, Chili-Riga Center Road, Riga, was arrested for alleged failure to appear on a petit larceny charge. Sisk was taken into custody by Monroe County Sheriff's deputies and turned over to Genesee County. Sisk was jailed on $500 bail.

Mitchell Edward Bryan, 18, of East Bethany-Le Roy Townline Road, Stafford, is charged with unlawful dealing with a child. Mitchell is accused of hosting an underage drinking party.

Craig Alan Tiberio-Shephard, 21, of Lathrop Avenue, Le Roy, is charged with DWI and speeding. Tiberio-Shephard was stopped 7:39 p.m., Saturday, on Route 33 near Colby Road in Darien by Sgt. Greg Walker. Walker responded to Route 33 following a complaint of an erratic driver. Tiberio-Shephard allegedly refused to submit to a breath test.

Kevin R. Eustice, 41, of 18 Church St., Le Roy, is charged with harassment, 2nd. Eustice is accused of pushing his ex-girlfriend. The alleged incident occurred at 11:50 p.m., Sunday.

Forrest F. Ansel III, 20, of 572 E. Main St., Batavia, is charged with harassment, 2nd, and criminal contempt. Ansel is accused of punching a family member at 2:35 p.m., Sunday. There is reportedly an order of protection in place involving Ansel and the family member. He was jailed on $1,000 bail.

Donald A. Stirk, 30, of 639 E. Main St., Batavia, is charged with criminal possession of a controlled substance, 7th. Stirk was charged after a Genesee County probation officer visited Stirk's residence and allegedly found crack cocaine residue on a pipe.

Candice J. Wells, 25, of 5280 Old Telephone Road, Bethany, is charged with DWI, driving with a BAC of .08 or greater, and running a red light. Wells was stopped at 2:20 a.m., Saturday, on West Main Street, Batavia, by Officer Marc Lawrence.

Eric J. Shultz, 30, of Main Street, Akron, is charged with DWAI (alcohol and drugs), and failure to comply with the lawful order of a flag person. Shultz reportedly exited the Tom Petty concert 11:58 p.m., Saturday, and nearly struck a flag person directing traffic.

Samuel Leonard Thomas, 51, of Lyell Avenue, Rochester, is charged with attempt to evade cigarette tax. Thomas was stopped for an alleged traffic violation at 2:08 p.m., Sunday, on Route 63 in Oakfield, by Deputy Loni Nati and allegedly found in possession of 32 cartons of untaxed cigarettes.

Rebecca Lee McCoy, 19, of Simonds Road, Darien, is charged with unlawful dealing with a child. McCoy is accused of hosting an underage drinking party Sunday morning.

Trevor Bent McGuckin, 19, of Johnson Road, Churchville, is charged with criminal possession of a hypodermic instrument, unlawful possession of marijuana and unlawful possession of fireworks. McGuckin was stopped at 1:04 a.m., Sunday, on West Main Street, Batavia, for an alleged traffic violation by Deputy Patrick Reeves.

Michael Anthony Amadori, 53, of West Tillen Road, Boston, is charged with DWI, driving with a BAC of .08 or greater, speeding and failure to keep right. Amadori was stopped at 11:23 p.m., Saturday, on North Main Street in Corfu by Deputy Patrick Reeves.

Mark E. Beatty Jr., 31, of 46 Church St., Le Roy, is charged with petit larceny. Beatty allegedly tried to leave Tops Market with a shopping cart full of merchandise without paying for the items.

Aaron R. Bosse, 19, of 6971 Knowlesville Road, Alabama, is charged with unlawful dealing with a child. Bosse is accused of hosting an underage drinking party Friday night.

Kyle John Helak, 18, of Meadow Lane, Attica, is charged criminal possession of a controlled substance. Helak allegedly did not have a prescription for medication he possessed while at Darien Lake.

Matthew D. Gregorius, 47, of Hessler Court, Dansville, is charged with disorderly conduct. Gregorious is accused of fighting with medical personnel at Darien Lake. He was jailed on $250 bail.

Eric T. Grundstrom, 23, of Thayer Street, Jamestown, is charged with trespass. He is accused of running past security in a restricted area after being ejected from the concert venue. He was jailed on $250 bail.

Douglas Brinkman (AKA John Doe), of Eden, is charged with trespass. Brinkman is accused of running past security in a restricted area. Brinkman reportedly refused to give his name or any information about himself. He was jailed on $200 bail. Paul A. Gibson, 25, of Linwood Avenue, Port Colborne, Ontario, Canada, is charged with trespass for allegedly failing to leave the venue after being told several times to leave. He was jailed on $200 bail.

Drew T. Oyler, 20, of Bucktooth Run, Little Valley, is charged with trespass for allegedly returning to campgrounds after being ejected. He was jailed on $200 bail.

Donna M. Lawyer, 50, of Warren Street, Tully, is charged with petit larceny and trespass. Lawyer is accused of shoplifting candy from the gift shop and then returning to the park after being ejected.

Jesse D. Sills, 26 of Windridge Lane, Hamburg, is charged with disorderly conduct and harassment, 2nd. Sills is accused of engaging in violent and threatening behavior outside the concert venue and then threatening another person. He was jailed on $200 bail.

Curtis J. Mooney, 21, of Hermitage Road, Rochester, is charged with trespass. He is accused of returning to the concert venue after being ejected.

Kaitlin C. Kolb, 24, of Main Street, York, is charged with petit larceny. She is accused of stealing two cups of beer from a food stand inside the concert venue.

Jacob J. Turley, 21, of Eggert Road, Amherst, is charged with trespass for allegedly returning to the concert venue after being told to leave.

Christopher D. Wolf, 21, of Thornwoods Drive, Niagara Falls, is charged with petit larceny and resisting arrest. He is accused of stealing a cup of beer from a concession stand inside the concert venue and the refusing to be taken into custody and struggling with deputies.

Justin K. Washburn, 18, of Fulton Street, Hornell, is charged with unlawful possession of marijuana and possession of alcohol under 21.

Batavia Police are looking for a tan Jeep Cherokee that probably has extensive front-end damage.

The SUV was reportedly involved in a hit-and-run accident on Richmond Avenue near VanDetta Stadium at 2:15 a.m.

One person was injured in the accident. The 41-year-old victim has not been identified by police. The woman was sleeping in the vehicle, which was legally parked. She had attended an earlier event at the stadium sponsored by the American Cancer Society.

The following people were arrested by the Genesee County Sheriff's Office at the KISS concert at the Darien Lakes Performing Arts Center.

Joseph A. Bishop Jr., 35, of West State Road, Olean, is charged with criminal trespass. He is accused of allegedly entering the backstage area of the concert venue without permission. He was jailed on $300 bail.

Steven P. Hare, 36, of S. Main Street, Warsaw is charged with petit larceny. He is accused of stealing a Red Bull table at the concert venue.

A 16-year-old of Erb Street, Buffalo is charged with petit larceny after stealing ice cream Dip ‘n' Dots from a food stand inside the amusement park.

Katie L. Kieliszek, 22, of Quaker Lake Terrace, Orchard Park, is charged with harassment, 2nd. She is accused of striking another person in the face.

There were no citations issued for underage drinking.

A 33-year-old Batavia man pled guilty today in U.S. District Court to a felony charge of receiving child pornography.

Samuel W. Nigro faces a prison sentence of five to 20 years and a fine of up to $250,000.

The case was prosecuted in a Buffalo federal court by Assistant U.S. Attorney Aaron J. Mango. Mango said Nigro received images and videos of child pornography using various internet sites on or about Dec. 9, 2008.

A search warrant was executed on Nigro's Batavia residence on Dec. 9, 2009. Mango said a forensic analysis of Nigro's computer revealed a total of 5,239 images and 113 videos of child pornography.

Sentencing is scheduled for 1 p.m., Nov. 16 in Buffalo.

Willie J. Woods Jr., 36, of Casper Street, Rochester, is charged with one count of criminal possession of a controlled substance, 3rd, one count of criminal possession of a controlled substance, 7th, and aggravated unlicensed operation of a vehicle. Woods was stopped at the entrance to the New York State Thruway by members of the Local Drug Enforcement Task Force and uniformed deputies. Woods was nabbed after a month-long investigation into the trafficking of crack cocaine in Batavia. Woods was allegedly found in possession of 22 bags of crack and a quantity of suboxon as well as $2,000 in cash. Woods was jailed without bail.

Jerry T. Saddler, 34, of 112 State St., Batavia, is charged with disorderly conduct and harassment, 2nd. Saddler was reportedly involved in an altercation in a front yard on State Street on Wednesday. Saddler reportedly aggressively approached neighbors and used profane language, leading to a disorderly conduct charge. On Wednesday, the woman he reportedly hit in the face declined to press charges. She changed her mind on Thursday and Saddler was charged with harassment, 2nd.

Ra Aaron, 39, of 111 Liberty St., Apt. C, Batavia, is charged with harassment, 2nd, disorderly conduct, attempted assault, 3rd. Aaron reportedly aggressively approached a person on Lewis Place and grabbed her by her wrists. When police responded, Aaron was located a short distance away. When approached by Officer Thad Mart, Aaron allegedly threatened the officer and then attempted to punch him. Aaron was jailed on $1,000 bail.

Martin L. Flickner, 48, of 4503 York Road, Leicaster, is charged with grand larceny, 3rd, and falsifying business records, 1st. Flickner was taken into custody on an arrest warrant upon his release from the Livingston County Jail. He is accused of falsifying the business records of his employer and stealing more than $3,000 between July 2008 and January 2009.

One Batavia man was arrested and a warrant issued for another last week by Monroe County Sheriff's deputies for an alleged scheme to shoplift a basketful of items from the Home Depot in Henrietta.

Chad M. Johnston, 24, of Batavia, was taken into custody Aug. 5 and a warrant was issued for Mark W. McWerthy, 43, also of Batavia.

The duo is accused of filling up two shopping carts full of identical merchandise, running one through a check-out stand while leaving one unattended, then returning for the second cart and trying to exit the store using the first receipt as a proof of purchase.

The cart reportedly contained more than $1,000 in merchandise.

Johnston, already on parole, was jailed without bail. McWerthy reportedly fled the scene before deputies arrived.

Both are being charged with grand larceny, 4th.

In February, Johnston admitted in Genesee County Court to a burglary on Fairway Drive, where he attempted to steal more than $1,000 in household items, including a washer and lawn mower. Johnston was reportedly on parole at the time.

The Genesee County District Attorney's Office has indicted a man locked up in Elmira Correctional Facility for sex crimes he allegedly committed in the City of Batavia back in 2008.

Phillip E. Kroft Jr., 22, is a former city resident. District Attorney Lawrence Friedman alleges that between Sept. 29 and Nov. 10 of 2008, Kroft raped a young victim under the age of 15 on 10 separate occassions. That's just a 43-day period.

The D.A.'s office confirms that the victim was the same each time.

Kroft is now charged with 10 counts of 2nd-Degree Rape. He is currently incarcerated in Elmira on previous convictions in Genesee County. According to the D.A.'s Office, those convictions were for 2nd-Degree Rape, 1st-Degree Sexual Abuse, 3rd-Degree Criminal Possession of a Weapon, and 4th-Degree Conspiracy.

A former Oakfield resident who is a person of interest in a local unsolved murder reportedly told a cellmate in a Pennsylvania jail that he killed a couple there for money.

Stephen Patrict Rebert, 45, will stand trial for the double homicide of Victoria and James Shugar, both 61, of Jefferson County, following a preliminary hearing in which District Judge David Inzana said the prosecution presented sufficient evidence to try Rebert.

District Attorney Jeffrey Burkett presented a signed statement at the end of the hearing from Rebert's cellmate saying Rebert was motivated by his desire to steal rare coins and currancy, according to the Punxsutawney Spirit.

Rebert was arrested in Genesee County on June 3 and turned over to Pennsylvannia law enforcement. Investigators there say they found evidence on Rebert's computer tying him to the 2005 murder of Bill Fickel in Oakfield as well as the unsolved murder of Kevin Smith in Orleans County.
