Brad Paisley concert results in eight arrests, 32 citations

The following are arrests from Friday's Brad Paisley Concert at Darien Lake:

James P. Balcom, 34, of Schutt Court, Grand Island, is charged with disorderly conduct. Balcom is accused of fighting with security. He was jailed on $250 bail.

Matthew G. Costanzo, 27, of Fletcher Street, Tonawanda, is charged with disorderly conduct. Costanzo is accused of fighting with security. He was jailed on $150 bail.

Samuel M. Muscarella, 23, of Exchange Street, Alden, is charged with assault, 3rd. Muscarella is accused of punching another person in the face, causing a cut above his eye requiring stitches. Muscarella was jailed on $250 bail.

Dayna L. Maimone, 22, of Viking Circle, Webster, is charged with trespass. Maimone allegedly re-entered the concert venue after being ejected.

Kevin G. Manners, 39, of Crandal Ave., Kendal, is charged with harassment, 2nd. Manners allegedly hit a security guard will being ejected from the concert venue.

(Name Redacted), 20, of Patricia Lane, Cheektowaga, allegedly hit another person in the throat (charge not listed in release).

Casie Jo Clearwater, 20, of Patricia lane, Cheektowaga, charged with two counts of harassment, 2nd. Clearwater is accused of hitting two people while inside the concert venue.

Stephen P. Wagner, 19, of East River Road, Rush, is charged with criminal possession of a controlled substance.

At least 67 arrests and citations at Dave Matthews concert in Darien

Thomas R. Allen, 28, of Elmsford Drive, West Seneca, was charged with assault, 3rd, after allegedly striking another patron in the face causing a split lip and bruising. He was jailed; $750 bail.

Dustin T. Forkell, 19, Linda Lane, Spencerport, was charged with criminal possession of a controlled substance, 7th, for allegedly unlawfully possessing prescription medication. He was also held on an outstanding warrant out of Gates. He was jailed; $750 bail.

Darien Lake has 'Father's Day Car Show' this weekend

The Father's Day Car Show will be happening on at the Darien Lake Theme Park Resort, at 9993 Alleghany Rd. in Darien Center. It runs from 10:30 a.m. to 10 p.m. on Saturday and Sunday.

Kid Rock driver admits to DWI after felony charge dropped

A Florida man who was working as a driver on a Kid Rock tour bus last year when stopped by deputies on Route 77 in Pembroke admitted to a misdemeanor charge of DWI today.

Joseph S. Devlin, 38, of St. Augustine, Fla., was facing a felony DWI charge, but the felony was dismissed by Judge Robert C. Noonan because there was no "competent proof" as to the weight of the 2003 Prevost Tour Bus that Devlin was driving.

Under terms of the plea, Devlin will be given probation if his local probation department agrees to supervise the case.

If Florida probation refuses to accept supervision of Devlin, his plea will be withdrawn.

Under questioning from Noonan, Devlin admitted to driving the tour bus on July 15, 2009, and that he consumed alcohol prior to getting behind the wheel, and that his ability to operate the bus was impaired to a "substantial degree."

Sentencing is set for Sept. 1.

Kid Rock fan pleads guilty to disorderly conduct in exchange for no jail time

Peter H. Scrooby is officially persona non grata at Darien Lake Theme Park after reaching a deal with the Genesee County District Attorney's office over his July 15 disorderly conduct charge.

The 33-year-old Irondequoit resident was accused of violating 240.20 of the state penal code while attending the Kid Rock concert last summer. Tonight in Darien Town Court, he agreed to plead guilty to the charge in exchange for no jail time and no factual admission of being a disorderly person.

Under what is known as the Alfred procedure, the prosecutor recited the evidence against the defendant, who waived his right to a trial and cross-examination by witnesses. It's the same as being convicted by trial.

Scrooby was present with his lawyer, Tom Burns, and wore cream-colored pants, black shoes, a dark-brown jacket, white shirt and a geometric-patterned, olive-green tie. His shoulder-length, light-brown hair appeared uncombed.

Assistant District Attorney Robert Zickl relayed the people's version of things to Justice Gary Graber.

Security guard Kevin Nunn reported that after another security employee made him aware of Scrooby's conduct, he found Scrooby standing on a chair and smoking a cigarette, neither of which are permitted at the concert venue.

Nunn claims he told Scrooby to stop those actions and that Scrooby "seemed to ignore" the directives at first, but did put the cigarette out and seemed about to get down off the chair when Nunn left. Shortly thereafter, Nunn returned to find Scrooby once again smoking a cigarette and standing on his chair. It was then that Scrooby was told to leave and he "indicated he would not leave."

Zickl said with thousands of concertgoers present, the security team aims to handle problems as quickly and efficiently as possible so as not to incite a riot or create more trouble.

"Scrooby had to be carried from the seating area to the gate, screaming profanities," Zickl said. "At the North Gate, where people enter and leave the concert area, a guard said he was kicking and rearing back with his head. He was screaming 'Look what you're doing to me! Can you see what they're doing to me?!'"

Zickl said Scrooby's behavior constituted public inconvenience, annoyance or alarm.

Burns said his client admits smoking and standing on his chair but claims someone came on the loudspeaker and told people to stand on their chairs, which is why he did that. As for Scrooby's behavior while being removed from the concert, Burns said the way his arm was twisted behind his back caused "excruciating pain" and he displayed an "instinctive type of reaction to pain." His client also maintains that there was inappropriate conduct by security personnel.

"We ask as part of this agreement that he not be welcome back at Darien Lake," Zickl said.

Justice Graber OK'd that restriction, fined Scrooby a mandatory surcharge of $125 and ordered bail money be refunded.

Graber said concerts are necessarily more restrictive than other public activities in what can and can't be allowed.

"There's a way to walk out and deal with it later," Graber told Scrooby. "We'll consider this a lesson learned."

Bus driver from Kid Rock tour pleads not guilty to DWI charges

The man accused of driving Kid Rock's tour bus while drunk entered a not guilty plea to three DWI charges during an arraignment this morning in Genesee County Court.

Joseph S. Devlin, 37, St. Augustine, Fla., was arrested July 15 after Sheriff's deputies spotted the bus on Route 77 in Pembroke, they say, operating erratically.

Devlin was employed at the time by a company contracted to provide transportation for Kid Rock and his entourage.

He faces two felony counts of DWI.

Devlin posted the $10,000 bail set in the case immediately.

Quick thinking helps save man stabbed during Motley Crue concert at Darien Lake

John Michael Bieganski is doing fine now,  but he might not be doing so great if not for the quick action of a group of people willing to step forward and help him Saturday night after he was stabbed in the leg by a knife-wielding assailant.

Bieganski, 23, a Clarence resident, had his leg cut during Cruefest, the concert of Motley Crue at Darien Lake Theme Park.

A friend carried him from the mosh pit (a tangle of dancing males (usually) who typically bang against each other and jump up and down and side-to-side rather violently) after he had been stabbed.

Trouble started for Bieganski, according to a Sheriff's Office report, when he thought he saw a friend being tackled and punched by one or two other men. When he tried to pull one of the men off his friend -- it turned out not to be his friend who was being attacked -- Bieganski said he suddenly felt something warm on his leg, touched it and then saw the blood.

The alleged attacker is described as a white male, about 25 years old, 6-feet tall, a strong build, wearing a gray T-shirt, khaki shorts, with a buzz cut, no glasses and clean shaven.

Bieganski required 28 stitches to close a gaping 4-inch long wound on his leg.

Contrary to initial reports, his artery was not cut, but he did bleed profusely before being treated.

After the attack, Bieganski's buddy, Evan Laczi, grabbed him in a fireman's carry hold and hoisted him from the mosh pit, but according to Glenn Hall, who was one of the first people to come to Bieganski's aid, Laczi and Bieganski came through a whole crowd of people who ignored Laczi's cries for help.

"They had walked past people to get up there (the beer trailer, where Hall was located)," Hall said. "They had walked past a number of people and nobody had done anything, to help him carry his friend or anything like that. Nobody had ran up. I'm sure he screamed out more than once, 'hey, I need help' and nobody ran out to get help or anything."

Hall, a six-year veteran of the Air Force, was a volunteer for a group of recruiters trying to raise funds to help with their recruitment effort (his wife is a military recruiter), and he said when he saw Laczi carrying Bieganski with blood soaking his right leg, his military emergency training just kicked in. He didn't even think about what he needed to do.

"Many soldiers who get this kind of training face this kind of stuff all the time," Hall said. "Overseas and abroad, these are guys are real heroes and they know what they're doing, but every military member gets this kind of training ... but I'd never reached that situation (before) and I didn't know how I would react in that situation (before Saturday night)."

Hall was working the beer trailer when he heard Laczi calling for help and he looked up and saw all the blood on Bieganski's leg.

"My immediate reaction was, 'we need to do something to stop this bleeding,'" Hall said.

His first instinct was to pull off his volunteer T-shirt and then his "wife beater" undershirt, which he ripped into two so it could be used as a tourniquet. Laczi helped place Bieganski on the long towing tongue of the beer trailer (which was covered by a sheet of plywood) while a non-military man who was part of the volunteer group asked, "hey, what can I do?"

Hall had the man put as much pressure on the wound as possible while keeping Laczi's leg elevated. Laczi held onto Bieganski's head. Then Hall went to fetch Darien's security personnel, who came to the scene to confirm the report of a man stabbed, and then called for emergency medical personnel.

It took about 15 minutes, according to Hall, for emergency personnel to arrive.

"The guy was being very compliant," Hall said. "He had bought beer from me earlier that night. He was a very nice guy, but you could tell, he had a very good buzz on. But he was not really moving, not really fighting us. He was just kind of laying there, but you could see that he had a lot of pain going on. At that point, there was nothing we could do but wait for emergency medical personnel to get there."

Hall doesn't want to be painted as a hero who saved a man's life, however.

"Truthfully, I feel like we all did our parts," Hall said. "I'm happy for the guy. It turns out he's alright, but I feel like this was group effort. Everything fell into place like dominoes and the situation was handled the best it could."

"I think the military just pounds it in there so hard and you're constantly trained on it, it almost became like second nature," Hall said. 

Bieganski is out of the hospital, but whomever stabbed him is still at large. The Sheriff's Office investigation is ongoing.

Body of Pennsylvania man found in lake at Darien theme park

A Pennsylvania man who was reported missing after attending a concert at Darien Lake Theme Park on Friday was found dead early Sunday morning in Sunshine Lake by scuba divers investigating his disappearance.

The death of William "Billy" Sutherland, 33, of Bradford, Pa., is not considered suspicious at this time, but the investigation continues.

Sutherland attended the Toby Keith and Trace Adkins concert Friday, but became separated from his friends. The group spent several hours looking for him, but eventually returned home.

When Sutherland did not return to Bradford Saturday, his family and friends drove back to Darien Lake to look for him and contacted the Genesee County Sheriff's Office to report him missing.

After interviews with friends and family, the Sheriff's Office concentrated its search in the parking area, especially in the area of Sunshine Lake, which is located within the parking area.

There is no word on how long the search took. His body was found by divers at 1:30 a.m..

The Sheriff's Office was assisted by the security staff of Darien Lake, the Darien Volunteer Fire Department, the Alden Fire Department's water rescue team, and the Genesee County Office of Emergency Management.

Charles J. Cook, 18, of 5 Cherry Lane, Orchard Park, charged with trespassing for allegedly jumping a fence to enter the concert venue.

Brett A. Causyn, 18, of 6596 Warboys Road, Byron, charged with trespassing for allegedly jumping a fence to enter the concert venue.

Matthew Maziarz, 26, of 216 Spaulding St., North Tonawanda, charged with criminal possession of marijuana.

Ryan P. Flannery, 20, 52 Lookout View Road, Fairport, allegedly found with LSD and charged with criminal possession of a controlled substance.

Ramon Ratiniskiy, 18, of 1048 N. French Road, Amherst, and a 16-year-old companion where charged with petit larceny for allegedly pushing a Darien Lake water cart through the crowd allowing patrons to take water for free.

Nhut D. Frawley, 41, 2 Brookside Drive, Catawissa, Pa., was allegedly found in possession of LSD and charged with criminal possession of a controlled substance. He was jailed on $500 bail.

Michael R. Sunley, 26, of 3893 Foleys Trail, Lexington, Ky., was charged with selling a noxious material. Sunley was allegedly selling balloons containing nitrous oxide. He was jailed on $500 bail.

Michael E. Mugridge, 24, of 47 Coldwater St., Hillsdale, was charged with disorderly conduct. He was jailed on $250 bail.

Justin D. Ritchie, 27, of 19 Chestnut St., Waretown, N.J., was allegedly found in possession of psilocybin (hallucinogenic) mushrooms. He was charged with possession of a controlled substance. Ritchie was jailed on $500 bail.

Robert J. Krueger, 37, of 38 Kenneth Ave., Toronto, Ontario, Canada, was charged with disorderly conduct for allegedly trying to break into vehicles in the parking lot. He was jailed on $500 bail.

Richard W. Tweedy, 24, of 6011 Fallough St., Taylor, Mich., was charged with selling a noxious material. Tweedy was allegedly selling balloons containing nitrous oxide. He was jailed on $500 bail.

Dianna M. Quinn, 36, of 65 Ashwood Lane, Phoenixville, Pa., was charged with selling a noxious material. Tweedy was allegedly selling balloons containing nitrous oxide. He was jailed on $500 bail.

Handful of arrests at Creed concert at Darien Lake announced

The following arrests were made related to the Creed concert at Darien Lake Theme Park over the weekend:

Adam R. Murray, 22, of 6173 Knickerbecker Road, Ontario, charged with disorderly conduct after allegedly fighting with security officers.

Alan R. Harris, 20, of 9783 State Road, Glenwood, allegedly possessed alcohol under the age of 21.

Michael A. Hill, 19, of 12670 West Schutt, Sardinia, allegedly possessed alcohol under the age of 21.

A 17-year-old from Delevan faces the same charge.

Kid Rock bus driver not drinking Tuesday night, Buffalo attorney says

The driver working with the Kid Rock tour when it came through Darien Lake hadn't been drinking the night he was arrested for alleged DWI, according to a Buffalo attorney contacted by Buffalo TV station.

Thomas J. Eoannou has reportedly been retained by Joseph Devlin, the 37-year-old Florida man accused of driving a Kid Rock tour bus while intoxicated on Tuesday night.

Eoannou reportedly told WBKW that his client has a clean record.

WBTA reported Thursday that Devlin's BAC was allegedly twice the legal limit.

Kid Rock's web site says Devlin wasn't directly employed by the tour and he has been fired from his job.

Devlin is out of jail after posting $10,000 bail.

Van's Warp Tour at Darien Lake leads to another round of under-age drinking tickets

Nineteen people age 20 or younger were issued tickets for possessing alcohol yesterday while attending the Van's Warp Tour concert at Darien Lake.

None of the 19 were Genesee County residents.

Seven of the people who received tickets from the Gensee County Sheriff's Office for violation of ABC Section 65-c were under 18 years of age.

Chief Dibble says underage drinking is significant problem at concerts

WBTA interviewed Deputy Chief Gordon Dibble about underage drinking enforcement at Darien Lake concerts.

It's almost as if he's been reading comments on The Batavian, addressing the suggestion by some that being under 21 and having a beer or two isn't a serious issue.

"I think underage drinking is, (but) on its surface people would say, 'it's no big deal kids having a few beers,'" said Dibble. "That's not what we're seeing on the law enforcement side. We're seeing people that are drinking underage for one thing, but drinking excessive amounts of alcohol and it's directly affecting their behavior to the point where they're getting arrested, they're getting injured and at these concerts. They get lost, they get disconnected -- there are too many opportunities to get hurt when they get drunk, especially to the extent that we're seeing." (Listen)

Also, WBTA reports that Joseph Devlin, the 37-year-old bus driver for the Kid Rock tour, was allegedly found to have a BAC of twice the legal limit. He's $10,000 bail has been paid.
