UPK, energy performance and preliminary budget on tap for this week’s Batavia City Schools board meeting

Universal Pre-Kindergarten to accommodate more than 100 children for the 2022-23 school year is on the table for consideration at Batavia City Schools.

A recommendation by Molly Corey is on the school board’s agenda for this week’s meeting. It’s set for 6 p.m. Thursday at Batavia High School, Superintendent's Conference Room, 260 State St.

Corey, the district’s executive director of curriculum and instruction, has proposed UPK sites at Imagination Station and GLOW YMCA, in addition to Jackson Primary School, in order to accommodate 112 students. The expected price tag is $672,719, to be paid with federal UPK grant funding, Corey said in a memo to the superintendent. 

In other meeting items, the board is expected to vote on a proposal from Johnson Controls of Rochester for an energy performance contract. Promising a “positive cash flow” from state rebates and energy savings, the contract is for $2,357,531, to be paid off over the course of nearly 18 years at 2.75 percent interest. 

If approved, construction would begin in September of this year with a completion date of August 2023. 

Other votes and discussions include:

  • The 2022-23 preliminary $55 million budget, which includes a 1.62 percent tax levy increase. The board had its first budget workshop on Tuesday of this week to discuss a financial plan that left a gap of $315,716 to be paid for by taxpayers.
  • Setting the official registration, voting, and public hearing dates for the 2022-23 budget.
  • Revising the description of a school social worker to replace an itinerant social worker.
  • Approval of several personnel appointments and resignations.
  • A shared services agreement between Batavia City School District and the Town of Batavia for shared services and equipment use for a five-year term.
  • The purchase of sensory room equipment for Jackson Primary and John Kennedy Intermediate from Fun & Function and School Specialty for $22,031.99.

The meeting includes time for public comments and an executive session to discuss a resolution to “assert paid leave for an employee until further notice,” followed by the vote in open session.

With an agreement to buy O'Lacy's in hand, Christiano promises continuation of the Irish pub theme

More than anything else, Batavia businessman Roger Christiano wants people to know that the “quaint, authentic atmosphere” that defines O’Lacy’s Irish Pub will continue when he assumes ownership of the establishment at 5 School St.

“We won’t be changing anything, but actually will make things better with some new menu items and sprucing the place up a bit,” Christiano said this morning. “Everything that Kent Ewell has done for 25 years, I promised to retain.”

Christiano and Ewell have agreed to terms for the former to purchase O’Lacy’s, which was founded on April 15, 1997, and has been a popular bar/restaurant ever since.

He said his plans are to paint the interior, sand the floor and put in new furniture.

“The only thing I'm going to do is take all the stuff off the walls and when we’re done, all of Kent’s Irish artifacts are going back up,” he said.

On Monday night, the Batavia City Council found no reason to not accept a liquor license application from Christiano.

For his part, Ewell informed the public that O’Lacy’s is gearing up for St. Patrick’s Day on Thursday and for its 25th anniversary celebration next month.

By now you probably have seen or heard that O’Lacy’s Irish Pub will be sold in the near future. However, several contingencies must be met, one being a liquor license which can take 60-90 days or more (for issuance by the New York State Liquor Authority).

Christiano said he has been a customer of O’Lacy’s since it opened.

“I like the place and I have a good crew that’s going to run it for me,” he said. “My son-in-law (Michael O’Donnell) is going to be included and our two employees that have been long-standing employees at O’Lacy’s.”

A former owner of a Verizon Wireless store, rental houses/apartments and self-storage units in the Geneseo and Leicester areas, Christiano, 74, now is devoting his attention to the bar/restaurant business. He owns Rookies Sports Bar & Grill in Rochester and Knuckles Knockout Grill in Chili and is close to buying another sports bar near Tinseltown in Gates.

“I just wanted to try something different … so I told my wife (Sharon) that I’d like to buy a sports bar,” he said, referring to the purchase of Rookies in 2019. He bought Knuckles last year.

He said COVID-19 put a major stress upon his businesses.

“I bought this big place (Rookies) and then the pandemic hit. If I didn’t have all my business expertise, I don’t know if we would have made it,” he said. “It was tough getting through – being closed for three months, but fortunately Rookies had a huge takeout business.”

French yogurt company plans to build plant in Batavia, creating 135 jobs

Governor Kathy Hochul today announced that La Fermière, a family-owned French yogurt and desserts company, will establish its U.S. production operations in New York State. The company has committed to constructing a 45,000 square-foot yogurt and dairy desserts production facility at Genesee Valley Agri-Business Park in Batavia, with plans for future, additional expansion. As a result, La Fermière, expects to create up to 135 New Jobs in the region. Additionally, the company will utilize millions of pounds of milk provided by New York dairy farmers to create its globally renowned dairy products. Agribusiness is a core pillar of the locally designed Finger Lakes Forward plan, a comprehensive plan that is working to revitalize and grow the regional economy.

"We’re proud to welcome La Fermière to Genesee County, bringing jobs and opportunity to the Finger Lakes region,” Governor Hochul said. “This investment shows that our bold economic recovery plan for the Finger Lakes is working, attracting new businesses and helping communities across the region grow and thrive."

Empire State Development is assisting this project with up to $1.35 million​ in performance-based Excelsior Jobs Tax Credits in exchange for job creation commitments. Genesee County, Greater Rochester Enterprise, and Invest Buffalo Niagara are providing support for the company’s growth in New York State. The total project cost has been placed at $25.8 million dollars. The company expects to be operational at the site by November of 2023.

Located in the Town of Batavia, Genesee County, the Genesee Valley Agri-Business Park was developed as the largest food and beverage greenfield in the northeastern U.S. to connect the region’s agricultural production, talent and transportation networks. The 250-acre Ag Park and the surrounding area has become the Dairy Processing Hub of the Northeast, with more than 1 million square-feet of operations and approximately 1,000 workers employed across multiple production and supply chain companies.

Founded in Marseille, France in 1952, the company was purchased by Groupe Tarpinian in 2002. In the mid to late 2010s, La Fermière began working with a New York state-based co-packer in an effort to bring its sustainably packaged French yogurt to the U.S. market. The company had considered site locations throughout the country for its state-of-the-art manufacturing facility but selected New York, thanks to the focused support from both the State and its regional economic development partners.

Tax levy increase questioned during Batavia City Schools budget workshop

A two-hour budget presentation that meant plenty of numbers, percentages and calculations for Batavia City Schools board Tuesday left board President Alice Benedict unsure it added up to a yes vote. 

Given a proposed tax levy increase of $315,716, or 1.62 percent, and uncertain enrollment projections, Benedict mused if an increase was really necessary.

“I’m wondering if our numbers are down, why are we adding more?” she said during the board’s first 2022-23 budget workshop in the district office conference room. “Once we get (additional teachers) into the district … are we at the right levels that we should be, enrollment versus teachers?”

Business Administrator Scott Rozanski had been laying out the $55 million budget for about 90 minutes, complete with a proposed $1.2 million increase in salaries for teachers, administrators and support staff. The increase supports new assistant principal and community schools coordinator salaries plus nine additional teachers. 

Benedict referred to a former board meeting guest who reviewed a report that included district enrollment projections. Although it wasn’t all bad news, the data told “a bitter tale,” consultant Paul Seversky had said. 

Genesee County births are still taking place, though at low numbers, more kids transferred to a private school — 174 in 2021 versus 137 in 2020 — and one out of 10 students leave the district within the school year, he said.

Increased expenses of nearly $3 million include additional personnel and bumping up bus purchases from 15 to 21 as a “worst-case scenario,” Rozanski said, as there has been a hike in numbers due to “foster care needing services.” 

This overall 1.62 percent tax levy increase would be within the state-mandated tax cap, he said. It translates to a tax rate increase of 31-cents per thousand assessed valuation, or an extra $27.90 for a home assessed at $90,000.

Benedict asked if the district buses 100 percent of its students now.

“No, we bus about 50 to 55 percent now,” he said. “We tentatively could bus 100 percent if we tier (the bus runs and students). We don’t have to transport everyone per State Education Department guidelines; for a small city school, it’s not mandated.”

He presented some of the district’s history and emphasized that remaining within the tax cap has saved taxpayers a cumulative $29.7 million over the last decade.

“Are you trying to convince me?” Benedict said, as Rozanski quickly replied: “No, I’’m not trying to convince you … it all plays into the big picture.”

“This tax levy increase is a wish list, and we as a board can say we don’t want any increase whatsoever,” she said. “I just don’t want to get to a point where we have more staffing than we need.”

Superintendent Jason Smith said that he and Rozanski have “identified some areas for reductions” and will provide them per the board’s directives. This is a preliminary budget and may be revised before a public vote in May.

Farmer worker trampled by cattle in Le Roy

Mercy Flight transported a farmer worker to ECMC this morning after he was trampled by cows that were being inseminated on a farm at 8569 Oatka Trail Road.

His condition is guarded.

Le Roy Fire with UTV 61 and Le Roy Ambulance responded to the scene shortly before 10 a.m.

The man was unconscious when were dispatched to the scene.

His name has not been released.

Benderson director gives some details, but keeps the names of the Kmart parking lot tenants to himself

Taking the lead from Chairperson Kathleen Jasinski, the Batavia Town Planning Board tonight set a public hearing for April 19 to consider a special use permit for the drive-thru lanes of Benderson Development’s proposal to place two restaurants on the parking lot of the former Kmart off Lewiston and Park roads.

“This is exciting to all of us,” Jasinski said about the Buffalo-based developer’s plan to construct a 4,000-square-foot restaurant with a drive-thru and bypass lane at one end of the parking lot and a 6,752-square-foot retail/restaurant building with a 2,000-square-foot endcap coffee shop and drive-thru at the other end.

Jasinski then turned the floor over to James Boglioli of Buffalo, an attorney for Benderson and a right-to-build director for the Northeast United States.

Boglioli said that a tenant has signed a lease for the endcap coffee shop and another business is close to signing a lease for the smaller restaurant.

He reported that Benderson plans to pave the parking lot, put in new striping for the parking spaces, improve the stormwater system and add much-needed green space to the lot.

“There will be significant improvement to the site … it will be much more attractive,” he said.

When Jasinski mentioned that “it sounds like you know who’s going in there,” Boglioli said he does know, “but if I say it, then I’ll get in trouble when I get back (home).”

He did say that the businesses will operate seven days a week (which eliminates Chick-Fil-A from the discussion), primarily during breakfast and lunch hours.

Boglioli said he foresees no issues with vehicles stacking out of the parking lot and onto either Lewiston or Park, and doesn’t expect any problems with overflow parking from Batavia Downs Gaming since there are plenty of spaces on the lot.

As far as the Kmart building which has been vacant for three years, he said Benderson is “marketing the building all over the country.”

“We’re not going to get that size retailer coming in; it will be different in the future … and will be consistent with the parking,” he said, prompting comments from planning board members that the large Kmart building could be subdivided into several businesses.

The board declared itself as the lead agency for the project and set the public hearing for April 19. Boglioli was asked to come back at that time to provide further information, such as traffic flow studies and signage needs.

In other developments, Town Building Inspector Dan Lang reported the following:

  • O-At-Ka Milk Products will present its plan, also on April 19, for a 3,200-square-foot addition at its Cedar Street location.
  • The Batavia Town Board on Wednesday will vote on a rezoning request to change a segment of the Genesee Valley Agri-Business Park on East Main Street Road from Commercial to Industrial Park – making the entire park an IP district.
  • The Town Board supports Genesee County Planning Board’s plan to eliminate smaller projects from its jurisdiction, handing them back to the local municipalities.  “We’ve been seeking autonomy for years,” Lang said.
  • The trees of many solar farms in the Town of Batavia are dying off, leaving them without the proper screening as stipulated in the solar ordinance. Lang said solar companies are being contacted to correct the situation and, for the most part, are being responsive.

Veteran Affairs report recommends building a new 'rightsized' medical center on the Batavia campus

A new VA Medical Center building in Batavia is among the many recommendations made by the U.S. Department of Veterans Affairs in a report released on Monday to a federal legislature-backed Asset and Infrastructure Review Commission.

The Batavia hospital (photo above) is part of the department’s VISN O2, which lists seven regions – Eastern, Central, Western, Finger Lakes, Long Island, Metro New York and New Jersey. Batavia and the Buffalo VA Medical Center comprise the Western region.

The report calls for tearing down the medical centers in both Batavia and Buffalo and building new ones to meet veterans’ health care needs in a changing market.

When considering the Batavia VAMC, it recommends modernizing and realigning the Richmond Avenue facility by modernizing the outpatient space.

“The Batavia VAMC was built in 1932, with FCA (Facility Condition Assessment) deficiencies totaling approximately $31.8M and annual operations and maintenance costs totaling an estimated $4.1M. In FY 2019, there were 54,134 enrollees within 60 minutes of the Batavia VAMC.

“The primary care and specialty care clinic at the Batavia VAMC is space-constrained and not designed to support patient-aligned care teams (PACTs); the current infrastructure and layout do not meet modern health care standards. As outpatient service demand is projected to increase across the market, the existing facility is inadequate to meet demand and insufficient to support functional space requirements.

“The Batavia VAMC has 12.0 acres available for additional development. Relocating and expanding outpatient services to a purpose-built, rightsized facility on the Batavia VAMC campus will meet the growing needs of the Veteran population.”

An overview of the Batavia VAMC operation shows that it has 80 Community Living Center beds and 32 Residential Rehabilitation Treatment Program beds.

The report indicates that the Western market had 40,444 enrollees in fiscal year 2019, but is projected to see a 15.8 percent decrease in enrolled veterans by fiscal year 2029. The largest enrollee populations are in the counties of Erie, Niagara, and Cattaraugus.

Furthermore, demand for inpatient medical and surgical services is expected to decrease by 13,9 percent and the demand for inpatient mental health services is projected to decrease by 11.0% between FY 2019 and FY 2029.

As a result, recommendations to reduce the RRTP capacity in Batavia from 32 to 28 beds “will better address current and projected demand.”

A story in The Buffalo News on Monday provided details about the recommendations for the Buffalo VAMC, with VA Secretary Denis McDonough stating that a new facility is warranted “because the current hospital is dated and because the population of veterans in the area is projected to remain high.”

The story noted that the VA proposes building a $1 billion hospital in Buffalo to replace the current facility on Bailey Avenue that opened in 1949 because it “is too big, too old and poorly located.”

Per the VA report, "Relocating the Buffalo VAMC near or in the Buffalo Niagara Medical Campus will enhance innovation, collaborative care, research and educational opportunities with local community institutions, including with VA’s academic affiliate, the State University of New York (SUNY) at Buffalo."

The Buffalo News story also indicated that the Batavia hospital would become "a hub for the treatment of post-traumatic stress disorder."

City of Batavia sets wheels in motion to replace Engine 12

It seems as though fire truck No. 12 is the “little engine that can’t” – for very much longer.

City of Batavia Manager Rachael Tabelski reported at Monday night’s City Council Business Meeting that the city fire department’s Engine 12 (photo above) is 20 years old and is just about ready to be retired from service.

“We have in our capital plan a fire truck replacement for Engine 12 and we are looking at getting grant funding from CDBG (Community Development Block Grant),” Tabelski said. “And before we submit a full application, they ask that municipalities go through a pre-application process.

“It’s a 2002 (model) that we will be replacing and the estimated cost is 700,000 dollars.”

From there, she turned it over to Interim Fire Chief Dan Herberger, who provided more details about Engine 12, including its shortcomings in the area of technology.

“We’re looking at replacing it with something very similar to our frontline engine, which is Engine 11,” he said. “It’s a rescue, fire engine-type style; basically, think of it as a fire engine with rescue capabilities.”

Herberger explained that the department operates with two main pieces of apparatus – one for the on-duty staff, “so we basically have to take everything with us, all the time.”

He said Engine 12 doesn’t have the safety features that come with today’s fire trucks, such as lighting and the ability to hook generators to the trucks. He also said the current vehicle has signs of rust.

“Right now, we’re in the design phase – looking at various vehicles from around the region to see what best fits our needs,” he said.

Tabelski, answering a question from City Council President Eugene Jankowski Jr., said she is hoping to receive $200,000 from the grant. Coupled with $400,000 that is in reserves, the city would be close to covering the full cost of the new truck – likely in 2023-24.

Herberger said there would be little trade-in value for Engine 12, noting that it would be 22 years old by the time a new truck was delivered to the city.

He said he remembers the sale of an old ladder truck to a tree trimming company in North Carolina but the monetary return “really didn’t offset anything too much.”

When asked if the cost of the new truck was a bottom line price, Herberger said the department may have to purchase “a few miscellaneous pieces of equipment for it.”

“In the past years, we’ve really tried to standardize all of our vehicles, so hose complement, rescue tools and hand tools, they’re pretty much the same throughout everything, so that bottom line price would be with equipment,” he said.

City manager on budget passing: 'A balanced plan that funds things people count on - police, fire, roads'

The Batavia City Council tonight unanimously passed the 2022-23 budget, ending a five-month process that resulted in the funding of a $17.78 million general budget with a slight decrease in the property tax rate.

“It was a long process that starts in November when departments submit their budget. And we sit and we meet, and we hash out priorities in each department’s budget, especially when we're looking at general fund police and fire and DPW snow removal,” said City Manager Rachael Tabelski said following the Business Meeting at the City Centre Council Board Room.

Tabelski said she was “excited” by achieving a balanced budget “where the revenues conservatively are estimated to come in and match the expenses we have going out to, again, run the operations that people come to count on -- police, fire and roads.”

Council’s passage of the budget – the All-Funds budget totals $29.7 million – means that city property owners will pay a tax rate of $8.94 per $1,000 of assessed value – down by 78 cents from the 2021-22 figure.

That doesn’t mean that everyone’s tax bill will decrease since most homeowners’ assessments went up – a fact not lost on Tabelski.

“The tax rate will go down It will depend on -- your payment -- … if your assessment went up,” she said. “I know many, many residents -- almost 4,200 -- assessments went up because of market conditions during COVID and the hot housing market. My hope is that that has cooled slightly, and we're not going to see large sweeping increases in assessments moving forward because it is difficult.”

Tabelski said that people react differently when assessments are raised.

“Some people like the assessment to go up because it increases the equity and value in their home, and others understand that it can mean at times a tax increase as well,” she said. “So, I'm very sympathetic to kind of understanding where residents of the city are and trying to keep our budget as efficient as possible.”

When asked if she could identify one highlight of the budget, she came up with the fact that more money was put into the police department’s Emergency Response Team.

“They are called a countywide response team, but it's run by City of Batavia Police and they're called on the scenes where they might need something like hostage negotiation or barricaded individuals,” she said. “And I was happy that we're able to bring more funding to that program this year.”

Council also approved a 1.5 percent increase in water rates, meter fees and capital improvement fees for the 2022-23 fiscal year.

Genesee Country Farmers Market gets words of support

Just in case the Batavia City Council was having second thoughts about supporting the Genesee Country Farmers Market, the president of the organization and one of the downtown market’s best customers touted its benefits at tonight’s Business Meeting.

Jan Goodenbury of Oakfield, in her second term as the GCFM president, encouraged council members to “support the market and make a timely decision to approve our application” at the board’s next meeting on March 28.

A former Batavian, Goodenbury emphasized the market’s value to the community, with locally-grown produce fresher than what is available in supermarkets and by keeping money in the GLOW region, which helps the local economy.

A flower, vegetable and chicken farmer, herself, she said the current location at the former JC Penney parking lot is ideal for customers, many who have to walk or ride their bicycle.

“With the Healthy Living (campus coming), it ties all in,” she said.

Goodenbury said the sooner the application to operate is approved, the better, because “vendor applications need to go out and go before the GCFM board for review.”

Pending City Council backing, the market will run three days a week for the seventh consecutive year on city-owned property in downtown Batavia. In 2021, it was open on Tuesdays, Thursdays and Fridays from June 4 through Oct. 29.

City resident Christine Zinni followed Goodenbury to the podium, stating that the market is important “because I've been the recipient of some of the wonderful food that is offered at this market, and I teach food and culture classes at the State University of New York at Brockport.”

“So, I talk to a lot of young people about what that means and about healthful produce – to be out in the open air and be able to connect with others on a face-to-face basis,” she said. “And it’s helped me to have that resource so close; to be able to walk or bike and get the healthy benefits of fresh food.”

Drawing a chuckle, she said, “What I usually say to my students, well look what’s happened (to me) -- I’m 110 years old.”

Zinni proposed that the Batavia market take a page from what is happening at similar venues in Clarence, Le Roy and Rochester by adding music, for example.

“I don’t know what’s currently on the table – (but) more of an investment in the farmer’s market. It would definitely help the image – Batavia’s image; the kind of image that I think would be beneficial to the city,” she said.

Her suggestions prompted Council member John Canale to urge GCFM officials to partner with the Genesee-Orleans Regional Arts Council to line up artists in various genres.

“Artists, music artists, fine artists – incorporate some of that (into the market), Canale said, noting that GO Art! is right across the street (at the corner of Bank and Main).

Canale also put in a plug for his favorite pastry.

“If you offer donuts from Sweet Ally’s donut shop in Oakfield, which are phenomenal, I will be there every week,” he said. “This is coming from a guy who knows donuts.”

Council member Patti Pacino assured Goodenbury and Zinni that the market is “well appreciated.” Council President Eugene Jankowski Jr. agreed.

“We understand. It brings a lot of people downtown,” he said. “But we have an aging (police) building that we have to replace (a reference to the new station that will be going up on the GCFM’s former location on the other side of Alva Place). I don’t see any problem. We usually welcome the application.”

Body of missing Batavia man recovered from Tonawanda Creek

The body of Lewis Hyde, missing for three days, was recovered this afternoon after an extensive water search in Tonawanda Creek.

Batavia PD requested a search of the creek by City Fire's water rescue team and other first responders because Hyde's jacket was found near the creek yesterday.

The 29-year-old's body was recovered at 12:35 p.m. and positively identified as the missing man.

"At this time, our thoughts and prayers are with the family and friends of Lewis Hyde," stated Batavia PD in a press release.

The release says there has been an extensive search for Hyde since he was reported missing and that the creek became a focal point of the search yesterday.  The first phase of the search included air reconnaissance. 

The water rescue team meticulously searched the creek between South Lyon Street and River Street starting early this morning.

There is an ongoing investigation by Batavia PD. There will also be an autopsy but investigators do not suspect foul play.

Batavia businessman files notification to obtain liquor license at School Street pub

The Batavia City Council has a full agenda for its Business Meeting tonight – 13 resolutions to vote on, a couple community events to approve and an application from a Batavia entrepreneur to obtain a liquor license for an establishment at 5 School St., currently operated as O’Lacy’s Irish Pub.

As required by the New York State Liquor Authority, Roger Christiano on Feb. 23 filed the standardized notice form for providing 30-day advance notice to the City of Batavia.

Contacted today, Christiano, who owns two sports bars in Rochester, said he is looking to purchase the popular bar/restaurant.

O’Lacy’s owner Kent Ewell did not wish to comment about the liquor license application or about the future of the pub that he opened 25 years ago – on April 15, 1997.

The two events on the agenda are the Batavia Concert Band Summer Concert Series, scheduled for 7 p.m. on Wednesdays from June 22 through Aug. 3 at Centennial Park, and the Living Waters Community Outreach from 10:30 a.m. to 5 p.m. at Austin Park.

Key resolutions are the adoption of the 2022-23 budget ordinance, water rates, meter fees and capital improvement fees; a contract with HUNT Engineers for services for the City Centre Mall Downtown Revitalization Initiative project, and to accept a $1 million Community Development Block Grant and authorize a $414,017 local match for the Jackson Street water main project.

Town board to vote on appointment of Tourt as highway superintendent, public hearing on solar ordinance

The Batavia Town Board is expected to appoint Ray Tourt as the town’s highway superintendent at its monthly meeting on Wednesday night.

A resolution included in the meeting agenda has Tourt, who has announced his retirement as City of Batavia Bureau of Maintenance superintendent, moving into the position, effective April 4.

A city employee since 1999, Tourt’s last day with the city is March 30.

Town Supervisor Gregory Post today said that Tourt will serve out the remainder of this year before being placed on the ballot to run for the part-time, salaried position for three more years. It pays around $20,000.

Tourt would be replacing Tom Lichtenthal, who resigned, but continues to work for the town in an engineering capacity.

Also, on the agenda for Wednesday’s meeting, which starts at 7 p.m. at the Town Hall on West Main Street Road, is the setting of a public hearing for 7 p.m. April 20 (at the Town Hall) on “A Local Law to Amend the Town of Batavia Zoning Ordinance for Solar Energy Systems.”

For the past several months, the town’s solar committee worked to revise the law governing solar systems in the municipality and has come up with a final draft for the public’s consideration.

Crews searching Tonawanda Creek for missing Batavia man

A water rescue team from City Fire with assistance from other local agencies has been searching the Tonawanda Creek off of West Main Street, between South Lyon and River streets, for a missing Batavia man.

There is no reason to believe the man, Lewis Hyde, went into the creek, said Investigator Eric Hill, Batavia PD, but because he was last seen in the area and his jacket was found yesterday on the bank of the creek, officials decided it best to undertake a search.

"We're doing our due diligence and hoping we don't find him," said Hill.

By 12:30, crews had searched the north half of the creek and were halfway done with the south side, and Hyde had not been located.

If his body is not found in the creek, it provides hope he's still alive, Hill noted.

Hyde is described as being 5’10”, 180 pounds.

He was last seen at 2 a.m. March 11, wearing a tan coat, jeans, and black boots.

Law and Order: Alexander man charged with multiple violations of an order of protection

Anthony Daniel Micucci, 27, of Darien Alexander Townline Road, Alexander, is charged with five counts of criminal contempt 1st, criminal contempt 2nd, stalking 3rd, and stalking 4th. Micucci was arrested on a warrant for allegedly violating a complete stay-away order of protection. Micucci was also arrested by State Police on charges of stalking 3rd and two counts of criminal contempt 2nd.  He was jailed without bail.

Matthew Scott Williams, 34, of Hundredmark Road, Elba, is charged with harassment 2nd and endangering the welfare of a child. Williams is accused of head butting a person while in the presence of a child during a disturbance reported at 9:15 a.m., March 10, at a residence on Hundredmark Road, Elba

Michael Joseph Elmore, 31, of Washington Avenue, Batavia, is charged with obstructing governmental administration. Elmore allegedly refused to obey lawful orders by deputies during an investigation at Days Inn in Batavia at 4:45 a.m., March 13.

Michael Andrew Kos, Jr., 43, of Hampton Brook Drive, Hamburg, is charged with DWI and driving with a BAC of .08 or greater.  At 8:25 p.m., March 10, Deputy Nicholas Charmoun and Sgt. Andrew Hale were dispatched to the Kwik Fill on West Main Street Road, Le Roy, for a report of a suspicious condition behind the building. At that location, they located Kos and upon investigation determined he was allegedly too intoxicated to operate a motor vehicle. He was transported to the Genesee County Jail for processing and issued an appearance ticket.

Lauralee Pacer, 36, of Batavia, was arrested on a warrant for failure to appear.  Pacer had previously been issued an appearance ticket. 

Shante R. Williams, 38, of Batavia, is charged with bail jumping 3rd. Williams was arraigned in City Court and released under supervision.

James D. Hooten, 33, of Batavia, and Brittanee J. Hooten, 33, of Batavia, are charged with petit larceny and conspiracy 6th. James and Brittanee are accused of shoplifting from the Kiwk Fill at 99 Jackson Street, Batavia. They were issued appearance tickets.

Shawn M. Twardowski, 39, of Le Roy, was arrested on multiple warrants for failure to appear for trespass and petit larceny.  Twardowski was arraigned in City Court and released under supervision.

Lyndsay T. Young, 38, of Batavia, is charged with harassment 2nd. Young is accused of striking another person in the face causing a scratch under the person's eye at 2:34 p.m., March 4, at a location on State Street, Batavia. Young was issued an appearance ticket.

Jolene Y. Stevens, 33, of Batavia, was arrested on a warrant for failure to appear. Stevens was arraigned in city court and released on her own recognizance. 

Rufus G. Johnson, 28, of North-Chili, is charged with petit larceny. Johnson is accused of stealing merchandise from a business in Batavia. He was allegedly located with the merchandise and arrested. He was issued an appearance ticket.

Matthew S. Williams, 34, of Elba, is charged with unauthorized use of a motor vehicle and criminal contempt 2nd. Williams was arrested by State Police in connection with an incident reported at 1:03 p.m., March 11, in Elba.  His release status is unknown.  No further information released.

50th Genesee County Chamber Awards event is golden celebration

There were no mask requirements during this year’s Genesee County Chamber Awards dinner, however, one aspect of last year’s event was brought to the podium: those 2020 award recipients who had to be recognized virtually due to COVID a year ago.

Tammy Hathaway presented the Geneseean of the Year Award to fellow Geneseean Jay Lazarony, recipient of the 2021 honor. Hathaway was one of several people touting Lazarony’s worthiness during the awards event Saturday at Batavia Downs Gaming.

After accepting a tiara from Chamber President Eric Fix, because she is “the queen,” Hathaway began a tribute to the GLOW Work Force Development Board executive director for his 25 years of working with thousands of youngsters in various roles throughout Genesee County.

“Jay is a pretty amazing human being,” Hathaway said. 

Karyn Winters, director of Genesee County's Business Education Alliance, nominated him for being an "exemplary professional and volunteer," and embodying what's great about Genesee County," she said. He founded GLOW With Your Hands in 2019 and has been a "selfless, kind, motivating and fearless leader," she said.

"While his career alone warrants recognition, what truly makes Jay an admirable Geneseean is his infectious enthusiasm to mentor local youth," Winters said in her nomination.

Colleagues, staff, and program participants continued the trail of accolades via pre-recorded videos played on several screens throughout the banquet room. Jocelyn Sikorski has known Lazarony through the county’s Youth Bureau for more than 20 years, she said, and has witnessed his focus on “looking out for the best interests of youth and our families.”

“He’s a very caring and outgoing man,” she said. “I want to honor Jay and say great job, you are so deserving.”

When Lazarony applied for the executive director position seven years ago, the board made “a unanimous decision” to hire him, board member Norb Fuest said. 

“He just exceeded our expectations, to say the least,” Fuest said. “Our training numbers have been some of the best in the state, a lot of that because of Jay.”

Entrepreneur Jessica Pratt, co-owner of several businesses in Genesee County, including Whole Life Fitness in Batavia, knows first-hand about Lazarony’s impact, she said. He has helped her become “the person I am today,” she said.

Lazarony thanked and acknowledged his family, wife Donna and children Christina, Scott, and Nick and his grandchildren, several colleagues within Genesee County, and his staff from the GLOW regions of Genesee, Livingston, Orleans, and Wyoming counties. 

He noted a group of counselors that, during the pandemic’s social distancing requirements, turned "traditional services into a virtual system and continued to provide unemployment opportunities during a very, very difficult time,” he said.

“What I was most impressed with was the time and understanding they gave to each and every customer case with massive layoffs,” he said.

He also took a few minutes to urge the audience of at least 200 people to “give youth a chance.” He shared a story of a young man named Justin, a program participant who wasn’t sure of his abilities to pursue a job in nursing. Lazarony made him a promise that if he did all of the work, Lazarony would find the funding to help him succeed on a career path. Justin became a nurse practitioner and worked at a facility where Lazarony’s father spent his last days until he died on December 28.

Justin called the family to notify them, and his demeanor was proof that he had absorbed his lessons well, Lazarony said.

“He provided the information with dignity and respect,” Lazarony said. "Take a chance on them."

Other award recipients included:

Valle Jewelers for Business of the Year, presented by Guy Pellegríno, who grew up next door to the Valle family, he said. 

“What a wonderful family,” he said. “I’m so proud to introduce you, you so earned this. I looked up to Mary and Dominic; I was so in awe.” 

Owners Stephen Valle and Carrie Lawrence, along with former owner and mom Mary Valle, accepted the award. In a pre-recorded video, Mary recounted the story of the store’s humble beginnings 70 years ago. It was founded by Grandpa Dominic, who arrived in New York City with $16 in his pocket. The physical location moved from Carey Mansion to Genesee Country Mall to its current spot at 21 Jackson St., all in Batavia. 

Her son Stephen added that over the years the jewelry business has changed, but “customer service has not.” He thanked the chamber, the store’s “fantastic staff” and one person who has been integral to the business’ success, his late father Dom.

“We’re missing one man,” Stephen said, taking an emotional breath. “But we know he’s smiling down on us.”

Theresa DeMars nominated Valle Jewelers for its customer service, engagement with and support of the community, steadfast participation in downtown events, and being a “fixture in our community for three generations,” DeMars said.

“Valle Jewelers is a community staple, a true family-run business, and one of our best-kept secrets,” she said in her nomination. 

Alleghany Farm Services for Agricultural Business of the Year, presented by last year’s recipient L&M Specialty Fabrication.

Their business protocols pushed the company into its sixth state and garnered the attention of Jeanna Clark of M&T Bank and Farm Credit East. Clark’s nomination cited several reasons, including how the company has:

  • Increased their fleet of tile plows from two to four, including a prohibitively expensive mini tile plow that fits the space constraints of vineyards and orchards 
  • Expanded company size and employees by 25 percent over the last two years
  • Thanked and gave back to customers with a yearly Field Day 
  • Focused on drainage education by working with local soil and water districts

Farm Credit East also cited the company’s impressive expansion statistics and lauded it for its remaining loyalty to Genesee County with headquarters in Basom.

Company partners Drew and his son Chad Klotzbach accepted the award. The business began in the 1980s with a landscaping focus, followed by Alleghany Farm Services, which was founded by Drew and his wife Dianne in 2001. 

The process is about much more than sticking a pipe in the ground to drain water from a field, Drew said. And Alleghany Farm Services has mastered that process to become one of the leaders of drainage issues in the Northeast. 

Business Operations Manager Christina Fetzer acknowledged those who helped make the company a success.

“We wouldn't be where we are today if it wasn't for the support of the ag community and our loyal customers. Every project that we do is unique and we take pride in being able to customize a solution that will benefit each farm,” she said. “Our goal is to build long-lasting relationships with each customer to provide ongoing education, maintenance, and guidance. A large portion of our growth has been through word of mouth from our existing customer base. And for that, we are very thankful.”

Drew thanked the Chamber, the company’s employees, and the ag community.

Batavia Muckdogs for Entrepreneurial Business of the Year. Dan Ireland, representing Rochester Regional Health, commended owners Robbie and Nellie Nichols and General Manager Marc Witt for their efforts to bring “baseball back to Batavia in 2021.”

“They didn’t just bring baseball back,” Ireland said. “You revitalized it. We want to say thank you for what you did.”

Their first year at Dwyer Stadium couldn’t have gone any better, Witt said.

“The community embraced everything we threw at them,” he said. “We’re already off to a great start. We can’t wait for the first pitch in June. We found zero challenges and accomplished all our goals. Thank you to the community.”

There was a dance competition, an Alzheimer’s Walk, a Dogs Trick or Treat Halloween event, and other public happenings at the Bank Street facility, plus participation in off-site activities including the Memorial Day parade, he said. Batavia Muckdogs drew the community support, he said, including from City Manager Rachael Tabelski who “was true to her word,” and the very first team sponsor, Bill Hayes of Turnbull Heating & Cooling. 

In his nomination of the Batavia Muckdogs for the award, lifelong Batavian Tom Turnbull said the city and county have been enriched because of Robbie and Nellie Nichols’ hard work and community spirit.

“While the Batavia Muckdogs may not seem like a new business due to the continuation of the name (from the former New York-Penn League), the new Batavia Muckdogs … are not only an incredible local business success story but have enhanced the quality of life for the residents of Genesee County,” Turnbull wrote.

Mike Rose Jr. of Rochester on Saturday once again showed why he’s one of the best tournament bowlers in the nation, rolling three strikes in the 10th frame to win the T.F. Brown’s Scratch Eliminator Tournament at Mancuso Bowling Center.

Needing the first strike in the final frame to secure the victory, Rose came through to post a 207 game, edging Rochester’s Phil Kaiser, who posted 194, to win the $1,200 first prize.

Rose qualified second off the Saturday 2 p.m. squad with 883 for four games.

Kaiser earned $800 for placing second while Kevin Alajko of Buffalo took home $700 for finishing third, posting 148 in the three-bowler title match.

Four Genesee Region USBC bowlers cashed in the event, which was bowled on a challenging oil pattern.

Adam Philp of Le Roy advanced to the semifinals where he rolled a 198 game, just short of reaching the finals as Alajko rolled 199. Philp won $190.

Mike Pettinella of Batavia, the tournament’s high qualifier with 893 for four games, made it to the second round, but missed by 10 pins from advancing to the semifinals. Pettinella earned $160.

Rich Wagner of Batavia and Marty Lindner of Scottsville were eliminated in the first round. Both won $130.

The tournament drew 60 bowlers.

In Genesee Region USBC league action last week, Brian Green of Batavia fired a 300 game and 770 series in the Mancuso Real Estate Doubles League at Mancuso Bowling Center.

Two men in custody in Alexander double homicide

Two men from outside Genesee County are in custody and charged with murder in the second degree in the double homicide in Alexander on Friday night.

The suspects are Raul Cruz, 18, of Warsaw, and Prince N.K. Wilson, 23, of Albion.

The men are accused of stabbing and killing two men in a bunkhouse at a dairy farm at 10216 Alexander Road, Alexander.

The names of the victims have not been released pending notification of next-of-kin.

Both Cruz and Wilson are being held without bail.

Wilson was located in Batavia a short time after the incident and taken into custody.

Cruz was the subject of a manhunt in Warsaw on Saturday and located in the afternoon in the Warsaw area.

The incident began at 9:59 p.m., Friday, when dispatchers received a report of a disturbance in the bunkhouse at the dairy farm.  A short time later, after deputies responded, smoke was seen coming from the bunkhouse and Alexander Fire was dispatched. The fire was quickly extinguished.  The Sheriff's Office release states the fire was set but doesn't clarify whether it was set for heat/cooking or another reason.

The Sheriff's Office reports that the two victims were found dead inside the dwelling upon arrival of patrols. 

Investigators believe this was an isolated incident and there was no threat to public safety. 

This is an ongoing investigation. Assisting are State Police, Warsaw PD, the Wyoming County Sheriff's Office, Albion PD, the Orleans County Sheriff's Office, and DEC. Assisting at the scene were Emergency Management and Alexander Fire.

Homicide investigation underway at dairy farm in Alexander

Sheriff's investigators are in the early stages of a homicide investigation at 10216 Alexander Road, Alexander, according to Chief Deputy Joseph Graff.

Late tonight, deputies responded to the Blumer Dairy Farm for a report of a disturbance. At about 10:20 p.m., Alexander Fire was dispatched for smoke coming from an employee bunkhouse and dispatchers informed responding units that the fire could be related to the disturbance. They were also informed that a person may have been stabbed at that location.

Graff declined to discuss the incident further while at the scene and said there will be a press release at some point with more information.

The bunkhouse is at the back of the farm property.

UPDATE: This is a double homicide, according to a statement from the Sheriff's Office.  The statement says this was an isolated incident and there is no threat to public safety. There was no further information released.

Senior corrections officer accused of stealing more than $50K from employee association

A senior corrections officer at the Genesee County Jail has been arrested and terminated after being accused of stealing more than $50,000 from the Sheriff's Employee Association.

Kevin D. Wolff, 51, of Stafford, is charged with grand larceny 2nd, a Class C felony.

Wolff worked for the Sheriff's Office for more than 20 years.

The association membership consists of corrections officers, emergency dispatchers, dog control officers, and jail cooks.

Wolff was arraigned in City Court today and released on his own recognizance.

The investigation into the alleged theft is being conducted by the Sheriff's criminal investigation division and is ongoing.
