A Brockport woman has been charged with offering a false instrument for filing in connection with a motor-vehicle accident where she allegedly gave false information about another vehicle hitting a pedestrian on Route 33 in Stafford.

Katelyn Marie Brown, 23, of Falling Leaf Trail, Brockport, is accused of saying a silver SUV struck the pedestrian at 3:21 p.m., March 19.

Brown allegedly told deputies that a silver SUV had been driving in front of her and struck the pedestrian before leaving the scene.

There's no evidence a silver SUV was involved in the accident.

Brown had previously been issued citations for alleged aggravated unlicensed operation, 2nd, failure to use due care and caution for a pedestrian, and moving from lane unsafely. 

The accident was investigated by investigators Chad Minuto and Joseph Graff.

A 31-year-old resident of Wyoming has been arrested and accused making up information about a car-tree accident at 2:35 a.m., June 10, on Fargo Road, Stafford, where a disabled passenger was seriously injured.

Nicole Kimberly Sullivan, 31, of North Main Street, Wyoming, is charged with assault, 2nd, endangering the welfare of an incompetent or physically disabled person, falsely reporting an incident, and operator leaving the scene of an accident with injuries. 

Sheriff's Office investigators say that following the accident, Sullivan was the actual driver of the vehicle, even though she initially told responders that the driver had left the scene. Firefighters and deputies then conducted an extensive search of the area for the possible driver, both to locate the driver and out of concern that the driver could be injured.

Later that morning, Sullivan admitted to deputies that she was the driver of the vehicle.

The passenger, Zachery W. Schwarts, 20, was transported by Mercy Flight to Strong Memorial Hospital.

Investigator Joseph Graff and Deputy Eric Meyer, who assisted in the investigation, assert that Sullivan failed to report the accident as soon as she was physically able to do so and that she failed to make timely notification of the need for medical assistance for the injured passenger.

Sullivan was also issued citations for driving left of pavement markings, unlicensed operator, aggravated unlicensed operation, 3rd, failure to notify DMV of address change, no seat belt, and unregistered motor vehicle.

Mercy EMS is finding its current ambulance staging area at St. Jerome's on Bank Street a little cramped and not conducive to keeping ambulances ready to roll in all kinds of weather, so it's planning a new 11,500 square foot facility off Route 98, just north of the Thruway, in the Town of Batavia.

The new facility will cost about $2 million and the site plan was reviewed and recommended for approval last night by the County Planning Board.

"There’s no space," said Mercy EMS General Manager Bill Schutt of the current location. "We’re in essentially four old hospital rooms there. There’s very limited parking space, obviously, if you’ve been there. In winter times, it’s especially difficult. Ambulances have fluids in them, medications that need to be kept warm, so you’re trying to run heaters inside them to warm them while parked outside. We don’t have any space there to hold meetings, do training, any additional private spaces, very limited crew space."

The new facility will have eight interior parking bays and additional spaces with electrical hook-ups for ambulances to park outside in emergency overflow situations.

The location, 2.2 acres being split out from an 8.6 parcel, is part of the Gateway II project on Call Parkway, just off of Oak Orchard Road.

Schutt said the new location will have no effect on response times.

There will also be expanded crew space, a meeting and training room.

The new location will also include a purchasing department that will house regional purchasing for Mercy Flight.

Also on Thursday's agenda:

• The board recommended approval of two new commercial buildings on a parcel just north of Home Depot, abutting the Thruway, at 4181 Veterans Memorial Drive. The buildings will be a 12,600 square foot facility that will house medical offices and a 7,500 square foot building that will contain three spaces. Two will be restaurant spaces. The $1.2 million project is being undertaken by Holland Trotta out of Rochester.  A spokesman for the developer told planners that the large space was originally intended for a well-known local restaurant, but those plans changed. The signage on the architectural drawings in the planning board packet for the smaller building show an urgent care business and a Mexican chain restaurant, Qdoba Mexican Eats.
• The board recommended approval of a conditional use permit for 17.4-acre, 2-megawatt solar farm at 2901 Pearl Street Road, Batavia. 
• The board recommended approval of a nine-month moratorium on the planning and construction of solar farms in Stafford, giving officials time to review policies and zoning plans for such facilities.
• The board recommended approval of a site plan review for a new 29,456 square foot paddock at Batavia Downs to be constructed on the east side of the race track. The previous paddock was removed to make room for construction of the new hotel. Currently, stables, are being used for paddock space. Paddocks are where horses and drivers are prepared for each race and return to after the race for washing and testing (winning horses are tested for banned substances, as required by the gaming commission). 

An ATV rollover accident is reported in the area of 8963 Woodland Drive, Stafford.

It's believed to be with minor injuries.

Robert E. Merritt, 62, of East Main Street, Batavia, is charged with: two counts of criminal possession of a controlled substance, 7th; possession of a hypodermic instrument; and controlled substance not in original container. Merritt was arrested following a complaint at 6:23 a.m. of an incident on Hutchins Place. He was jailed on $1,000 bail or $2,000 bond. 

A 17-year-old resident of Holland Avenue, Batavia, is charged with petit larceny and burglary, 3rd. The youth is accused of entering Speedway after being previously barred from the store and stealing merchandise.

Kelli E. Wallace, 54, of Swan Street, Batavia, is charged with petit larceny. Wallace was arrested on a warrant stemming from an alleged theft at Kwik Fill on Ellicott and Jackson streets.

Nikayla C. Jackson, 19, no permanent address, was arrested on a warrant for alleged failure to appear in City Court. She was jailed on $5,000 bail or $10,000 bond.

Eric J. McGill, 33, of Porter Avenue, Batavia, is charged with harassment, 2nd. McGill is accused of threatening a neighbor. 

Gregory A. Burgess, 24, of Bowen Road, Attica, is charged with harassment, 2nd. Burgess is accused of grabbing another person during an argument.

Alex Isaac, 27, of East 83rd Street, Brooklyn, is charged with criminal contempt, 2nd. Isaac allegedly sent text messages to a protected party in violation of a court order.

Amar S.M. Zainelabdin, 29, of Affinity Lane, Buffalo, is charged with unlawful possession of marijuana, no headlights and suspended registration. Zainelabdin was stopped on Ellicott Street at 9:02 p.m. Friday by Officer Arick Perkins.

Sean M. Madigan, 31, of Collegeview Drive, Batavia, was arrested on a warrant for alleged failure to appear. Madigan was arrested following an anonymous tip on his location. He was jailed on $500 bail.

Tammy Marie O'Shea, 45, of Main Road, Stafford, is charged with criminal trespass, 3rd. O'Shea is accused of trespassing at an apartment complex on Main Road, Stafford, at 2 p.m. on Jan. 22.

Shana Lee Sullivan, 25, of Griswold Road, Stafford, is charged with unlawful possession of marijuana. Sullivan was charged following a traffic stop at 9:48 p.m. Tuesday on Griswold Road, Stafford, by Deputy Brian Thompson.

A driver who initially claimed she wasn't the one who struck a pedestrian in Stafford, causing the woman serious injuries, was issued traffic tickets related to the accident on Route 33 at 12:28 p.m., Sunday.

Cited was Katelyn Brown, 23, of Falling Leaf Trail, Brockport. She was also arrested on an unrelated warrant and turned over to Ogden PD.

Brown was issued tickets for aggravated unlicensed operation, 2nd, moving from lane unsafely and failure to use due care approaching a pedestrian.

The name of the woman who was injured was not released, but she reportedly suffered serious injuries and was transported by Mercy EMS to University of Rochester Medical Center. 

The original report was for a pedestrian struck by a vehicle with the vehicle leaving the scene, followed by a report of a car leaving the roadway, traveling into a ditch and striking a utility pole.

Brown reportedly told deputies when they first arrived that another car had struck the pedestrian and that she drove off the road when she became scared after seeing the accident.

Upon further investigation, deputies determined that Brown was the alleged driver who struck the woman with her vehicle.

The accident is being investigated by Deputy Andrew Hale, Investigator Joseph Graff and members of the Crash Management Team. 

Stafford fire assisted at the scene.

A motor-vehicle accident with injuries is reported in the area of 6150 Clinton Street Road. It's between Caswell Road and Route 237. Stafford Fire Department is responding along with Mercy medics. Responders are told to use caution upon approach because a utility pole "may be involved."

UPDATE: Two flatbed tows are called. National Grid is responding to repair a damaged pole. Sheriff's deputies are on scene. The Crash Management Team is called in. A patient(s) was transported to Strong Memorial Hospital University of Rochester Medical Center. The Stafford fire assignment is back in service.

James Pontillo, who operates a residential rental company in the city, agreed to a plea deal today over an allegation that he falsified business records related to a residence he was operating as a rental after his sister died.

The 49-year-old Stafford resident entered a guilty plea to second-degree falsifying business records, a misdemeanor, and faces up to a year in jail when sentenced.

He also agreed to pay $2,550 in restitution.

The plea satisfies several initial charges, including forgery and grand larceny.

Fred Rarick, attorney for Pontillo, previously explained to The Batavian that the charges stemmed from a dispute over how Pontillo handled the estate of his late sister, who died in 2012. Pontillo was accused of providing false information to Pathstone on paperwork related to Section 8 housing.

A driver has been cited for alleged failure to yield the right of way leading to an injury accident at 5:04 p.m. Monday on Griswold Road in Stafford.

Cited was Thomas J. Scheuerlein, 78, of Griswold Road, Byron. Griswold along with passenger Patricia Scheuerlein, 78, were transported to Strong Memorial Hospital by Mercy EMS.

The other driver, Danielle Rozell, 35, of Elm Street, Batavia, was not injured.

According to the report by Deputy Robert Henning, Scheuerlein pulled onto Griswold Road from Godfrey's Pond Road without yielding the right of way to traffic on Griswold.

Rozell's car struck Scheuerlein's car on the driver's side.

David Lane Handley Jr., 54, of Ontario Avenue, Niagara Falls, is charged with burglary, 3rd, and criminal mischief, 3rd. Handley allegedly broke into the Yellow Goose Store in Pavilion at 2 a.m. Feb. 12. The investigation was conducted by Deputy James Diehl.

Jeffrey Allan Youngs, 56, of Montclair Avenue, Batavia, is charged with DWI, driving with a BAC of .08 or greater, inadequate headlamps, driver's view obstructed, and open container. Youngs was stopped at 1:20 a.m. Sunday on Route 20 in Alexander by Deputy Eric Meyer.

Timothy K. Smith, 23, of South Street Road, Le Roy, is charged with unlawful possession of marijuana, driving without insurance, inadequate headlamp, aggravated unlicensed operation, 3rd, and unregistered vehicle. Smith was stopped at 9:56 p.m. Saturday on West Main Street, Le Roy, by Deputy Kyle Krzemien.

Chad Allen Cooper, 21, of Emily Court, Bergen, is charged with criminal possession of a controlled substance, 7th. During a "check the welfare" request, Cooper was allegedly found in possession of heroin.

Ghislaine Pena, 25, of Highland Park, Batavia, is charged with aggravated unlicensed operation, 2nd, and failure to stop. Pena was arrested on a warrant during a traffic stop at 2:07 a.m. Saturday on Clinton Street Road, Stafford, by Deputy Andrew Hale.

Shamir Kamran Aslam, 29, of Landstone Terrace, Rochester, is charged with menacing, 2nd, and two counts of criminal contempt, 1st. Aslam allegedly drove his vehicle at a high rate of speed and swerved by a person covered by a protective order when leaving the Genesee County Courts facility at 11:05 a.m., March 1.

Mark Joseph Amico Jr., 29, of Route 237, Le Roy, is charged with aggravated harassment, 2nd. Amico allegedly called another person and made several threatening statements at 6:07 a.m., March 7.

Randall Henning left the Stafford Fire Department's annual installation dinner at Batavia Downs with a handful of hardware, having logged the most training hours for both firematic training and EMS training. Each of those categories have their own awards, and there's also an award for most combined training hours, which Henning won, with 191 total training hours in 2016.

The department responded to 271 calls on the year. Of those 22 were fire calls, 166 medical, 11 hazardous conditions, 15 service, 54 good intent and three false alarms.

With 165 answered alarms, Timothy E. Eckdahl had the most responses for the year.

Marlek Eugene Holmes, 43, of Batavia, is charged with criminal mischief, 4th. Holmes, an inmate in the Genesee County Jail being held on sexual assault charges, and who has a prior charge related to alleged misconduct in jail, is accused of damaging a food tray and bed sheet belonging to the jail.

Teresa Anne Anderson, 42, of Sandybrook Drive, Hamlin, is charged with petit larceny. Anderson is accused of finding a change purse on the floor near a slot machine at Batavia Downs and taking the money inside and ticket vouchers and discarding the purse between two slot machines.

Nicholas Gerald Schafer, 18, of Broadway, Darien, is charged with unlawful possession of marijuana, leaving the scene of a property damage accident, moving from lane unsafely and illegal parking on a highway. Schafer was allegedly involved in a property-damage accident on Route 98, Alexander, at 10:55 p.m. Friday. The accident was investigated by Deputy Eric Meyer.

Milton Quinones Guzman, 38, of McKenzie Street, Bergen, is charged with DWI, driving with a BAC of .08 or greater and moving from the lane unsafely. Guzman was stopped at 6:52 p.m. Thursday on Clinton Street, Bergen, by Deputy Michael Lute.

Ramon J. Galvez, 35, of Washington Avenue, Batavia, was arrested as a fugitive from justice. Galvez was located during a traffic stop on Washington Avenue, Batavia. He is wanted in Franklin County, Wash., on unspecified charges.

Russell R. Miles, 48, of South Main Street, Batavia, is charged with criminal contempt, 1st. Miles allegedly violated a stay away order.

Jacquelyn K. Hildebrant, 35, of State Street, is charged with dog running at large. Hildebrant following an investigation into a complaint that her dog attacked another dog at 4:30 p.m. Feb. 27 on State Street. Shaun A. Surowka, 59, of South Main Street, Batavia, is charged with criminal use of drug paraphernalia. Surowka was charged following a traffic stop at 12:43 a.m. Sunday on West Main Street by Officer Peter Flanagan.

Melissa R. Piazza, 27, of Walnut Street, Batavia, is charged with identity theft, 3rd, criminal possession of stolen property, 4th and petit larceny. Piazza was arrested on a warrant for allegedly using the credit card of another person without consent.

Justin Thomas Stephenson, 32, of Hutchins Street, Batavia, was arrested on a warrant. The nature of the warrant was not released. He posted bail.

Alisha A. Soule, 20, of Route 237, Stafford, was arrested on two warrants for alleged failure to appear on a traffic ticket and alleged failure to pay a fine.

Thomas A. Culver Jr., 38, of Wood Street, Batavia, was arrested on a warrant for alleged failure to report to the Genesee County Jail per terms of his jail sentence. He was jailed on $2,000 bail or $5,000 bond.

Ryan C. Bishop, 26, of Scottsville West Henrietta Road, Scottsville, is charged with felony DWI, felony driving with a BAC of .18 or greater, and lights not meeting standards. Bishop was stopped at 2:18 a.m. Thursday on Main Street, Batavia, by Officer Matthew Wojtaszczyk.

Chad E. Alwardt, 37, of Holland Avenue, Batavia, is charged with felony DWI, lights not meeting standards, aggravated unlicensed operation, expired inspection, unlicensed driver. Alwardt was stopped on Jackson Street at 12:54 a.m. Friday by Officer Matthew Wojtaszczyk.

Assemblyman Steve Hawley (R,C,I-Batavia) today (March 1) announced that legislation to amend New York’s antiquated gaming laws and help restore the Stafford Fire Department’s historic car raffle has been introduced in the Assembly and is awaiting a vote in the Racing and Wagering Committee.

Hawley, who is cosponsoring this bill, was influential in ushering very similar legislation through the Assembly last year only for it to be vetoed by Gov. Cuomo.

“I am excited to announce that we have introduced the Charitable Gaming Act of 2017, and I look forward to garnering support throughout the Legislature and seeing that this bill finally becomes law,” Hawley said.

Foster, an Alexander native, and Adams, who grew up in East Bethany, officially took ownership of the restaurant – known throughout WNY for its prime rib – on April 20 of last year, and have displayed a large measure of generosity to the people of Genesee County through event sponsorships, donations and employee-supported fundraising.

As a result, the Red Osier® Restaurant has been selected as the Special Service Recognition of the Year award from the Genesee County Chamber of Commerce.

Foster and Adams, who also own Adams’ Welding & Fabrication in Stafford, will be honored at the 45^th annual Awards Ceremony on March 4 at Quality Inn & Suites on Park Road.

In her nomination letter, Lynette Skelton of Starowitz Farms in Byron praised Foster and Adams for purchasing the restaurant – possibly saving it from closing for good and saving the jobs of around 60 employees.

“The two men decided to take the chance, and the opportunity to save the local landmark and the local jobs in their community,” Skelton wrote.

Foster, a Red Osier® employee since 1998, said he was hesitant about buying the business – “it needed a lot of help,” he said – but finally agreed. Since then, and he and Adams have moved full speed ahead.

The list of the duo’s Genesee County civic contributions over the past 18 months is impressive, to say the least:

-- The Genesee County 4H program. Tim is a former Geneseean of the Year for his service to 4H and Cornell Cooperative Extension, and he is continuing his support by purchasing two pigs (which have been processed for special dishes at the restaurant).

-- GO ART!’s Picnic in the Park. The restaurant was the major sponsor for the July 4^th event last year, coming to the forefront at the last minute to prevent the event from being canceled.

-- Genesee Cancer Assistance. A joint venture between the restaurant and welding shop last Thanksgiving resulted in the presentation of $10,000 to GCA – money derived from proceeds of diners that day and a contribution from the welding shop.

-- Le Roy Food Pantry, Genesee County Animal Shelter, Crossroads House, Michael Napoleone Foundation. The two men contributed to fundraisers supporting these causes.

-- Oatka Festival, American Warrior Event at Frost Ridge, Le Roy Youth Football.  The restaurant signed on as major sponsors for these events, and also has sponsored individuals participating in horse shows, cheerleading contests, and other endeavors.

-- Spirits & Skivvies. An employee-led initiative, more than 600 pairs of socks and underwear were donated to the homeless.

“Our staff is right with us every step of the way,” Foster said. “They are on board with our donation program.”

On the business side, the owners said they have “broken every record” for sales – seeing repeat and new customer and raising the average per capita bill from about $25 to around $45.

“Everything here is made from scratch – the meals, desserts, salad, bread; it’s all fresh,” Foster said.

While prime rib is the main attraction, the menu includes a variety of dishes, and much of the food and some of the spirits and liquors are purchased from local vendors.

The owners also reported that, upon their return from a recent trip to Nashville, they have purchased a custom-built, 24-foot food trailer with a full kitchen “to take our chefs out on the road.”

They said they will be able to cater weddings, parties, graduations and other gatherings, and hope to get that started in May.

“It’s a replica of our kitchen,” Foster said.

The Genesee County Sheriff’s Office filed charges Feb. 16 against Nicole K. Sullivan in relation to a one-car accident that occurred during the early morning hours of June 10.

Sullivan, 31, of Perry, is charged with: falsely reporting an incident in the third degree; unlicensed operator of a motor vehicle; aggravated unlicensed operation of a motor vehicle in the third degree; operation of an unregistered motor vehicle; failure to notify the Department of Motor Vehicles of change in address; no seat belt; and driving left of pavement markings.

On June 10, at approximately 2:25 a.m., an accident on Fargo Road, Stafford, was reported. When deputies arrived on the scene, they say they found a male, later identified as Zachery W. Schwartz, 20, unresponsive in the vehicle and a female, Sullivan, on the front porch at a nearby home.

At the time, Sullivan told officers that there was a third occupant, who was driving the car, and fled the scene, traveling north on Fargo Road.

Schwartz was flown via Mercy Flight 5 to Strong Memorial Hospital, Rochester, for extensive head injuries. Sullivan was taken via Mercy ambulance to Strong for head and leg injuries.

Fire personnel conducted a thorough search on foot of the surrounding areas using FLIR Technology (thermal imaging) in an attempt to locate the unknown driver involved in the crash. The New York State Police assisted by maintaining a roving perimeter of the area. Area hospitals were also notified to call the Genesee County Sheriff’s Office if they received any potential car accident patients.

Approximately three hours after the accident was reported, Sullivan admitted to police that she and Schwartz were the only occupants in the vehicle and she was the driver.

The charges stem from the allegation that Sullivan was in fact the driver of the car at the time of the collision and she gave false information concerning the details of the incident. It is further alleged that there was not an unknown driver of the car who fled the scene as originally reported by Sullivan.

Assisting at the scene of the accident included Stafford, Batavia, and Le Roy fire departments, Genesee County Emergency Management, and Mercy medics.

Davon Shaquille St. John, 18, of Oak Street, Batavia, is charged with assault, 2nd. St. John is accused of assaulting somebody while confined at the Genesee County Jail at 8:49 p.m., Monday. He was jailed on $10,000 bail.

Wayne L. Pierce, 75, of Alexander, is charged with forcible touching. Pierce is accused of inappropriately grabbing a female employee at the Ben Go's gas station in Attica.

Bishop Williams, 23, of Genesee Street, Le Roy, is charged with criminal sale of a controlled substance, 4th, and criminal possession of a controlled substance, 4th. Williams is accused of selling Suboxone in May while in the Village of Wyoming. He was arrested by Wyoming County Drug Task Force following an investigation. He was jailed on $15,000 bail.

Odanis Betances, 21, of Morris Avenue, Bronx, is charged with petit larceny. Betances is accused of stealing $125.99 in merchandise from Kmart.

Brian James Lipinski, 33, of Richley Road, Darien, is charged with criminal possession of a forged instrument. Lipinski allegedly used a counterfeit bill to pay for food delivered to his residence.

Jarvis Davon Seymore, 33, of Michigan Street, Rochester, is charged with unlawful possession of marijuana, unlicensed driving, aggravated unlicensed driving, and speeding. Seymore was stopped at 1:51 p.m., Monday, on Clinton Street Road, Stafford, by Deputy Chad Cummings.

A power outage affecting 471 National Grid customers is reported along Clinton Street Road in Stafford and is also, we are told, causing a power outage at Genesee Community College.

The outage was reported at about 4:30 a.m.

A repair crew has been assigned, according to National Grid. The estimated time of power restoration is 8:30 a.m.

The area affected runs along Route 33 from about Seven Springs Road to nearly Route 237 and includes parts of Horseshoe Lake and up to Byron Road.

UPDATE 8:40 a.m.: The ETA for repairs has been revised to "assessing conditions."

UPDATE 8:57 a.m.: The size of the outage area has been reduced to 137 customers, between Clinton Street Road and Byron Road. The college is no longer included in the outage area.

UPDATE 10 a.m.: Not sure when power was restored to the entire area, but power has been restored.

Gari Lyn Fields, 33, of Lehigh Street, Rochester, is charged with failure to dim headlights and aggravated unlicensed operation, 2nd. Fields was stopped at 2:21 a.m., Feb. 8, by Deputy Jeremy McClellan on Morganville Road, Stafford, and arrested on a warrant out of Town of Stafford Court from Sept. 4, 2007. Fields was held on $250 bail or $2,500 bond.

Eileen L. Biaselli, 58, of Ellicott Street, Batavia, was arrested on a warrant from 2005. The warrant was discovered by Batavia PD officers during an investigation of an unrelated domestic dispute. Biaselli was jailed without bail.

Taylor Maya Miley, 20, of Heidt Avenue, Middletown, is charged with harassment. Miley allegedly threatened another person at Genesee Community College at 2:30 p.m., Feb. 8. 

Chevon Mae Duryea, 25, of Watercure Road, Nunda, is charged with petit larceny and possession of a hypodermic instrument. Duryea is accused of shoplifting from Kohl's Department Store. During the investigation he was allegedly found in possession of a needle. Also arrested and charged with petit larceny was Carl Abraham Goossens, 32, of Coverdale Road, Leicester.

Christine Ann Gelardo, 64, of Fargo Road, Stafford, is charged with criminal possession of a controlled substance, 7th, and possession of a controlled substance not in original container. Gelardo was arrested following the completion of an investigation stemming from an incident reported Sept. 27 on Fargo Road in Stafford. Also arrested and charged with possession of a hypodermic instrument was Daniel Leonard Pelton, 59, of Fargo Road, Stafford.

Katrina L. Drake, 26, of Locust Street, Lockport, is charged with disorderly conduct and aggravated unlicensed operation. Drake was arrested by Officer Peter Flanagan following a complaint of a fight in the roadway at 1:07 a.m. Sunday on Summit Street, Batavia.

Robert S. Sodja, 52, of Lake Street, Batavia, was arrested on a warrant out of City Court and jailed on $1,000 bail.

Jessie J. Sayyeau, 23, of Iroquois Street, Rochester, was arrested on a warrant out of City Court for alleged failure to appear and jailed on $1,000 bail.

Joseph M. Marsceill Jr., 31, of Pringle Avenue, Batavia, was arrested on a warrant by Batavia PD after being located by probation officers in a home of one of their probationers. He was released under supervision of Genesee Justice.

A one-vehicle rollover accident with injuries is reported at 5976 Clinton Street Road. Stafford fire and Mercy medics are responding.

UPDATE 2:05 p.m.: South Byron requested to the scene. There is entrapment.

Two people arrested in December following an accident and pursuit through the woods off Keeney Road in Le Roy are now being accused of attempting to rob a nearby gas station that same night.

Giancarolo A. Miranda, 18, of Clipnock Road, Stafford, and Haleigh I. Ogden, 19, of East Avenue, Batavia, were charged today with attempted robbery, 2nd.

The arrest stems for a series of incidents the night of Dec. 12 that started the Kwik Fill in Le Roy when the pair allegedly showed up there about 10 p.m. with the intention to steal property. 

Ogden allegedly displayed a handgun.

The sole employee of the gas station had already locked the front door and there was apparently nothing stolen.

Miranda and Ogden then left the station and were involved in a motor-vehicle accident on Keeney Road.

They fled into the woods and after a search that involved deputies, Le Roy PD, troopers, a helicopter, and a K-9, the duo was located and taken into custody.

Once located, they were identified as suspects in a burglary a few days earlier. They were found in possession of a pit bull allegedly stolen from the animal shelter.

They were charged with burglary, 3rd.

They remain in custody with bail set at $15,000 each.
