Lockport man charged with trespass, resisting arrest in incident Sunday on Bank Street

Charges have been filed against a 33-year-old man who allegedly failed to stop for a trooper in Byron and continued on at high speeds into the City of Batavia before barricading himself in an apartment on Bank Street.

Akeem Rashaad Gibson, of Washburn Road, Lockport, is charged with criminal trespass in the second degree, obstruction of governmental administration in the second degree, and resisting arrest.

At about 3:31 on Sunday, a state trooper attempted to stop a red Toyota sedan for alleged traffic violations but rather than yield to emergency lights, the Toyota reportedly sped up and led the trooper on a high-speed chase with speeds reportedly in the range of 90 mph.

As the vehicle passed GCC and approached the City of Batavia, Officer Sam Freeman, Batavia PD, deployed spike strips. 

The Toyota turned into a driveway at Northside Meadows, 335 Bank St., Batavia, and the vehicle struck a small boulder near an apartment building.

The driver fled, and officers initially believed he ran into the woods but a witness informed officers that he entered an upstairs apartment. 

Officers soon determined that the apartment was supposed to be vacant.  It's tenant is reportedly incarcerated, according to a trooper at the scene on Sunday, and witnesses. 

According to Batavia PD, officers could hear the subject barricading himself in the apartment. 

A standoff ensued and officers entered into negotiations with the subject for a peaceful resolution but the subject refused to cooperate, police said.

A person known to the rightful tenant of the apartment responded to the scene and provided the officers with a key to the front door but because of the barricade, officers needed to make a forceable entry. 

Offices forced them into the apartment at 5:48 p.m.

According to Sgt. Arick Perkins at the scene on Sunday and the subject was taken into custody without further incident.

While being led by officers to a patrol car, the subject made statements indicating he didn't understand why he was being arrested, why he was being taken to a State Police car when he was in the City of Batavia, and why police had reporters there taking his picture.

According to police, State Police cited Gibson for several traffic violations. A spokesman for the State Police said the case was turned over to Batavia PD.

Gibson was held following his arrest pending arraignment in Centralized Arraignment Court.

Law and Order: Batavia resident accused of owning six unlicensed, feces-covered dogs

Rulee A. Allyn, 60, of Batavia, is charged with six counts of owning an unlicensed dog and six counts of failure to provide sustenance to animals. On the morning of July 12, Officers were called to Brooklyn Avenue, Batavia, for a report of numerous dogs running loose in the area. Officers located five dogs and were able to contain them. They were determined to belong to Allyn. A sixth dog was located in Allyn’s residence. All the dogs were allegedly covered in feces and were not being properly cared for. Allyn was issued an appearance ticket and is scheduled to appear.

Jason Eric Howard, 38, of Millison Crescent Street, Angus, Ontario, Canada, is charged with trespass and disorderly conduct.  Howard is accused of remaining on Six Flags Darien Lake Theme Park property after being told to leave by security staff. He is also accused of yelling obscenities and "causing a public inconvenience by making unreasonable noise." He was issued an appearance ticket.

Michael J. Torres, 39, of Batavia, is charged with criminal possession of a controlled substance 3rd and obstructing governmental administration. Police officers spotted Torres riding a bicycle at 5:30 p.m. on July 12 on Ellicott Street near Ellicott Place.  Officers were aware the Sheriff's Office was looking for Torres, who had a warrant out for his arrest. When officers attempted to stop him, Torres allegedly fled on his bike. Officers followed him onto Colorado Avenue, where he crashed his bicycle into a patrol vehicle. He then attempted to flee on foot, according to police, but was taken into custody a short distance away. Torres was allegedly found in possession of multiple bags of a narcotic and a large sum of cash. Torres was arraigned and released. He is due back in court at a later date. 

Juan Nieves, 31, of Parkside Avenue, Buffalo, is charged with felony DWI, felony driving with a BAC of .18 or greater, driving a vehicle with a revoked registration, driving without insurance, and leaving the scene of a property damage accident. Nieves was apparently (it's not mentioned in the Sheriff's Office press release) in an accident at an undisclosed location on Main Street in Pembroke at 5:53 p.m. on July 9. Nieves was arrested by Deputy Alexander Hadsall. His release status was not disclosed. 

Cassandra L. Elmore, 31, of Batavia, was arrested on a pair of warrants issued by City Court. The first case is the result of a traffic stop on Aug. 30, 2022. Elmore was charged with two counts of criminal possession of a weapon 4th, obstructing governmental administration 2nd, aggravated unlicensed operation of a motor vehicle 3rd, operating without an inspection certificate, insufficient tail lamps, two counts of criminal use of drug paraphernalia 2nd, failure to change address and depositing refuse on the highway. Elmore was issued appearance tickets and released. She allegedly failed to appear in court, and a warrant was issued on Sept. 8. She was arrested on that warrant on Sept. 10. During that arrest, Elmore allegedly fought with a police officer and was additionally charged with obstructing governmental administration. Warrants were issued in both cases on Jan. 23, after Elmore allegedly failed to appear in court. She was arrested on Feb. 2. Warrants were again issued on Feb. 21, after she failed to appear in court. On July 14, Elmore was located at a residence on River Street and arrested. She was additionally charged with two counts of bail jumping 3rd. She was arraigned and remanded to the custody of the Genesee County Jail. 

Phillip Ashley Ruffin, 50, of Main Street, Niagara Falls, is charged with felony DWI and parking on a highway. Ruffin was allegedly found in his vehicle at 1:57 a.m. on July 15, parked in the middle of the roadway on Redfield Parkway with his emergency flashers activated Sgt. Mathew Clor. Ruffin was held pending arraignment.

Jamonte O. Murrell, 19, of Batavia, is charged with assault 2nd. Murrell is accused of cutting another person during a disturbance on July 19 at a residence on Watson Street, Batavia. He was arraigned in City Court and released on his own recognizance.

Ahdeosun R. Aiken, 25, of Attica, and Amanda J. Jackson, 22, of Batavia, are charged with endangering the welfare of a child. Aiken and Jackson are accused of engaging in sexual conduct in a vehicle on July 8 at a location not released by police while a one-year-old child was in the vehicle. They were both issued appearance tickets.

Richard A. Demmer, 30, of Batavia, was arrested on a City Court warrant on July 13. Demmer was originally arrested on May 29 and charged with Attempted Robbery 3rd. It’s alleged that he entered a local business and demanded money from the clerk. The warrant was issued on July 12 after Demmer allegedly failed to appear in court. He was located by Police on July 13 at the location of an unrelated incident. He was arraigned and ordered to reappear at a later date.

Richard Allen Demmer, Jr., 30, of South Spruce Street, Batavia, is charged with petit larceny and criminal possession of a controlled substance 7th. Demmer is accused of stealing merchandise from the East Pembroke Crosby's on Main Road, Pembroke at 8:20  a.m. on July 18. During his arrest by Chief Deputy Joseph Graff, he was allegedly found in possession of a controlled substance. Demmer was released on an appearance ticket. 

Benjamin G. Evans, 34, of Batavia, is charged with petit larceny. Evans is accused of stealing a package from the porch of a residence on State Street On July 8. He was issued an appearance ticket.

Jordan A. Baxter, no age nor address provided, is charged with criminal contempt 2nd and criminal trespass 2nd. Baxter is accused of entering the residence of another person in violation of an order of protection on July 8. He was arraigned and ordered held on $1,000 bail, $2,000 bond, or a $5,000 partially secured bond.

Ronald W. Lewis, 35, of Rochester, is charged with petit larceny. Lewis is accused of stealing from a local business on July 7. He was issued an appearance ticket. 

Crystal M. Boute. 34, of Batavia, is charged with criminal mischief 4th. Boute is accused of damaging another person's mobile phone during an argument in the parking lot of a local business. She was issued an appearance ticket.

Brian M. Raphael, 35, of Batavia, is charged with petit larceny. Raphael is accused of stealing from a business on West Main Street, Batavia. He was issued an appearance ticket.

Lance D Beals, 53, of Batavia, is charged with petit larceny and criminal mischief 4th. Beals is accused of stealing a mobile phone from another person and intentionally damaging it. He was issued an appearance ticket.

Karina M. Treleaven, 39, of Batavia, is charged with felony DWI, moving from lane unsafely, and leaving the scene of a property damage accident. Treleaven was reportedly involved in a one-vehicle accident at 11:30 p.m. on July 11 in the 300 block of Washington Avenue, Batavia. A vehicle allegedly driven by Treleaven struck a parked car.  The driver fled on foot, and officers located Treleaven nearby the accident a short time later and determined she was the driver of the vehicle and was allegedly drunk at the time of the accident. Treleaven was previously convicted of DWI on June 1. She was arraigned in City Court and released under supervision.

Michelle L. Misiak, 58, of Le Roy, was arrested on a warrant issued by City Court. Misiak was initially charged with petit larceny on Sept. 27 for allegedly stealing from Aldi on East Main Street, Batavia. The warrant was issued on March 10 after she allegedly failed to appear in court. On July 12, Misiak was located by the Village of Leroy Police and turned over to Batavia Police. She was additionally charged with Bail Jumping 3rd and arraigned in  City Court. She was held on bail and remanded to the custody of the Genesee County Jail.

Mason Andrew Hogle, 19, of Lockport Road, Oakfield, is charged with petit larceny. Hogle is accused of shoplifting from Walmart at 1 p.m. on July 6. He was released on an appearance ticket.

Maurice Richard McCoy, 70, of North Street, Batavia, is charged with DWI and driving with a BAC of .08 or greater. McCoy was stopped at 6:13 p.m. on July 2 on Veterans Memorial Drive by Deputy Alexander Hadsall. He was released on an appearance ticket.

Sara Marie Conrow, 34, of Rochester, is charged with DWI, driving with a BAC of .08 or greater, and an unregistered vehicle. Conrow was charged following an investigation by Deputy Austin Heberlein at the Speedway Truck Stop on Route 77 in the Town of Pembroke on July 13 at 2:35 a.m. Conrow was issued an appearance ticket.

Nathaniel Ashton Finta, 18, of North Main Street, Oakfield, is charged with criminal mischief 3rd. Finta was arrested in connection with an incident reported at 3:30 a.m. on July 11 at a location on North Main Street, Oakfield. The Sheriff's Office did not release information on the alleged incident. Finta was held pending arraignment.

Derek John Machala, 28, of West Main Street, Batavia, is charged with trespass. Machala is accused of remaining unlawfully on a property at 8:39 p.m. on July 16. He was held pending arraignment.

Benjamin Gove Evans, 34, of State Street, Batavia, is charged with petit larceny and criminal possession of a controlled substance 7th. Evans was arrested in connection with an incident reported at 9:45 p.m. on July 17. The Sheriff's Office did not release information about the alleged incident. The address of the location, somewhere on Veterans Memorial Drive, was redacted from the release. Evans was released on an appearance ticket.

Jada Lee Coursey, 32, of West Fifth Avenue, Warren, Pa., is charged with harassment 2nd and endangering the welfare of a child. Coursey is accused of striking another person in front of a child while at Darin Lake at 11:35 p.m. on July 17. Coursey was issued an appearance ticket.

Joshua Lee Jones, 41, of Auburn, is charged with disorderly conduct. Jones is accused of being involved in a disturbance at Six Flags Darien Lake Theme Park on July 19 at 9:46 p.m. He was released on an appearance ticket.

O'Neil Dejusus Cruz, 34, of Poplar Avenue, Mineral, Va., is charged with DWI drugs.  Following a driving complaint called into dispatchers at 8:21 p.m. on July 21, Cruz was allegedly found by Deputy David Moore on Alleghany Road, Pembroke, operating a semi-truck while his ability was impaired by drugs. Cruz was issued an appearance ticket.

Joseph Lowell Hampton, 26, of Myrtle Street, Le Roy, is charged with harassment 2nd. Hampton allegedly pushed a former friend at 1 a.m. on July 19 at a location on Myrtle Street, Le Roy. Hampton was arraigned, and an order of protection was issued.

Joseph Thaddeus Martino, 31, of West Main Street, Batavia, is charged with attempted assault 3rd.  Martino was arrested at the Genesee County Jail. It's unclear from the Sheriff's Office press release if he was an inmate. The incident was reported at 5:05 p.m. on July 22. There were no other details about the alleged incident released. Martino was issued an appearance ticket.

Daniel Jay Torok, Jr., 36, of Liberty Avenue, Rochester, is charged with criminal possession of a controlled substance 7th. Torok was arrested by Deputy Ryan Mullen in connection with an incident reported at 11:40 p.m. on July 22 at the Genesee County Jail. The Sheriff's Office did not release information on what led to the arrest of Torok. He was issued an appearance ticket.

Kasondra Lynn Hubbard, 38, of Gilbert Street, Le Roy, is charged with DWI, driving with a BAC of .08 or greater, driving drunk with a child in the vehicle, and endangering the welfare of a child. Hubbard was stopped at 10:16 p.m. on July 22 on Gilbert Street, Le Roy, by Deputy Mason Shultz. Hubbard was processed at the Genesee County Jail and released on an appearance ticket.

Laurin Angeline Moro, 21, of Kalar Road, Niagara Falls, is charged with trespass. Moro was arrested at Darien Lake on July 15 at 8:30 p.m. The Sheriff's Office did not release information on events that led to her arrest. Moro was issued an appearance ticket.

Brian Michael Raphael, 35, of Fisher Park, Batavia, is charged with petit larceny. Raphael is accused of concealing merchandise while at Tractor Supply Co. on East Main Street Road, Batavia, and attempting to leave the store without paying for the merchandise. Raphael was arrested by Deputy Zachary Hoy and released on an appearance ticket. 

Thomas Anthony Salerno, 56, of Hall Road, Lancaster, is charged with DWI and insufficient tail lamps. Salerno was stopped at 9:39 pm. on July 29 on Route 20 in Darien by Deputy Jacob Kipler. He was released on an appearance ticket.

Adam Troy Shipwash, 42, of West Main Street Road, Batavia, is charged with criminal contempt 2nd. Shipwash was arrested in connection with an incident reported at 1:50 p.m. on July 30 at a location on Terry Street, Byron. The Sheriff's Office did not release information on events that led to the charge. Shipwash was released on an appearance ticket.

Open letter to city residents regarding recent gunfire incidents

Three incidents of shots fired in the City of Batavia over the last few months is certainly not the norm here.  

We want residents to know that the City of Batavia Police Department is taking a number of steps to protect our community. 

We will be enhancing the current Neighborhood Enforcement Teams (NET) to respond to neighborhood issues in our efforts to get guns and drugs off the street and put criminals in jail.  

The City will commit dedicated resources to this initiative, including personnel and equipment. 

We will partner with outside agencies, such as the Genesee County Sheriff’s Office, the State Police, along with other local, state and federal partners.  

We also will be calling on the Governor’s Office to allocate resources to the City in response to the recent incidents of gun violence.  

Individuals who illegally use guns will be apprehended and brought to justice.  

If you commit a crime, especially with a gun, you will be caught, you will be arrested, and you will be convicted. 

Batavia is a small and tight-knit community where neighbors look out for each other and support our police officers.   

We would be remiss if we did not recognize the hard work and dedication of the men and women of the Batavia Police Department and who, in these incidents, not only put their lives on the line to protect and serve our community, but quickly apprehended the individuals responsible for these crimes.  

We ask you to be vigilant and, if you see anything suspicious, to immediately call 911.

Charges reportedly pending against man who fled troopers, barricaded himself in apartment

A man who is apparently a Batavia resident is in custody facing possible criminal charges after allegedly leading State Police on a high-speed chase from Byron into the city and then barricading himself in an apartment that was not his own.

The name of the suspect has not yet been released.  He is facing likely charges from both State Police and Batavia PD, and both agencies said more information will be released once criminal charges are sorted out.

It's not known yet why or at what location in Byron a trooper first tried to stop the subject, but he apparently refused to yield to emergency lights from a patrol vehicle.

Speeds eventually reached in excess of 90 mph.

As he headed into the city on Bank Street Road, Batavia PD deployed spike strips on Bank Street.

The strips were successful at deflating the Toyota's tires, said Sgt. Arick Perkins, Batavia PD, but the subject continued into the driveway of Northside Meadows, 335 Bank Street, where the car eventually ran into a small boulder along the driveway. 

The subject ran from the vehicle and entered a second-floor apartment.

The apartment has been unoccupied for about four months while its tenant is incarcerated, according to witnesses.

The witnesses stated that they believe the man resides in a downstairs apartment, but he, along with other people, has been accessing the upstairs apartment for some time without permission.

"I could see that as being a possibility," said Perkins, who said it wasn't clear yet how the man gained access to the supposedly locked apartment this time or if he had ever been in the apartment before.

With troopers, deputies, and officers, including two K-9 units (one from Batavia PD and one from DEC) on scene, the man refused to exit the apartment.

Officers secured a key to the front door from a family member of the tenant and were able to unlock it, but the subject had barricaded the door.

Once inside, the man offered no other resistance, Perkins said, and was taken into custody without further incident.

K-9s could be heard barking when officers made their way into the apartment, but Perkins said the K-9s remained in the hallway since the suspect did not resist officers further.

A trooper said the driver of the vehicle was not the registered owner. It's unclear at this time whether the driver had permission of the owner to operate the vehicle.

Police officers searched the vehicle while the incident was ongoing and then inventoried its contents before impounding it after the incident was over.

Officers remained alert for the possibility that the subject had access to a weapon, Perkins said they did not believe during the incident that he was armed.

Three arrests made in alleged gunfire incident in the City of Batavia

Two young men and a teenager from Batavia were taken into custody early Thursday morning following a report of shots fired in the area of Washington Avenue and Willow Street in the city, followed by the sound of gunshots on Dellinger Avenue.

The initial call of shots fired was received by emergency dispatchers at 11:22 p.m. on Wednesday.  

Police officers responded to Washington Avenue and Willow Street and found evidence at the intersection consistent, according to Batavia PD, with a weapon being discharged.

The nature of the evidence was not disclosed.

While officers were canvassing the area, multiple shots were heard coming from the area of Dellinger Avenue, and officers immediately responded.

At that location, officers again discovered evidence, police said, consistent with a weapon being discharged.

As the investigation continued, police reviewed footage from pole cameras, which helped them develop a vehicle description.

Information about the shooting and the suspect vehicle was shared with surrounding law enforcement agencies for their assistance in locating the vehicle and potential suspects. 

After the scene had been secured, the City Fire responded to the Willow Street scene to provide ground ladders for officers to assist officers in their search of the scene. 

At 1:11 a.m., four males were located walking in the area of Chase Park and North Spruce Streets. 

The males were transported to a business parking lot on East Main Street, where a vehicle apparently matching the vehicle viewed on the surveillance video was located. 

Officers at that scene located evidence consistent with a weapon or weapons being discharged, and all four males were taken into custody at that time. 

After interviews, one male was released, and the other three were arrested. 

Tmario H. Ayala, 20, Bryson R. Gentile, 18, and a 17-year-old male, all of Batavia, were taken into custody and charged with criminal possession of a weapon in the second degree, a Class C felony, and reckless endangerment in the first degree, a Class D felony. 

Police did not say whether a weapon was recovered, nor did they reveal who or what may have been targeted, or if there was a target, by the alleged shooter or shooters.

They did not say which individual, or if it's multiple individuals, may have discharged a weapon.

The investigation did conclude, police said, that a residence had been struck by gunfire on Dellinger Avenue. 

No injuries were reported.

Ayala and Gentile were arraigned in City Court and ordered held on $100,000 cash bail, $200,000 bond, or $300,000 partially secured bond. 

The 17-year-old male was arraigned in Youth Part Court and was held on $25,000 cash bail, $50,000 bond, or a $100,000 partially secured bond. 

Batavia PD was assisted by City Fire, the Sheriff's Office, and Emergency Dispatch. Citizens also assisted by providing information that aided the investigation.

The investigation is ongoing, and Batavia PD asks that any members of the public with information that may be relevant to the incident to contact the detective bureau at 585-345-6444.

Parolee from Rochester charged in Key Bank robbery

A 53-year-old Rochester resident on parole for a prior robbery conviction has been charged in Monday's Key Bank branch robbery in Batavia.

Stacy R. Moss is charged with robbery in the third degree and grand larceny in the fourth degree. 

Moss is accused of entering the Key Bank branch at 69 Main St. shortly before 9:36 a.m. and handed a teller a note demanding money.

Police said the suspect did not display a weapon or threaten use of a weapon.

The suspect then left on a bicycle with an unspecified amount of money. 

Officers from Batavia PD, along with the Genesee County Sheriff's Office, checked the area and were initially unable to locate the suspect. 

Batavia PD detectives worked quickly to obtain an identification of the individual involved using the Monroe County Crime Analysis Center's facial recognition software. 

Batavia shared the suspect's photos from the robbery scene with local media, and officers checked the last known addresses of the person they believed was identified in the photos.

While gathering further information, investigators received information that the suspect was hiding inside a residence on South Spruce Street.

Moss was taken into custody without incident.

Moss was released on parole in January after serving seven years on a 2016 convict for three counts of robbery in the third degree, grand larceny.

He also has prior convictions for robbery in the first degree in 2004, robbery in the second degree in 1989, and burglary in the third degree in 1987.

Following his arrest, Moss was arraigned and ordered held pending his next court appearance.

Batavia PD looking for Key Bank robbery suspect

The Key Bank branch in Batavia was robbed at 9:35 a.m. on Monday and Batavia is seeking the public's assistance in identifying the suspect.

The suspect is descirbed as a balding black male wearing a black T-Shirt, gray shorts, black socks, and no shoes.  

According to police, the suspect passed a note to the teller demanding cash.  

He arrived and left on a black colored bicycle last seen heading West on Main Street.  

Police did not say how much or if any cash was stolen.

Batavia man given 20 years in prison for random knife attack of man walking on Jackson Street

Prior to attempting to kill a man on Jackson Street in Batavia on Oct. 18, Tyshon L. Taylor, 25, had been in and out of the state's mental health system -- encounters brought about by his expressed desire to kill someone or himself -- and depending on your point of view, either Taylor failed to take advantage of what the system offered or the system failed him.

An agitated and impassioned defense attorney, Frederick Rarick, argued the system had failed Taylor. He said healthcare practitioners who handled his cases knew about his threats of violence and that he was dangerous when he wasn't taking his medication but failed to hold him or make sure he got the help he needed.

"I don't mean to, well, actually, I do blame the mental health system," Rarick said.

District Attorney Kevin Finnell argued the fault for his crime lay squarely on Taylor's own decisions.

While acknowledging that Taylor has significant mental health issues, Finnell said Taylor had previously been to the comprehensive psychiatric emergency program at U of R on multiple occasions. Each time they medicated him, stabilized him, and got him back to "baseline." They then gave him referrals for follow-up care. While he came into the emergency program because of the violent thoughts running through his mind, by the time he was discharged, he was back in a calm state.

Taylor didn't take advantage of the follow-up care, Finnell said.

Prior to the attempted murder on Oct. 18, Taylor had been to the University of Rochester emergency program and left stable with enough medication to get him through the next week.

Four days later, Taylor decided, Finnell said, to walk through Batavia looking for a victim.

"There was a safety plan referral for what he could do if he was feeling violent," Finnell said. "He didn't take advantage of (the referral), and instead, on the night of the offense, he transversed the city, leaving the hotels on the north end until he got to the south side and found somebody walking back from the store minding his own business. And he just stabbed him for no other reason. The victim was unknown to him. He stabbed him. He stabbed him, intending to kill him."

Finnell said that the Batavia PD detectives who handled the case and Chief Shawn Heubusch said they considered Taylor a risk to the community and should be incarcerated. 

The victim in the case, Finnell said, has suffered substantially because of the attack.  He no longer walks to the store just a block from his residence, driving instead, and his physical injuries have prevented him from returning to work full time.

Taylor was in court on Tuesday to be sentenced on his conviction on a charge of attempted murder, a Class B violent felony. He entered a guilty plea on March 28. 

He is also a second-time violent felony offender.

Before he was sentenced, Taylor read from a statement in which he apologized for his actions, both to the victim and his family. He said he was feeling helpless and angry every day. 

"I have a lot of regrets," Taylor said. "I could have ruined my life. Well, I ruined my life, but I could have ruined it more, and I ruined somebody else's life. I want to take steps to be better."

Judge Melissa Lightcap Cianfrini said that perhaps Taylor's case could be a case study for the state's mental health system, but that didn't relieve Taylor of his responsibility for his actions. 

"Our mental health system may be imperfect. It needs to be improved," Cianfrini said. "But you didn't take advantage of the opportunities offered to you."

She sentenced him to 20 years maximum in state prison and 20 years on parole.

Two arrests at Sam Hunt concert

The following people were arrested on July 15 at the Sam Hunt Concert at Darien Lake Performing Arts Center.

Laurin A. Moro, 21, of Kalar Road, Niagara Falls, Ontario, Canada. Moro was charged with trespass after allegedly entering the area of the concert venue after being advised several times to leave the venue and not return.

Emma J. Chiavaroli, 19, of Grouse Point, Webster, is charged with trespass after allegedly entering the area of the concert venue after being advised several times to leave the venue and not return.

At end of chase, suspects accused of possessing loaded 'ghost gun'

After a high-speed chase from Oakfield to Bergen, deputies say they recovered a loaded 9mm handgun with no identifying information on it from the vehicle two suspects ran from after it wouldn't go any further.

Taken into custody were Sylvan P. Grayson, 24, from Le Roy, and Luke A. Rose, 19, from Batavia. A juvenile backseat passenger did not flee from the vehicle and was detained at the scene without incident.

Grayson and Rose are accused of possessing a "ghost gun," which is an unserialized and untraceable firearm. 

The case began at 2:38 a.m. on Thursday on Batav ia Oakfield Townline Road and Route 63 when Deputy Jacob Kipler attempted a traffic stop on a 2013 blue Dodge Avenger for an alleged headlight violation.

The Avenger fled at speeds that reached 90 mph. The vehicle went off the road several times on Batavia Stafford Townline Road, and the Sheriff's Office reports that the Avenger "intentionally" drove through a crop field, causing extensive damage to the crops.

Spike strips were successfully deployed on Route 237 in the Town of Stafford, according to the report. The Avenger lost several tires but continued to drive on rims at high rates of speed.

The driver lost control of the vehicle in the area of Clinton Street Road and Apple Tree Avenue in Bergen.  It went off the road, struck a street sign and crashed into an earthen embankment. 

According to deputies, the driver and a front-seat passenger took off running, heading south toward businesses an Apple Tree.  The passenger was apprehended without further incident after a short foot pursuit and was later identified as Luke A. Rose.

The other suspect, Sylvan P. Grayson, was located behind a business on Apple Tree about an hour later and taken into custody without further incident.

During an inventory of the contents of the vehicle, before it was impounded, deputies allegedly found a loaded 9mm handgun with no serial number, make or model identification.

Grayson is charged with:

  • Criminal possession of a weapon in the second degree, a Class C felony;
  • Criminal possession of a weapon in the third degree, a Class D felony;
  • Criminal possession of a firearm (a "ghost gun"), a Class E felony;
  • Criminal possession of a weapon in the fourth degree, a Class A misdemeanor;
  • Unlawful fleeing a police officer in a motor vehicle;
  • Obstructing governmental administration;
  • And 16 traffic tickets.

Rose is charged with:

  • Criminal possession of a weapon in the second degree, a Class C felony;
  • Criminal possession of a weapon in the fourth degree (a "ghost gun"), a Class A misdemeanor;
  • And criminal possession of a firearm, a Class E felony.

Both Grayson and Rose were arraigned and ordered held on bail.

The Sheriff's Office did not release whether there were charges against the juvenile in the backseat.

Law and Order: Grand larceny charged in alleged theft of shopping cart full of merchandise

Jose Luis Agosto Santiago, 39, of Ravine Avenue, Rochester, is charged with grand larceny 4th. Santiago is accused of stealing $1,384.90 in merchandise from Target in Batavia at 12:41 p.m. on July 6. He was issued an appearance ticket. Previously: Shoplifting suspect flees Target on foot with more than $2,000 in merchandise

David Lofton, Jr., 28, of Locust Street, Rochester, is charged with assault 2nd. Loften was arrested in connection with an incident reported at 1:28 p.m. on July 8,  in the Genesee County Jail. He was arraigned and returned to jail.

Jocolby S. Wallace, 34, of Bryan Street, Rochester, is charged with driving while ability impaired by drugs, aggravated unlicensed operation 3rd, smoking cannabis while driving, and obstructed view. Wallace was stopped on Feb. 14 at an undisclosed location in the City of Batavia by Officer Wesley Rissinger. Following an investigation, he was arrested on July 4.  He was arraigned and released under supervision.

Dominic J. Taylor, 20, of State Street, Batavia, is charged with menacing 2nd and criminal possession of a weapon 4th. Taylor is accused of displaying a knife during an incident on Grandview Terrace on July 3. He was arraigned and ordered to appear in City Court at a later date. 

Tonya M. Weber, 39, of Highland Park, Batavia, is charged with criminal possession of a controlled substance 3rd, criminal possession of a controlled substance 7th and criminal use of drug paraphernalia 2nd. Weber was arrested on a warrant on July 1 and allegedly found in possession of narcotics and drug paraphernalia. She was arraigned and ordered held in the Genesee County Jail.

Victor A. Rivera-Cotto, 55, no known address, is charged with aggravated DWI. Rivera-Cotto was arrested following a civilian traffic complaint on East Main Street in the City of Batavia. During the investigation, Officers Andrew Mruczek and Megan Crossett located a suspect vehicle and determined that Rivera-Cotto was allegedly operating the vehicle while intoxicated by alcohol. Rivera-Cotto was processed and released on appearance tickets. 

Heidi L. Klein, 48, of South Spruce Street, Batavia, is charged with petit larceny. Klein is accused of stealing from a business (Batavia PD did not release the name of the business) on June 22. She was issued an appearance ticket. UPDATE: The business was 7-Eleven on East Main Street, Batavia.

Adam B. Thomas, 34, of South Main Street, Batavia, is charged with criminal Contempt 2nd.  On July 11, Thomas was allegedly driving a vehicle on July 11 on North Street with a passenger in the vehicle who is protected by an order of protection. He was issued an appearance ticket.

Mark S. Lucas, 41, of Gregory Street, Rochester, was taken into custody on an arrest warrant on June 29. Lucas was charged on April 8 with aggravated unlicensed operation 3rd, driving with a suspended registration and operating with an expired inspection during a traffic stop on Main Street in Batavia. Lucas was issued several traffic tickets and released. The warrant was issued on June 14 after Lucas allegedly failed to appear in court. Lucas was arraigned and released on his own recognizance. The arrest was handled by Officer Stephen Quider.

Kimberly L. Blue, 34, of Hutchins Street, Batavia, was taken into custody on a bench warrant. Blue was initially arrested on Nov. 27, 2021, after she allegedly left four children under the age of 10 unsupervised for several hours. The warrant was issued on June 9, 2002, after Blue allegedly failed to appear in court. She was arraigned and ordered to appear in court again at a later date.

Shelby L. Fryer, 27, of Prune Street, Batavia, was taken into custody on two warrants. The first is a bench warrant that stems from a traffic stop on East Main Street on Jan. 2. Fryer was charged with aggravated unlicensed operation 2nd. A warrant was issued for Fryer on April 5 after she allegedly failed to appear in court. She was arrested on that warrant on April 21. She was arraigned and released. The current warrant was issued on May 3 after Fryer allegedly failed to appear in court again. The second warrant stems from an incident on April 21. Fryer allegedly lied to police about her identity in order to avoid being arrested on the previous warrant. She was charged with criminal impersonation 2nd. She was issued an appearance ticket and released. An arrest warrant was issued on May 3 after she allegedly failed to appear in court. Fryer was arrested on June 20 when she was located during a traffic stop on Washington Avenue in Batavia. She was arraigned and remanded to the Genesee County Jail on $500 cash bail, a $1,000 bond, or a $5,000 partially secured bond.

Christopher Joseph Tunney, 48, of Pierpoint Street, Rochester, is charged with criminal possession of a controlled substance 7th. Tunney is accused of possessing cocaine at the time of his arrest on a warrant out of Ontario County on July 7 at 10 p.m. at a location on Veterans Memorial Drive, Batavia. He was issued an appearance ticket.

Cologeno Anthony Gallo, 19, of Calpin Parkway, Clarence, is charged with grand larceny 4th. Gallo is accused of stealing a backpack with contents valued at more than $1,000 while at Darien Lake Theme Park on July 4 at 9 p.m.

Rebeca Rochelle Fugate, 22, of Lewiston Road, Batavia, is charged with harassment 2nd.  Fugate is accused of striking another person in the person's back with a bare hand at 6 p.m. on July 9 at a location on Lewiston Road, Batavia.

Maurice Richard McCoy, 70, of North Street, Batavia, is charged with DWI and driving with a BAC of .08 or greater. McCoy was stopped at 6:13 p.m. on July 2 on Veterans Memorial Drive by Deputy Alexander Hadsall.

Josephine Barreto, 52, of Batavia, is charged with petit larceny. Barreto is accused of stealing something from an undisclosed location in the Town of Batavia on July 6 at 9:25 a.m.  The State Police did not release further information. She was released on  an appearance ticket.

Woman sustains gunshot wound on Holland Avenue, Batavia

Police are investigating the shooting of a woman on Holland Avenue in the City of Batavia just after midnight on Wednesday.

The woman was found with a gunshot wound by officers after dispatchers received a report of a disturbance at 12:07 a.m. involving 10 to 15 people on Holland Avenue. There was a report of callers hearing gunshots. 

When officers arrived, multiple people fled. 

The woman was transported to ECMC by ground ambulance.  Police said the status of her injuries are not known.

Batavia PD states it will not release further information at this time.

Batavia's former star running back, Ray Leach, faces criminal charges

Raymond L. Leach, III, 22, a former Batavia football star who has been called among the greatest high school running backs in New York State history, has been charged with rape and sexual abuse.

The Sheriff's Office announced his arrest on Friday. 

Leach is charged with rape in the first degree, a Class B felony, criminal sexual act in the first degree, a Class B felony, and sexual abuse in the first degree, a Class D felony.

All charges are related to an accusation that Leach had sexual contact with a person incapable of giving consent. 

According to a Sheriff's Office investigation, Leach allegedly subjected another person to sexual contact, including sexual intercourse as well as oral or anal sexual intercourse while the person was incapable of consent due to physical helplessness.

The Sheriff's Office states that the alleged crime occurred in the Town of Batavia in August.

Leach was arrested Wednesday by Batavia PD on a sealed grand jury indictment and turned over to the Sheriff's Office, and arraigned in County Court that day.  He was released on his own recognizance and is scheduled back in court for further proceedings on July 18.

In 2018, Leach set the Section V single-season scoring record with 310 points. That was fifth all-time in the state. He set the Section V single-season rushing record at 3,012 yards, which was sixth all-time in the state. He scored 50 points against Cheektowaga on Nov. 10, 2018, a Section V record. He is first in Section V in career rushing yards at 6,203. He also leads Section V with 111 career touchdowns. 

Leach carried Batavia to a state title game in 2018, which the Blue Devils lost to Glen Falls and their star QB Joseph Girard.

Before the start of the 2018 season, Leach and former football and basketball teammate, Antwan Odom, were involved in a dispute, and Odom was accused of stabbing Leach. 

Odom was charged with assault in the first degree and criminal possession of a weapon in the fourth degree.

The young basketball star was represented by flamboyant Buffalo attorney Frank Housh.

In a jury trial, Odom was found not guilty.

Earlier this year, Housh was suspended by the Bar Association for misconduct in handling the civil matters of other clients.

In May 2022, Odom was charged with an alleged burglary in Covington. His trial on that charge was stopped after Housh was suspended.

Following Housh's removal from the case, new counsel was appointed for Odom and Odom and his co-defendants entered guilty pleas. 

According to Wyoming County District Attorney Donald O'Geen, Odom entered a guilty plea to four counts of burglary in the second degree, a Class D violent felony.  He was sentenced on May 18 to five years in prison and five years on parole on each charge, with each term running concurrently. He was ordered to pay restitution of $10,411.87.

In the same case, Christopher McClinic entered guilty pleas to the four counts of burglary in the third degree. He was sentenced in accordance with his plea agreement:  one to three years in prison on each charge to run concurrently.  He was also ordered to pay the same restitution. McClinic entered his plea on July 29, 2022, and he was sentenced per the plea deal on June 15, 2023.

Law and Order: warrant suspect accused of resisting arrest

Jacob William Patterson, 27, of Killian Road, Pembroke, is charged with destroying physical evidence, criminal possession of a controlled substance 7th, resisting arrest, and obstructing governmental administration. Deputy Jeremiah Gechell and Deputy Alexander Hadsall conducted a traffic stop on Dellinger Avenue, Batavia, at 1:41 a.m. on June 21. During the traffic stop, deputies identified Patterson as a backseat passenger. The deputies were aware of warrants for the arrest of Patterson. While attempting to take Patterson into custody, Patterson allegedly resisted arrest and fought with the deputies. Once he was taken into custody, a further investigation with the assistance of Deputy James Stack and K-9 Razor, a controlled substance was allegedly recovered from the vehicle. Patterson had allegedly tried to destroy the controlled substance just prior to his arrest. Patterson was held pending arraignment.

The warrant stems from an incident on April 24 where Patterson was charged with driving while ability impaired by drugs, obstructing governmental administration 2nd and four counts of criminal possession of a controlled substance 7th. During that incident, Patterson allegedly ran from and fought with officers as they attempted to take him into custody. He was issued an appearance ticket. On May 10, a warrant was issued after Patterson failed to appear in court. Patterson was located on a traffic stop and arrested on the warrant on June 21. He was arraigned in City Court and remanded to the Genesee County Jail. The arrest was handled by Officer Richard Messmer.

Gerald Lawrence Smith, 37, of Walnut Street, Batavia, is charged with criminal possession of a controlled substance (degree not specified), moving from lane unsafely, speed not reasonable and prudent, and criminal use of drug paraphernalia.  Smith was reportedly involved in a motor vehicle accident at 10:18 p.m. on June 25 on Byron Road, Stafford. According to an investigation by Deputy Kenneth Quackenbush and Deputy Nicholas Charmoun, Smith's vehicle went off the roadway and into a wooded area. Following the accident, Smith was allegedly found in possession of cocaine, scales, and baggies for packaging. Smith was processed at the Genesee County Jail and released on an appearance ticket.

Nekia Drio Newton, 47, of Rochester, is charged with criminal possession of a controlled substance 3rd, signal less than 100 feet, and aggravated unlicensed operation of a motor vehicle 3rd. Newton was stopped by Deputy Jeremiah Gechell at 11:49 p.m. on June 28 on West Main Street in the City of Batavia. During the stop, Newton allegedly admitted to possession of a controlled substance.  Newton was processed at the Genesee County Jail and released on an appearance ticket.

Nicholas C. Kingdollar, 27, of Batavia, was arrested on a warrant stemming from charges of criminal mischief 4th and harassment 2nd. Kingdollar is accused of being involved in a disturbance on April 15 at an undisclosed location in Batavia, where he allegedly damaged property and pushed another person. Officers were unable to locate him, and a warrant was issued. On June 22, Kingdollar was located and arrested. He was arraigned in City Court and released on his own recognizance pending his next court appearance.

Jaqulyn A. Dueppengiesser, 39, of Perry, was arrested on June 22 on a pair of warrants out of City Court. The first warrant stems from an investigation on April 20 where Dueppengiesser was initially arrested for petit larceny, after allegedly stealing merchandise from a local business. She was issued an appearance ticket and was to appear in Batavia City Court at a later date. Dueppengiesser allegedly failed to appear, and an arrest warrant was issued. She was arrested on the warrant on May 24 and arraigned in City Court, where she was released on her own recognizance. She allegedly failed to appear again, and a bench warrant was issued on June 15. On June 22, Dueppengiesser was arrested on that warrant and arraigned in City Court. The second warrant initially stems from a traffic stop on Feb. 19, where Dueppengiesser was allegedly found to be in possession of a narcotic. She was charged with criminal possession of a controlled substance 5th. She was arraigned and released under the supervision of Genesee Justice. On May 1, a bench warrant was issued after Dueppengiesser allegedly failed to comply with a court-ordered program. She was arrested on that warrant on May 24 and released on her own recognizance. Another bench warrant was issued on June 15 after she allegedly failed to appear in court. She was arrested on that warrant on June 22. Dueppengiesser was arraigned in City Court and remanded to the Genesee County Jail. The arrests were handled by Officer Andrew Mruczek.

Andrew D. Beedham, 37, of Batavia, is charged with harassment 2nd. The arrest is the result of an investigation into a disturbance where Beedham allegedly hit another person. During his arrest, Beedham was allegedly found to be in possession of a narcotic. He was charged with an additional count of criminal possession of a controlled substance 7th. Beedham was arraigned in City Court and released on his own recognizance. 

Jennifer J. Hogan, 32, of Rochester, is charged with two counts of bail jumping 3rd and one count of bail jumping 2nd. Hogan was arrested on June 27. She was already in custody at the Genesee County Jail after a previous arrest on June 15 on three bench warrants. The bail-jumping charges stem from those three cases. She was arraigned in City Court and remanded to jail.

Breanna E. Brummond, 32, was arrested on two bench warrants. Brummond was arrested on June 27 on warrants out of City Court. The warrants stem from two separate incidents on Feb. 3 where Brummond was charged with petit larceny and criminal trespass 3rd. Brummond was issued appearance tickets in both cases and released. She allegedly failed to appear, and two warrants were issued on Feb. 14. Brummond was arrested on both warrants on April 5. She was arraigned and released. April 20, warrants were issued again after she allegedly failed to appear. Brummond was arrested on those warrants on June 27 and arraigned. She was remanded to the custody of the Genesee County Jail and is due back in court at a later date. The arrest was handled by Officer Kevin Defelice. Brummond was also arrested by the Sheriff's Office and charged with bail jumping 2nd. She is accused of failure to appear in City Court.

Shameek T. Taylor, 36, of Bergen, is charged with criminal obstruction of Breathing. Taylor was arrested on June 27, after an investigation into a disturbance on West Main Street. Taylor allegedly placed his hand around the neck of another person and applied pressure, causing their breathing to be obstructed. Taylor was arraigned in City Court and released on his own recognizance. He is scheduled to appear back in court at a later date. 

Bill A. Thomas, 63, of Batavia, is charged with open container. Thomas was allegedly found to be in possession of an open alcoholic beverage container on June 21 in a local park. He was issued an appearance ticket and released. 

Billy Joe Budziszewski, 31, of Varysburg, was taken into custody on an arrest warrant issued in City Court. The warrant is the result of an incident on Jan. 1 where Budziszewski allegedly refused to leave a local business. He was charged with trespassing and allegedly fought with officers when they attempted to take him into custody. He was issued an appearance ticket and released. Budziszewski allegedly failed to appear, and a warrant was issued on Jan. 24. He was arrested on the warrant on June 24. 

Dustin T. Forkell, 32, of Ogden, was arrested on two bench warrants. Forkell was taken into custody on June 24. The warrants stem from an incident that led to a charge of criminal possession of stolen property 4th after he was allegedly found in possession of a stolen vehicle. He was additionally charged with false impersonation and petit larceny after he allegedly stole merchandise from a local business and lied to officers about his identity. Forkell was arraigned and ordered to return to court at a later date. 

Brittanee J. Hooten, 34, of Batavia, was taken into custody on an arrest warrant issued by City Court.  Hooten was arrested on June 22. Hooten was originally charged with petit larceny on Sept. 17 after allegedly stealing merchandise from a local business. Hooten was released on an appearance ticket. A warrant was issued on Oct. 20 after Hooten allegedly failed to appear in court. Following her June 22 arrest, Hooten was arraigned and remanded to the Genesee County Jail on $100 cash bail and $200 surety bond. 

Kenyetta D. Culver, 47, of Batavia, was taken into custody on an arrest warrant on June 23. Culver turned herself into Batavia PD on a warrant issued by City Court. The warrant is the result of a traffic stop on Feb. 12 where Culver was issued a misdemeanor traffic ticket for operating a vehicle with a suspended registration. The warrant was issued on June 14 after Culver allegedly failed to appear in court. She was arraigned in City Court, where she pled guilty and was assessed a fine. 

William Avant Lewis, 37, of Riley Street, Buffalo, is charged with bail jumping (degree not specified). Lewis is accused of failure to appear in Batavia Town Court. He was held pending arraignment. 

Dontaya Nell Kyles, 31, of Jessamine Street, Macon, Ga., is charged with bail jumping 2nd. Kyles is accused of failure to appear in Town of Batavia Court on a grand larceny 3rd charge and then failing to appear on her reappearance date. She was arrested and ordered held on $10,000 bail.

Amber Lynne Westenberger, 32, of Loomis Road, Farmington, is charged with bail jumping 2nd. Westenberger was held pending arraignment.

Cain Alexander Catino, 51, of South Swan Street, Batavia, is charged with grand larceny 4th. Cantino is accused of stealing a wallet while at Batavia Downs on June 25 at 10:30 p.m. He was processed at the Genesee County Jail and released on an appearance ticket.

Lester Shakayla Ebony Deas, 25, of Affinity Lane, Rochester, is charged with petit larceny. Deas is accused of stealing from an undisclosed location (the Sheriff's Office withheld the information) on Veterans Memorial Drive in the Town of Batavia at 6:27 p.m. on June 27. Deas was issued an appearance ticket. UPDATE: The Batavian submitted a FOIL request for the name of the store. It is Old Navy.

Pablo Viera, 44, no known address, is charged with criminal mischief 4th and criminal possession of a weapon 4th. Viera is accused of using a wooden tire knocker to strike the side of a Kenworth semi-truck multiple times, causing dents in the side door at 7:35 p.m. on June 25. Viera was released on an appearance ticket.

Joseph Gerard Eyer, 75, of Cowen Road, Piffard, is charged with grand larceny 4th. Eyer is accused of stealing a purse that contained a mobile phone and multiple credit cards at 5:15 p.m. on June 23 while at Target. He was issued an appearance ticket.

Mark Louis Frongetta, 53, of Park Road, Batavia, is charged with criminal possession of a weapon 3rd and menacing 2nd. Frongetta is accused of threatening another person with a weapon making the person fear for his life at a location on Park Road at 8:44 p.m., July 1. Frongetta was held pending arraignment. 

Francis Jermey Fuest, 44, of South Main Street, Batavia, is charged with DWI, driving with a BAC of .18 or greater, and speeding. Fuest was stopped at 12:14 a.m. on May 25 on Clinton Street Road, Batavia, by Deputy Mason Schultz. Fuest was arraigned on the charges on July 1 and released on an appearance ticket.

Maurice Richard McCoy, 70, of North Street, Batavia, is charged with DWI and driving with a BAC of .08 or greater. McCoy was stopped by Deputy Zachary Hoy in the parking lot of Walmart at 8:38 p.m. on July 2. He was released on an appearance ticket.

Andrew Scott Hartman, 40, of Route 78, Java Center, is charged with DWI, driving with a BAC of .08 greater, and inadequate headlamps. Hartman was stopped at 12:13 a.m. on July 2 on Clinton Street Road, Stafford, by Deputy Ryan Mullen. He was released on an appearance ticket.

Austin F. Buzard, 25, no known address, is charged with assault 2nd and aggravated criminal contempt. Buzard was arrested by State Police in connection with an incident reported at 8:30 p.m. on July 3 in the Town of Stafford. He was held in custody. No further details released.

Andrew R. Bastiano, 36, of Batavia, is charged with felony DWI. Bastiano was stopped at 12:39 a.m. on July 3 in the Town of Elba by State police. He was released on an appearance ticket.

Paula A. Kingdollar, 54, of Pavilion, is charged with petit larceny. Kingdollar is accused of stealing in the Town of Batavia at 1:33 p.m. on June 2. She was arrested by State Police and released on an appearance ticket. No further details released. 

A 17-year-old was arrested by State Police and charged with petit larceny in connection with a theft reported at 5:17 p.m. on July 2 in the Town of Darien. The youth was released on an appearance ticket.

Rudy Lebron Cartagena, 33, of Niagara Falls, is charged with felony DWI. Cartagena was stopped at 5:25 a.m. on June 30 in the Town of Alabama by State Police. He was released on an appearance ticket.

Shoplifting suspect flees Target on foot with more than $2,000 in merchandise

Police officers have been dispatched to Veterans Memorial Drive in order to locate a shoplifting suspect who is accused of stealing more than $2,000 in merchandise from Target, including a $500 scooter.

The suspect is on foot and described is wearing a black T-shirt, jeans, and a grey baseball cap.  He's headed toward the Thruway.

He was last seen behind Sally Beauty.

UPDATE 12:47 p.m.: The suspect apparently got into a Black SUV, silver trim, newer model, and the caller didn't see direction of travel, but a patrol officer reports, "We're lighting him up on Route 98 heading toward the hotels."

UPDATE 12:49 p.m.: The suspect will be in the passenger seat, a dispatcher informs the officer.

UPDATE 12:55 p.m.: The suspect apparently left the cart and merchandise in the parking lot. Target loss prevention has secured the shopping cart and will be awaiting law enforcement in the store.

Law and Order: Batavia man accused of assault arrested on warrant after failure to appear

Daniel J Bakowski, 42, of Ellicott Street, Batavia, was arrested on a bench warrant. Bakowski was arrested on June 12 on a bench warrant from  City Court. The warrant was issued on Feb. 14, after Bakowski allegedly failed to appear in court. Bakowski was originally arrested on Jan. 18 on charges of assault 3rd, criminal obstruction of breathing, criminal mischief 4th, endangering the welfare of a child and harassment 2nd. Bakowski was also charged with an additional count of bail jumping 3rd. He was arraigned in City Court and remanded to the Genesee County Jail on $2,000 cash bail. The arrest was handled by Officer Peter Post.

(name redacted upon request), 53, of South Main Street, Batavia, is charged with sexual abuse 1st, sexual abuse 3rd, and forcible touching. The Sheriff's Office released little information about the case, which was reported on June 1 and investigated by Stephen Smith and Deputy Kevin McCarthy. xxx was released on his own recognizance. (NOTE: The charges were dismissed. A grand jury found there was insufficient evidence to sustain the charges and returned a "no bill.")

Tommy L. Crawford, 34, of Walnut Street, Batavia, is charged with petit larceny.  Crawford was also arrested on a warrant from Pennsylvania as a fugitive from justice. He is accused of stealing from a business on East Main Street. In Pennsylvania, Crawford is accused of making terroristic threats, disorderly conduct, harassment, and solicitation of a ride. Crawford was jailed pending extradition. He was issued an appearance ticket on the local charge.

Christopher M. Waide, 31, of Bank Street, Batavia, is charged with harassment 2nd. Waide is accused of playing loud, amplified music and banging on his apartment walls with the intent to annoy and alarm a neighbor on June 14. He was issued an appearance ticket.

Lee Allen Baxter, 39, of West Main Street, Batavia, is charged with grand larceny 4th. Baxter is accused of stealing an electric bicycle from a residence on West Main Street Road, Town of Batavia, on June 12. Baxter was issued an appearance ticket.

Joshua Allen Grosskopf, 32, of Beaver Street, Albion, is charged with assault 2nd. Grosskopf was arrested in connection with an incident -- no details released -- reported at 12:50 p.m. on June 20 at a location on Bloomingdale Road, Alabama. He was arraigned and ordered held without bail.

Jeffrey A. Hewitt, 44, of North Street, Le Roy, is charged with DWI, aggravated unlicensed operation 1st, and failure to yield the right of way at a stop sign.  Hewitt was reportedly involved in an accident at Clinton Street and East Avenue at 9:25 p.m. on June 2. Officer Joseph Weglarski conducted an investigation and arrested Hewitt. Hewitt was held overnight in the Genesee County Jail pending arraignment. At arraignment, he was ordered held until his next court appearance.

Kevin M. McCoy, 56, of West Main Street, Batavia, is charged with criminal contempt 1st, criminal tampering 3rd, and burglary 2nd. Officers Richard Messmer and Adam Rissinger responded to a report of a disturbance on Ross Street at 6:37 p.m. on May 31. The complainant accused McCoy of entering her home while she was away, tearing down her curtains as well as dumping her garbage on the kitchen floor. McCoy allegedly violated a stay-away order. He was located a short time later and taken into custody. McCoy was arraigned in Centralized Arraignment Court. His release status is unknown.

Zoro Somano Reisman, 19, of Roosevelt Avenue, Batavia, is charged with robbery 3rd, two counts of grand larceny 4th, criminal possession of stolen property, and petit larceny. Reisman is accused of grabbing a wallet from a person's hands and running on June 17 at 10:45 p.m. at a location on Park Road, Batavia.  Reisman was held pending arraignment.

Lyndsay T. Young, 40, of Park Road, Batavia, is charged with criminal contempt 2nd and aggravated family offense. Young is accused of violating an order of protection on June 10. Young was issued an appearance ticket. 

Frank R. Cratsenberg, 62, no known address, is charged with petit larceny. Cratsenberg is accused of stealing beer from the Kwik Fill on Jackson Street, Batavia, on June 7. He was issued an appearance ticket.

Kody A. Wenzel, 30, of Brooklyn Avenue, Batavia, is charged with petit larceny. Wenzel is accused of stealing medication from a family member on June 8. Wenzel was issued an appearance ticket.

Susan M. Jordan, 60, of Prospect Avenue, Batavia, is charged with harassment 2nd. Jordan is accused of pushing another person during an argument on June 15 on State Street. Jordan was issued an appearance ticket.

Diana F. Curcio-Abou, 43, of Pittsford, is charged with DWI and speeding. On June 14, at an undisclosed time and location, Curcio-Abou was stopped by officers Sam Freeman and Felicia Martinez. Curcio-Abou is accused of driving with a BAC of .08 or greater. Curcio-Abou was issued an appearance ticket.

Sarah A. Malone, 41, of Graham Street, Batavia, was arrested on a bench warrant. Malone was arrested on June 14 on a bench warrantd out of City Court. The warrant was issued on May 19 after Malone allegedly failed to appear on charges of theft of services and criminal impersonation 2nd. Malone was arraigned and released. 

Jennifer J. Hogan, 32, of Rochester, was arrested on three bench warrants. Hogan was arrested on June 15 on three bench warrants out of City Court. All three warrants were issued on Aug. 18, 2020, after Hogan allegedly failed to appear in court. The first warrant is the result of an investigation into a robbery on Hutchins Street on Oct. 2, 2019, where Hogan was charged with robbery 2nd. The other two warrants stem from an incident on Oct. 18, 2019, where Hogan was charged with criminal possession of a controlled substance 7th, criminal use of drug paraphernalia 2nd, unlawful possession of marijuana and drinking alcohol in a motor vehicle, after a traffic stop on North Spruce Street in Batavia. Hogan was arraigned and remanded to the Genesee County Jail. The arrest was handled by Officer Austin Davis and Officer Felicia Martinez.

Latoya D. Jackson, 37, of East Main Street, Batavia, was arrested on three bench warrants.  Jackson was arrested on June 7 on three warrants out of City Court. The first warrant stems from an incident in June of 2022, on State Street, Batavia, where Jackson was charged with harassment 2nd. The second warrant stems from another incident in June of 2022 at an address on East Main Street, Batavia, where Jackson allegedly violated an order of protection and was charged with criminal contempt 2nd. The final warrant is the result of an incident in February of 2023, where Jackson was located, during a traffic stop, having several active warrants. Jackson allegedly fought with officers as they attempted to take her into custody. She was charged with resisting arrest. Jackson was arraigned in  City Court and remanded to the Genesee County Jail. The arrest was handled by Officer Stephen Quider and Officer Peter Post.

Mark John Kaszubski, 42, of Buffalo, is charged with driving while impaired by drugs, criminal possession of a controlled substance, and moving from lane unsafely. Kaszubski was stopped at 11:23 p.m. on June 9 on Route 20 in Alexander by Deputy Austin Heberein. Patrols were dispatched to Route 20 in Alexander after a caller reported observing a vehicle on Route 20 driving on a flat tire. Kaszubski was released on an appearance ticket.

Katherine Ann Goff, 34, of Byron Road, Byron, is charged with criminal contempt 2nd. Goff is accused of violating an order of protection at 1:45 a.m. on June 4. Goff was issued an appearance ticket.

Kelly P. Jones, 43, of 80th Street, Niagara Falls, is charged with harassment 2nd. Jones is accused of punching a Live Nation security guard at the Dave Matthews Concert at Darien Lake on June 14. Jones was issued an appearance ticket.

Drew Evan Lord, 27, of County Road 33, Campbell, is charged with driving while impaired by drugs, failure to obey a traffic control device, unsafe passing on left, and speeding. Lord was stopped at 7:25 p.m. on June 17 on Pearl Street Road, Batavia, by Deputy Mason Schultz.

Matthew Eric Price, of Longs Lane, Corfu, is charged with DWI, driving with a BAC of .08 or greater, failure to dim lights, drinking alcohol or using cannabis in a motor vehicle. Price was stopped at 1:33 a.m. on May 6 on Stroh Road, Alexander, by Deputy Jacob Kipler. Price agreed to be transported to UMMC for a voluntary blood draw.  He was later arrested and issued an appearance ticket.

Gary Leigh Dewind, 53, of West Bergen Road, Bergen, is charged with assault 3rd. Dewind was allegedly involved in a disturbance at midnight on June 18 at a location on Indian Falls Road, Pembroke. He was held pending arraignment.

Elizabeth Autumn Ceiotto, 24, of Groveland Street, Buffalo, is charged with petit larceny. Ceiotto is accused of stealing at Darien Lake Theme Park at 9 p.m., June 18. She was issued an appearance ticket.

Devante M. Wells, 27, of Rochester, is charged with grand larceny 3rd and unauthorized use of a motor vehicle, and Jalen I. Brown, 22, of Rochester, is charged with grand larceny 3rd and criminal possession of stolen property. Wells and Brown were arrested by State Police in connection with an incident reported at 12:37 p.m. on June 24, in the City of Batavia. Wells was ordered held and Brown was released on an appearance ticket. No further details released.

Thomas A. Biaselli, 23, of Batavia, is charged with petit larceny. Biaselli was arrested by State Police in connection with an incident reported at 1:53 p.m. on June 22 in the Town of Batavia. Biaselli was released on an appearance ticket. No further details released.

Aidan D. Cooney, 20, of Bataiva, is charged with criminal trespass 3rd. Cooney was arrested by State Police in connection with an incident reported at 12:30 p.m. on June 22 in the City of Batavia. Cooney was released on an appearance ticket. No further information was released.

Brittanee J. Hooten, 34, of Batavia, is charged with petit larceny. Hooten was arrested by State Police in connection with an incident reported at 2:54 p.m. on June 22 in the Town of Oakfield. She was issued an appearance ticket. No further information was released.

Man charged after toddler reportedly ingested edible, taken to Batavia emergency room

A two-year-old reportedly ingested chocolate containing marijuana on Thursday and was taken unconscious to the UMMC Emergency Room, according to the Sheriff's Office.

James Zackary Gray, 32, of Park Road, Batavia, has been charged with endangering the welfare of a child for allegedly leaving an edible within the reach of a child.

According to the arrest report, the child was found unconscious multiple hours after the edible was ingested.

Gray was released on an appearance ticket by Deputy Morgan Ewert.

The current condition of the child was not included in the arrest report.

Man convicted of firing shotgun at two people on Elm Street given 15 years in prison

Jeremy Ives is going to have 15 years, in the words of Judge Melissa Lightcap Cianfrini, to contemplate the kind of person he is.

Is he the kind, intelligent, and articulate person of his letters to the court and his appearances in County Court, or is he the man a jury of Genesee County residents said committed a horrible act on Aug. 12, 2022? 

Ives was convicted on May 12 at the end of a jury trial of two counts of attempted assault in the first degree and menacing. The jury found that Ives had threatened two people with a shotgun.  

In the incident, one person was reportedly injured as a result of Ives firing one shot in the area of 2 Elm St., Batavia.

Since his arrest, through the trial, and into Friday's court appearance, Ives has maintained his innocence. 

Assistant District Attorney Will Zickl, who prosecuted Ives, said that one reason Ives deserved the maximum possible sentence on his conviction was his failure to express remorse for his actions on Aug. 12, 2022.

"He's demonstrated he's a danger to the community," Zickl said. "He's expressed no remorse. He's taken no responsibility for his frankly brutal actions."

Zickl said Ives has only spoken in general terms about his conduct, saying he's sorry -- primarily expressed to his family -- in a letter to the court for his behavior.

Joseph Lobosco, the defense attorney, said it wasn't exactly fair to expect Ives to say he is sorry while he is planning an appeal on what he believes is a wrongful conviction.

"He shouldn't be put in a position of needing to express remorse for something he believes he didn't do," Lobosco said.

Zickl said the maximum sentence available, 15 years, wasn't enough. Lobosco asked for the minimum term for his client.

Then Lobosco read a letter from Ives to the court dated June 6.  

He expressed his "absolute love" for his family, and said his family extended beyond his blood relations to anybody who had ever helped him in life.

"My family are the people that hold the strongest pieces of my heart that help me focus on my relationship with the gods and the other members of my bloodline and family. My honor is loyalty, and that is my oath, and that is my pride. Concentrating on my family and my faith is what helps me daily in my strive to find inner peace," Ives wrote.

He mentioned his mental health issues, struggles with addiction, and a traumatic brain injury and said he thought he had been doing well with the help of his doctors and medication. 

"The issues that I have written about have affected some of the people in my life in negative ways, in different degrees," he wrote. "I have to write these words to these people instead of speaking the words to them and looking into their eyes because of self-inflected situations, but I want each and every one of you to know and believe in your hearths that I am sorry. I apologize for the wrongs I have done."

"I'm a good man, and I love you all with all of my heart," he added.

He promised to return from prison with a greater determination to be good to his family.

"I pray to Odin and all the gods above us to help make me the best man I can be, the best father I can be, the best son I can be, the best brother I can be, and hopefully, the best husband I can be," he wrote. "Over the years, and in the past, I have fallen short of being those things.

"To all the people involved in my life, I swear on my honor I will not allow my addictions or my afflictions to negatively affect my life or my decisions ever again. I will return to my life after this situation more focused than ever before."

After Lobosco finished reading the letter, Ives spoke up for himself.  He wanted to address something he saw as a bit of misinformation from Zickl. Zickl criticized Ives for claiming to love his children when, during the pre-sentence investigation, he told an interviewer he didn't know where two of his children currently live.

Ives said he has children aged two to age 25.  His two oldest children graduated from college while he has been in custody and he hasn't been able to stay in regular contact with them. That's the only reason, he said, he doesn't know where they are living at the moment. 

During the discussion about long-term orders of protection, Ives asked that he be allowed to contact a woman who has children that he considers to also be his children, though he is not the biological father. Cianfrini said if the woman wants to contact the court to modify the order of protection, she could, but Cianfrini said she was issuing a full stay-away order of protection. 

Ives also asked for no order of protection for a friend who has helped him during the legal process, but Zickl spoke with the victim's advocate, who was in court for sentencing, and that person reportedly asked for a temporary order of protection to become long-term.

Cianfrini did modify one order of protection to allow Ives' parents to contact a person in order for them to retrieve Ives' personal belongings.

The order of protection will be in place for the length of the sentence imposed by Cianfrini plus eight years. The sentence is for 15 years plus five years post-release supervision.

Cianfrini told Ives his was a perplexing case.  He's obviously well-spoken and intelligent, able to advocate for himself, and he has a reputation, which came out at trial, for doing unbidden kind acts for others, such as installing handrails on a stairway that had no handrails.

And though he is mindful that he maintains his innocence and is planning an appeal, he was convicted of a horrific act.  He also has five prior DWI convictions and a weapons conviction in Florida.

Those two versions of Jeremy Ives don't fit together, she said.

"You're going to have to reconcile which Jeremy Ives you are going to be when you get out of prison," Cianfrini said. "It's completely up to you as to who you are going to be. You can be the person who does good deeds or you can be the person who commits these kinds of crimes. Only you can make that decision."

Police looking for person of interest in thefts at Dwyer Stadium, other locations in county

During Monday's baseball game at Dwyer Stadium, two fans had wallets stolen from their cars after the windows of the cars were smashed open.

Credit cards from the stolen wallets were later used at local businesses. This has led Batavia police investigators to identify a person of interest in the case.

The public is being asked to help identify the person.

The crime may be linked to similar thefts under investigation by the Sheriff's Office.

Four arrests reported at Luke Bryan concert

The following were arrested at Six Flags Darien Lake during the Luke Bryan Concert on June 16.  The defendants were issued appearance tickets.

Jaxson R.W. Larsen, 21, of Lakeview Road, Lakeview, is charged with two counts of disorderly conduct after allegedly spitting on a Darien Lake security guard and knocking over a fence and threading security in the parking lot.

Cole L. Friend, 18, of Winfield Avenue, Lancaster, is charged with criminal trespass 3rd after allegedly jumping a fence into the venue.

Ryan A. Miller, 22, of Bailey Road, East Aurora, is charged with criminal trespass 3rd after allegedly re-entering the concert venue after being ejected and told not to return.

Derek J. Goodwin, 27, of Sherman Avenue, Hamilton, Ontario, is charged with harassment 2nd after allegedly punching another subject in the face.
