The attorney for Nicholas Antonucci, accused of multiple counts of burglary, would like a little more information from the prosecution on one burglary charge.

In November, Antonucci allegedly entered the home of a person he was ordered not to contact. The fact that he entered the house and stayed earned him a charges of burglary, 2nd, and criminal contempt, 2nd.

Defense attorney Thomas Burns requested a "bill of particulars" from the District Attorney's Office -- a document outlining exactly what Antonucci did to get saddled with a burglary charge.

To be charged with burglary, you must enter a dwelling unlawfully with the intent to commit a crime.

Burns said in court that recent case law would indicate the criminal contempt allegation alone wouldn't sustain the burglary charge.

Assistant District Attorney Robert Zickl told Judge Robert C. Noonan that the people had turned over to Burns everything they had on the charges.

Noonan is considering that and other motions filed in the multiple cases pending against the 25-year-old fromer Alexander resident, who is currently in state prison on felony convictions in Wyoming County.

Earlier this year, Antonucci was indicted on charges stemming from the alleged attempted theft two snowmobiles. He entered a not guilty plea to counts of attempted grand larceny, 3rd, petit larceny and two counts of criminal mischief, 4th.

Antonucci is scheduled to appear in Genesee County Court again on April 22.

A rollover accident is reported in the area of 3341 Stroh Road, Alexander.

No word on injuries. Alexander fire and Mercy EMS being dispatched "as a precaution."

Route 20 was shut down for a time early this morning after a DOT truck driver reportedly fell asleep at the wheel and his truck collided with a tree near Brookville Road, Alexander.

The accident was reported at 2:06 a.m.

The driver, Thomas D. Drumstra, of Brookville Road, Alexander, was not injured and no other vehicles were involved.

Alexander Fire Department responded to the accident.

Drumstra was driving at 2003 International dump truck registered to the NYS Department of Transportation, according to a Sheriff's Office accident report.

No citations were issued.

The accident was investigated by Deputy James Diehl.

A serious injury accident with possible entrapment is reported at 9938 Alexander Road. Multiple medics are responding, along with law enforcement and Alexander Fire Department. Mercy Flight is contacted and is checking the weather. There are at least two people injured. The location is in the area of Route 98 near Peaviner Road. A responder reports at least one person is outside the vehicle.

UPDATE 6:46 p.m.: A driver and medics for Alexander Ambulance are called. "There is heavy entrapment."

UPDATE 6:48 p.m.: All units are told to expedite their response. Town of Batavia Fire Department and Wyoming County are called to provide mutual aid and have fire police shut down traffic at Dodson Road. Responders are told to use caution upon approach because the roads are very icy.

UPDATE 6:51 p.m.: Mercy Flight #5 is en route.

UPDATE 7:01 p.m.: Route 98 at Sprague Road is being shut down. A state Department of Transportation rep is on scene. Mercy Flight is about to land in a field just east of the crash site.

UPDATE 7:03 p.m.: The entrapped patient has not yet been extricated.

UPDATE 7:05 p.m.: Mercy Flight has landed.

UPDATE 7:09 p.m.: The patient has been extricated.

UPDATE 7:24 p.m.: Mercy Flight is airborne and headed to Strong Memorial Hospital.

UPDATE 7:27 p.m.: One flatbed tow is on scene and a second flatbed is called. Town of Batavia rescue is back in service.

UPDATE 7:36 p.m.: Mercy Medic #2 is inbound to UMMC with a 45-year-old female who was involved in this two-car accident. She is conscious and alert and her only complaint is some chest discomfort due to air bag deployment.

UPDATE 7:55 p.m.: According to information obtained by Howard at the scene, a red sedan northbound on Route 98 hit a patch of ice, spun out, and was T-boned by a southbound minivan. The driver of the minivan was not seriously hurt and was taken to UMMC. The driver of the sedan was taken by ground ambulance to Strong and the passenger in the sedan suffered a serious leg injury and was flown to Strong. All units are back in service and the roads are reopened.

Richard T. Gross, 49, of Wyoming, is charged with DWI, open container and driving with no brake light. Gross was stopped by Le Roy PD.

Scott M. Dickson Jr., 27, of Le Roy, is charged with DWI and driving with a BAC of .18 or greater. Dickson was stopped by Le Roy PD for questioning related to a suspicious condition.

Timothy J. Sattora, 48, of Avon, is charged with driving while ability impaired by drugs. Sattora was stopped by Le Roy PD for allegedly speeding. He allegedly possessed a small amount of marijuana.

Jason Rex Forkey, 32, of Trumbull Parkway, Batavia, is charged with DWI, speeding and using a mobile phone while driving. Forkey was stopped at 6:35 a.m. Wednesday on Route 33, Stafford, by Deputy Joseph Corona.

Thomas Scott Spencer, 45, of West Bethany Road, Alexander, is charged with criminal obstruction of breathing. Spencer was arrested in connection with an event reported at 7:30 p.m., Feb. 23.

Christopher Lynn Allison, 18, of Hickox Road, Alexander, is charged with unlawful possession of marijuana and unlawful possession of alcohol under age 21. Allison was charged following a check by Deputy Joseph Corona of a disabled vehicle at 1:17 a.m. Tuesday on Main Street, Pembroke.

Willie J. Miles Jr., 49, of 45 Washington Ave., Batavia, is charged with criminal contempt, 2nd. Miles allegedly violated an order of protection by sending numerous text messages to the protected party.

Ashley J. Ziminski, 23, of 25 Franklin St., Batavia, is charged with DWI and driving with a BAC of .08 or greater. Ziminski was stopped by Sgt. Dan Coffey at 4:20 a.m., after Batavia PD received a report of an erratic driver.

A pair of tractor-trailers is involved in a collision on Route 20 at Sandpit Road, Alexander.

There are believed to be no injuries, though there is a fuel spill.

Alexander Fire Department is responding. Fire police are requested to the scene to shut down at least one lane of traffic.

UPDATE 6:51 a.m.: Pavilion requested to respond and stop all westbound tractor-trailer traffic at route 20 and 63.

UPDATE 7:56 a.m.: Route 20 is reopened and Alexander is back in service.

Stephanie A. Wixson, 26, of Batavia, is charged with petit larceny. Wixson was arrested by State Police at the Walmart in Warsaw for allegedly stealing a woman's purse that had also been stuffed with other merchandise. The value of the items was $292.76.

Stephen W. Thweatt, 32, of Alexander, is charged with criminal mischief 2nd, a Class D felony, Thweat is accused of causing more than $2,000 of damage in October to the interior of a residence where he previously lived. Thweatt was arrested by State Police, Warsaw, with the assistance of the Genesee County Sheriff's Office. Thweatt was jailed in Wyoming County without bail.

Manuel L. Valdez, 35, of 2 Miller Ave., Batavia, is charged with petit larceny. Valdez was taken into custody on an arrest warrant out of Batavia City Court.

Robert L. Stanley, 53, of Batavia, is charged with harassment, 2nd, and endangering the welfare of a child. Stanley is accused of pushing a juvenile to the ground and then kicking the juvenile Saturday on Ganson Avenue. Stanley was located by Batavia PD on Sunday and taken into custody.

Kasean L. Shannon, 20, of 115 Jackson St., Batavia, is charged with criminal contempt, 1st. Shannon allegedly went to the residence of a protected party. Because of a prior criminal contempt conviction in the previous five years, the charge is elevated to a felony. Shannon was jailed without bail.

Russell Lowther III, 55, of 541 E. Main St., Batavia, is charged with menacing, 2nd, and criminal possession of a weapon, 4th. Lowther is accused of threatening another person with a knife.

Matthew James Cronin, 24, of Crushing Street, Fredonia, is charged with felony DWI, driving with a BAC of .18 or greater, failure to keep right, driver's view obstructed and no or inadequate exhaust. Cronin was stopped at 12:14 a.m. on West Main Street Road, Batavia, by Deputy Patrick Reeves.

Keith Andrew Hamilton, 46, of Scribner Road, Penfield, is charged with DWI, driving with a BAC of .08 or greater and failure to keep right. Hamilton was stopped at 2:46 a.m. Sunday on Richmond Avenue, Batavia, by Sgt. Thomas Sanfratello.

Joshua Paul Moore, 22, of Batavia, is charged with unlawful possession of marijuana. Moore was a passenger in a vehicle stopped at 1:51 a.m. Sunday on Main Street, Batavia, by Deputy Patrick Reeves. Moore was allegedly found to have a small quantity of marijuana concealed in his pants.

Jackson Ray Snow, 23, of Milestrip Road, Irving, was arrested on a bench warrant out of Pembroke Town Court. Snow was stopped for an alleged traffic infraction in Brant and turned over to the Sheriff's Office on an active warrant by Brant PD. Snow was jailed on $1,000 cash bail or $2,000 bond.

Latisha Renee Woods, 25, of Syke Road, Rochester, was arrested on a bench warrant for alleged unlicensed operation. Woods was stopped on I-490 in Rochester for allegedly using her mobile phone while driving and was turned over to the Sheriff's Office on a bench warrant out of Town of Elba Court. She was jailed on $800 bail.

Gerald Earl Hensel, 57, of S. Pearl St., Oakfield, is charged with DWI and driving with a BAC of .08 or greater. Hensel was arrested at 12:25 a.m., Friday, after a report of a sick or intoxicated driver heading into Batavia from Oakfield. Hensel was taken into custody at the Genesee County Jail, where he had reportedly gone to pick up an inmate scheduled for release.

Kristen Antwan Miller, 32, of State Street, Batavia, is charged with falsifying business records, 1st, and grand larceny, 4th. Miller allegedly stole money from Radio Shack in Batavia and falsified business records in an attempt to conceal the crime.

The second alarm is called for a fully involved barn fire in Bethany at 4658 Route 20, just west of Francis Road. A deputy there reports black smoke billowing from the barn. The road will be shut down. The Bethany chief is on scene and all equipment from his department is called in.

Mutual aid is requested from Darien, Alexander, Attica, Town of Batavia, the city's Fast Team, and the Village of Wyoming. Stafford is called to stand by in Bethany's fire hall. The city's first platoon is called to stand by in headquarters.

The occupants are out of the house. Power is shut off in the barn. Vehicles have been removed from the property. The propane tank is also shut off.

UPDATE 3:34 a.m.: Westbound Route 20 is shut down at Texaco Town (the junction of routes 63 and 20).

UPDATE 4:01 a.m.: Command reports the fire is under control.

UPDATE 4:45 a.m.: The town and city units from Batavia have returned to quarters. Wyoming responders are released.

A man house sitting for a hospitalized friend at a residence known to neighbors as "the old school house" at 11030 Sandpit Road, Alexander, died Sunday evening after a fire broke out near the front of the building.

The victim has been identified as Scott A. Cramer, 47, of 11000 Sandpit Road, Alexander.

Investigators have determined the likely cause of the fire was electrical.

Cramer was found about 15 feet inside the doorway, which was initially blocked by flames. Once the fire was knocked down and the safety of the crew assured, firefighters were able to enter the residence to look for Cramer.

The Sheriff's Office reports that Cramer was pronounced dead at UMMC.

The fire was reported by neighbors and a member of the Alexander Volunteer Fire Department, who spotted flames coming from the front of the house as he drove past.

Both the neighbor and the firefighter attempted to locate the man inside, but he did not respond to calls and the flames were already blocking the entrance.

"I was hollering," Grant Whitmore said. "I couldn't get anything from the front door, so I went to the back of the house. There was a screen there and I was hollering, but I didn't hear anything."

Whitmore said there was a fire extinguisher near the front entrance of the house, which he tried using, but it proved ineffective against the size of fire that had already developed.

Tim Yaeger, emergency management coordinator for Genesee County, said there was only one way in or out of the residence and that was the front door.

Firefighters first knocked down the flames, but then entry was delayed because the area above the entrance was used for storage. There was a TV and filing cabinet in the space and fire crews were concerned about the soundness of the structure at that point.

"They were concerned about their safety, being trapped in there, so they had to make sure it was safe," Yaeger said.

Once found, Cramer was immediately taken out and brought to a Mercy EMS ambulance and transported to UMMC. Medics attempted CPR on Cramer from the time he was brought out of the residence and during his transport to the hospital.

The man was house sitting, watching over the property and taking care of the pets, while the homeowner is hospitalized at UMMC, Whitmore and Yaeger said.

There's no word on the fate of the pets.

The property owner is listed on county records as Joseph Snyder. The structure was built in 1850. The front of the structure, a later add-on, was heavily damaged in the fire.

Whitmore said Cramer had been house sitting for a week, possibly two, and that he often attended church with Whitmore and another friend. 

Fire investigators were working late into the night trying to determine the cause of the fire.

Along with Alexander Fire, Bethany, Darien and Attica fire departments responded to the scene. Town of Batavia's ladder truck was dispatched, but stayed at Alexander's fire hall on standby.

The Sheriff's Office is assisting in the fire investigation.

Samantha Mary Williams, 32, of Lake Street, Le Roy, was arrested on bench warrants for alleged robbery, 3rd, grand larceny, 4th, criminal mischief, 4th, and petit larceny. She is also charged with resisting arrest. Deputy John Baiocco reportedly attempted to arrest Williams at 2:15 p.m., Wednesday, in the lobby of the DSS office. Williams allegedly resisted arrest. Deputy Joseph Graff assisted in the apprehension. Williams was jailed on $10,000 cash bail or $20,000 bond. Williams is reportedly also wanted by Batavia PD on a resisting arrest warrant.

John James Slack, 27, of Exchange Street, Attica, is charged with burglary, 2nd. Slack is accused of entering a residence in Alabama sometime over Father's Day weekend and stealing electronics, jewelry, money and other property. Slack is incarcerated at the Attica Correctional Facility on an unrelated matter.

Michael John Antonucci, 30, of Alexander Road, Alexander, is charged with menacing, 2rd, and harassment, 2nd. Antonucci is accused of pushing a person against a refrigerator and throwing a glass bowl and plate in her direction. An order of protection has been issued.

A serious injury two-car accident is reported on Attica Road (Route 238) near Griswold. A Sheriff's deputy is on scene and Darien fire and ambulance are responding along with Mercy medics from the city.

Traffic at routes 20 and southbound 238 is being shut down. Fire police from Alexander and Wyoming County are called to assist with traffic. Mercy Flight is unavailable due to weather.

UPDATE 6:32 a.m.: Traffic police are called to Darien-Alexander Townline Road for traffic control.

UPDATE 6:34 a.m.: It's a head-on collision and members of the Crash Management Team are responding to the scene.

UPDATE 6:40 a.m.: A patient has been extricated from one of the vehicles.

UPDATE 6:44 a.m.: Darien ambulance is transporting a patient to Erie County Medical Center.

UPDATE 7:17 a.m.: All Alexander units are clearing the scene.

UPDATE 7:42 a.m.: One person was killed in this accident, according to a fire official at the scene.

UPDATE 9:03 a.m.: The road should reopen in 10 to 15 minutes. Town of Alexander Highway requested to plow and salt Route 238.

Kelly L. Alcorn is indicted on a count of assault, 2nd. Alcorn is accused of slamming a victim against a cinder-block wall at the Darien Lake Performing Arts Center on Aug. 25. (Prior Coverage: Alcorn is a Niagara Falls police officer who was initially charged with a misdemeanor; her alleged victim pressed for upgraded charges).

Nicholas A. Antonucci is indicted on two counts of attempted grand larceny, 3rd, petit larceny and two counts of criminal mischief, 4th. Antonucci is accused of attempting to steal a 2007 Yamaha snowmobile with a value of $5,000 from a location in Alexander, and of attempting to steal a 2006 Yamaha snowmobile with a value of $4,000 from a location in Alexander, on or about Jan. 6, 2010. He is accused of stealing on the same date a backpack containing a Leatherman tool, flashlight and beer. He is accused of damaging the ignitions on the snowmobiles. (Prior Coverage)

John R. Chrisley is indicted on two counts of first-degree sexual abuse and one count of endangering the welfare of a child. Chrisley is accused of sexual contact with a child less than age 11 during the summer of 2011.

Armand P. Cummer is indicted on counts of felony DWi and felony driving with a BAC of .08. Cummer is accused of driving drunk Aug. 26 on Route 5, Town of Pembroke. Cummer is alleged to have a prior DWI conviction in 2008.

Francis S. Smith is indicted on a count of burglary, 2nd, and criminal mischief, 4th. Smith is accused of breaking into a residence on Washington Avenue, Batavia, on Jan. 1.

Alexander Cub Scout Pack 650 has been holding pinewood derbies for who knows how many years, but this year was a little different.

The scouts collected more than 20,000 bottles and cans and raised $1,000 toward a new $1,500 three-lane racetrack with all the bells and whistles, and the track was dedicated to the memory of Burton Bigsby.

Bigsby is the late husband of Melinda Bigsby. The former den leader died following a long battle with cancer. His son, Jonathan, is now a Boy Scout in Troop 650 and was the official starter for today's races.

Pack 650 had 28 scouts and Cub Master Jason Davis said all of the scouts and families are very active in the pack.

Participants in the race are given a block of pinewood and instructions on how to cut it into a proper racer. There is a five-ounce weight limit, except in the unlimited division, in which cars can weigh up to a pound.

The event teaches the scouts about sportsmanship along with the craftsmanship of making something, Davis said.

"The race teaches them a little of the skills they'll use later in life," Davis said.

And the secret to winning? Davis said, graphite our axles, hit the weight limit and build a well-balanced car.

Donations that helped pay for the track came from Batavia Police Benevolent Association, Crystal Clear Pools, Select Collision, Harrington's Produce and Alexander Troop 650.

UPDATE (by Howard): Landen P. McCormick, 24, of Sandpit Road, Alexander, was driving on a gravel road cutting through farmland owned by his family when he lost control of his 2007 Dodge Ram pickup. The truck appears to have fishtailed, causing it to hit an embankment and roll up a small hill on the west side of the road. McCormick may have suffered a dislocated shoulder and was complaining of chest pain. Because of the nature of the accident and the complaint of pain, McCormick was flown to Strong by Mercy Flight as a precaution. No citations were issued. The accident was investigated by Deputy Chris Parker.

North and southbound Route 238 is closed. That's in Darien.
