Congresswoman Claudia Tenney (NY-24), Member of the Ways and Means Committee, sent a letter to New York Governor Kathy Hochul urging her to prioritize repayment of the state’s billions of dollars in outstanding federal Unemployment Insurance (UI) loans.  

The Federal Unemployment Tax Act (FUTA) imposes a 6.0 percent gross federal unemployment tax rate on the first $7,000 paid annually by employers to each employee, resulting in a maximum federal tax of $420 per employee per year. Employers in certain states may credit up to 5.4 percentage points of state unemployment taxes paid against the 6.0 percent tax rate, meaning that the typical FUTA tax is $42 per worker per year.

However, employers in states whose unemployment insurance funds have outstanding federal advances for two or more consecutive years, like New York, could have their FUTA credit reduced by an additional 0.3 percent for each year the outstanding balance is not repaid in full. This means that New York small businesses, through increased employer taxes, will bear the brunt of Governor Hochul’s irresponsibility and inaction in paying back the state’s federal UI loans.

“Governor Hochul’s inaction in paying back New York’s outstanding federal UI loans in a timely manner irresponsibly places that burden on our small businesses and hardworking families,” said Congresswoman Tenney. “At a time of skyrocketing inflation due to President Biden and Governor Hochul’s far-left fiscal policies, Main Street businesses across New York are struggling and are now facing even higher taxes as a result of New York failing to repay its outstanding federal UI loans. During the COVID-19 pandemic, far-left officials in New York forced businesses to shut down, causing disastrous effects on our economy. Now, these same businesses will be forced to help repay the state’s federal UI loans despite the fact that the state had other means to repay the debt. This is reckless management from Governor Hochul and only serves to further hurt New York businesses while they’re already reeling from many other pressures. Today, I sent a letter to Governor Hochul urging New York to prioritize repayment of the outstanding federal UI loans to prevent additional harm to our small, local businesses and workers in New York.”

Each year, Tenney has the distinct privilege of nominating a limited number of people to four of the five service academies. These students were recommended to Tenney for nomination by a local committee made up of community leaders and veterans from across New York’s 24th Congressional District. The honor of attending a service academy comes with an obligation and commitment to serve in the military for a minimum of five years upon graduation.

David Wagenhauser announced today that he is challenging Representative Claudia Tenney for New York’s District 24 Congressional seat in 2024. Wagenhauser, who grew up in Upstate NY, has served as a Public Interest/First Amendment Attorney and Executive Director for a public interest group in Washington, DC. He was the Vice President of his family’s home care business for 15 years and served a full term as an elected Village Trustee in Brockport, NY.  

Wagenhauser launched his website (DaveforUpstate.com) and released a video to announce the kick-off of his campaign. “It’s time Claudia Tenney came home.”  He continued, “Tenney has become more interested in fighting partisan battles, booking TV and radio time and inciting social media outrage, than in working to solve the problems she complains about daily.”   

Wagenhauser notes he offers a clear alternative to Tenney’s often combative, ultra-partisanship that is the   “politics as usual” in DC today.  “Instead of simply blaming others for problems, we need to be working to find solutions. That means finding common ground for the common good.” He added, “You don’t have to agree with someone to work with them and improve the lives of our neighbors.” 

Wagenhauser seeks significant government reform. “They go in rich and come out richer,”  he stated. “We need meaningful Congressional reform, including working to put an end to stock trading, an end to corporate financing of elections, and an end to gerrymandering.” He also called for the passage of term-limit legislation. “Washington is broken and needs leaders who will step up and lead by example.”

Are Social Security and Medicare endangered?  “It’s not a threat, it’s a plan,” he said - referencing the Republican Study Committee’s stated intention to cut these programs.  Tenney is a member of this group.  Wagenhauser also acknowledged the importance of reducing the cost of prescription drugs. “Steps have been taken to get these costs down, but Tenney has fought reforms every step of the way.” He continued,“Tenney is largely bankrolled by corporate interests and PACS, including Big Pharma titan Pfizer.” Wagenhauser’s website details many of these transactions.

Congresswoman Claudia Tenney (NY-24) today introduced the Producing Incentives for Long-term Production of Lifesaving Supply of Medicines (PILLS) Act to promote the production of generic medicines in the United States.

This legislation offers pharmaceutical companies various tax incentives to encourage them to shift all aspects of the manufacturing process for generic medicines, including materials and testing, to the United States. Currently, the generic drug industry is experiencing a trend toward centralization in India and China due to their significantly lower production costs. However, this shift raises concerns about inadequate drug safety measures and the potential for supply chain disruptions.

“In recent years, drug manufacturing has shifted away from the United States, threatening American jobs and the security of our vital medicine supply chains,” said Congresswoman Tenney. “To bolster domestic generic medicine production and guard against future supply chain disruptions, I introduced the PILLS Act to incentivize businesses to produce these important pharmaceutical products in the United States. This legislation is a crucial step to not only re-shore drug production but also to strengthen our domestic supply chains and create American manufacturing jobs."

"The PILLS Act is an incredibly important bill that would create massive incentives to strategically restore U.S. domestic production of generic medicines," said Zach Mottl, Chairman of the Coalition for a Prosperous America.

Rep. Claudia Tenney (NY-24), alongside Rep. Dan Kildee (MI-8), introduced H.R. 6007, the Retirement Investment in Small Employers Act (RISE Act) to incentivize micro-businesses with fewer than 10 employees to adopt retirement plans, helping more workers save for retirement.

The SECURE 2.0 Act of 2022 enhanced the retirement plan startup tax credits for small businesses with fewer than 50 employees to create incentives to adopt new plans. SECURE 2.0 allows for 100 percent of retirement plan administrative and startup costs to be covered for new plans, up to $5,000 per year. However, the law did not amend the formula relied upon to determine the amount an employer may claim in retirement plan startup tax credits, leaving the smallest micro-businesses and their employees unable to take full advantage of the credit. The RISE Act rectifies this issue, ensuring that micro-businesses benefit in the same manner as larger businesses.

The “Operation Swords of Iron” Iron Dome Supplemental Appropriations Act has received widespread support from a range of stakeholders, including FDD Action, JINSA, CUFI Action, the Zionist Organization of America (ZOA), and the Republican Jewish Coalition (RJC).

This past weekend, as millions of Israelis were celebrating Shabbat and Shemini Atzeret, Hamas launched a surprise air, land, and sea invasion of Israel. Hamas, which has ruled over Gaza since 2007, showed its savagery during this invasion by killing, raping, torturing, and kidnapping Israeli civilians, including children, women, and the elderly. As of Monday, the attacks have killed over 900 Israelis, including 11 Americans, and over 100 Israelis are being held hostage. These attacks have been supported by the Islamic Revolutionary Guard Corps (IRGC), and Hezbollah and Palestinian Islamic Jihad are starting to get involved.

“This week, we’ve seen the full depravity and inhumanity of the Palestinian leadership,” said Congresswoman Tenney. “This is not Hamas fighting a war against IDF soldiers; this is Hamas attempting to kill, rape, torture, brutalize, and kidnap as many Jews as possible, particularly civilians! In response to these abhorrent crimes and attacks, Israel announced Operation Swords of Iron, a full-scale mobilization of troops, and a massive ground operation in Gaza. I unequivocally support Israel’s right to self-defense and am introducing the “Operation Swords of Iron” Iron Dome Supplemental Appropriations Act to support Israel’s Iron Dome defense system. Congresswoman Claudia Tenney (NY-24) voted in favor of H.R. 5110, Protecting Hunting Heritage and Education Act, which authorizes the use of federal elementary and secondary education funds to purchase and use weapons for purposes of training students in archery, hunting, or other shooting sports.

This bill, which Tenney cosponsored, passed the House by a vote of 424-1.

Currently, the Biden Administration is intentionally misconstruing Congressional intent to advance its radical anti-Scond Amendment agenda. 

The Administration is warping the “Bipartisan Safer Communities Act” to prohibit funds authorized under the Elementary and Secondary Education Act from being used to fund hunting, archery, and shooting sports programs in schools. 

This bill specifies that this prohibition shall not apply to training students in archery, hunting, or other shooting sports.

“President Biden and Governor Hochul continue to undermine our constitutional right to bear arms, but this time, they are coming after our efforts to teach students how to safely handle firearms,” said Congresswoman Tenney. 

“By defunding hunting, archery, and shooting sports programs, the Left is preventing young Americans from exercising their Second Amendment right and learning important life skills. I voted in favor of the Protecting Hunting Heritage and Education Act to defend our constitutional rights and support outdoor recreational programs!”

Congresswoman Claudia Tenney (NY-24) questioned whether an impeachment inquiry should be considered to examine the unethical behavior of Energy Secretary Jennifer Granholm at a full Science, Space and Technology Committee Hearing.

Tenney’s query for an impeachment inquiry follows the Department of Energy’s Inspector General, sounding the alarm that one-third of DOE senior officials own stocks relating to their work. During the hearing, Tenney highlighted multiple situations where Secretary Granholm violated the law, had conflicts of interest, and lied to Congress under oath. 

This includes President Biden and Vice President Harris, who have repeatedly touted the company Proterra while Secretary Granholm owned stock in this company. On a separate occasion, it was reported that Secretary Granholm's husband owned Ford stock while the Secretary was serving and made tweets promoting Ford. Additionally, Secretary Granholm testified under oath that she did not own any individual stocks and only later admitted that she lied.

“Secretary Granholm has admitted to lying to Congress under oath and committing perjury,” said Congresswoman Tenney. “Perjury grants Congress clear grounds for impeachment. This is yet another example of the colossal ego and arrogance of the Biden Administration that Americans despise most. It is far past time that Secretary Granholm is held accountable for these clear crimes and conflicts of interest. Secretary Granholm has made our lives unaffordable and pushed a radical green energy agenda all while lining her own pockets on the backs of the American people. Enough is enough.”

Congresswoman Claudia Tenney (NY-24) today, alongside Congressman Chris Pappas (D-NH), reintroduced the Remembering Our Local Heroes Act to establish a federal grant program to provide financial aid to assist in the construction, maintenance, and restoration of local memorials that recognize the service of veterans, active-duty military, law enforcement, and firefighters across the nation.

• Mandates that the Secretary of the Interior establish the grant program within 180 days of its enactment.
• Allows local governments and nonprofit organizations to seek funding, which can be utilized for the construction, restoration, renovation, or maintenance of community memorials.
• Requires that the individuals being memorialized have made positive contributions to their community, either through exemplary public service or by demonstrating exceptional bravery.
• Sets a maximum limit of $100,000 for each grant awarded. Recipients are also obliged to provide non-Federal matching funds equivalent to at least 50% of the grant amount. This stipulation ensures both robust community endorsement for funded memorials and the effective leveraging of local funds.

Congresswoman Claudia Tenney (NY-24), member of the House Science, Space, and Technology Committee, announced her support for establishing a Space National Guard as the reserve component of the Space Force. This builds on Tenney’s previous support for establishing the Space Force, which occurred during the Trump administration.

Under the current system, individuals who serve as de facto Space Force reservists are part of the Air National Guard. This could prevent these individuals from participating in official Space Force educational and training opportunities and cause organizational issues. Importantly, creating a Space National Guard would require no additional personnel, units, or facilities and would improve communication, reduce costs, and allow these dedicated space warfighters to continue supporting the Space Force’s missions at a high level. 

Tenney recently cosponsored H.R.3048, the Space National Guard Establishment Act, to formally establish the Space National Guard as the primary reserve component of the U.S. Space Force. H.R. 3048 was introduced in the House by Rep. Jason Crow (D-CO) and Rep. Doug Lamborn (R-CO). 

“Now more than ever, as our adversaries continue to ramp up their space capabilities, we must enhance our own efforts and continue to focus on space exploration and defense,” said Congresswoman Tenney. “By supporting the creation of the Space National Guard as the primary reserve component of the U.S. Space Force, we are leveraging the technical expertise of part-time reservists who work full-time in the private sector. Notably, this would have a direct impact on the 222nd Command and Control Squadron, based in Rome, New York, which is part of the 107th Attack Wing, based at Niagara Falls Air Reserve Station. This Air National Guard Squadron would be a natural fit for the Space National Guard. Further, the 222 CACS is particularly vulnerable to the potential risks of continuing to delay establishing a Space National Guard. I look forward to the positive impact this will have on our region and on our nation's ability to maintain its dominance in space."

“There are seven states and one territory that have a space mission as part of their Air National Guard Wing’s and New York State is fortunate to be one of them,” said John Cooper, Chairman of the Niagara Military Affairs Council. “The creation of a Space National Guard is critical to us in New York State as the 222nd Command and Control Squadron in Rome, N.Y. presently performs a space mission and is part of the 107th Attack Wing in Niagara Falls, NY. The establishment of a Space National Guard must be included in the operational structure of the Space Force and is critical to the future of the 107th Attack Wing. Failure to do so could negatively affect the State of New York and the Niagara Falls Air Reserve Station for many years to come. “The 222nd Command and Control Squadron (222 CACS) of the 107th Attack Wing, New York Air National Guard, has a unique and enduring partnership with the National Reconnaissance Office (NRO),” said Colonel Andrew Carlson, Commander of the 107th Attack Wing, New York Air National Guard. “Our highly trained space professionals provide surge and contingency support to the NRO and are also involved with the State Partnership Program. My personal opinion is that the creation of a Space National Guard (SNG) would prevent the possibility of a future training void. This void could happen if the US Space Force decided to limit their space-based training programs to those service members with only Space Force Specialty Codes, and not Air Force Specialty Codes (members of the 222 CACS have Air Force Specialty Codes). It is also my personal opinion that an attempt to transfer Air National Guard space mission sets and space professionals into the Active-Duty component, even on a part-time basis, will potentially cost the US Space Force expertise that could require 7+ years to recapitalize. Lastly, it is my personal opinion that the creation of a Space National Guard would appropriately align the members of the 222 CACS to provide forces in accordance with US Space Force deployment models. In the 222 CACS members’ current status, they will align to the Air Force Generation (AFFORGEN) model as Air National Guard members, even though they are space professionals.”

Congresswoman Claudia Tenney (NY-24), alongside Congressman Andrew Garbarino (R-NY), today reintroduced the Local Law Enforcement Protection Act, which protects qualified immunity for police officers serving at the state and local levels nationwide.

The legislation reinforces the principle established in the Supreme Court case Saucier v. Katz, which ruled that a police officer can only be held liable if there is a clear violation of an individual's constitutional rights. The Local Law Enforcement Protection Act prevents state and local governments from seeking specific federal grants if they strip away qualified immunity protections for police officers.

The year 2021 was the deadliest year for our law enforcement officers in over two decades, and 2023 is not much better. So far this year, 226 police officers have been shot, and 75 have died in the line of duty. With numerous states and localities significantly cutting police budgets and chipping away at qualified immunity safeguards, the Local Law Enforcement Protection Act serves as a crucial legal safeguard, providing necessary protection to police officers who dutifully serve communities with dedication and honesty.

“With crime rates continuing to surge across our country and assaults against our brave police officers on the rise, it is deeply concerning that Democrats in Congress and Albany continue to advocate for defunding the police and ending qualified immunity,” said Congresswoman Tenney. “Our law enforcement officers risk their lives every day for our communities, and they deserve to be able to perform their duties without fear of frivolous lawsuits. By introducing the Local Law Enforcement Protection Act today, Rep. Garbarino and I reiterate our call for members on both sides of the aisle to stand in solidarity with our police officers. Congresswoman Claudia Tenney (NY-24), alongside Congressman Andrew Garbarino (R-NY), introduced the Volunteer First Responder Housing Act, legislation to expand eligibility for qualified volunteer emergency responders to participate in certain federal housing assistance programs.

Original cosponsors of the legislation include Representatives Elissa Slotkin (D-MI), Mike Lawler (R-NY), Dan Kildee (D-MI), Frank Lucas (R-OK), and Derek Kilmer (D-WA).

Specifically, this bill would expand eligibility for the Single Family Housing Guaranteed Loan Program through the U.S. Department of Agriculture’s Rural Development Division and the Department of Housing and Urban Development’s Good Neighbor Next Door Sales Program. The Single Family Housing Guaranteed Loan Program assists approved lenders in providing loans to low and middle-income households to help build, rehabilitate, and improve homes in eligible rural areas.

“Rural communities across New York’s 24th District and the country rely on volunteer first responders to keep our communities safe,” said Congresswoman Tenney. “The Volunteer First Responder Housing Act will expand federal housing assistance to these dedicated individuals in the communities they serve. Providing housing assistance to volunteer firefighters will help to reduce response times by enabling volunteer firefighters and EMTs to live closer to their stations. This bill provides much-needed and well-deserved housing incentives and benefits to our next generation of volunteer firefighters and EMTs so they can continue their brave work serving our communities.”

“Long Island relies almost entirely on volunteer firefighters to prevent, combat, and extinguish fires while also providing other emergency services and, according to the National Fire Protection Association’s 2017 U.S. Fire Department Profile, 65 percent of firefighters nationwide are volunteers,” said Congressman Garbarino. “Recruiting and retaining volunteer firefighters is critical for thousands of communities, yet local volunteer fire departments continue to find it difficult to meet staffing needs. With a high cost of living making it more difficult than ever to buy a home, the Volunteer First Responder Housing Act would provide a helping hand to those who give their time, at great personal risk, to safeguarding our communities.

China, in particular, has chosen to invest heavily in R&D by providing a “super deduction” for R&D expenses. By enhancing the R&D tax credit, we can help small businesses and entrepreneurs across America invest in innovation that will unleash economic growth and create jobs on American soil. The FIRST Act is a crucial step in boosting American innovation and advancing our competitiveness on the world stage, reinforcing our nation’s position as the economic powerhouse of the 21st century.”

Specifically, this bill would:

• Increase the "Traditional" Credit to 40 Percent: Established companies would see their current traditional credit rate, determined by a complex formula, boosted from 20 percent to 40 percent of the increase in R&D spending.
• Raise the Alternative Simplified Credit (ASC) to 28 Percent: The existing ASC rate, calculated through a simpler formula, would be raised from 14 percent to 28 percent of the increase in R&D spending.
• Significantly Enhance the Credit for Firms with Limited Research History to 14 Percent: Companies without any U.S. research track record in the past three years would experience a more than twofold increase in the credit from 6 percent to 14 percent of R&D spending.
